The Moral Manager: Communicative Ethics and the Exxon Valdez Disaster

For many, the case of the Exxon Valdez oil spill has become a symbol of unethical corporate behavior. Had Exxon’s managers not callously pursued their own interests at the expense of the environment and other parties, the accident would not have happened. In this paper, we (1) present a short case study of the Valdez incident; (2) argue that many analyses of the case either ignore or fail to give sufficient weight to the uncertainties managers often face when they make decisions; and (3) propose a framework for moral management grounded in principles of communicative ethics, moral dialogue, and in the non-traditional ideas of many current management and behavioral decision theorists. From this view, the moral manager is not expected to know the “correct” answer to every ethical issue, but rather to participate responsibly in an open dialogue with other interested parties.

Abstract This chapter focuses on historic garden tourism and the current management and development of historic gardens. Here the focus is on landscape, which is a more holistic approach to historic sites, and marks innovation in historic garden tourism. In this chapter, examples are presented of the four strategies of preservation, reconstruction, restoration, renovation; and the fifth new direction of landscape integration. A case study is presented of the Bellamy-Ferriday House & Garden in Bethlehem, Connecticut, USA.

AbstractWith increasing globalization, transnational crime in general, and human trafficking in particular, a design of new legal framework is required in order to effectively operationalize interstate law enforcement operations and prosecutions. The development of a transnational criminal legal framework—or frameworks—can build on pre-existing transnational economic frameworks. There is also the need to extend the application of domestic law beyond national borders to influence transnational corporate behavior. Regulations based on reflexive law are one possible approach. Teubner's idea of reflexive law has been informing developments in this area. This approach uses traditional national law to inform corporate governance strategies in order to achieve effects on the market. A few jurisdictions have already adopted measures modeled on this approach to tackle human trafficking and slavery-like conditions in global supply chains. Weaknesses in the approaches adopted by the UK and the State of California have already been identified. If strengthened, this approach could be adopted in more jurisdictions—including the EU—and also to combat more areas of transnational crime—such as money laundering. This paper will examine the resulting challenges using human trafficking as a case study.

Jaundice caused by hemolysis continues to challenge practitioners caring for infants in the NICU. Bilirubin levels can rise quickly in the first days of life, and interventions must be prompt to prevent side effects related to hyperbilirubinemia. Conventional treatments such as hydration and phototherapy are common, but new studies suggest that use of intravenous immunoglobulin (IVIG) as an additional treatment may prevent the need for exchange transfusion in some babies. This article presents a case study of an infant with blood-type incompatibility treated successfully with multiple doses of IVIG, discusses the pathophysiology and clinical presentation of hemolytic jaundice, and reviews current management strategies for this disease.

The case study presented in this investigation, addresses the analysis of the current management of the maintenance of the machinery and equipment used in the balanced feed mixing plant for cattle of a private company in the northern region of Sinaloa, with the purpose of design and implement an efficient methodology to improve unscheduled stoppages due to recurring failures. Within the applied activities, a routing of the machinery and equipment was carried out to diagnose the state in which they were, the 5's methodology was applied in the warehouse and cellar area to be able to maintain the order, cleaning and classification of tools, materials and spare parts. The formats and logs were designed as an integral maintenance plan, validating it to carry out the controls for several weeks to compare the initial diagnosis with the final results. An increase in productivity was obtained as corrective maintenance decreased, reducing downtime and developing a commitment with the staff, keeping the areas tidy, classified and clean.

A intervenção psicossocial (2018) centrou-se na qualidade das relações interpessoais dos funcionários e equipe técnica de um centro de acolhida para mulheres em vulnerabilidade social (CAE) e visou promover a conscientização da potencialidade de cada funcionário, reforçando seus pontos fortes, reconhecendo seus pontos fracos e, a partir disso, desenvolver uma reflexão acerca de como melhorar, por meio de ações concretas, seu desempenho dentro da instituição, estabelecendo a compreensão das delimitações de suas funções. O objetivo geral da proposta foi compreender as inter-relações de trabalho dentro do CAE e analisar como a subjetividade de cada funcionário influencia o funcionamento da instituição. Constou de um estudo de caso, uma atuação em campo, com caráter exploratório e características qualitativas de análise. As técnicas foram observacionais, entrevistas individuais e dinâmicas em grupo. Os resultados da pesquisa mostraram que os funcionários estão divididos, uns não aceitam a atual gestão e os demais por serem novatos ou indicados pela atual gestão, identificam-se com as novas propostas e estão mais satisfeitos. A intervenção buscou por meio da reflexão dos funcionários, evitar as contradições, em prol da coesão e do ambiente de trabalho mais saudável.Palavras-chave: Centro de acolhida. Instituição.AbstractFocusing on the laborers’ and technicians’ staff, the psycho-social intervention project aimed to promote an awareness of the self potential of each individual worker, reinforcing their strengths and recognizing their weaknesses and, by that, promote a reflection about the means of improving, by concrete actions, their effectiveness in the institution, establishing the delimitations of their own functions. The project was held in a Shelter Center for Women – Centro de Acolhida Especial para Mulheres (CAE) –, in São Paulo. The general target of this study was to understand the interrelations of work inside the CAE and analyze how the subjectivity of each worker influence the operation of the institution. The study consists of a Case Study, exploratory and of qualitative analysis characteristics. The techniques used were observation, interviews and group dynamics. The results of the study show that the workers are divided, some of them accepting the current management and others, being recently arrived or appointed by the management, identify oneself with the new propositions and have more satisfaction. The importance of this intervention was, by an exercise of self reflexion of the workers, to help them in avoiding contradictions in name of a group cohesion and a healthier work space.Keywords: Shelter Centre. Regenwetter, Robinson, and Wang (in press) argue that research on decision making is plagued with conjunction fallacies or “Linda Effects”. As a case study, they provide a critical analysis of Kahneman and Tversky’s seminal paper on Prospect Theory and its 1992 sequel. This commentary evaluates their criticisms and ultimately finds them to be predicated on a number of misconceptions. As argued below, a reliance on stylized effects at the aggregate level is perfectly legitimate when dismissing a received view and first proposing a new account that organizes said effects in theoretically-meaningful ways.
