Hurricane Harvey made landfall as a Category-4 storm in the United States on 25 August 2017 in Texas, causing catastrophic flooding in the Houston metropolitan area and resulting in a total economic loss estimated to be about $125 billion. To monitor flooding in the areas affected by Harvey, we used data from sensors aboard the Suomi National Polar-Orbiting Partnership Satellite (SNPP) and the new Geostationary Operational Environmental Satellite (GOES)-16. The GOES-16 Advanced Baseline Imager (ABI) observations are available every 5 min at 1-km spatial resolution across the entire United States, allowing for the possibility of frequent cloud free views of the flooded areas; while the higher resolution 375-m imagery available twice per day from the Visible Infrared Imaging Radiometer Suite (VIIRS) aboard the SNPP satellite can observe more details of the flooded regions. Combining the high spatial resolution from VIIRS with the frequent observations from ABI offers an improved capability for flood monitoring. The flood maps derived from the SNPP VIIRS and GOES-16 ABI observations were provided to the Federal Emergency Management Agency (FEMA) continuously during Hurricane Harvey. According to FEMA’s estimate on 3 September 2017, approximately 155,000 properties might have been affected by the floodwaters of Hurricane Harvey.

Infection with bovine leukemia virus (BLV) results in economic loss because of reduced productivity, especially reduced milk production, and early culling. In the United States, studies in 1996, 1999, and 2007 showed BLV infection to be widespread, especially in dairy herds. We updated information herein on BLV seroprevalence in the United States, using samples submitted for testing and found negative for antibodies for Brucella by the Kentucky Eastern Regional Federal Brucellosis Laboratory. From October 2014 through August 2015, 2,000 samples from all regions of the contiguous United States were selected and tested for BLV antibodies by enzyme-linked immunosorbent assay. The overall percentage of samples positive for BLV antibody was 38.6%. Based on the animal’s origin, the percent positive by region ranged from 32.5% (Mountain West region) to 54.3% (Northeast region; p < 0.05). The positive rate for slaughter plants that processed mainly dairy animals (dairy plants; 47.6%) was higher than the positive rate at slaughter plants that processed mainly beef animals (beef plants; 33.6%; p < 0.05). The results suggest that BLV infection remains widespread in all regions of the United States and that rates may differ between beef and dairy cattle.

On September 24, 2007, the conflict in Burma, also known as Myanmar, between the public and the military junta, officially known as the State Peace and Development Council (SPDC), reached a serious point. The military junta, which represented the Burmese government, had raised the price of oil through its monopoly, which subsequently elevated food prices. In response, the public, including 1000 monks, protested against the tyrannical rule of the junta. The junta reacted by killing thousands of people and arresting democratic leaders such as U Gambira, the leader of the protesting monks. Amidst this turmoil, many foreign countries intervened to try to find a solution. Keck and Sikkink suggest that these are voluntary and angel states coming to the aid of others. On the other hand, Kaufmann and Pape argue that these are states masking their acts as aid while looking for gains for themselves. They add that these political gains are made at the costly price of economic loss. By examining how the United States has been involved in the crisis in Burma, Kaufmann and Pape’s view on these states appears to be more correct than that of Keck and Sikkink, who believe in the existence of voluntary states.

The economic loss rule bars recovery by a party who suffers only economic loss, unaccompanied by harm to the person or property. Although the economic loss rule was developed as a way to maintain a “boundary line” between contract and tort law, the application of the rule has proven difficult because of its potential for broad applicability and inequitable results. Because of this, several jurisdictions across the United States have adopted exceptions to the general economic loss rule. One such exception is negligent misrepresentation. The negligent misrepresentation exception is outlined in section 552 of the Second Restatement of Torts. The exception provides that a person who conveys negligent information in the course of his or her business for the guidance of persons within a limited class, who then rely on that information to their detriment, are liable to those persons in tort notwithstanding the economic loss rule. Until recently, Texas law was unclear as to whether it had adopted negligent misrepresentation as a general exception to the economic loss rule. It is clear, however, that Texas has adopted an exception to the economic loss rule for professionals who provide negligent information in the course of their profession. The Court in LAN/STV v. Martin K. Eby Constr. Co. (“LAN/STV”) chose not to extend this exception to design professionals who provide negligent design plans to contractors for a construction project. This decision has received backlash by many in the construction industry as it produces inequitable results and does not extend the “professional” exception to design professionals. Texas should adopt the negligent misrepresentation exception to the economic loss rule, as applied to design professionals in the construction context, so that tort remedies are available to contractors who suffer economic losses due to their reliance on negligent plans from a design professional.

Minnesota is the top sugar beet (Beta vulgaris L.) producing state in the United States. In 2020, sugar beet plants were observed for the first time in which the two to three oldest leaves had light brown to dark brown necrotic leaf lesions that eventually became yellow or brown and died but remained attached to the plant. Morphological data and sequences of internal transcribed spacer regions identified the pathogen as Sclerotinia sclerotiorum. Because over 90% of the plants in identified fields were infected it was difficult to quantify loss in yield or quality caused by this disease. All fields with symptomatic plants had soybean or edible beans in the rotation. One field planted to several different varieties indicated that all the varieties were symptomatic. It will be useful to determine any economic loss caused by S. sclerotiorum and any known varietal resistance to this pathogen.

Annual decreases in soybean (Glycine max L. Merrill) yield caused by diseases were estimated by surveying university-affiliated plant pathologists in 28 soybean-producing states in the United States and in Ontario, Canada, from 2010 through 2014. Estimated yield losses from each disease varied greatly by state or province and year. Over the duration of this survey, soybean cyst nematode (SCN) (Heterodera glycines Ichinohe) was estimated to have caused more than twice as much yield loss than any other disease. Seedling diseases (caused by various pathogens), charcoal rot (caused by Macrophomina phaseolina (Tassi) Goid), and sudden death syndrome (SDS) (caused by Fusarium virguliforme O’Donnell & T. Aoki) caused the next greatest estimated yield losses, in descending order. The estimated mean economic loss due to all soybean diseases, averaged across U.S. states and Ontario from 2010 to 2014, was $60.66 USD per acre. Results from this survey will provide scientists, breeders, governments, and educators with soybean yield-loss estimates to help inform and prioritize research, policy, and educational efforts in soybean pathology and disease management.
