The final persistence of democracy depends upon whether its right decisions outweigh the wrong ones in number and value, though conceivably one really bad decision might ruin the structure built on all the right ones. It is passing from the stage where a few reasoning leaders govern the masses through their emotions, to the next perilous stage in which every man's thoughts matter. Right decisions depend upon access to relevant facts and doing the right thinking about them. It is of the essence of Nazi philosophy that general liberty of thought is self-destructive, the common man not being rational; it is of the essence of Nazi practice to flatter the many by the pretence that their thinking does matter, but to control and modify the whole supply of factual material upon which they must reason. One declared to me once that he favoured freedom of thought and was not afraid of it, for if he was allowed to supply the “facts” any ordinary rational mind could come to only one conclusion, viz. the one he intended. And in the process the ordinary man might remain proud of his reasoning power, so long as he could be sheltered from seeing the falsity of his conclusions. Control of facts must be perpetual, and cats must never be allowed to get out of bags. But in a democracy, where facts are all born free (and much too equal), it is the thinking about them that really matters.

Famine remains one of the major causes of deaths and displacements in the Sub-Saharan African countries where people have continuously been compelled to cross international borders in search of livelihood securities. There is no question that the continent has been exposed to erratic rainfalls, crop failures and droughts, but contemporary famine has less to do with natural-related crop failures and much to do with poor governance. The author argues that state’s premeditated action, inaction and incompetency to respond to insecurity and threats are largely responsible for African famines. Due to historical misperception of African famine and oversimplification of refugees’ motives from Africa, however, food-based persecution has not been a common subject of research. Besides, the absence of drought does not necessary mean the absence of famine either, because the aforementioned factors frequently cause it to happen even in the middle of plenty. Therefore, the purpose of this paper is to explore how government’s action or inaction can lead to famine in the absence or presence of drought which in return forces people to escape from drastically deteriorating conditions of existence by flight. The goal of this paper is mainly to challenge the common perception that famine as being the drought-induced outcome of humanitarian crisis in Africa and refugees as being victims of the natural circumstance. Thus, this paper argues that a government that deprives its citizens of the basic necessity such as the right to food is as dangerous as the one that persecutes its citizens on the five Convention grounds. Hence, taking Eritrea as a case example, this article discusses chronic food insecurity and mass starvation as a state-induced disaster, which I believe should be considered a crime against humanity under the Rome Statute of the International Criminal Court.

This article reconstructs the cultural doctrine of the famous publicist of populism (narodnichestvo), I.I. Kablits (Yuzov). To just equate Kablits views with the slogan of yuzovshchina would be a narrow interpretation of his kul'turnichestvo; the slogan is characteristic for extreme right-wing populism during the upsurge of the revolutionary populist movement (narodovol'cheskoe dvizhenie). In 1880, Kablits was the first of the legal populists to pose the question, What is populism? According to the publicist, true narodnichestvo should be based on the principle that the forms of public life of the people must be in conformity with the development level of their consciousness. The author explains Kablits evolution from Bakunism to a peasant-centered narodnichestvo by his interpretation of the reasons for the split between the intelligentsia and the people. Kablits considered them antagonists, and defined the ultimate goal of the narodniki as the liberation of the people from the power of the intellectualbureaucratic minority, the latter supposedly trying to subjugate the life of the masses to its will. The article analyzes the main provisions of Kablits sociocultural concept of social transformations: apolitism, populism, and the initiative of the masses. The article identifies the differences between his program of developing the cultural identity of the people, on the one hand, and other populists' understanding of the tasks of cultural work, on the other. Particular attention is paid to Kablits-Yuzov's attitude towards the problem of educating the masses. Kablits was one of the few Russian populists who opposed the idea that the foundations of the worldview of the people must be changed, arguing that this would eliminate the traditional moral values of the village, including the sense of collectivism. The author assesses how Kablits, the leading publicist of the newspaper Nedelya, contributed to the establishment of a cultural direction in narodnichestvo at the turn of the 1870s and 1880s. According to the author, Kablits played a leading role in shaping the ideology of the right flank of the cultural direction in narodnichestvo. However, the pure populism of Kablits turned out to be too pseudo-scientific, dogmatic and irrational to attract the democratic intelligentsia for a long time; the latter had already become disillusioned with the idea of the people as the creator of new forms of social life.

