The provision of legal aid is one way to realize access to law and justice for the poor people provided by the state on the mandate of the constitution. Several regulations regarding legal aid have been issued by the state through the Act and its implementing regulations as well as from the Supreme Court or the Constitutional Court through the Supreme Court Regulations and the Constitutional Court's decisions. Legal aid is the constitutional right of every citizen to guarantee legal protection and guarantee equality before the law stipulated in Law Number 16 of 2011, the State is responsible for recognizing and protecting the human rights of every individual without differing backgrounds so that everyone has the right to be treated equally before the law is contained in Article 28D of the 1945 Constitution of the Republic of Indonesia. For the poor who experience legal problems in the form of injustice, they can request legal assistance from legal aid institutions that are regulated in legislation. The purpose of providing legal aid is to guarantee and fulfill the right for Legal Aid Recipients to gain access to justice, to realize the constitutional rights of all citizens in accordance with the principle of equality in law, to ensure the certainty that the implementation of Legal Aid is carried out equally across the territory of the Republic of Indonesia. , and to create an effective, efficient and accountable court.

Legal aid is something that is given by the state to people who are unable to get justice and their basic rights before the law. The state has an obligation to protect every citizen, especially legal protection for the poor or the poor. To ensure this protection, the government forms a law which can help the underprivileged or poor in dealing with the legal problems they experience. With the existence of the Law on Advocacy, the Law on Legal Aid, as well as the existence of this Legal Aid Institute, it is hoped that it will be able to reduce the burden on what people experience before the law, especially related to the costs of legal aid.

Bantuan hukum adalah salah satu upaya mengisi hak asasi manusia (HAM) terutama bagi lapisan masyarakat termiskin rakyat Indonesia. Bantuan hukum harus dimaknai dan dilaksanakan sebagai upaya perjuangan menegakkan HAM bagi si miskin. Tujuan bantuan hukum perlu diperluas, dak saja terbatas pada bantuan hukum individual, tetapi juga struktural dan juga jangan terbelenggu dengan jalur-jalur formal semata. Dengan diundangkan Undang-Undang Nomor 16 Tahun 2011 tentang Bantuan Hukum memunculkan permasalahan bagaimana pengaruh bantuan hukum terhadap masyarakat? Dengan menggunakan metode peneli an norma f dan dengan pendekatan data secara kualita f yang dianalisis deskrip f, didapatkan kesimpulan bahwa keberadaan Undang-Undang Bantuan Hukum belum maksimal memberikan pengaruh terhadap bantuan hukum bagi masyarakat miskin, karena bantuan hukum masih dalam jalur formalis k dan masih bersifat pasif. Pendanaan penyelenggaraan bantuan hukum yang digeser dari Mahkamah Agung, Kejaksaan Agung, dan Kepolisian kepada Menteri Hukum dan HAM dan dilaksanakan oleh Lembaga Bantuan Hukum atau Organisasi Kemasyarakatan agar dapat menyentuh orang atau kelompok orang miskin, tetapi besar anggaran perlu memper mbangkan proses peradilan yang berjalan, karena dikhawa rkan dapat menghambat orang miskin dan kelompok orang miskin untuk mengakses keadilan guna mewujudkan hak-hak kons tusional mereka.<p>Legal aid is an effort to fulfill human rights, especially for Indonesian poorest society. Legal aid should be interpreted and implemented as an effort of human rights enforcement for the poor. The purpose of legal aid should be expanded, not just limited to individual legal assistance, but also structural and not fe ered by mere formal channels. By enacted the Law Number 16 Year 2011 on Legal Aid, raises the ques on of how the in fl uence of legal assistance to the society? By using norma ve research methods and approaches qualita ve data were descrip vely analyzed, was concluded that existence of legal aid has not been maximized e ff ect to legal assistance for the poor, and because of it is s ll on formalis c track and passive. Funding of legal assistance shi ed from the Supreme Court, A orney General and Police to the Ministry of Jus ce and implemented by a Legal Aid Ins tu on or civil society organiza on in order to reach people or the poor community, but the magnitude of budget needs to consider the judicial process, because it feared could hinder the poor to access of jus ce to realize their constuonal rights.</p>

Provision of Legal Aid is one of the ways the state can achieve access to law and justice for poor people in accordance with what has been mandated by the constitution. The principle of equality before the law in the Criminal Procedure Code (KUHAP) and Article 27 paragraph (1) of the 1945 Constitution tries to be realized by the state with this legal assistance so that the poor will experience justice in law enforcement in Indonesia. Justice is the right of all Indonesian people. Justice can be obtained by all people, this is contained in the Pancasila Values ​​especially in the 5th (five) precepts which read "Social Justice for All of Indonesia". For the poor who experience legal problems in the form of injustice, they can request legal assistance from legal aid institutions that are regulated in legislation. The purpose of providing legal aid is to guarantee and fulfill the right for Legal Aid Recipients to gain access to justice, to realize the constitutional rights of all citizens in accordance with the principle of equality in law, to ensure the certainty that the implementation of Legal Aid is carried out equally across the territory of the Republic of Indonesia, and to create an effective, efficient and accountable court. The community's right to get free legal assistance (pro-bono) is regulated in Law No. 16 of 2011 concerning Legal Aid. This law regulates the communities receiving legal assistance, grants, and funding as well as legal aid mechanisms.

