This contribution takes as its point of departure the spatial turn in law and the notion of spatial justice. It traces the term ‘spatial justice’ as introduced through the Spatial Planning and Land Use Management Act and it looks at the underlying view of space that has influenced the spatial turn in law. It furthermore investigates the ways in which the spatial turn in law has been influenced by the thinking of Henri Lefebvre, who relies on a Leibnizian conception of space. Lastly the link between Leibniz and legal positivism is considered in order to reach the final conclusion in the form of a caution against merely adding the language of spatial justice to an approach to space that remains caught up in abstract space. This will only further entrench existing fault lines in society. For this conclusion the work of Roger Berkowitz is central. Berkowitz argues convincingly that the work of Leibniz was central in the development of legal positivism, despite Leibniz in general being considered as a natural law thinker. The same applies to spatial justice theory, where the work of Leibniz is central: it may present the possibilities of another law – the law as it ought to be. The law conceptualised as ‘ought’ instead of ‘is’ would promote reconciliation. Alternatively, spatial justice can simply present the law as it ‘is’ and reconfirm and deepen the chasms in our world.

AbstractThere is now a well-established ‘spatial turn in law’. However, it remains oriented towards notions of space rather than law. How, then, to capture both the spatiality of law and the legality of space? This article draws on Bruno Latour's concept of the legal construction of the ‘social’ to explore the assemblage of the city of law. It shows how law functions as a particular form of association in urban life by tracing two key forms of urban legal association in London, the city of law. The first form is ‘legal ordering’. This seeks to order urban life through domination, and includes citadel law, police law and laws of exception. The second is ‘legal consociations’, which build new forms of urban life, such as urban rights, the rights of the city and the right to the city. Finally, the article explores the creation of a spatial justice that can build more just legal associations.

AbstractWhile spatial justice could be the most radical offspring of law’s recent spatial turn, it remains instead a geographically informed version of social justice. The majority of the existing literature on the subject has made some politically facile assumptions about space, justice and law, thereby subsuming the potentially radical into the banal. In this article, I suggest that the concept of spatial justice is the most promising platform on which to redefine, not only the connection between law and geography, but more importantly, the conceptual foundations of both law and space. More concretely, the article attempts two things: first, a radical understanding of legal spatiality. Space is not just another parameter for law, a background against which law takes place, or a process that the law needs to take into consideration. Space is intertwined with normative production in ways that law often fails to acknowledge, and part of this article is a re-articulation of the connection. Second, to suggest a conception of spatial justice that derives from a spatial law. Such a conception cannot rely on given concepts of distributive or social justice. Instead, the concept of spatial justice put forth here is informed by post-structural, feminist, post-ecological and other radical understandings of emplacement and justice, as well as arguably the most spatial of philosophical discourses, that of Deleuze–Guattari and the prescribed possibilities of space as manifold.

This paper examines food system social provisioning at low levels of geographic scale to merge the heterodox microeconomic approach outlined by Frederic Lee (2018) and the activist spatial justice methodology of Edward Soja (2010). Combining these two theoretical frameworks blends academia and activism by joining community perspectives with spatial, quantitative and qualitative data techniques to hypothesis test and investigate disparities in social provisioning. Initiating the inquiry with data available at the address level of geography allows the analysis to develop across diverse geographic scales and reveal consistent patterns of inequality. It is argued that these consistencies afford researchers, activists, and practitioners benchmarks for the study and development of transdisciplinary intervention design and implementation. This spatial study of pediatric food allergy frames a practical example of how this approach is applicable across a variety of socioeconomic and environmental health disparities and the pursuit of spatial justice outcomes at local and national levels of social provisioning.

This article uses a fictionalised encounter as the basis for an autoethnographic exploration of the intersections between the South African social value of ubuntu and the notion of spatial justice. Ubuntu describes the interconnectedness of human lives. It asserts that a person is only a person through other people, a recognition that calls for deep respect, empathy and kindness. Ubuntu is expressed in selfless generosity and sharing. The spatial turn in the social sciences and humanities has resulted in a concern with the relationship between space and justice. It recognises that space is not simply an empty container in which people live and act, but is something that is constructed by social relations – and simultaneously constitutive of them. While this recognition gives rise to spatial perspectives on justice, what constitutes spatial, justice, as distinct from other notions of justice, and how such justice is to be achieved are contested. Building on the work of legal scholar, Andreas Philippopoulos-Mihalopoulos, on spatial justice, I argue that the notion of ubuntu is able to shape our understanding of spatial justice, and when practised, it is able to disrupt space and challenge dominant spatial configurations.

