Saminist is indigenous peoples and a local communities at North karts Kendeng. Saminist expected that North Karts Kendeng maintained and conserved continuity to be able to contribute to the life around this region especially abundant water. Water is one of the main needs of living beings on Earth, besides that water is a primary requirement of farmers in farming communities. Saminist as traditional community who only permitted to be farmers still practice the environmental wisdom from their heritage which aims to preserve the natural environment so that they could alive depend on nature around, especially Saminist just sack their business of farming crops that are not market oriented as much farming is done farmers in general. They tried to maintain a relationship of harmony between communities around the North Karts Kendeng to conserve North Karts Kendeng region from mining destruction, the negative impacts from mining in this region was disappears of water and others impacts such as natural disaster, flood, rough, and danger of tornado. North Karts Kendeng Sukolilo have 79 springs and 24 caves spread across 3 sub-district namely Sukolilo, Kayen and Tambakromo. Abundant natural resources certainly is a gift that needs to be maintained and conserved. To maintain and conserve this region with planting the three, not mining the rocks, maintain local wisdom, and refusal cement industry in North Karts Kendeng Sukolilo.

The conservation of environment and the protection of human rights are two of the most compelling needs of our time. Unfortunately, they are not always easy to combine and too often result in mutual harm. This book analyses the idea of biocultural rights as a proposal for harmonizing the needs of environmental and human rights. These rights, considered as a basket of group rights, are those deemed necessary to protect the stewardship role that certain indigenous peoples and local communities have played towards the environment. With a view to understanding the value and merits, as well as the threats that biocultural rights entail, the book critically assesses their foundations, content, and implications, and develops new perspectives and ideas concerning their potential applicability for promoting the socio-economic interests of indigenous people and local communities. It further explores the controversial relationship of interdependence and conflict between conservation of environment and protection of human rights.

Chapter 3 explores the controversial relationship of interdependence and conflict between environmental concerns and the protection of human rights by offering insights on the necessity—and the opportunity—of new ideas such as biocultural rights. Such necessity is made clear by bringing forward the inadequacy of human rights rhetoric in fully incorporating environmental challenges, as well as the damages environmental conservation can do to human rights of indigenous peoples and local communities. The chapter introduces attempts to combine conservation and rights interests through the recognition of the stewardship relationship indigenous peoples and local communities have towards the environment. Keeping distance from the dangers of the myth of the noble savage, and describing the important steps forward that have been done against fortress conservation practices, the chapters underlines those steps that still need to be taken.

Abstract Wildlife and ecotourism resources were assessed in and around Bale Mountains National Park (BMNP) to examine their contribution for sustainable use of natural resources which will improve the livelihood of local communities and conservation of park. Survey questionnaires, interview, field observation and literature reviews were employed to collect primary and secondary data. The analyses of the study revealed that natural and cultural resources such as abundance and diversity of mammals and birds, scenic landscape, cultural and historical attractions and some hotels or lodges at nearby areas are the main ecotourism potential in BMNP. The study also revealed some income generating alternatives or ecotourism potentials which could help to reduce the present degradations of natural resources of the park. About 37.2% of sampled households expressed their interests for diversified livelihood or ecotourism activities. Offering tourist facilities and services and creating job opportunities for members of local communities are the positive impacts of the tourism activities whereas, cutting trees, occurrences of seasonality and leakages are the negative impacts. Reinforcing existing off-agricultural livelihoods, introducing additional alternative options or ecotourism are important strategic directions for sustainable management of natural resources for BMNP and related protected areas.

Tourism development often does not pay attention to the preservation of natural resources and local culture which are also affected by tourism development and considers that the tourism industry is an industry whose existence is interrelated. This research is descriptive research in the form of written or oral words from people and observable behavior and to be able to better identify the variables to be examined in relation to them and aims to present a structured, factual, and accurate description of the facts -fact and the relationship between the variables to be studied. From the results of the study there are positive and negative impacts that arise. Both environmental, socio-cultural, and economic impacts on local communities who are the main actors who feel the impact of tourism development. The community has felt the positive impact provided by the tourism sector. Although there are still negative impacts that are also felt.

