I. INTRODUCTIONIt has become a commonplace in contemporary historiography to note the frequency of war in ancient Greece. Yvon Garlan says that, during the century and a half from the Persian wars (490 and 480–479 B.C.) to the battle of Chaeronea (338 B.C.), Athens was at war, on average, more than two years out of every three, and never enjoyed a period of peace for as long as ten consecutive years. ‘Given these conditions’, says Garlan, ‘one would expect them (i.e. the Greeks) to consider war as a problem …. But this was far from being the case.’ The Greek acceptance of war as inevitable was contrasted by Momigliano and others with the attention given to constitutional changes and to the prevention ofstasis: ‘the Greeks came to accept war like birth and death about which nothing could be done …. On the other hand constitutions were men-made and could be modified by men.’Moralist overtones were not absent from this re-evaluation of Greek civilization. Havelock observed that the Greeks exalted, legitimized, and placed organized warfare at the heart of the European value system, and Momigliano suggested that:The idea of controlling wars, like the idea of the emancipation of women and the idea of birth control, is a part of the intellectual revolution of the nineteenth century and meant a break with the classical tradition of historiography of wars.

In an earlier article in this journal the decision of the Open University to offer two half-credit courses on classical civilization was noted.1 The first of these, ‘The Early Roman Empire and the Rise of Christianity’, has been available since 1974. The matching halfcredit was to be on Greece. We readily decided to concentrate on Athens and on the fifth and fourth centuries B.C. This is not a history course: it is an attempt to look at the total culture of a period, and the period virtually selected itself. Aeschylus has not found a place in the drama course: we felt that the Oresteia must come in here. For philosophy Plato was essential, and, it was felt after discussion, Aristotle too, even if he seeped beyond our probable historical bounds. For it was plainly going to be impossible to treat the Persian Wars at one end or Alexander at the other, and do any justice to the events and movements which lay between.

The Society for the Promotion of Hellenic Studies, established in 1879, provided arguments for the bridging of the gap that separated British Hellenism from British philhellenism for the most part of the nineteenth century. For academics and scholars interested in Greek civilization sympathy with modern Greece was always a matter of choice, which might be influenced by classical reading but did not constitute an indispensable part of it. The necessity to visit Greece, study on the spot and, when possible, bring to light the material remnants of Hellenic civilization, and to trace among the people living evidence of the classical age emerged with the introduction of historicity as a concept and archaeology as a practice into British Hellenism. The formation of the Society represented a single but important step in this process. Its rules, on the other hand, “officially” sanctioned the assumption of the continuity of the Greek race.

AbstractIslamic Law is one of the broadest and most comprehensive systems of legislation in the world. It was applied, through various schools of thought, from one end of the Muslim world to the other. It also had a great impact on other nations and cultures. We will focus in this article on values and norms in Islamic law. The value system of Islam is immutable and does not tolerate change over time for the simple fact that human nature does not change. The basic values and needs (which can be called maṣlaḥa) are classified hierarchically into three levels: (1) necessities (Ḍarūriyyāt), (2) convenience (Ḥājiyyāt), and (3) refinements (Kamāliyyāt=Taḥsīniyyāt). In Islamic legal theory (Uṣūl al‐fiqh) the general aim of legislation is to realize values through protecting and guaranteeing their necessities (al-Ḍarūriyyāt) as well as stressing their importance (al‐ Ḥājiyyāt) and their refinements (taḥsīniyyāt).In the second part of this article we will draw attention to Islamic norms. Islam has paid great attention to norms that protect basic values. We cannot explain all the Islamic norms that relate to basic values, but we will classify them categorically. We will focus on four kinds of norms: 1) norms (rules) concerned with belief (I’tiqādiyyāt), 2) norms (rules) concerned with law (ʿAmaliyyāt); 3) general legal norms (Qawā‘id al‐ Kulliyya al‐Fiqhiyya); 4) norms (rules) concerned with ethics (Wijdāniyyāt = Aḵlāqiyyāt = Ādāb = social and moral norms).

Although racial lines eventually hardened on both sides, in the opening decades of colonization European and native ideas about differences between themselves and the other were fluid and dynamic, changing on the ground in response to local developments and experiences. Over time, perceived differences were understood to be rooted in more than just environment and culture. In the eighteenth century, bodily differences became the basis for a wider range of deeper, more innate distinctions that, by the nineteenth century, hardened into what we might now understand to be racialized differences in the modern sense. Despite several centuries of dispossession, disease, warfare, and enslavement at the hands of Europeans, native peoples in the Americans almost universally believed the opposite to be true. The more indigenous Americans were exposed to Europeans, the more they believed in the vitality and superiority of their own cultures.

