Introducing Native American Conflict History (NACH) data

The colonization of the Northern Hemisphere between 1500 and 1900 produced nearly 150 separate conflicts between colonial powers and Native American communities. These conflicts have been largely overlooked in studies of international relations, particularly the quantitative tradition of scholarship. This article introduces a new dataset on conflicts involving Native American groups and colonial actors. As a starting point, this article briefly examines how the discipline has approached Native Americans and indigenous peoples. Next, the criteria for a new dataset on Native American Conflict History (NACH) is introduced. The challenges of navigating the historical record are discussed. And finally, a descriptive statistical overview of the data is presented that explores temporal and geographic patterns in the frequency, scale, and duration of conflicts. The article notes different patterns between European state combatants and ‘settler’ state combatants. Notably, the frequency of conflict increases dramatically in both Mexico and the United States during the second half of the 19th century while the scale of conflict remains largely unchanged.

Settler colonialism was imbued with intolerance towards Indigenous peoples. In colonial North America brutal military force was applied to the subjection and conversion of Native Americans to Christianity. In the United States, that offense continued, joined with condemnations of Indian religious practice as savagery, or as no religion at all. The violence was legitimated by appeals to Christian scripture in which genocide was commanded by God. Forced conversion to Christianity and the outlawing of Native religious practices were central aspects of white intolerance.

Religion was a point of cultural conflict, political motivation, and legal justification throughout the European and American colonization of North America. Beginning in the 14th century, Catholic monarchs invoked Christian doctrine and papal law to claim Native American “heathenry” or “infidelity” as legal grounds that legitimized or mandated their policies of military invasion and territorial occupation. More progressive Christian thinkers argued for the recognition of Native Americans as human beings entitled to certain natural-law protections that morally obligated Spain to conquer and convert them for their own benefit. Spain and France worked with the church throughout the 16th and 17th centuries to establish missions throughout seized Native American territories, while English colonists often segregated Native Americans into “praying towns” for their moral benefit or the sanctity of the colonies. After the United States declared independence, American politicians quickly identified dissolution of Native American cultures as a necessary step in undermining tribal saliency and in ensuring the political dominion of state and federal governments. By the 19th century, policymakers were convinced that encouraging Indians to put aside their “savage ways” would help tribal populations achieve cultural and spiritual salvation through Christianity. In 1869, President Grant initiated a “Peace Policy” that granted Christian missions contracts and federal funding to civilize and Christianize the Native American peoples of assigned reservations. The federal government established boarding schools for the children of tribal communities to teach English, Christianity, and occupational skills in order to “Kill the Indian in him and Save the Man.” During the 19th and 20th centuries, federal legislation stripped Native Americans of lands, property, and rights, while federal agencies forbade the practice of indigenous Native American religions. Subsequent courts legitimated the historic claim of European nations to Native American lands pursuant to the “Doctrine of Discovery,” thus ruling these policies either legal or unreviewable. While judicial decisions throughout the 20th century also recognized tribal rights to land, water, and self-government as well as the legal obligation of the federal government to protect tribal resources, these rulings have been inconsistently realized. Throughout the history of the United States, law has articulated, in the language of privilege, right, and moral prescription, American values and visions of ideal relations. As American culture has changed, federal policy has swung back and forth among initiatives to relocate, terminate, assimilate, and appropriate Native American cultures. Religion and law have advanced agendas of conquest and colonization and become means by which Native Americans peoples have resisted those agendas.

This research paper is a review of ten years of sacred lands management and policy in the United States. The author reports from the unique position of having been involved in national and international meetings with communities of indigenous peoples and intergovernmental stakeholders during this time. Discussion includes an historical overview of such topics as environmental justice and the 2001 Native American Sacred Lands Forum, one of the first national meetings in the United States to specifically address the sacred lands of Native Americans. Further discussion draws attention to the adoption of the United Nations Declaration on the Rights of Indigenous Peoples in 2007 as a gateway to better sacred lands management and policy for Native Americans in the future.

