Introduction. Public control is an attribute of a developed civil society in the state. In Russia, the Federal law regulating the procedure for public control was adopted in 2014. This law has established a limited range of subjects of public control in Russia, however, current legislation indicates the actual inclusion of other subjects not stipulated in the law in this mechanism. A citizen of the Russian Federation is not directly listed by the Federal law as a subject of public control, however, the law provides for forms of participation of citizens in the process under consideration. Theoretical analysis. Russia today stands on the path of democratic transformation of all state institutions. The implementation of fundamental constitutional provisions regarding the recognition of human and civil rights and freedoms as the highest value is impossible without the functioning of instruments of public control over the activities of public authorities. Developed democracy presupposes the exercise of public control by the entire multi-level system of civil society institutions, with the citizen at the center. Empirical analysis. The analysis of the content of the Federal law “On fundamentals of public control in the Russian Federation” from the point of view of consolidation of constituent entities of social control and forms of its implementation, allows to conclude that, in fact, the law duplicated the forms of social control and subject composition fixed earlier by the Federal law “On Public chamber of the Russian Federation. The current legislation indicates that the central link in the number of subjects of public control are public chambers and public councils operating in Russia and that there are no legal guarantees of citizen participation in the implementation of public control. Results. The current development of the procedure for implementing public control in Russia implies the need for legislative consolidation of direct forms of participation of citizens of the Russian Federation in this mechanism. Direct forms of such participation can be: appeals to state authorities and local self-government bodies in the form of proposals with wide public awareness via Internet resources; participation of citizens in the electoral process as public observers; participation as a member of the public chamber of any territorial level of the organization; participation as members of public associations and other non-governmental non-profit associations; participation as public inspectors and experts on the initiative of Russian citizens.

В статье анализируются вопросы деятельности членов общественных наблюдательных комиссий, контролирующих соблюдение прав лиц, содержащихся в учреждениях уголовно-исполнительной системы Российской Федерации. Теоретически реализация института общественного контроля необходима для соблюдения законности и повышения эффективности деятельности сотрудников мест принудительного содержания, выполнения ими возложенных на них обязанностей, предупреждения и выявления нарушений законности в их деятельности, а также соблюдения прав содержащихся лиц. В работе определяется перечень субъектов общественного контроля, дается их классификация и приводится предмет общественного контроля, реализуемого общественными наблюдательными комиссиями. С точки зрения правового регулирования деятельности членов общественных наблюдательных комиссий рассматриваются такие нормативные правовые акты, как Уголовно-исполнительный кодекс Российской Федерации и Федеральный закон «Об общественном контроле за обеспечением прав человека в местах принудительного содержания и о содействии лицам, находящимся в местах принудительного содержания». Исследуются положения Уголовно-исполнительного кодекса Республики Казахстан, регулирующие задачи общественного контроля, порядок создания и некоторые аспекты функционирования общественных наблюдательных комиссий в Республике Казахстан. The article analyzes the activities of members of public monitoring commissions that monitor compliance with the rights of persons held in institutions of the Penal system of the Russian Federation. Theoretically, the implementation of the Institute of public control is necessary to comply with the law and improve the efficiency of the employees of places of forced detention, perform their assigned duties, prevent and detect violations of the law in their activities, as well as respect the rights of detainees. The article defines the list of subjects of public control, gives their classification and provides the subject of public control implemented by public monitoring commissions. From the point of view of legal regulation of the activities of members of public monitoring commissions, such normative legal acts as the PenalCode of the Russian Federation and the Federal law «On public control over enforcement of human rights in places of custody and assistance to persons in places of forced detention» are considered. The article examines the provisions of the Penal code of the Republic of Kazakhstan that regulates the tasks of public control, the procedure for creating and some aspects of the functioning of public monitoring commissions in the Republic of Kazakhstan.

The subject of this article is the problems of the nature, essence and purpose of prosecutorial activity. The purpose of the article is to study and justify the role of the human rights function in prosecutorial activities in the concept of a modern legal state. At the heart of prosecutorial activity is the implementation of the main function of the Prosecutor’s office – its rights and freedoms, their protection. This means that any type (branch) of Prosecutor's supervision is permeated with human rights content in relation to a citizen, society, or the state. This is confirmed by the fact that the Federal law “On the Prosecutor's office of the Russian Federation” establishes an independent type of Prosecutor's supervision-supervision over the observance of human and civil rights and freedoms. It is argued that the legislation enshrines the human rights activities of the Prosecutor's office as its most important function. It is proposed to add this to the Law “On the Prosecutor's office of the Russian Federation”.