To Professor E. R. Dodds, through his edition of Euripides'Bacchaeand again inThe Greeks and the Irrational, we owe an awareness of new possibilities in our understanding of Greek literature and of the world that produced it. No small part of that awareness was due to Professor Dodds' masterly and tactful use of comparative ethnographic material to throw light on the relation between literature and social institutions in ancient Greece. It is in the hope that something of my own debt to him may be conveyed that this paper is offered here, equally in gratitude, admiration and affection.The working out of the anger of Achilles in theIliadbegins with a great scene of divine supplication in which Thetis prevails upon Zeus to change the course of things before Troy in order to restore honour to Achilles; it ends with another, human act in which Priam supplicates Achilles to abandon his vengeful treatment of the dead body of Hector and restore it for a ransom. The first half of theOdysseyhinges about another supplication scene of crucial significance, Odysseus' supplication of Arete and Alkinoos on Scherie. Aeschylus and Euripides both wrote plays called simplySuppliants, and two cases of a breach of the rights of suppliants, the cases of the coup of Kylon and that of Pausanias, the one dating from the mid-sixth century, the other from around 470 B.C. or soon after, played a dominant role in the diplomatic propaganda of the Spartans and Athenians on the eve of the Peloponnesian War.

Abstract In nineteenth-century France, liberals assumed that a conservative judiciary was frequently biased in favour of the prosecution, and socialists assumed that juries were dominated by the upper classes and too unrepresentative of the population to render justice equitably. Agitation by the left to combat these perceived biases led to the adoption of two key reforms of the fin de siècle. One was the abolition in 1881 of the résumé, or summing-up of the case by the chief justice of the cour d’assises (felony court). Liberals thought this reform was necessary because judges allegedly often used the résumé to persuade jurors in favour of conviction, a charge repeated by modern historians. The other reform, beginning at about the same time, was to make jury composition more democratic. By 1880, newly empowered liberals (at least in Paris) had begun to reduce the proportion of wealthy men on jury lists. This was followed in 1908 by the implementation of a circular issued by the Minister of Justice ordering the jury commissions to inscribe working-class men on the annual jury lists. However, a quantitative analysis of jury verdicts suggests that the reforms of the early 1880s and 1908 had only modest impacts on jury verdicts. Ideas and attitudes seem to have been more important. This has implications regarding two key controversies among modern jurists: the extent to which judges influence jurors and the extent to which the characteristics of jurors influence their verdicts.

A recent article of Leon Livingstone rightly calls attention to the importance of Pérez Galdós' assimilation of Cervantine irony as a forerunner of the concern of modern Spanish novelists about the autonomy of their characters. The unreality of rationalism, which Livingstone holds to be the germ of El amigo Manso, the imagination's capacity to create reality at the heart of Misericordia, lead to the even bolder experiments in the artistic representation of reality undertaken by Unamuno, Azorín, Valle-Inclán, and Pérez de Ayala. Anomalous for his time yet so pervasive in his work is Galdós' employment of “interior duplication” that a separate study would contribute to our fuller understanding of his art as well as to our measure of the advances in the Spanish novel of the latter half of the nineteenth century. The present essay focuses on Galdós' developing skill with internal repetitions from La Fontana de Oro (publ. 1870), through the rich complexities of the novels written between 1886–89, to their almost stylized simplicity in El abuelo (1897). Always related to Cervantine irony, the variety of verbal echoes, the mirroring of one character in another, the unconscious illumination each may offer the other, underscore the increasingly intimate wedding of form and matter with which Galdós came to unfold his narratives.

Abstract Piglets often experience hypothermia early after birth. Previous research has suggested that drying piglets and administration of oxygen (a potential treatment for asphyxiation) at birth may increase post-natal rectal temperatures. The objective of this study was to determine the effects of drying and administering oxygen at birth on piglet rectal temperature over the first 24 h after birth. The study, conducted at a commercial facility, used a CRD with 42 sows/litters randomly allotted at start of farrowing to 3 treatments (applied at birth): Control (no drying or oxygenation); Dried (using a cellulose-based desiccant); Dried+Oxygen [dried and placed in a chamber (40% oxygen) for 20 min]. At birth, piglets were weighed and uniquely identified. Rectal temperature was measured at 0, 20, 30, 45, 60, 120, and 1440 min after birth. Data were analyzed using PROC MIXED of SAS. Litter was the experimental unit; piglet was a subsample of litter. The statistical model included effects of treatment, time of measurement, and the interaction. Both the Dried and Dried+Oxygen treatments had greater (P < 0.05) rectal temperatures than the Control between 20 and 120 min. However, the Dried+Oxygen treatment had lower (P < 0.05) rectal temperatures than the Dried treatment between 20 and 60 minutes. Temperatures at 1440 min were lower (P < 0.05) for the Dried+Oxygen than the other treatments; however, differences were small. In conclusion, drying piglets at birth increased rectal temperatures over the first 2 h after birth. The combination of drying piglets at birth and placement in an oxygen chamber for 20 min was less effective at moderating post-natal temperature changes than drying alone. Further research on piglet oxygenation is necessary to understand the reason for these reduced temperatures, and whether this treatment affects pre-weaning mortality. This research was funded by the National Pork Board.
