An Overview of Current Practice and Policy Relating to Business Activities and Human Rights: Some of the Implications for Corporate ‘Rule-Making’

This Article considers the position of defendants charged with murder who are found to be unfit to plead or insane at the time of the offence. If the court is satisfied that the defendant did the act charged as murder then the judge has no option but to impose a hospital order with restrictions. This Article examines the statutory requirements for medical evidence prior to a finding of unfitness or insanity and asks whether this satisfies the requirements of Article 5 of the European Convention on Human Rights. It concludes that there is no obvious justification for requiring defendants to be sent to hospital in the absence of a conviction where the medical evidence does not indicate that such a disposal is necessary. It follows that the current practice is likely to violate the Convention.

The article, based on clarifying the content of related concepts of law-making, considers the principles of the rule-making activity as the power activity of public authorities. Such principles include the principles of humanism, democracy, the rule of law, human rights, and scientific validity of rule-making decisions, which necessitates the professionalism of rule-making activities, planning, systematics, complexity, timely revision and updating of legislation, and transparency. The content of these principles is revealed, their ranking is carried out, their importance for legal science and practice is emphasized, and the positions of scientists concerning their optimal list and characteristics are analyzed. In particular, attention is drawn to the fact that the principle of humanism is reflected in the fundamental values that underlie the constitutional order, the basis of the current law and human rights enshrined in the Constitution and laws of Ukraine: human dignity, the right to self-realization, justice and freedom, non-discrimination and equality before thelaw, tolerance, responsibility and respect for others. The principle of democracy, as a fundamental principle of rule-making, legitimizes the subjects of rule-making and creates a basis for their legal activities. The rule of law is also a fundamental principle of rule-making (including its components such as the principle of direct effect of the Constitution of Ukraine, the rule of the Constitution as the Basic Law, the principle of legality, legal certainty, the equality before the law and non-discrimination, and proportionality). It is emphasized that the principle of scientific validity of rule-making decisions necessitates professionalism of rule-making activities, and ensuring a high professional level of rule-makers makes it possible to carry out rule-making activities at a high scientific level, on a planned, systematic, comprehensive basis, the legal regulation of public relations, and the implementation of state functions. Aspects of the principle of publicity of normative activity of the Parliament, the Government, and the President of Ukraine are also analyzed.

This chapter emphasizes Chairman Liebman’s Board’s efforts to bring the statute’s workers’ rights emphasis back to life through case decisions, fuller use of the NLRB’s remedy power, and rule-making that would have required most private sector employers to post a notice at the workplace informing workers of their rights under the Act and would have streamlined the NLRB’s representation election process by eliminating unnecessary delays.

AbstractThe reality in the society of equality before the law and the protection of the law can�t easily be realized. Differences in ability, both economically and intellectually, make it difficult for justice seekers to access justice. Discrimination often occurs against marginalized communities, ranging from rule-making, implementation, to law enforcement. Therefore, we are motivated to do the devotion by providing socialization, counseling, consultation and assistance for residents of Kuningan Regency in this case the citizens of the IIA Kuningan class correctional institution who want to seek justice. this activity received a very good response, not only for the assisted citizens, but also for the officers and employees in charge. The material given in the form of film screenings about legal aid made by BPHN and the Ministry of Justice and Human Rights of Indonesia, as well as discussion material prepared by the Community Service Team. Oleh karena itu, kami tergerak untuk melakukan pengabdian dengan memberikan sosialisasi, penyuluhan, konsultasi dan pendampingan bagi warga masyarakat Kabupaten Kuningan dalam hal ini warga binaan lembaga pemasyarakatan kelas IIA Kuningan yang ingin mencari keadilan. kegiatan ini mendapat respon yang sangat baik, tidak saja bagi warga binaan, tetapi juga bagi aparat dan pegawai yang bertugas. Materi yang diberikan berupa pemutaran film tentang bantuan hukum yang dibuat oleh BPHN dan Kementerian Hukum dan HAM RI, juga materi diskusi yang disiapkan oleh Tim Pengabdian Masyarakat. Luaran yang diharapkan dari pengabdian ini adalah terbukanya akses terhadap jaminan hukum bagi masyarakat tidak mampu dan terpinggirkan, sehingga prinsip dasar Negara hukum yaitu equality before the law terpenuhi.Kata kunci : Bantuan Hukum, Warga Binaan, Persamaan

Modern Mexico is a country that has long ceased to perform its basic competences. This is particularly evident in the area of human rights protection. Decades of action by organized crime groups have led to the establishment of their power in occupied territories and, consequently, to their impunity. The social response to the crime groups’ activities was the creation of areas belonging to a “warlord” in which warlords exercise their own power, unlimited by law. In this context, several questions arise about what is currently the constitutional form of power and what form of power actually exists in Mexico, including how this power is exercised and, finally, what the current practice of human rights protection is. The answers to these questions can be found in the present article.

