Alternative or Appropriate Dispute Resolution (‘ADR’) is a crucial area for lawyers to understand in order to engage in present day legal practice. ADR is now common in courts and the community and is supported by legal policy at both federal and state levels. Learning about ADR can contribute to the moulding of law students’ professional identity so that they are better able to engage in commonly used processes such as negotiation and mediation. This article discusses research into the teaching of ADR in legal education. It draws on a project where the teaching of ADR was researched in depth to examine the content and pedagogy of this area of the legal curriculum. The article argues that ADR is an important part of legal education as it can assist law students to develop non-adversarial, holistic approaches to legal problem-solving.

Legal training and expertise equip crisis lawyers with powerful capabilities to help lead in a crisis; yet some of their learned behaviors and tendencies may create significant impediments to successful crisis resolution. In the context of the groundbreaking meta-leadership model developed jointly by scholars at the Harvard School of Public Health and Kennedy School of Government, this chapter discusses how lawyers can successfully cultivate and leverage their legal education, skills, experience, and problem-solving abilities to help lead in a crisis. It also offers suggestions as to how to train lawyers to improve their self-awareness of and help to mitigate against counterproductive activities and reactions that they may exhibit when under stress in a crisis.

The issue of intellectual property is inevitable for an engineering design course today. Traditionally, it would be discussed separately from the technical or the legal perspective. But they are two sides of the same coin. In the course of comparative analysis of patent dispute, the case method was used to treat the issue involved from both perspectives at the same time. Patent disputes are mainly concerned with the issue of patentability or infringement, and normally both involved. For analysis of a dispute, it is normally required to compare the elements of the invented object with either the prior arts or the alleged infringement, depending on the cases. For such legal analysis one can instead take design methods such as TRIZ (an acronym in Russian standing for “theory of inventive problem solving”) and SCAMPER (an acronym standing for “substitute, combine, adapt, magnify or minify, put to other uses, eliminate or elaborate, and rearrangement or reverse”) to check the design concepts or the inventive principles behind the objects, so that the students can learn the innovation methods and the legal procedure at the same time. In this paper pedagogical experience with concrete examples was demonstrated.

Legal reasoning is a type of problem solving, and is situated within thinking skills, one of the six threshold learning outcomes established under the auspices of the Australian Learning and Teaching Council’s Bachelor of Laws Learning and Teaching Academic Standards Statement. The threshold learning outcomes define what law graduates are ‘expected to know, understand and be able to do as a result of learning’ (Kift et al., 2010, p. 9). The assessment of legal reasoning, and thus problem solving, should receive greater attention in legal education discourse (James, 2011, p. 15, James, 2012, p. 88). The dominant approach for problem-based questions in the discipline of law over the last 40 years is IRAC (issue, rule, application and conclusion). The acronym IRAC is not offensive and potentially instils a positive professional legal identity and is a student-centred approach to problem solving. This journal article documents an incremental approach to IRAC in law where first year students answer a problembased law question using a grid format before preparing a barrister’s advice.

Land officials services related to the preparation and manufacture of deed blanks for Land Deed Officials (PPAT) has been developed by no longer using special blanks for deed and replacing it with the application of barcodes on deed of land. It aims to replace the registration number issued by land officials and to apply various technologies to a deed of land to develop various aspects in order to realize an efficient legal certainty. Besides, it also aims to provide an overview that can be used as a reference in legal problem solving where the legislation shall provide stronger legal certainty to deed of land. This study applied a legal normative and conceptual research design. The results showed that there is a form of cultural lag as an ongoing issue when new regulation is applied, namely the application of barcodes as a substitution to registration numbers. Finally, it can be concluded that the application of barcodes in the making of deeds in Land Deed Officials still encounters problems, particularly in terms of proof consequences.