At the close of Pater’s career, then, one can summarize the broad strokes of his Platonism. He calls it a tendency and a temper; but it is really a critical acuity for negotiating or reconciling the paradox of opposites one sees on a daily basis, such as the many and the one, or the finite in the infinite, the recognition of form in matter, which in the right balance is beauty. Calling it a tendency emphasizes its enduring power in a person’s personality. It is taking seriously the importance of love in Platonism that opens Pater’s teaching up to charges of a peculiar or idiosyncratic form of the philosophy. Platonically, his aestheticism is the desire to possess beauty, and begins with the very things around us, possessing a high degree of form, becoming rarer and rarer, more select, as one learns to identify better instances of it and his taste advances. Because he is a lover and philosopher at once, he progresses up the Platonic ladder with enthusiasm for visible ideas and knowledge of Dialectic, which relies on scepticism, or a suspension of judgement, which is both a suspension of belief and disbelief. David Hume’s critique of religion reveals what seems to be a vacillation in his commitment to an argument-based paradigm of legitimate believing. On the one hand, Hume assumes such a traditional (argumentbased) model of rational justification of beliefs in order to point to the weakness of some classical arguments for religious belief (e.g., the design argument), to chastise the believer for extrapolating to a conclusion which outstrips its evidential warrant. On the other hand, Hume, ‘mitigated’ or naturalist skeptic that he is, at other times rejects an argumentbased paradigm of certainty and truth, and so sees as irrelevant the traditional or ‘regular’ model of rational justification; he places a premium on instinctive belief, as both unavoidable and (usually) more reliable than reasoning. On this view, a forceful critique of religion would have to fault it, not for failing to meet criteria of rational argument (failing to proportion belief to the evidence), but (as Hume sometimes seems to) for failing to be the right sort of instinct.

The Painter's Triumph, created by William Sidney Mount in 1838, has long been interpreted as an icon of the democratization of American art (Figure 1). Nearly every scholarly analysis of the painting frames it in the context of Mount's well-known charge to himself, “Paint pictures that will take with the public, in other words, never paint for the few, but for the many.” The farmer's enthusiastic involvement in the artist's work is viewed as emblematic of Mount's commitment to promoting the visual arts among ordinary folk. The painter's “triumph,” most assert, is his ability to reach the common man. This is certainly an appealing message and consistent with the desire to see mid-19th-century American artists as resolute democrats in tune with Jacksonian cultural reforms. Yet, Mount never called it The Painter's Triumph, referring to it only as “artist showing his work,” and there is no evidence that viewers in the late 1830s and early 1840s recognized a particularly democratic message. The current title first appeared in a catalogue in 1847, long after Mount sold the painting and two years after the death of Edward L. Carey, the man who commissioned it. Despite the 1847 title change, in his later autobiographical sketch Mount referred to the painting as “Artist showing his own work.”

Based on interviews conducted within a community of St. Lucian Creole (Kwéyòl) speakers on the island of St. Croix, U.S. Virgin Islands, the authors investigated the use of and attitudes towards Kwéyòl, English, Spanish, and Crucian Creole, the four most widely-spoken languages on St. Croix. The article examines the roles of two social variables, namely gender and education, in questions of language choice and attitudes in this bilingual creolophone community. Some of the more remarkable revelations of this study were found in the many apparently conflicting responses. On the one hand, we observed a general trend towards the loss of Kwéyòl, yet on the other, pride in the language is exceedingly high. We observed a strong tendency pointing towards a taboo against speaking Kwéyòl in public on St. Croix, while at the same time, a significant number proclaimed the right to speak Kwéyòl in public.