The struggle for Native American voting rights has lasted more than two centuries. Although the 1924 Indian Citizenship Act granted citizenship to indigenous peoples born within the geographic boundaries of the United States, it did not ensure the right to vote. Because the Constitution gives states the power to determine the “times, places, and manner of holding elections,” many states statutorily denied Native Americans the franchise until federal lawsuits forced them to change. Having the statutory right to vote, however, did not ensure that it could be exercised in a meaningful way. Since the passage of the 1965 Voting Rights Act there have been more than ninety voting rights cases involving Native Americans. While the overall historical trend has been toward extending the vote, periods of enhanced voting rights often have been followed by periods of retrenchment. In this article, we argue that the traditional frameworks used to explain racial inequalities fail to account for the unique character of relations between indigenous peoples and the U.S. government, and we propose a tripartite approach that draws from studies in core–periphery development and “racial institutional orders,” but also considers the many ways that tribal identities intersect with these.

In this history of the social and human sciences in Mexico and the United States, Karin Alejandra Rosemblatt reveals intricate connections among the development of science, the concept of race, and policies toward indigenous peoples. Focusing on the anthropologists, sociologists, biologists, physicians, and other experts who collaborated across borders from the Mexican Revolution through World War II, Rosemblatt traces how intellectuals on both sides of the Rio Grande forged shared networks in which they discussed indigenous peoples and other ethnic minorities. In doing so, Rosemblatt argues, they refashioned race as a scientific category and consolidated their influence within their respective national policy circles. Postrevolutionary Mexican experts aimed to transform their country into a modern secular state with a dynamic economy, and central to this endeavor was learning how to “manage” racial difference and social welfare. The same concern animated U.S. New Deal policies toward Native Americans. The scientists’ border-crossing conceptions of modernity, race, evolution, and pluralism were not simple one-way impositions or appropriations, and they had significant effects. In the United States, the resulting approaches to the management of Native American affairs later shaped policies toward immigrants and black Americans, while in Mexico, officials rejected policy prescriptions they associated with U.S. intellectual imperialism and racial segregation.

We draw on new and original data to examine both partisan and systemic inequities that have fueled the spread of COVID-19 in Native America. We show how continued political marginalization of Native Americans has compounded longstanding inequalities and endangered the lives of Native peoples. Native nations have experienced disproportionate effects from prior health epidemics and pandemics, and in 2020, Native communities have seen greater rates of infection, hospitalization, and death from COVID-19. We find that Native nations have more COVID-19 cases if they are located in states with a higher ratio of Trump supporters and reside in states with Republican governors. Where there is longstanding marginalization, measured by lack of clean water on tribal lands and health information in Native languages, we find more COVID-19 cases. Federal law enables non-members to flout tribal health regulations while on tribal lands, and correspondingly, we find that COVID-19 cases rise when non-members travel onto tribal lands. Our findings engage the literatures on Native American politics, health policy within U.S. federalism, and structural health inequalities, and should be of interest to both scholars and practitioners interested in understanding COVID-19 outcomes across Tribes in the United States.

Indigenous literary studies, as a field, is as diverse as Indigenous Peoples. Comprising study of texts by Indigenous authors, as well as literary study using Indigenous interpretive methods, Indigenous literary studies is centered on the significance of stories within Indigenous communities. Embodying continuity with traditional oral stories, expanding rapidly with growth in publishing, and traversing a wild range of generic innovation, Indigenous voices ring out powerfully across the literary landscape. Having always had a central place within Indigenous communities, where they are interwoven with the significance of people’s lives, Indigenous stories also gained more attention among non-Indigenous readers in the United States and Canada as the 20th century rolled into the 21st. As relationships between Indigenous Peoples (Native American, First Nations, Métis, and Inuit) and non-Indigenous people continue to be a social, political, and cultural focus in these two nation-states, and as Indigenous Peoples continue to work for self-determination amid colonial systems and structures, literary art plays an important role in representing Indigenous realities and inspiring continuity and change. An educational dimension also exists for Indigenous literatures, in that they offer opportunities for non-Indigenous readerships—and, indeed, for readers from within Indigenous nations—to learn about Indigenous people and perspectives. Texts are crucially tied to contexts; therefore, engaging with Indigenous literatures requires readers to pursue and step into that beauty and complexity. Indigenous literatures are also impressive in their artistry; in conveying the brilliance of Indigenous Peoples; in expressing Indigenous voices and stories; in connecting pasts, presents, and futures; and in imagining better ways to enact relationality with other people and with other-than-human relatives. Indigenous literatures span diverse nations across vast territories and materialize in every genre. While critics new to the field may find it an adjustment to step into the responsibility—for instance, to land, community, and Peoplehood—that these literatures call for, the returns are great, as engaging with Indigenous literatures opens up space for relationship, self-reflexivity, and appreciation for exceptional literary artistry. Indigenous literatures invite readers and critics to center in Indigeneity, to build good relations, to engage beyond the text, and to attend to Indigenous storyways—ways of knowing, being, and doing through story.

