The Council’s decision regarding a uniform rate of collection for the unrecycled mass of plastic packaging waste, the digital fee and the incurrence of debt by the European Commission does not result in any transfer of competence from the Member States to the European Union. The lack of such transfer excludes the necessity of applying Article 90 of the Constitution (the so called the great ratification, majority of 2/3 votes in the Sejm). However, because the ratification would cause a significant financial burden on the state, the decision should be ratified pursuant to Article 89 para. 1 of the Constitution, i.e. by means of a statute.

After expressing concerns about the state of democracy and civil rights in Poland and Germany in recent years, the European Commission proposed to implement the so-called rule of law condition in the 2021–2027 multiannual financial framework scheme, under which EU budget funding would not be allocated to those Member States which do not comply with the condition. This work will examine the financial and legal aspects of this condition and assess the impact of its application on the economy of the European Union.

The global economic development is, to a great extent, dependent on access to large amounts of cheap energy sources. The growing social awareness of ecology and the enormous damage to the Earth’s ecosystem due to the production of energy from conventional sources have forced fundamental changes in the energy sector. Renewable energy is considered to be an opportunity for such changes. The current state of the art allows such changes to be made without restricting economic development. Therefore, activities related to the energy transition are being taken all over the world. The European Union has definitely managed to achieve the most tangible effects in this regard. This article presents the findings of the research aimed at presenting the current state of renewable energy in the European Union and analyzing the changes reported in this sector in the last decade. The research was carried out using a selected set of 11 indicators characterizing renewable energy in individual countries. These indicators were selected on the basis of literature review and own studies of the state of renewable energy and its development prospects. Based on these indicators, changes in the energy structure of individual European Union countries between 2008–2018 were determined. The study is divided into two main stages. The principal components analysis (PCA) was used for the first analysis. In turn, the Technique for Order Preference by Similarity to Ideal Solution (TOPSIS) was adopted to assess the level of renewable energy development in the European Union countries. Both these methods and the extended statistical analysis were applied to determine the state of renewable energy development in the European Union countries in the studied period and to divide the Member States into classes with different levels of development. The results of the study showed that the EU countries are characterized by significant differences in the development of RES during the period in question. The unquestionable leaders in this respect are Sweden, Austria, Finland, and Latvia. Based on the findings, it is possible to evaluate the effects of activities related to renewable energy development and to prepare assumptions for future activities. Additionally, both the research and its findings broaden the knowledge of the directions of renewable energy development in individual European Union countries. This is particularly important in the context of changes related to the need to reduce harmful substance emissions and the implementation of the European Green Deal idea.

The decision on Britain’s secession from the European Union, taken by the British Parliament and agreed by London and Brussels, divided the Union history into “before” and “after”. Not only will the remaining member states have to “digest” the political, commercial, economic and mental consequences of parting with one of the largest partners. They will also have to create a substantially new algorithm for the functioning of United Europe. On this path, the EU is confronted with many geopolitical and geo-economic challenges, which should be answered by the new leaders of the European Commission, European Council, and European Parliament.

This chapter examines the European Commission’s functions and structure, along with its role in policy making. The Commission initiates legislation, may act as a mediator, manages some policy areas, is guardian of the Treaties, is a key actor in international relations, and the ‘conscience of the European Union’. The chapter proceeds by discussing the debate on the extent to which the Commission is an autonomous political actor or simply an agent of the member states. Finally, it analyses the increasing challenges faced by the Commission in securing effective implementation of EU policies and its response to concerns over its financial management of EU programmes.