Hall, Wendy J. Alison's Asthma. Mediwonderland, 2018. Part of the Mediwonderland series of works by author Wendy J. Hall, Alison’s Asthma tackles the common inflammatory disease, asthma.  Beginning with listing some of the symptoms of asthma, as faced by the protagonist Alison, the book details the tests required in the process of asthma diagnosis, as well as the available treatments.  Focusing also on positive aspects of the journey, such as Alison’s opportunity to choose a style of medical alert bracelet, as well her continued ability to run and play with her friends, Alison’s story comforts and informs readers who may be facing similar circumstances. The telling of Alison’s story is aided by the brightly coloured drawings, which accompany each page of text. Although these illustrations are simple, they establish flow within the text from one page to the next. These illustrations are also educational, such as the one comparing a normal airway to an asthmatic one.  Highly educational and written in accessible language, this book is intended to educate the masses, and breaks down a medical journey faced by many into simple, undaunting steps. However, because of its educational intent, the book tends to be less engaging. While Alison’s journey is realistic, it lacks the details required to engage the audience, instead presenting facts. With that being said, Alison’s Asthma is a perfect read for young children, who, with the help of an adult, will learn the ins and outs of the medical world.  Therefore, Alison’s Asthma is a worthwhile read, which will leave its audience comforted and informed! The main focus of this note is the case of Roseveare v Katmer, Katmer v Roseveare 2013 ZAGPJHC 18, which provides an interesting (though possibly constitutionally problematic) perspective to the encroachment problem. The decision in this case has opened the door for courts to create servitudes in instances where encroachments are left intact based on policy reasons. Concerning these policy reasons, the note investigates the reasonableness standard as it was applied in the case. It is argued that it is important to differentiate between the applications of reasonableness in encroachment cases and alleged nuisance disputes. The decision in this case creates the impression that courts may now order that a servitude be registered in favour of the encroacher against the affected landowner’s property. It seems as though the court had in mind the creation of a praedial servitude to justify the continued existence of the encroachment. The servitude is created by court order against the will of the affected landowner. At common law, the creation of a servitude in this respect does not exist, and the authority from which the power derives to make an order like this is not entirely clear. The court also does not provide any authority for the creation of the servitude in favour of the encroacher. Consequently, it is argued that this may have serious constitutional implications. For one, lack of authority for the deprivation that results may be unconstitutional because there is no law of general application that authorises the deprivation in terms of section 25(1). The creation of a servitude to explain the continued existence of the encroachment is not automatically included in the general discretion to replace removal with compensation. It is contended that an order that forces the affected landowner to register a servitude in favour of the encroacher to preserve the existing encroachment situation will be in conflict with section 25(1) as far as the common law does not authorise such an order. Furthermore, an order creating a servitude against the affected landowner’s will need to be separately justified in terms of the non-arbitrariness requirement in section 25(1). In this respect, the order will be unjustified and therefore arbitrary on both a general and personal level. Although this decision eliminates the enduring problem in encroachment law concerning the rights of the respective parties to the affected land where encroachments are not removed, it is reasoned in this note that the solving of this problem may have created another one. The decision is undoubtedly a step in the right direction, in so far as the court has attempted to provide clarity in terms of the rights to the encroached-upon land. However, the absence of authority either in terms of the common law or legislation to create a servitude in this context, indicates that courts should avoid orders of this nature because of their implications. If legislation is enacted to regulate building encroachments, it may be useful to explain what happens when the encroachment is not removed and it may also provide the required law of general application to prevent constitutional infringement. The legislation should specify the nature of the right acquired by the encroacher, which in the South African context should probably be a servitude created against the affected landowner’s property. This may ensure that the required authority exists for the creation of the servitude and would also provide the necessary justification to prevent the arbitrary deprivation of property. It is accordingly submitted that the unnecessary confusion that results from the inability to explain the outcome (or provide sufficient reason) on the one hand, and the possible constitutional infringement due to the lack of authority on the other, may therefore be cleared up by the suggested legislation.

AbstractBoth the Qumran scrolls and the rabbinic sources teach of a controversy between the Pharisees, on the one hand, and the Sadducees and the Qumran sect, on the other, concerning the standing of the red heifer: The Sadducees, considering the red heifer as a sacrifice, held that a tevul yom was not permitted to deal with the heifer, whereas the Pharisees, not considering the red heifer as a sacrifice, held that a tevul yom was permitted to deal with it. This controversy derived from the Pharisees' desire to enable the common people to participate as much as possible in divine worship: by not considering the red heifer as a sacrifice, they made it possible for the masses to participate in the preparation of the ashes and even to sprinkle it upon the impure; this was opposed by the Sadducees and the Qumran sectarians.

Ducation as a subject for post-war planning is on everyone’s lips today. E Public interest has never been higher. Yet it may be doubted whether even now the full measure of its importance is realized. Next to winning the war, nothing is of greater moment than the battle for enlightenment, for if this is lost the ‘victory’ will be vain and we may all prepare for an ordeal more terrible than the present, because fought out among still larger aggregations of political and military power. The whole of history bears witness to the corruption of power, the struggles of the few for spoil of the many, the ignorance of the peoples and its lethal consequences to themselves. Today, thanks for the most part to the heroism of the common man, whether citizen of a bombed city, defender of Stalingrad, peasant of China, inhabitant of oppressed Europe or member of the forces of liberation, we stand on the threshold of what could be a new world: whether we cross that threshold or are elbowed back into the dark passage that leads to another holocaust, depends primarily on our attitude to education, on the steps taken during the next few years to bring to the common man everywhere a realization of his inheritance as a citizen of the world and an awareness of his power to mould his own destiny. What is needed above all is an overriding sense of human solidarity such as can come only from consciousness of common origins. Divided we fall victims to tribal leaders: united we may yet move forward to a life of elementary decency.
