Text and Data Mining Exception in South America: A Way to Foster AI Development in the Region

  In 2015, authors wondered if Europe was falling behind in the artificial intelligence (AI) race because of the lack of a text and data mining (TDM) exception. What can then be said for South America? Copyright regimes and their interaction with the development of digital technologies in this continent have been overlooked by authors. This paper intends to start filling this gap by mapping the current state of copyright exceptions that serve computational analysis in South America. After reviewing the copyright regimes of the five largest economies of the region (i.e. Argentina, Brazil, Chile, Colombia and Peru), I concluded that they are not prepared for digital research techniques such as text and data mining. Researchers in these countries are at a competitive disadvantage, as rigid and outdated copyright regimes act as a constraint against keeping pace with the latest developments in subsequent years. If policymakers want to develop their nations’ AI capabilities, as many governments and international organizations claim they do, they will need to look for a more flexible and enabling approach to copyright.

Currently the speeding up of digital transformation makes it obvious that application of digital technologies and the degree of involvement into digital transformation is an essential and significant aspect of scientific and technical potential of an industrial enterprise. The article is devoted to the analysis of trends and prospects of development of basic technologies which are the basis for digital transformation of the world economics: the Internet of things, artificial intelligence, robotization and technologies of the big data processing. The authors present the assessment of the current state of digitalization for Russian industrial enterprises by analyzing the data on the implementation of the above mentioned technologies in business-process.

The paper focuses on the current legal barriers to text and data mining (TDM) in the context of smart disclosure systems (SDSs) whose aim is to provide consumers with improved access to the data needed to make informed decisions. The use of intellectual property rights and contracts, combined with technological protection measures, can hinder TDM and the deployment of SDSs.Further, those legal constraints can negatively impact artificial intelligence innovation that requires improved access to data. There are thus various arguments for enhanced “machine legibility”.However, the TDM exception included in the draft Copyright in the DSM Directive and the various amendments proposed by the European Parliament or the Council do not appear to clear the way for enhanced “machine legibility”. In relation to SDSs, we also argue that the principle of transparency, embedded in consumer and data protection laws, can serve as a last line of defence against prohibition of TDM.

This chapter focuses on Article 4 of Directive 2019/790, the European copyright directive, which require Member States to provide for an exception or limitation for reproductions and extractions of works and other subject matter for the purposes of text and data mining. It talks about digital technologies that permit new types of uses that are not clearly covered by the existing Union rules on exceptions and limitations in the fields of research, innovation, education, and preservation of cultural heritage. It also describes the optional nature of exceptions and limitations that could negatively impact the functioning of the internal market. The chapter discusses the exceptions and limitations provided in Directive 2019/790 that seek to achieve a fair balance between the rights and interests of authors, other rightholders, and users. It clarifies that text and data mining can be carried out in relation to mere facts or data that are not protected by copyright.

The discussion issues of the digital economy and its corresponding tools and management technologies are studied, attention is paid to the current state of digital technologies, economic principles and provisions of formation and peculiarities of functioning, forecasts of the development of digitalization processes in society are made. Comparative study of classical views of management in the conditions of intensification of processes of digitization and building digital models of the world, the peculiarities of the influence of the control subsystem, presented various algorithms, features, and components of artificial intelligence to the control subsystem, namely, personnel, human resources, user groups, social groups. The conclusion is made about the cardinal change of management paradigm and depersonalization of highly effective processes of management of various focus groups by formalized and algorithmized teams of artificial intelligence.
