Building on sociological research on institutions and organizations and psychological research on risk and decision making, we propose that the development of institutions that reduce the risks of entering new sectors has a stronger effect on the founding rates of firms using novel technologies than on firms using established technologies. In an analysis of the independent-power sector of the electricity industry from 1980 to 1992, we found that the development of regulative and cognitive institutions legitimated the entire sector and provided incentives for all sector entrants; thus, foundings of all kinds of firms multiplied rapidly but had a stronger impact on those using risky novel technologies. In contrast, the central normative institutions that developed in this sector, state-level trade associations, provided greater support for particular forms (those using established technologies) and thus increased foundings of those favored forms more than foundings of less favored forms (those using novel technologies). Our study demonstrates how institutional forces can alter the mix of organizations entering a new industry and thus contribute to diversity, as well as similarity, among organizations.

Met dit boek levert Frank Seberechts een nagenoeg volledige studie af van een van de minder fraai kanten van de Belgische samenleving in 1940: de administratieve arrestatie en de wegvoering naar Frankrijk van enkele duizenden personen (de ‘verdachten’), Belgen of in België verblijvende vreemdelingen. De extreem-rechtse en pro-Duitse arrestanten hebben na hun vrijlating dit feit politiek in hun voordeel uitgebaat, waardoor volledig in de schaduw kwam te staan dat de overgrote meerderheid van de weggevoerden joodse mensen waren die in de jaren voor de oorlog naar België waren gevlucht. Dat het beeld van de wegvoeringen niet volledig is, is grotendeels te wijten aan het feit dat de meeste archieven die hierop betrekking hebben tijdens de meidagen van 1940 vernietigd werden. Met name de politieke besluitvorming over de wegvoeringen vertoont nog steeds schemerzones, zodat het vastleggen van verantwoordelijkheden ook vandaag nog een gewaagde onderneming is.________Deportations and the deported during the Maydays in 1940 By means of this book Frank Seberechts provides an almost complete study of one of the less admirable sides of Belgian society in 1940: the administrative arrest and the deportation to France of some thousands of people (‘the suspects’), Belgians or foreigners residing in Belgium. The extreme-right and pro-German detainees politically exploited this fact after they had been freed, but this completely overshadowed the point that the large majority of the deported people were Jews who had fled to Belgium during the years preceding the war. This incomplete portrayal of the deportations is mainly due to the fact that most of the archives relating to the events had been destroyed during the Maydays of 1940. The history of the political decision-making about the deportations in particular still shows many grey areas and it is therefore still a risky business even today to determine which people should be held accountable.

This chapter presents a framework for understanding the most promising contributions of psychological methods and insights for private law. It focuses on two related domains of psychological research: cognitive and social psychology. Cognitive psychology is the study of mental processes, which one might shorthand as “thinking.” Social psychology asks about the role of other people—actual, implied, or imagined—on mental states and human behavior. The chapter is oriented around five core psychological insights: calculation, motivation, emotion, social influence, and moral values. Legal scholarship by turns tries to explain legal decision-making, tries to calibrate incentives, and tries to justify its values and its means. Psychology speaks to these descriptive, prescriptive, and normative models of decision-making. The chapter then argues that psychological analysis of legal decision-making challenges the work that the idea of choice and preference is doing in private law, especially in the wake of the law and economics movement.

Abstract Background Much of the disease burden in the United States is preventable through application of existing knowledge. State-level public health practitioners are in ideal positions to affect programs and policies related to chronic disease, but the extent to which mis-implementation occurring with these programs is largely unknown. Mis-implementation refers to ending effective programs and policies prematurely or continuing ineffective ones. Methods A 2018 comprehensive survey assessing the extent of mis-implementation and multi-level influences on mis-implementation was reported by state health departments (SHDs). Questions were developed from previous literature. Surveys were emailed to randomly selected SHD employees across the Unites States. Spearman’s correlation and multinomial logistic regression were used to assess factors in mis-implementation. Results Half (50.7%) of respondents were chronic disease program managers or unit directors. Forty nine percent reported that programs their SHD oversees sometimes, often or always continued ineffective programs. Over 50% also reported that their SHD sometimes or often ended effective programs. The data suggest the strongest correlates and predictors of mis-implementation were at the organizational level. For example, the number of organizational layers impeded decision-making was significant for both continuing ineffective programs (OR=4.70; 95% CI=2.20, 10.04) and ending effective programs (OR=3.23; 95% CI=1.61, 7.40). Conclusion The data suggest that changing certain agency practices may help in minimizing the occurrence of mis-implementation. Further research should focus on adding context to these issues and helping agencies engage in appropriate decision-making. Greater attention to mis-implementation should lead to greater use of effective interventions and more efficient expenditure of resources, ultimately to improve health outcomes.

Information needs of government for SEA, EIA, and other aspects of biodiversity conservation and sustainable development are studied and reported in this chapter. This includes needs related to biodiversity for land use planning, for operation of the EU Common Agricultural Policy, for agricultural policy more generally, and for Biodiversity Action Plans. Legislation and its implementation are considered at European Union and member state level by direct enquiries and a preliminary questionnaire survey in project partner countries. Preliminary conclusions are drawn and lessons learned for a Pan-European survey.


This chapter describes the ideological forms and beliefs that are considered either evangelical or liberal. The differences between these two types of faith worldviews influence legislative decision making and inform culture. To the extent that gay issues represent a cultural divide between religious traditionalism and progressivism policy outcomes are impacted by these differences.

AbstractThis article analyses the effect of the anti-Enlightenment tradition on the functioning of the European Union. This tradition covers a lack of belief in liberal values, human rights, egalitarianism, the rule of law, individualism, tolerance, and the respectful cooperation among people. Its ideological background is not new: its existence is also the reason why scholars started to talk about post-fascism in the twenty-first century. In a number of European Union member states, where autocratic tendencies have recently been witnessed (like in Hungary or Poland), it started to dominate decision-making, while its presence is also visible elsewhere, like in the UK, Germany, and Italy. This article selects four prime examples (the rule of law backlash, refugee law, Brexit, and changes to the single market) to show how arguments containing elements of the anti-Enlightenment tradition are used in a cynical way to support partisan and oppressive politics while maintaining a seemingly inclusive façade of democratic decision-making. In the European Union, this can result in dubious, un-explained measures and great policy changes both at EU and member state level.

A risk-based decision-making process conceived of and developed at JPL and NASA, has been used to help plan and guide novel technology applications for use on spacecraft. These applications exemplify key challenges inherent in multidisciplinary design of novel technologies deployed in mission-critical settings: 1) Cross-disciplinary concerns are numerous (e.g., spacecraft involve navigation, propulsion, telecommunications). These concerns are cross-coupled and interact in multiple ways (e.g., electromagnetic interference, heat transfer). 2) Time and budget pressures constrain development, operational resources constrain the resulting system (e.g., mass, volume, power). 3) Spacecraft are critical systems that must operate correctly the first time in only partially understood environments, with no chance for repair. 4) Past experience provides only a partial guide: New mission concepts are enhanced and enabled by new technologies, for which past experience is lacking. The decision-making process rests on quantitative assessments of the relationships between three classes of information-objectives (the things the system is to accomplish and constraints on its operation and development), risks (whose occurrence detracts from objectives), and mitigations (options for reducing the likelihood and/or severity of risks). The process successfully guides experts to pool their knowledge, using custom-built software to support information gathering and decision-making.
