Abstract This paper describes the most important problems related to the management of intellectual property in startups. Startups have become an inseparable element of the innovative economy. Many of these companies base their development on intellectual capital and innovations. In this context, it is extremely important to legally secure the innovations and protect intellectual property. These activities can often be the decisive factor in the development of startups. This article aims to identify, analyse and evaluate the most important issues related to the management of intellectual property in startups. The first part of this paper presents the performed literature review, which mainly concerns the definition of innovation, the state of entrepreneurship in Poland, and the definition of a startup. The second part of the article deals with the main problems related to the management of intellectual property in startups. It is divided into three issues: underestimating the importance of intellectual property, the lack of intellectual property management strategies in startups and financial challenges of startups. The main results of the research indicate that many startups still have low awareness of what is intellectual property and what can be the consequence of using exclusive rights of others. The protection of intellectual property should become one of the elements of business strategies. However, startups find that the creation of the strategy and its implementation is rather expensive.

Software technology is seeing enormous growth as it is used in all fields of technology. It is continuously evolving at a rapid pace and has a short span of the technological life cycle. The use of the software is not restricted only to information and communication technology but is used in all fields of technology. In many cases, the inventive step of a product or service lies solely in the software. Hence, the software plays a crucial role in all fields of technology. However, ease of copying poses a financial risk for the software industry, thereby creating major disincentives to the development of innovation. Still, the technology is changing very fast and firms investing in this technology expect quick returns on their innovation investments. Strategies for generating and managing intellectual property have subsequently taken center stage for information and communication technology companies, and patents have become an important feature providing maximum protection for any technology. Hence, intellectual property rights strategies in general and patenting strategies especially play a crucial role in the information and communication technology industry to be globally competitive. Firms never publish or disclose their intellectual property strategies; hence, this study makes use of the literature review to highlight various intellectual property management strategies used by information and communication technology firms for managing their intellectual property. These strategies can be offensive or defensive and may be used as proactive or reactive depending on various aspects such as market, territory, technology, or time. The insights provided in this work may help the research community from the IT domain in industry and academia to learn and modify their strategies for patent acquisition.

Relevance. In the modern interpretation, intellectual property has an interdisciplinary nature, being a legal and economic category, which determines the complexity of training personnel in the field of intellectual property as one of the key elements in building an innovative economy. Great importance is attached to the solution of this problem in the implementation of the State Program of Innovative Development of the Republic of Belarus and the Strategy of the Republic of Belarus in the field of intellectual property. Methodology: the research is based on general scientific methods of complex and systematic analysis, including the methodology of comparative analysis of international and national experience in the field under study. Results. In a historical aspect, the article describes the experience of the Republic of Belarus in training personnel in the field of intellectual property, identified the main problems at the present stage and proposed a set of measures to solve them. Particular attention is paid to the development and teaching experience of the discipline «Fundamentals of Intellectual Property Management», which was introduced as a mandatory state component in the studying programs of higher educational institutions. Discussion. The study considered content of training programs for training students of the first and second levels of education, retraining on the basis of higher education and advanced training of specialists. The authors proposed and substantiated an approach to the organization of education in the field of intellectual property for economic specialties in the Republic of Belarus. The article concluded that the implementation of a set of proposed measures for the development of a system for training specialists in the field of intellectual property management will make it possible to train personnel for an innovative economy, digital transformation and solve social and economic problems facing the country.

Subject. Currently, as the global economy evolves, its innovative components should demonstrate a tendency of accelerated growth as intellectual capital, information technologies, increasing knowledge and digitization of mushrooming production processes. Nowadays, intellectual capital is one of the economic development drivers. However, the economic community is found to have no generally accepted wording of the concept, thus laying the basis for this article. Objectives. The study sums up the analysis of approaches used by the Russian and foreign economists to determining the economic substance of intellectual capital. We also identify the importance of human capital as its components and specify the definition of the concept. Methods. The article overviews and analyzes proceedings by the most renowned authors, which substantiate how the economic substance of intellectual capital should be unveiled, and suggest its definitions. Results. We specified the definition of intellectual capital concerning the current economic development. We suggest integrating a new component into intellectual capital, such as intellectual property, which includes products of intellectual activity and intangible assets. They can be owned by the entity or other legal entities and individuals, including some employees of the entity. Conclusions and Relevance. The specified definition of intellectual capital will help address issues of sustainable economic development and ensure the competitiveness of the Russian entities nationwide and worldwide, since it directly contributes to intellectual capital and its components.