Jaminan kesesuaian undang-undang terhadap norma dan prinsip hak asasi manusia secara langsung membutuhkan sebuah mekanisme dan metodologi yang mampu memprediksi (predict) dampak produk legislasi terhadap penikmatan hak asasi manusia (human rights enjoyment) oleh setiap individu atau kelompok masyarakat. Atas dasar pemahaman tersebut, tulisan ini hendak menguraikan sekelumit peluang dan tantangan secara metodologis atas gagasan untuk merumuskan sebuah kerangka kerja analisis dampak hak asasi manusia terhadap naskah rancangan peraturan perundang-undangan. Untuk itu, tulisan ini akan dipilah ke dalam tiga bagian utama yakni: pertama, gambaran umum analisis dampak hak asasi manusia sebagai instrumen teknis dari pendekatan berbasis hak asasi manusia (human rights based approach) yang tengah berkembang sejak dasawarsa terakhir; kedua, peluang untuk meletakkan pendekatan tersebut ke dalam proses pembentukan regulasi (rule making process); dan ketiga, adalah gambaran tentang tantangan metodologis ilmu sosial dalam merumuskan cara kerja analisis dampak hak asasi manusia ke dalam tahapan pembentukan peraturan perundang-undangan di tingkat nasional. Adapun tulisan ini menyimpulkan bahwa dalam rangka merumuskan analisis dampak hak asasi manusia atas rancangan undang-undang, secara fundamental dalam perspektif ilmu hukum diperlukan pergeseran paradigma doctrinal gaze yang cenderung positivistik; yang kerap melanda penelitian hukum di Indonesia. Dengan meminjam metode dan teknik analisis yang dikenal dalam sains dan ilmu-ilmu sosial lainnya, dan dengan tetap berpegang pada standar reasoning penegakan hukum, maka pelbagai rupa ‘pseudo-prediction’dapat dilakukan dalam rangka menilai dampak dari sebuah rancangan undang-undang terhadap hak asasi manusia.

The article explores the concepts of sources of law and their main types. The source of law means the way of external influence of legal norms, which certifies their binding nature. The concepts and place of judicial precedent in the system of sources of law are defined. It is noted that judicial precedent should be understood as a court decision rendered in a particular case and entered into force, and which is the basis for resolving similar cases by other bodies. As part of the integration process in Europe, two important judicial bodies have been formed – the European Court of Human Rights (hereinafter – the ECtHR) and the Court of Justice. Each of these courts plays an important role in the rule-making process within its competence. The ECtHR's function is not limited to dealing with specific complaints. Its decisions also provide a comprehensive interpretation of the main provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms. As a result, they acquire a special significance that is precedent-setting. Therefore, the application of the case law of the ECtHR is considered as a source of law. It is also noted that EU courts play a role in the development of the rule-making process within the EU. They interpret the main provisions of the founding treaties and other regulations and formulate autonomous concepts and concepts that complement and clarify the provisions of regulations and implement new fundamentally important for the development of integration law provisions. Recognition of judicial precedent as a source of law means that judicial bodies perform not only a jurisdictional function (resolving conflicts on the basis of law), but also law-making. This function increases the role and importance of the judiciary in the mechanism of checks and balances of abuse of state power.

In spite of the common global position of protecting the right to confidential communication, the Japanese prison authorities create barriers to communication between pre-trial inmates and defence counsel. Any correspondence, including correspondence between pre-trial inmates and defence counsel, may be opened and read by prison staff. In addition, prison authorities have established regulations to prohibit any visitors from bringing in cameras or mobile phones. They do not allow counsel to take photos in visiting rooms, claiming that these regulations are equally applicable to lawyers. This article examines the legality of the current practice regarding mail censorship and the prohibition of photography in visiting rooms, taking into consideration international human rights standards. It concludes that the current practice diverges from the international human rights standards including the Nelson Mandela Rules, which protects the full confidentiality of communication between inmates and lawyers, and access to effective legal aid. Since the arrest of Nissan’s former chairman Carlos Ghosn in November 2018, Japan’s ‘hostage justice’ system – in which suspects are held for a long period in harsh conditions to coerce a confession – has encountered a barrage of criticism. It should be noted, however, that interruption of inmates-defence counsel communication constitutes another dark side of Japanese criminal justice. This article will shed light on the everyday issues which Japanese defence counsel face in actual criminal cases.