A spatial turn has occurred in various disciplines over the past decades. This article holds that it has not occurred in a similar decisive manner in theological discourse and not in South Africa in particular. After considering the necessity of a spatial turn and spatial consciousness, the article examines the concept of spatial justice against the backdrop of how injustice was and is spatially expressed in South African cities. Considering the way in which South African cities have evolved since the Native Land Act of 1913 – the segregated and apartheid city and the (post)apartheid city – the article then argues that deep and sustained reconciliation will be impossible should current spatial patterns of segregation, exclusion and injustice continue. It advocates theological and ecclesial participation in a national agenda for spatial transformation, to be fleshed out in relation to four interconnected challenges: land, landlessness, housing and home; the ‘creative destruction’ of neighbourhoods, gentrification and the displacement of the poor; participation in city-making (from below) and transformative spatial interventions; and close collaboration with social movements working for spatial justice. It concludes by asserting that such a trans- and/or postdisciplinary agenda for spatial justice would participate with the Spirit to mend the oikos of God.

Theories and philosophies of space and place have seen a rise in prominence in recent times, specifically in the disciplines of theology, law and philosophy. This so-called spatial turn in contemporary theory is one that attempts to think through the vicissitudes and conceptual lineages related to the existence of space as both a physical and a social reality. The politics of space in South Africa, however, cannot be thought of separately from the concept of alienation. South Africa is a space whose existence is predicated upon a relationship of alienation to its located place. South Africa, like most other settler colonies, is a space that was created through occupation and alienation: the occupation of a territory and the alienation of the indigenous people from this occupied territory. This relationship of alienation is not only observable in the physical reality engendered by this occupied space but also by its social reality. In this paper we reflect on the intersections of the physical and social manifestations – in Bourdieu’s sense – of an occupied space and consider its effects of alienation on the indigenous people. To this end we will proceed to interrogate current South African geographical markers – such as the existence of townships and suburbs – from its positionality within the history of South Africa as an occupied space. To discern a theological agenda for the issue of spatial justice would also require an investigation into the theological agenda that prohibited the realisation of spatial justice in South Africa or, in other words, the religious reconciliation preached post-1994 at the expense of justice.

Society is constituted by both historical and spatial elements; however, education research, policy, and practice often subordinates the spatial in preference for the temporal. In what is often referred to as the “spatial turn,” more recently education researchers have acknowledged spatial concepts to facilitate understandings and inform debates about identity, belonging, social justice, differentiation, policy, race, mobility, globalization, and even digital and new communication modes, amongst many others. Social geographers understand place as more than a dot on a map, instead focusing on the sociocultural and sociomaterial aspects of spaces. Space and place are core elements of social geography. Schools are comprised of architectural, material, performative, relational, social, or discursive spaces, all of which are socially constructed. Schools and education contexts, as social spaces and places, produce and reproduce modes of social interactions and social practices while also mediating the relational and pedagogical practices that operate within. Pedagogical spaces are also about the exercise of power—a spatial governmentality to regulate behavior. Yet pedagogy can focus on place-based and place-conscious practices that highlight the connectedness between people and their non-human world. A focus on the sociospatial in education research is able to foreground inequalities, differences, and power relations that are able to speak to policies and practices. As such, in this field there is often a focus is on spatial justice, where inequalities based on location, mobility, poverty, or indigeneity are analyzed using spatial understandings of socioeconomic or political characteristics. This brings together connections between place and space in a powerful combination around justice, equity, and critical thinking.

This article presents methodological starting points, heuristics and the results of a GIS-based analysis of the history of Slovenian literary culture from the 1780s to 1941. The ethnically Slovenian territory was multilingual and multicultural; it belonged to different state entities with distant capitals, which was reflected in the spatial dynamic of literary culture. The research results have confirmed the hypotheses of the research project ‘The Space of Slovenian Literary Culture,’ which were based on postulates of the spatial turn: the socio-geographical space influenced the development of literature and its media, whereas literature itself, through its discourse, practices and institutions, had a reciprocal influence on the apprehension and structuring of that space, as well as on its connection with the broader region. Slovenian literary discourse was able to manifest itself in public predominantly through the history of spatial factors: (a) the formation, territorial expansion and concentration of the social network of literary actors and media; (b) the persistent references of literary texts to places that were recognized by addressees as Slovenian, thereby grounding a national ideology. Taking all of this into account, and based on meta-theoretical reflection, the project aims to contribute to the development of digital humanities and spatial literary studies.