By the end of 2025, a minimum of 50% of aluminium packaging waste has to be recycled within the Member States of the European Union. Aluminium packaging can be recovered through different systems (separate collection, deposit refund systems, informal collection, treatment of municipal solid waste incineration bottom ash or mechanical treatment of mixed municipal solid waste). The present article analysed if the agreed targets for the recycling and reuse of aluminium packaging are reasonable and realistic. To this end, the management of aluminium packaging in 16 selected European countries, yielding results for 11 countries, were investigated. The results show that six out of 11 countries recycle at least two-thirds of the aluminium packaging from MSW and only two report very low recycling rates of 20%. The overall recycling rate reported by the different countries cannot be directly linked to the system of recovery. Only the assertion that a deposit refund system together with selective collection leads to a higher overall collection rate seems permissible. This does not necessarily lead to a higher recycling rate as other countries with similarly high recycling rates make up for it with high amounts of aluminium recovered from bottom ash treatment. A direct comparison of the recycling rates within the European Union Member States, however, is problematic for several reasons, such as data that are often differently or incorrectly assigned, incomplete or rely on estimations and assumptions. The authors therefore propose a clearer assignment of the corresponding data and more extensive mandatory reporting on losses and shares of non-packaging, imported and exported waste.

In 1999, the European Commission presented its second report on the numbers of laboratory animals used in the European Union (EU). The plausibility of the data and the usefulness of the format of the registration tables remain questionable, for reasons previously discussed in connection with the Commission's first statistical report. In addition, it is impossible to derive sound information on trends in animal use in the EU and its Member States from the second statistical report. The European Commission and the Member States have agreed on new tables to be used for future statistics on the use of experimental animals in the EU. These new tables have been significantly extended and improved. Several categories of little relevance have been revised, and ambiguous expressions have been clarified. However, several problems either persist or have been newly created. Moreover, some important data (i.e. categories for pain and distress, as well as for several specific purposes of use; the origin of some animal species; types of institutions; and the use of genetically engineered animals) are still not required. Nevertheless, these are highly relevant to animal welfare and must be regarded as indispensable for a well-aimed application of the statistics to set priorities concerning the Three Rs.

The European Commission has recognised that “[l]aws do not serve their full purpose unless they are properly applied and enforced”. In addition “[t]he European Institutions and the Member States should continue to develop their work to ensure that Community law is correctly applied and implemented”. There are diverse tools for guaranteeing compliance such as compliance indicators, compliance and enforcement strategies and environmental inspections, the purpose of which is to supervise compliance. This article focuses on the latter. Firstly, the way in which this instrument was incorporated under Community environmental policy is examined. Secondly, the current status of environmental inspections at EU level is briefly analysed. Thereafter, it will concentrate on the proposals for the review of this tool, ending with some recommendations on how environmental inspections should be regulated in the European Union with a focus on the demands of European Environmental Bureau (EEB) on this matter.

In recent years, a growing literature has argued that European Union (EU) member states have undergone a profound transformation caused by international institutions and by the EU, in particular. However, the state core – the monopoly of the legitimate use of physical force, embodied by the police – seemed to remain intact. The literature has argued that in this area, international institutions are weak, and cooperation has remained informal and intergovernmental. We take issue with these claims and evaluate the strength of international institutions in two core areas of policing (terrorism and drugs) over time. We find that in terms of decision-making, precision, and adjudication, international institutions have become considerably stronger over time. Even when international institutions remain intergovernmental they strongly regulate how EU member states exercise their monopoly of force. Member states are even further constrained because adjudication is delegated to the European Court of Justice. Thus, even the state core is undergoing a significant transformation.

Three perspectives on delegation in the European Union are presented in this article. The transaction-costs perspective focuses on information asymmetries between policy makers and implementers. According to the commitment perspective, policy makers delegate authority as a solution to commitment problems. The consensus-building perspective views the decision to delegate as a trade-off between decisiveness and inclusiveness during the bargaining process. Hypotheses are derived from these perspectives regarding the amount of delegation to both the European Commission and to member states in legislation. From detailed information on eighty-six EU laws, there is some evidence for the transaction-costs perspective as an explanation of delegation to the Commission. With respect to delegation to member states, there is some evidence for both the transaction-costs perspective and the consensus-building perspective.

This article points out the aim and purpose of the competition law in the European Union. Competition law is one of the most crucial and essential part of law that has to be implemented properly to support and ensure smooth functioning of the economy in the state. At the same time, brief explanation of the most anticompetitive agreements such as called “Cartel Agreements” are being described in the article. It is worth to point out the most important and restrictive types of agreements in details that can be seen on the market and within the European Union, that definitely needs special attention by the relevant competition authorities of the Member States.
