Acccording to the Arrticle 24C paragaaph (1) the Constttution of thr Republic of Indonesia of 1945, the Constitutional Court of thr Republic of Indonesia have thr power to decide upon disputes over the results of general election. The general election referred to here is elections to elect members of the legislature, regional representative councils, regional legislatures, president amd vice president. Both of thr provisions have been limitative, so there will no be any other elections that included. However, in its development, the Constittutional Court of the Republc of Indonesia is given the power to decide upon disputes ovrr the results of regional hed elections with a legal basis of the Constittutional Court Ruling Number 072-073/PUU-II/2004. However, a litle later the Constttution Court of the Republic of Indonesia issued a Consttttuional Court Ruling Number 97/PUU-XI/2013 which said tht the Constitusional Court of the Republic of Indonesia can’t have the power to decide upon disputes over the resuls of regional hed elections. This reaises problems regarding whether regional head elections are included in thr general election regime? And whether the Constitutional Court of the Republic Indonesia has thr authorty to decide upon disputes over the results of regional hed elections? Thr Author examined the issue by normative method. The results of thr resrarch show tht thr regional hesd elections is not a part of the general electiins regime and the Constututional Corrt of the Republic Indonesia can’t have thr power to decide upon disputes ovrr thr resulls of the regional hesd elections.

In the 1945 Constitution of the Republic Indonesia, there is an order to further regulate in the Law such as the general election that has been enacted Law No. 7/ 2017 on General Election. In its Law, the results of the general election is merely a dispute over the result of the general election regarding the determination of the vote which may affect the election participants’ seats and the President and Vice President election results. The objective of this paper is to find out the legal consequences of the provisions of the law which reduce the authority of state institutions that have been regulated in the 1945 Constitution. The approach of this research is status approach that will be used by examining the laws and regulations relating to the problem. The provisions of the Law on General Elections can be said to have reduced the authority of the Constitutional Court granted the Constitution. There should be strong grounds for an amendment to this provision it can be done immediately by the House of Representatives and the President. Testing by the Constitutional Court may be done but it is better through changes by the House of Representatives and the President.

Constitutional Court’s authority under Article 24C section (1) of the 1945 Constitution of the Republic of Indonesia in terms of review the legislation only to review the legislation against the Constitution. However, the decision No. 85/PUU-XI/2013 on Review of Law Number 7 of 2004 on Water Resources, the Constitutional Court declared some of the implementing regulations of these laws do not fulfill the basic principles of water resources management restrictions. So it will be seen how the legal consequences of the Constitutional Court Number 85/PUU-XI/2013 and how to apply the power of the implementing regulations of Law Number 7 of 2004 on Water Resources. Whereas under Article 57 of Law of the Constitutional Court stated that the ruling of the Constitutional Court stated that the substance of sections, articles and/or parts of laws contrary to the constitution. So that the implementing regulations of Law Number 7 of 2004 on Water Resources remains in effect throughout has been no decision or rule that states no longer valid. To avoid government regulation promulgated after the Constitutional Court ruling to overturn legislation that became the legal basis for the government to promulgate regulations, to be made the rule that when the Constitutional Court to investigate and adjudicate a law, then the process of formation of the implementing regulations on enactment legislation being tested is to be suspended until there is a decision of the Constitutional Court.