Together, the articles in this special issue of the American Indian Culture and Research Journal offer a discussion of how Indigenous peoples have represented themselves and their communities in different periods and contexts, as well as through various media. Ranging across anthropology, art history, cartography, film studies, history, and literature, the authors examine how Native people negotiate with prominent images and ideas that represented Indians in the dominant culture and society in the United States and the Americas. These essays go beyond the problems of cultural appropriation by non-Indians to probe the myriad ways Native Americans and Indigenous people have challenged, reinforced, shifted, and overturned those representations.

Since the early 19th century, the expansion of American empire has constrained Native American autonomy and cultural expression. Native American history simply cannot be told apart from accounts of violent dispossession of land, languages, and lifeways. The pressures exerted on Native Americans by U.S. colonialism were intense and far-reaching: U.S. officials sought no less than the complete eradication of Native cultures through the assimilation policies they devised in the 19th century and beyond. Their efforts, however, never went uncontested. Despite significant asymmetries in political power and material resources, Native Americans developed a range of strategies to ensure the survival of their communities in the complicated colonial context created by American expansion. Their activism meant that U.S. colonialism operated as a dynamic process that facilitated various forms of cultural innovation. With survival as their goal, Native American responses to U.S. colonialism can be mapped on a continuum of resistance in which accommodation and militancy exist as related impulses. Native Americans selectively deployed various expressions of resistance according to the particular political circumstances they faced. This strategy allowed them to facilitate an array of cultural changes intended to preserve their own cultural integrity by mitigating the most damaging effects of white rule. Because religion provided the language and logic of U.S. colonial expansion and Native American resistance, it functioned as a powerful medium for cross-cultural communication and exchange in the American colonial context. Religion facilitated engagement with white (mostly Protestant) Christian missionaries and allowed Native Americans to embrace some aspects of white American culture while rejecting others (even within the context of Native conversion to Christianity). It also allowed for flexible responses to U.S. consolidation policies intended to constrain Native autonomy still further by extending the reservation system, missionary oversight of indigenous communities, and land use in the late 19th century. Tribes that fought consolidation through the armed rebellions of the 1870s could find reasons to accept reservation life once continued military action became untenable. Once settled on reservations, these same tribes could deploy new strategies of resistance to make reservation life more tolerable. In this environment of religious innovation and resistance, new religious movements like the Ghost Dance and peyote religion arose to challenge the legitimacy of U.S. colonialism more directly through their revolutionary combinations of Native and Christian forms.

This paper explores the complex evolution of the role anthropologists have played as cultural experts in the regulation of the entheogenic use of the peyote cactus throughout the 20th century. As experts of the “peyote cult”, anthropologists provided testimonies and cultural expertise in the regulatory debates in American legislative and judiciary arenas in order to counterbalance the demonization and prohibition of the medicinal and sacramental use of peyote by Native Americans through state and federal legislations. In the meantime, anthropologists have encouraged Peyotists to form a pan-tribal religious institution as a way to secure legal protection of their practice; in 1918, the Native American Church (NAC) was incorporated in Oklahoma, with its articles explicitly referring to the sacramental use of peyote. Operating as cultural experts, anthropologists have therefore assisted jurists in their understanding of the cultural and religious significance of peyote, and have at the same time counseled Native Americans in their interaction with the legal system and in the formatting of their claims in appropriate legal terms. This complex legal controversy therefore provides ample material for a general exploration of the use, evolution, and impact of cultural expertise in the American legal system, and of the various forms this expertise can take, thereby contributing to the contemporary efforts at surveying and theorizing cultural expertise. Through an historical and descriptive approach, the analysis notably demonstrates that the role of anthropologists as cultural experts has been marked by a practical and substantive evolution throughout the 20th century, and should therefore not be restrictively understood in relation to expert witnessing before courts. Rather, this paper underlines the transformative and multifaceted nature of cultural expertise, and highlights the problematic duality of the position that the two “generations” of anthropologists involved in this controversy have experienced, navigating between a supposedly impartial position as experts, and an arguably biased engagement as advocates for Native American religious rights.
