This article presents the issues of sex discrimination, working conditions, and equal pay raised in the legal dispute between the United States Soccer Federation and the Women's National Soccer Team. The authors study the application of the Civil Rights Act of 1964 and the Equal Pay Act of 1963, and the implications of applying Title IX of the Education Amendments of 1972 to the U.S. Soccer Federation. The authors conclude by offering some observations and suggestions on the practical course of action that the US Women’s Soccer Team may consider in attempting to solve its dispute with the Federation.

The 1960s witnessed landmark legislation that aimed to increase women's wages, including the Equal Pay Act of 1963, Title VII of the Civil Rights Act, and the 1966 amendments to the Fair Labor Standards Act. Although the gender gap in pay changed little at the mean/median during the decade, our distributional analysis shows that women's wages converged sharply on men's below but diverged above the median. However, the bulk of women's relative pay gains are not explained by changes in observed attributes. Our findings suggest an important role for legislation in narrowing the gender gap in the 1960s.

In civil rights actions, employee-plaintiffs alleging discrimination must attempt to prove a prima facie case;1 and if accomplished the employer-defendant must attempt to rebut such cases with some type of defense. These defenses may be very narrow and specific in scope such as the seniority or merit system defenses explicitly provided for under the 1963 Equal Pay Act (EPA). On the other hand, broader “business” and or “job” defenses (and the wording and meaning varies from situation to situation) have been both devised by the courts as standards of behavior for employers, and stipulated for employers by legislation. This article will analyze four important of these employer defenses: (1) the legitimate business reason and its antecedents in EPA litigation; (2) the Bona Fide Occupational Qualification (BFOQ) “reasonably necessary” defense provided in both the Civil Rights Act of 1964 and in the Age Discrimination in Employment Act of 1967; (3) the business necessity and job related standards promulgated in Griggs v. Duke Power, 401 U.S. 424 (1971), as eventually codified by the Civil Rights Act of 1991; and (4) the job relatedness/business necessity/reasonable accommodation defense of the Americans with Disabilities Act of 1990 (ADA). All of the above defenses pose current challenges to employers except probably the BFOQ, so that their examination should be of value to all those involved in employee relations law.

Historically, women have been paid less than men. This pay disparity between men and women exists even when women hold similar jobs and are comparable to men with regard to seniority and experience. The goal of the Equal Pay Act of 1963 and the Civil Rights Act of 1964 was to change this situation. The Equal Pay Act states that men and women should receive the same pay for equal work. Three decades have passed but women's wages remain less than wages for men in equal positions. The focus of this paper is a discussion of the Equal Pay Act on wage differentials between men and women. Strategies will be presented that organizations can follow to minimize compensation disparities.

Much of the early scholarship in Asian American studies sought to establish that Asian Americans have been crucial to the making of the US nation and thus deserve full inclusion into its polity. This emphasis on inclusion affirms the status of the United States as the ultimate protector and provider of human welfare, and narrates the Asian American subject by modern civil rights discourse. However, the comparative cases of Filipino immigrants and Vietnamese refugees show how Asian American racial formation has been determined not only by the social, economic, and political forces in the United States but also by US colonialism, imperialism, and wars in Asia.

This paper reviews the U.S. Supreme Court’s opinion in Bostock v. Clayton County (2020). There, the Court held that by barring employer discrimination against any individual “because of such individual’s . . . sex,” Title VII of the Civil Rights Act of 1964 also bars employment discrimination because an individual is gay or transgender. The paper then speculates about how much Bostock will affect how likely lower court judges will read other “sex” discrimination prohibitions in the U.S. Code in the same way, in part based on a canvass of the text of about 150 of those prohibitions. The paper also discusses the religion-based defenses that defendants may raise in response under Title VII itself, the Religious Freedom Restoration Act, and the First Amendment of the U.S. Constitution.

Pakistan, since 1947 remains under the umbrella of US, as a result, relations of Pakistan were not smooth with anti US states including USSR. The US was to increase its role in the region in order to make secure the largest petroleum reserves in the Persian Gulf. Pakistan’s alignment with the western world was mainly to counter possible Indian aggression, not to lessen the Soviet influence in the region, but the approach was more or less thwarting Soviet interests in the region. Over 3 million Afghan refugees had travelled to Pakistan in the 1st year of Soviet intervention in Afghanistan. The main objective of the USA during the initial stages of the Soviet invasion of Afghanistan was primarily to ensure that the Soviet exercise would be a costly one. The United States of America supported Afghan militants with the help of Pakistan to organize them against the USSR. A general perception is that US did not want to be directly involved to thwart the Soviet invasion; rather USA handed over the operational aspect of the program to the Pakistan. The Pakistan was in charge of providing the funds and weapons to the mujahedin and setting up training camps. The US remained indecisive over the next course of action in Afghanistan and the Pakistan took the opportunity to carry out its own agenda in Afghanistan to promote their national interests.

In this article I show that the form of argument put forward by the climate change denial movement in the United States (US) closely resembles that used in Nazi Germany with regard to Nazi racial definitions. Each involves a rejection of scientific method. This rejection inherently lends itself to far-right politics, which is a philosophy of prejudice. The prevalence of such a philosophy in contemporary American political culture, exemplified through climate change denial, has arguably opened the door for a president of Trump's type. Nevertheless, the US Constitution is far more difficult to suspend than that of the Weimar Republic. As a result, US institutional safeguards against a philosophy of prejudice are likely to hold against a short-term assault on environmental justice in a way that the Weimar Republic's constitutional order did not against Nazism's assault on civil rights. The greater threat to environmental protection in the contemporary US situation is the slow erosion of democratic norms by the Trump administration.

Personnel and vocational testing has made a huge impact in public and private organizations by helping organizations choose the best employees for a particular job (personnel testing) and helping individuals choose occupations for which they are best suited (vocational testing). The history of personnel and vocational testing is one in which scientific advances were influenced by historical and technological developments. The first systematic efforts at personnel and vocational testing began during World War I when the US military needed techniques to sort through a large number of applicants in a short amount of time. Techniques of psychological testing had just begun to be developed at around the turn of the 20th century and those techniques were quickly applied to the US military effort. After the war, intelligence and personality tests were used by business organizations to help choose applicants most likely to succeed in their organizations. In addition, when the Great Depression occurred, vocational interest tests were used by government organizations to help the unemployed choose occupations that they might best succeed in. The development of personnel and vocational tests was greatly influenced by the developing techniques of psychometric theory as well as general statistical theory. From the 1930s onward, significant advances in reliability and validity theory provided a framework for test developers to be able to develop tests and validate them. In addition, the civil rights movement within the United States, and particularly the Civil Rights Act of 1964, forced test developers to develop standards and procedures to justify test usage. This legislation and subsequent court cases ensured that psychologists would need to be involved deeply in personnel testing. Finally, testing in the 1990s onward was greatly influenced by technological advances. Computerization helped standardize administration and scoring of tests as well as opening up the possibility for multimedia item formats. The introduction of the internet and web-based testing also provided additional challenges and opportunities.