Abstrak Implikasi putusan mahkamah konstitusi terkait penggunaan KTP dan paspor dalam pemilihan presiden dan wakil presiden dalam kerangka menjamin hak memilih dalam pemilihan umum. Terkait dengan ini maka memunculkan permasalahan terkait implikasinya. Bagaimana implikasi baik secara langsung maupun tidak langsung putusan Mahkamah Konstitusi terkait penggunaan KTP dan Paspor dalam pemilihan umum. Mahkamah Konstitusi sebagai lembaga pelaksana kekuasaan kehakiman yang salah satu kewenangannya adalah menguji Undang-Undang terhadap UUD Negara Republik Indonesia Tahun 1945 dalam rangka mewujudkan negara demokrasi yang berdasarkan hukum sebagaimana termaktub dalam Pasal 1 UUD Negara Republik Indonesia Tahun 1945. Hasilnya adalah implikasi langsung yang terdiri dari penerapan KTP dan Paspor sebagai ganti DPT, Memunculkan putusan yang bersifat self executing, mengesampingkan Peraturan Pemerintah Pengganti Undang-undang, mengesampingkan keputusan dan peraturan KPU terkait aturan baru akibat putusan MK dan Implikasi tidak langsung yang terdiri dari Mengurangi terjadinya perselisihan hasil Pemilihan Umum Presiden, KPU bekerja ekstra. Tujuan ke depan penelitian ini adalah untuk mengetahui dan memberikan sumbangsih dalam dunia akademik terutama terkait tentang penjaminan hak asasi manusia terutama hak memilih dalam pemilihan presiden dan wakil presiden. Penelitian ini menggunakan metode kajian peraturan perundang-undangan yang sesuai dengan metode ilmu hukum. Kata Kunci: Putusan Mahkamah Konstitusi, Pemilu, Kartu Tanda Penduduk Abstract The implications of the constitutional court's decision regarding the use of resident identity cards and passports in the election of president and vice president in the framework of guaranteeing the right to vote in general elections. Related to this, problems arise regarding their implications. What are the implications of either directly or indirectly the decision of the Constitutional Court regarding the use of Identity Cards and Passports in general elections. The Constitutional Court as the executing agency of judicial power whose authority is to examine the Law against the State Constitution of the Republic of Indonesia of 1945 in order to realize a democratic state based on law as stipulated in Article 1 of the Constitution of the Republic of Indonesia of 1945. The result is implications directly consisting of the application of Identity Cards and Passports in lieu of the Permanent Voters List, Raising decisions that are self-executing, overriding Government Regulations Substituting the Law, overriding the decisions and regulations of the General Election Commission regarding new rules due to the Constitutional Court ruling and indirect implications consisting of Reducing the disputes over the results of the Presidential General Election, the Election Commission works extra. The future goal of this research is to know and contribute in the academic world, especially related to guaranteeing human rights, especially the right to vote in the presidential and vice presidential elections. One of the authorities of the Constitutional Court governed by the Constitution of the Republic of Indonesia in 1945 was the examining of laws against the contitution or judicial review. Inside the regulations which governing the implementation of this authority, the Constitutional Court only acts as a negative legislator, namely canceling or reinforcing a norm tested by the Petitioner. But in practice, the Constitutional Court has changed its role to become a positive legislator, who is forming a new legal norm, which is the authority of legislators. The Constitutional Court should not be able to form a new legal norm because there is no legal basis which regulate that. But Constitutional Court can form a new legal norm in some urgent circumstances, relating to Human Rights, and preventing legal vacuum. In addition, the establishment of laws by lawmakers that require a long process and time. This is compelling Constitutional Court to make substitute norm before the law was established by the legislators. In the Decision of the Constitutional Court Number 46/PUU-XVI/2016, the Court actually wants to establish a new legal norm, but because the articles in the petitioned have criminal sanctions, and if the Constitutional Court approves the petition, the Constitutional Court has formulated a new criminal act that can only be formed by the lawmaker. Whereas in the Decision of the Constitutional Court Number 21/PUU-XII/2014, the Constitutional Court established a new norm because in the article a quo there were no criminal sanctions.