A common practice of imposing various prohibitions and rules in the constituent entities of the Russian Federation, owing to the need to solve acute social problems and achieve constitutionally significant goals, draws attention to the problem of restricting by the law of the constituent entity of the Russian Federation fundamental rights and freedoms of the man and citizen. Using the regulation of retail sale of non-alcoholic toning drinks as a case-study, the paper discusses the relevant legislative work, court practice, conditions and content of imposed restrictions. The laws of the constituent entities of the Russian Federation provide for prohibitions imposed on the sale of non-alcoholic tonic drinks to minors, retail trade in educational and medical organizations, as well as in places holding activities with the participation of young people and the consumption of such drinks by minors in public places. Attempts have been made to adopt a federal law with similar content, but taking into account the negative attitude of the Government of the Russian Federation and arguments concerning the absence of unambiguous scientific data with regard to the harm caused by ”energy” drinks, the State Duma rejected four draft laws. The regional laws’ analysis is carried out in the context of delineation of jurisdictions and powers between federal bodies of state power, sectoral legislative regulation and provisions consolidated in Part 3 Article 55 of the Constitution of the Russian Federation. Restrictions on the sale of “energy” drinks are considered within the framework of the content of the legislation regulating the protection of rights of the child, civil legislation and other legal acts, as well as legal stances of the Constitutional Court of the Russian Federation. The paper has revealed uncertainty in the interpretation of the constitutional provision restricting human rights and freedoms by the federal law, which leads to contradictions in court practice.

The stalling of civil society development within the Russian Federation and its attendant causes have been a focus of academic study since the collapse of the Soviet Union in 1991. Alongside the emergence of a fragmented and chronically under-funded community of advocacy groups, the literature points to a rejection of democratic structures by the Russian populace and an absence of active civil engagement. Consequently, the international community has sought to bolster the growth and development of the Russian third sector by funding projects and organisations with a view to increasing public participation.Utilising research undertaken in Samara oblast of the Russian Federation, this paper examines the role played by overseas donor agencies within the Samara Environmental Movement (SEM). In examining both the quality and quantity of donor assistance received, it reveals a number of dysfunctions arising from this aid, and in particular, a lack of contextualization and mis-direction of the assistance offered vis-à-vis citizen participation, alongside other behavioural impacts of donor funding within the SEM itself.

В статье рассмотрены основные положения Федерального закона от 31.07.2020 г. № 248-ФЗ «О государственном контроле (надзоре) и муниципальном контроле в Российской Федерации», который вступает в силу с 1 июля 2021 года. Проанализированы изложенные в Федеральном законе процессуальные основы осуществления государственного и муниципального контроля, акцент которых сделан на профилактические мероприятия. The article considers the main provisions of the Federal law No 248-FZ dated 31.07.2020 “On state control (supervision) and municipal control in the Russian Federation”, which comes into force on July 1, 2021. The article analyzes the procedural bases of state and municipal control expounded in the Law. The focus of these bases is on preventive measures.

This article is devoted to constitutional legal analysis of international legal bases of the legislation of the Russian Federation on public control. The work substantiates the position that to understand the constitutional legal mechanism of public control in Russia it is necessary to study the international legal framework of control of civil society over public authority in connection with the implementation of generally recognized principles and norms of international law in the legal system of the Russian Federation as a priority the rules of the legal regulation under Part 4 of Article 15 of the Constitution.

The paper is devoted to the analysis of the limits and the possibility of using international and foreign experience of its organization and functioning in optimizing the institution of public control in the Russian Federation. The author defines the concept of public control in the Russian Federation. The necessity of using international and foreign experience in the organization and functioning of the institution of public control in the process of optimizing this institution of civil society in Russia in the following areas is substantiated: 1) regarding the formulation of the concept of the institution of civil society control over public authority; 2) in terms of its consolidation in regulatory legal acts; 3) by definition of its basic principles, goals and objectives; 4)on consolidation of the list of objects in respect of which control is exercised; 5) on the development and implementation of the main forms and methods of this control; 6) to institutionalize the diversity of its subjects, as well as their authority. In this regard, a number of amendments and additions to the current legislation of the Russian Federation regulating issues of public control are proposed. The author applies a number of methods of scientific research, in particular: historical, comparative legal, and formal logical analysis. This will not only solve modern problems that arise during the organization and functioning of public control in the Russian Federation, but also ensure its full development as a promising civil society institution. The paper proposes a number of changes and additions to the current legislation of Russia, regulating issues of public control. The results can be used both in educational and scientific, and in practical activities, including in lawmaking.