This chapter focuses on the connection between property rights and natural resources. Most national jurisdictions are based on a model of ‘State property’, whereby ownership and control of natural resources are vested in the ultimate authority of the State. This chapter analyses how the right to property supports the recognition of property rights over natural resources for certain category of citizens, notably indigenous peoples, landless peasants, and rural women. Based on this analysis, the chapter then explores how human rights law is gradually supporting the recognition of some forms of community property rights, notably for local forest communities and small-scale fishing communities. It also explores some of the underlying tensions between the concessionary rights of corporations and investors over natural resources and the rights of local communities.

Abstract The paper demonstrates how the evolution of international law on colonial and indigenous peoples, in particular evolving rights to sovereignty over natural resources, shaped the changing relationship between Greenland and the rest of the Danish Realm. Greenland today is in a unique position in international law, enjoying an extremely high degree of self-government. This paper explores the history, current status and future of Greenland through the lens of international law, to show how international obligations both colour its relationship with the Kingdom of Denmark and influence its approaches to resource development internally. It considers the invisibility of the Inuit population in the 1933 Eastern Greenland case that secured Danish sovereignty over the entire territory. It then turns to Denmark’s registration of Greenland as a non-self-governing territory (colony) in 1946 before Greenland’s-purported decolonisation in 1953 and the deficiencies of that process. In the second part of the 20th century, Denmark began to recognise the Greenland Inuit as an indigenous people before a gradual shift towards recognition of the Greenlanders as a people in international law, entitled to self-determination, including the right to permanent sovereignty over their natural resources. This peaked with the Self-Government Act of 2009. The paper will then go on to assess competing interpretations of the Self-Government Act of 2009 according to which the Greenland self-government is the relevant decision-making body for an increasing number of fields of competence including, since 1 January 2010, the governance of extractive industries. Some, including members of the Greenland self-government, argue that the Self-Government Act constitutes full implementation of the UN Declaration on the Rights of Indigenous Peoples (UNDRIP 2007), but this view is not universally shared. The paper also considers the status and rights of two Greenland minorities: the North Greenlanders (Inughuit) and the East Greenlanders, each of whom has distinct histories, experiences of colonisation, dialects (or languages) and cultural traditions. While the Kingdom of Denmark accepts the existence of only one indigenous people, namely, the Inuit of Greenland, this view is increasingly being challenged in international fora, including the UN human rights treaty bodies, as the two minorities are in some cases considered distinct indigenous peoples. Their current position in Greenland as well as in a future fully independent Greenland is examined, and the rights that they hold against the Greenland self-government as well as the Kingdom of Denmark explored. Greenland’s domestic regime for governance of non-renewable natural resources (principally mining and hydrocarbons) is briefly analysed and compared with international standards, with a particular emphasis on public participation. The paper assesses the extent to which it complies with the standards in key international instruments.

This article examines the hypothesis that the developmental priorities of Indonesia in the post-Suharto era, in particular three legislative Acts that purport to protect indigenous peoples’ rights, in fact serve to undermine these rights. These Acts are: the Basic Agrarian Act, the Forestry Act, and the Plantation Act, and relate to land use for development purposes and also affect the autonomy of indigenous peoples. Despite being crucially important, these Acts have had detrimental effects on indigenous peoples’ lives. This article, using a qualitative socio-legal approach, analyses the historical and political contexts of the Acts to determine whether they enhance or undermine indigenous peoples’ rights, and how the government uses the Acts for suppression. This analysis identifies reasons for the weak regime, notably that the legislative Acts on land-related sectors are used as a political tool to suppress local communities, while allowing the government’s land market businesses to exploit natural resources.

The role of Indigenous peoples and local communities (IPLCs) in sustainably using and managing natural resources is becoming broadly recognised within some international platforms (e.g., the UN Permanent Forum on Indigenous Issues and Intergovernmental Platform on Biodiversity and Ecosystem Services). However, the support for IPLCs to continue managing their land is either completely absent or scanty. This paper presents the value of only four ecosystem services, estimated at USD 1.16 trillion per year, that are delivered from IPLCs managed lands alone (excluding coastal, marine, and other resources). These four ecosystem services (ES), i.e., carbon sequestration, biocontrol, air, and water regulation offer offsite benefits to the wider regional and global populations yet without returns to the IPLCs themselves except for facing more climate and natural disaster-related challenges mainly caused by the actions of mainstream society. It further outlines key challenges and advocates for establishing stewardship mechanisms to promote and support IPLCs land management practices that will effectively help in protecting and preserving biodiversity, water, and other natural resources on Earth to sustain and enhance human well-being.