This study examined the rights of the constutional court’s decision on the house of representative’s representatives about on the president prospective and/ or the president’s vice private vocational school by the state basic state of the Republic of Indonesia year 1945. The purpose of this study is to find out the mechanism of the Constitutional Court in examining, adjudicating and deciding the opinion of the People's Legislative Assembly that the President and / or Vice President have violated the law in the form of treason against the state, corruption, bribery, other serious criminal acts, disgraceful acts, and / or the opinion that the president and / or the vice president no longer meets the requirements as President and / or Vice President. And also To find out the decision of the Constitutional Court as a binding judicial institution on the opinion of the House of Representatives followed up by the MPR as a political institution that the President and / or Vice President has violated the law in the form of treason, corruption, bribery, other serious crimes, disgraceful acts and / or the opinion that the president and / or vice president no longer fulfill the requirements as President and / or Vice President.

<p>Kedudukan komisi yudisial sebagai pengawas system peradilan di Indonesia di rasa sangat penting untuk menjadikan system peradilan di Indonesia professional dan berintegritas. Persoalan kemudian hadir pasca putusan <a href="http://kepaniteraan.mahkamahagung.go.id/kegiatan/1181-putusan-mk-no-43-puu-xiii-2015-proses-seleksi-hakim-tingkat-pertama-tidak-perlu-melibatkan-ky">MK No 43/PUU-XIII/2015</a> dimana dalam putusan menjadikan Komisi Yudisial tidak lagi sebagai pihak yang ikut serta mengawasi perekrutan hakim tingkat pertama. Padahal dalam system ketatanegaraan jika lembaga komisi yudisial peran dan fungsinya dibatasi akan menjadikan mahkamah agung sebagai lembaga absolute dalam kekuasaan yudikatif.</p><p>.</p><p>Pasca putusan Mahkamah Konstitusi <a href="http://kepaniteraan.mahkamahagung.go.id/kegiatan/1181-putusan-mk-no-43-puu-xiii-2015-proses-seleksi-hakim-tingkat-pertama-tidak-perlu-melibatkan-ky"> No 43/PUU-XIII/2015</a> tidaklah menjadi penghambat Komisi Yudisial dalam melakukan penegakan kode etik. Bahkan pada sisi lain Komisi Yudisial harus mampu melakukan penerobosan penafsiran bahwa putusan tersebut semata-mata memberikan ruang dan kedudukan Komisi Yudisial untuk merespon upaya kemerdekaan kekuasaan kehakiman yang secara mandiri dan merdeka akan tetapi harus sesuai real nilai-nilai pancasila dan Undang-Undang Dasar Negara Republik Indonesia dengan menempatkan Komisi Yudisial yang nantinya akan menguji idependensi hakim-hakim yang merupakan hasil seleksi dari Mahkamah Agung secara ketat dalam menjalankan tugas dan fungsinya sesuai dengan prinsip-prinsip dasar kode etik yang telah telah dicanangkan sesuai dengan peraturan perundang-undangan yang berlaku.</p><p>Status of the Judicial Commission as the regulatory system in the sense of justice in Indonesia Sangat system makes for a review of integrity and professional judiciary in Indonesia. Even on the other side of the Judicial Commission should be able to make a breakthrough interpretation that the decision merely provides the space and the position of the Judicial Commission to respond to the efforts of the independence of judiciary is independent and free but must be corresponding real values of Pancasila and the Constitution of the Republic Indonesia by placing the Judicial Commission which will examine idependensi judges were selected from the Supreme Court strictly in performing their duties and functions in accordance with the basic principles of the code of conduct that has been implemented in accordance with the legislation in force.</p>

The enactment of Law Number 32 Year 2004 is a manifestation of the development ofadvanced democracy, namely all local chief elected directly by the people except the positionof the Governor of Yogyakarta. However, in its development, the implementation of theGeneral Elections of Regional Head gave rise to dissatisfaction which resulted in the appealof the results of the General Election to the court for various reasons. The presence of theConstitutional Court as an institution that resolved the dispute over the General Election ofRegional Heads has not been able to provide justice to the public, especially the emergenceof many Constitutional Court rulings that cause debate. In its development, the ConstitutionalCourt abolished its authority in the settlement of disputes in the General Election of RegionalHeads as stipulated in Decision Number 97 / PUU-XI / 2013. The Constitutional Court is ofthe opinion that the Constitutional Court only has the authority to resolve election disputes ofDPR, DPD, President/Vice President because the election is done nationally, while theelection is conducted in certain areas only. In addition, the volume of incoming cases relatedto election disputes more than the law review case which is the main authority of theConstitutional Court, so that this can affect the quality of the decisions of the ConstitutionalCourt considering the dispute resolution of the results of the General Election should beterminated within fourteen days. DOI: 10.15408/jch.v5i2.7090

