Many countries have promoted the multilateral commerce in the global market according to the WTO/TBT (Agreement of Technical Barrier to Trade). One of the most important factors to implement this agreement is that the trade goods should be evaluated once in the export or import country. Therefore the test laboratories for product assessment should construct the new management systems to get the same results of tests anywhere in the world. Even the research laboratories are in the same situation as well as the test laboratories because they must compare their data with others for joint study. They should be encouraged to apply the requirements of ISO/IEC 17025 to their systems.

This article discusses a number of pitfalls of the US-Tuna II Panel Report. This Report is interesting because it offers an occasion to reflect on some provisions of the Technical Barrier to Trade (TBT) Agreement, which may be crucial for the assessment of the legality of environmental labelling regimes. The most troubling part of the Report is the one dealing with the trade-restrictive nature of the measure. The Panel seems to have relied on a test by which if a measure does not reach its objectives perfectly, any other ineffective measures adopted with allegedly the same goals can be judged as a valid less-trade restrictive alternative. In other words, two wrongs seem to make a right in the view of the Panel; a conclusion that, for obvious reasons, will not be greeted with enthusiasm by environmentalists.

Isu lingkungan hidup tidak dapat dipisahkan dari perdagangan intemasional. Dalam sejarahpembentukan GATT pada tahun 1947 isu lingkungan hidup telah dimuat dalam artikel XX tentang "General Exception ". Aturan dasar ini kemudian disepakati dalam "Tokyo Round"menjadi "Agreement on Technical Barrier to Trade" dan disempumakan dalam "Uruguay Round". Melalui perjanjian ini GATT/WTO kemudian mengakui keberadaan "International Organization for Standarization (ISO)". Dengan demikian melahirkan pengakuan keterkaitan antara perdagangan intemasional dengan isu lingkungan hidup.

Increased awareness of food safety issues has resulted in non-tariff measure in the form of sanitary and phytosanitary, technical barrier to trade applied to various importing countries. The policy is widely applied by various countries on agricultural commodities, especially Cocoa. Cocoa is Indonesia's flagship commodity exported to many countries. The purpose of this research is to analyze the implementation and impact of non tariff measure on Indonesian cocoa exports. The model used in this research is to estimate the result of inventory approach in gravity model. The results show that Sanitary and Phytosanitary policy has an effect on decreasing export value of Indonesian Cocoa while Technical Barrier to Trade has no significant effect. SPS policy is mostly applied to Cocoa Beans while TBT is more applied to processed cocoa. So, Indonesia needs to improve the processing of cocoa beans such as cacao shells, cacao paste, cacao butter, cacao powder, chocolate and other preparations. The government needs to provide socialization to Indonesian cocoa agribusiness entrepreneurs in the implementation of sanitary and phytosanitary policy. Government programs or policies are designed according to the characteristics of SPS and TBT.

Undang-Undang Nomor 3 Tahun 2014 Tentang Perindustrian mengatur tata industri nasional menjadi lebih peduli terhadap lingkungan dengan mengusung paradigma pembangunan berkelanjutan. Norma pembangunan berkelanjutan diatur lebih lanjut melalui mekanisme Standardisasi Perindustrian. Sebagai konsekuensi Indonesia menjadi anggota WTO, regulasi standardisasi industri telah diperbarui dengan cara mengintegrasi ketentuan standardisasi dalam perjanjian Agreement on Technical Barrier to Trade. Penulisan artikel ini bertujuan mengetahui perbandingan kaidah standardisasi yang diatur Agreement on Technical Barrier to Trade dan UU Perindustrian serta hubungannya dengan pembangunan berkelanjutan. Hasil yang didapat adalah kaidah dari kedua sumber hukum tersebut identik dan terhubung sebagai instrumen pengaturan yang efektif dalam pembangunan industri dengan tetap menjamin aspek keamanan, keselamatan dan kesehatan manusia serta kelestarian fungsi lingkungan hidup.

SummaryRecently, there has been a proliferation of international agreements imposing minimum standards on states in respect of their treatment of foreign investors and allowing investors to initiate dispute settlement proceedings where a state violates these standards. Of greatest significance to Canada is Chapter 11 of the North American Free Trade Agreement, which provides both standards for state behaviour and the right to initiate binding arbitration. Since 1996, four cases have been brought under Chapter 11. This note describes the Chapter 11 process and suggests some of the issues that may arise as it is increasingly resorted to by investors.
