Johnny Cash's live prison albums, “At Folsom Prison” and “At San Quentin,” are significant and under-recognized social statements of the 1960s. Cash encouraged his listeners to empathize with prisoners by performing songs with prison themes and by recording the electric reactions of inmates to his music. Cash performed before a multiracial audience, and his music was popular with the counterculture as well as with traditional country fans. Cash's albums and his prison reform activism rejected the law-and-order policies of conservative politicians who sought to enlist country music in their cause. An examination of Cash's prison records challenges the commonly held notion that country music provided the soundtrack for the white conservative backlash of the late 1960s.

In a recent issue of this journal (Volume 15, Number 4, Fall 1990), Susan Sterett examined the role of the Law Commission in the development of English administrative law. She suggested that the Commission mimicked a “peak association” and adopted an “idiom of legalism” in order to justify its reform proposals. This comment disagrees with Sterett on three grounds. First, the role and constitutional position of the Commission is far more complex than Sterett suggests, and this affects the way in which the Commission works. Second, judges and academic lawyers were central to the reform of substantive principles of judicial review in the 1960s and 1970s, making it unnecessary for the Law Commission to act in this field. Finally, it is wrong to ignore the fact that much administrative law occurs outside the judicial review procedure.

AbstractThe article discusses the development of international groundwater law from the first codification efforts of modern water law until present and raises relevant issues for the way forward. It first traces international groundwater law from the 1960s until the end of the last century. It then reviews the growing attention groundwater has received during the last decade and third discusses the status quo. It places particular emphasis on the 2008 Draft Articles on the Law of Transboundary Aquifers adopted by the International Law Commission and the legal arrangements made for five of the 273 transboundary aquifers. It concludes with thoughts on the way forward in this important and understudied area of international law.

By the end of the 1960s, anti-institutionalism had extended beyond mental health and bled into prison reform. This chapter tracks the rise and fall of efforts to find alternatives to prisons. In the late 1960s and early 1970s, changes in psychiatry, politics, and the law led to a deinstitutionalization in both mental health and corrections policy making. Not only did politicians and advocates look for alternatives to mental hospitals, they also sought alternatives to prisons. They expanded probation, parole, and furlough and created community corrections initiatives such as halfway houses and work-release programs. The number of people in prisons and jails fell, even during a time of increased policing. These reforms came under attack, however, as politicians depicted people in prison as dangerous criminals and ushered in harsh sentencing reforms. A law and order politics that relied on racial discrimination halted efforts to deinstitutionalize prisons. By the mid-1970s, after more than a decade of decline, new prison construction began and the number of imprisoned people nationwide rose. These changes had a devastating effect on individuals with mental health conditions. Many of them were caught in the web of this new era of mass incarceration.

Here I set the stage for developing a Kantian account of punishment attuned to social and economic injustice and to the need for prison reform. I argue that we cannot appreciate Kant's own discussion of punishment unless we read it in light of the theory of justice of which it is a part and the fundamental commitments of that theory to freedom, autonomy and equality. As important, we cannot properly evaluate Kant's advocacy of the law of retribution unless we recognize his theory of justice as an ideal theory. Once we understand both Kant's larger account of justice and its relationship to his less basic commitments, we discover grounds to accept that larger theory, but reject components like the law of retribution with their basis in empirical conclusions we may not share with Kant. We also open the way to develop an account of punishment responsive to social circumstances.

This chapter looks at the life and times of the psychiatrist Franco Basaglia (1924–1980) from a series of points of view. It analyses the importance of his experiences as Director of Psychiatric Hospitals in Gorizia (1961–1968) and Trieste (1971–1978), and the legacy of the law (1978) which carries his name. The chapter also looks at the connections between Basaglia’s life and his work as a radical and critical psychiatrist, and at the way in which certain sources—above all, those linked to Basaglia’s personal descriptions of his life—have been used to tell this story, creating a circularity of sources and a tendency towards a ‘Basagliacentric’ account of the movement itself. The chapter ends with a reflection of the global impact of the Basaglia law and movement, and the different messages emerging from the 1960s and 1970s for the world of psychiatrists and patients.

In Uruguay, Lacanian ideas arrived in the 1960s, into a context of Kleinian hegemony. Adopting a discursive approach, this study researched the initial reception of these ideas and its effects on clinical practices. We gathered a corpus of discursive data from clinical cases and theoretical-doctrinal articles (from the 1960s, 1970s and 1980s). In order to examine the effects of Lacanian ideas, we analysed the difference in the way of interpreting the clinical material before and after Lacan's reception. The results of this research illuminate some epistemological problems of psychoanalysis, especially the relationship between theory and clinical practice.

This article undertakes to show the way that has led to the statutory decriminalization of euthanasia-related murder and assisted suicide in the Kingdom of the Netherlands. It presents the evolution of the views held by Dutch society on the euthanasia related practice, in the consequence of which death on demand has become legal after less than thirty years. Due attention is paid to the role of organs of public authority in these changes, with a particular emphasis put on the role of the Dutch Parliament – the States General. Because of scarcity of space and limited length of the article, the change in the attitudes toward euthanasia, which has taken place in the Netherlands, is presented in a synthetic way – from the first discussions on admissibility of a euthanasia-related murder carried out in the 1970s, through the practice of killing patients at their request, which was against the law at that time, but with years began more and more acceptable, up to the statutory decriminalization of euthanasia by the Dutch Parliament, made with the support of the majority of society.

This article studies the concept of Ihsan (good deed) in the thought of ulama mufassirs (Muslim scholars interpretering the Qur’an). The result of the study being carried out by the writer is that the concept of ihsan being too narrowly interpreted, proves that it has wide interpretation in the thought of muffasirs. If so far among society the concept of ihsan has been narrowly interpreted on the good deed or doing good deed, so according to mufassirs, the concept means: (1) carrying out all obligations, (2) being patient to receive all the obligation and anything forbidden by God, (3) being obedient and always perfects his obedience in quality as well as in the way, (4) forgiving, (5) being sincere, (6) realizing the existence of God, (7) emphasizing the esoteric aspect rather than exoteric world, (8) knowledge, (9) being firm in the truthfulness, (10) havng understanding about the true teachings of God, (11) having good comprehension about the law appropriately applied among the Islamic society. The wide meaning of this concept because this concept is really expressed by the Koran in context. This article tries to attach the concept of Ihsan in several meanings about the education world

The 1960s saw the triumph of cognitive science over behaviorism. This chapter examines three literary–philosophical objections to this shift: “West Coast” phenomenology, Richard Powers’s Galatea 2.2, and the writings of Walker Percy, the first of the postwar sages featured in this book. For “West Coast” philosophers, cognitive science ignores the way human action is structured by what we “give a damn” about—a sense of significance that orients our actions. Powers’s novel goes a step further: no more than machines do we know what to give a damn about. Percy’s essays and fiction challenge both these positions, asking us to see analogies between the significance we find in language and the significance we find in living a Christian life. Establishing such an analogy is the goal of Percy’s 1971 Love in the Ruins, which seeks to embody—with only partial success—what terms such as “faith” and “community” might mean.