Pasal 60 ayat (4) Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintah Aceh dinyatakan bahwa masa kerja Panitia Pengawas Pemilihan (Panwaslih) berakhir 3 (tiga) bulan setelah pelantikan kepala daerah tepilih, sementara dalam regulasi yuridis lainnya khususnya Undang-Undang Nomor 15 Tahun 2011 tentang Penyelenggara Pemilihan Umum dan Pemilihan menegaskan berakhir paling lambat 2 (dua) bulan setelah seluruh tahapan penyelenggaraan Pemilihan Umum selesai. Ketua Badan Pengawas Pemilihan Umum (Bawaslu) Republik Indonesia mengeluarkan Surat Edaran Nomor: 0240/K.Bawaslu/TU.0001/III/2017 tentang Penegasan Masa Tugas Lembaga Pengawas Pemilihan Umum Ad Hoc dalam Rangka Pemilihan Gubernur dan Wakil, Bupati dan Wakil Bupati dan/atau Walikota dan Wakil Walikota Tahun 2017. Surat Edaran tersebut disimpulkan bahwa masa kerja Panwaslih di Aceh berakhir pada bulan Mei bagi daerah yang terdapat penyelesaian sengketa di Mahkamah Konstitusi dan bulan Juni bagi daerah yang vakum sengketa. Hal ini mengakibatkan ketidakpastian hukum bagi penyelenggara Pemilihan Kepala Daerah dan menimbulkan kegaduhan dalam internal Panwaslih di Aceh. Penelitian ini mengkaji bagaimanakah kedudukan dan  kekuatan hukum Surat Edaran Bawaslu, mengkaji kepastian hukum masa kerja Panwaslih di Aceh atas keputusan Bawaslu Republik Indonesia yang telah mengeluarkan Surat Edaran yang dijadikan rujukan Pemerintah Aceh untuk merevisi Peraturan Gubernur sebelumnya mengenai masa kerja Panwaslih di Aceh. Metode Penelitian yang digunakan adalah penelitian normatif atau penelitian hukum kepustakaan.The article 60 paragraph (4) of the Act Number 11, 2006 concerning the Government of Aceh stated that the working period of the Election Committee ends 3 (three) months after the inauguration of the elected regional head, while in other juridical regulations especially the Act Number 15, 2011 concerning the General Election Organizer and the Election stipulates to expire no later than 2 (two) months after all stages of the election are completed. Chairman of the Election Supervisory has issued the Circular Letter Number: 0240/K.Bawaslu/TU.0001/III/2017 on the Affirmation of Ad Hoc Election Observer Period of Governor and Deputy Regent, Deputy Regent and Deputy Regent, and or Mayor and Deputy Mayor 2017. Based on the Circular Letter, it states that the working period of the Committee in Aceh ends in May for the area where there is a dispute resolution at the Constitutional Court and in June for the vacuum of the dispute. This has resulted in legal uncertainty for the election organizers and caused frenzy within the internal the Election Advisory in Aceh. This research aims to explore the position and legal power of the Election Supervisory Board Circular Letter, to review the legal certainty of the working period of the Election Committee in Aceh on the decision of General Election Supervisory Board of the Republic Indonesia which has issued a Circular Letter as the reference of the Government of Aceh to revise the previous Governor Regulation concerning the working period of the committee in Aceh. This is doctrinal legal research or library research.
