The European Union has seen the rise of informal groups of states as an increasingly important governance mechanism within its formal structures. Such groups can make decision-making processes more efficient, but they also suffer from a substantial lack of legitimacy in the eyes of the non-members. In this article, we examine how informal groups overcome this fundamental dilemma between efficiency and legitimacy and sustain themselves at the forefront of important policy areas. To this end, we trace the development of what we argue to be a particularly useful case: the E3 directoire in the nuclear negotiations with Iran. The empirical results point to new insights into how directoires – and informal groups in general – can use different types of legitimation strategies to gain and maintain legitimacy. More specifically, the E3 implemented three successive legitimation strategies – detachment, co-optation and integration – using different types of legitimacy sources, in particular problem-solving, institutional adjustments and fostering institutional and policy congruence.


This book provides the first comprehensive analysis of the withdrawal agreement concluded between the United Kingdom and the European Union to create the legal framework for Brexit. Building on a prior volume, it overviews the process of Brexit negotiations that took place between the UK and the EU from 2017 to 2019. It also examines the key provisions of the Brexit deal, including the protection of citizens’ rights, the Irish border, and the financial settlement. Moreover, the book assesses the governance provisions on transition, decision-making and adjudication, and the prospects for future EU–UK trade relations. Finally, it reflects on the longer-term challenges that the implementation of the 2016 Brexit referendum poses for the UK territorial system, for British–Irish relations, as well as for the future of the EU beyond Brexit.

Health technology assessment (HTA) has become increasingly important in the European Union as an aid to decision making. As agencies and programs have been established, there is increasing attention to coordination of HTA at the European level, especially considering the growing role of the European Union in public health in Europe. This series of papers describes and analyzes the situation with regard to HTA in the 15 members of the European Union, plus Switzerland. The final paper draws some conclusions, especially concerning the future involvement of the European Commission in HTA.

Sanctions are one of the toughest and most coercive tools available to the European Union (EU). They are increasingly used in order to respond to breaches of international norms and adverse security developments in the neighbourhood and beyond. However, the EU sanctions policy is facing a number of challenges related to the efficiency of decision-making, shortcomings in the coherent implementation of restrictive measures, as well as the adjustments to the post-Brexit relationship with the United Kingdom. This article analyses these key challenges for EU sanctions policy. Against the backdrop of an intensifying global competition, it points out the need to weatherproof this policy tool. The current debate on the future of the EU provides an opportunity to clarify the strategic rationale of EU sanctions and to fine-tune the sanctions machinery.

This article considers how to enhance the institutional structure of the Eurasian Economic Union (EAEU) in order to enable timely decision-making and implementation of governance decisions in the interests of Eurasian integration deepening. We compare the governance structures of the EAEU and the European Union (EU) using the author’s technique and through the lens of theories of neofunctionalism and intergovernmentalism elaborated with respect to the EU. We propose to determine a major driver of the integration process at this stage (the College of the Eurasian Economic Commission or the EAEU member states), to reduce the number of decision-making bodies within the current institutional structure of the EAEU, and to divide clearly authority and competence of remaining bodies to exclude legal controversies in the EAEU.

The making of modern authority centred on efforts to formalise and de-personalise power, and transnational orders such as the European Union have often been viewed as an extension of that project. As this article argues, recent developments tell a different story. More than a decade of crisis politics has seen institutions subordinated to and reshaped by individuals and the networks they form. Locating these tendencies in a wider historical context, the article argues that greater attention to informality in transnational governance needs to be paired with greater recognition of the normative questions it raises. Just as a separation between rulers and the offices of rule was central to the making of modern legal and political structures, the weakening of that separation creates legitimacy problems for contemporary authorities both national and supranational. Rather than acclaimed as flexible problem-solving, the step back from institutions should be viewed as a challenge to accountable rule.

Their analysis illuminates the distinctive features of the EU's pluralist constitutional construct but also the interesting parallels to the Canadian constitutional experience and provides the tools to understand the Union's development, especially during the Laeken (2001–2005) and Lisbon (2007–2009) processes of constitutional reform.

<p>The EUs Water Framework Directive, was adopted on October 2000, and it has been the basis for water management in all the EU countries since then (EU-WFD, 2000). According to the EUs-WFD, the use of groundwater bodies can be considered as sustaibale only when the portion of the overall recharge not needed by the ecology is abstracted (EU-WFD, 2000). Nonetheless, there are still cases where the implementation of the EUs-WFD faces challenges, and there is a need to better communicate the above message to water users. But how can we achieve this at a local scale?</p><p>In this work, we present the example of SW Messinia, Greece, an interlinked coastal-inland area in the Eastern Mediterranean region. In this case study, the water supply for all water uses (agriculture, tourism, domestic use) depends on groundwater resources which are also the main freshwater provider to a coastal wetland with high ecological and commercial value (Birds directive 2009/147/EC; Habitats Directive 92/43/EEC). Due to man-made interventions over the last 70 years, the wetland has passed the tipping point of being brackish (Maneas et al., 2019), and at present it is characterized as saline with hypersaline conditions for nearly 30% of the year (Manzoni et al., 2020). Unless freshwater inputs are enhanced by restoring hydrologic connectivity between the wetland and the surrounding freshwater bodies, salinity in the lagoon is expected to increase even more under future drier and warmer conditions (Manzoni et al., 2020). But how can we balance between societal and ecological groundwater needs, and how future decision making can get a broader acceptance by the society?</p><p>Under COASTAL EU project (COASTAL, 2019), we use System Dynamic (SD) models for communicating with local stakeholders towards improving land-sea interactions. In this work, we present a model which describes how inland groundwater abstraction has impacts to the wetland’s salinity. The model is used as a basis for a discussion with stakeholders and the co-creation of sustainable decision making with broader acceptance.</p><div>Literature<br><div> <p>EU WFD, 2000. A main feature of the European Union’s constitutional arrangements, as laid down in the Treaty on the European Union (TEU) and the Treaty on the Functioning of the European Union (TFEU), is the organization of the rules governing external policies around the theme of integration. This is illustrated in different ways. First, the external policies of the Union are all part of what the Treaties describe as the Union’s ‘external action’. Terms such as ‘external policies’ or ‘actions’ are avoided. Instead, the choice of the reference to ‘external action’ signifies the design of the EU’s foreign affairs as a coherent whole.