Legal aid in Indonesia, particularly in terms of access to justice, legal aid provided by the state for people is still pivoted on positive law. Laws regulating legal aid in Indonesia remain revolving around the number of cases and budget absorption targets given to legal aid institutions that have been verified and accredited by the state for people/groups in need. Verification and Accreditation from the state with parameters written in the law inhibit those who need legal assistance if they are not categorized as the poor. The requirement of the poor to access legal aid implies that access to legal aid for everyone in conflict is far from justice. Access to legal aid is essential since the purpose of the law is justice. Besides, legal aid aims to provide justice for those who do not have law knowledge, in other words, blind to the law. Justice for all is the vein of legal aid which is inseparable from the right of legal aid for those in need. Legal aid can be administered by social institutions/legal aid agencies which should provide access to those who need legal assistance and those who are in dispute, be it poor or rich so that justice for all can be achieved. This research discusses the transcendental dimension of legal aid. This study used a descriptive research method intending to analyze legal aid from legal aid institutions viewed from the study of legal philosophy and legal aid with transcendental dimensions.

Based on Law No. 16 of 2011 on Legal Aid, Article 1 paragraph (1) states that Legal Aid is a legal service provided by legal aid providers free of charge to Legal Aid Recipients. Legal aid is a guarantee of legal protection and a guarantee of equality before the law, which is a constitutional right for every citizen. Because, the constitution guarantees the right of every citizen to get equal treatment before the law, including the right to access justice through legal aid. Due to the Covid-19 pandemic, many people are asking for legal assistance related to the case of installment billing by debt collectors. The debt collector itself is a third party, which has an agreement with the financing institution to make efforts to force the collection of debtor vehicles because it has not paid installments as agreed. The result of this paper is that under these circumstances there is another legal remedy, namely restructuring.

<p>There are two law enforcement agencies combating corruption, namely the Corruption Eradication Commission (KPK) and the Police, having the same authority, but in implementing authority there are differences, for example in the application of laws that govern the two institutions.The problem that becomes the study of this research is how the problem of the existence of the KPK as an institution to eradicate corruption has the authority regulated in RI Law No. 30 of 2002 concerning the Corruption Eradication Commission, whose authority lies with the Police regulated in RI Law No. 2 of 2002 concerning the National Police of the Republic of Indonesia which refers to the Criminal Code The results of the study showed that the resolution of the dispute between the Police and the Corruption Eradication Commission in the investigation of corruption was carried out by coordinating the Corruption Eradication Commission and the Police in Corruption Criminal Investigations. Law number 30 of 2002 concerning the Corruption Eradication Commission regulates the relationship between the performance of the KPK and the Police regarding investigations, investigations and prosecutions.Settlement of authority disputes between the Police and the KPK should be the authority of the Supreme Court, due to judicial review under the Supreme Court Law. The right to test the law is the application of a balanced and balanced government. The doctrine of habeas corpus is that no one should be imprisoned contrary to the law of the land. The habeas corpus review is used as a form of inquiry issued to test whether a conviction or restraint is lawful. However, before having a chance to present their case before a federal forum, state prisoners have to fulfill the state’s gatekeeping requirements, such as the exhaustion of all available state remedies, requirements of the Anti-Terrorism and Effective Death Penalty Act, and the absence of procedural default. Procedural default arises when the state court declines to address a prisoner’s federal claims because the prisoner failed to meet a state procedural requirement. To overcome the procedural default the petitioner has to satisfy the “cause-and-prejudice test.” In many cases the fulfillment of the “cause” element is often based on the claim of ineffective assistance of counsel. To prove the ineffective assistance of counsel, the petitioner has to satisfy the test consisting of two prongs: establishing the deficient performance of counsel and demonstrating that the deficient performance prejudiced the defense. In federal proceedings the rule is to raise the claim of the ineffective assistance of counsel in the collateral review. However, the right to a counsel does not extend to collateral attacks upon conviction, including a post-conviction appeal. Moreover, the counsel’s deficient performance does not constitute a basis for a procedural default reversal in the post-conviction claim. The abovementioned assertation may pose a question: what happens when the defendant is eligible to raise the ineffective assistance of counsel claim only in the collateral proceeding and the counsel representing the defendant in such a proceeding does not raise the claim?The Supreme Court resolved this matter in the decision from the Martinez v. Ryan case. The Court allowed for treating inefficient assistance of post-conviction counsel as a cause that could reverse procedural default. Taking into consideration the amount of ineffective assistance of counsel claims in habeas corpus review, the Martinez v. Ryan case may influence a fair amount of individuals seeking their constitutional rights and give them their last chance to contest unfair conviction.Nieefektywna pomoc obrońcy jako przesłanka wniosku o habeas corpus w postępowaniu po skazaniu Wniosek o habeas corpus jest środkiem, który umożliwia osobie pozbawionej wolności zbadanie przez sąd legalności jej skazania. Przed skorzystaniem z tej możliwości skazany powinien wyczerpać wszelkie możliwe środki służące ponownemu zbadaniu legalności skazania, przysługujące mu na podstawie prawa stanowego. Ponadto wnioskodawca powinien uczynić zadość wszelkim stanowym przepisom proceduralnym. W wypadku niezadośćuczynienia temu obowiązkowi sąd stanowy nie rozpozna wniosku, chyba że wnioskodawca udowodni, iż nie mógł spełnić wymogów proceduralnych z powodów, na które nie miał wpływu. Wnioskodawcy w takiej sytuacji bardzo często powołują się na nieefektywną pomoc obrońcy. Zasadą jest, iż na nieefektywną pomoc obrońcy w postępowaniu przed sądem federalnym można powołać się poza postępowaniem głównym obejmującym rozpoznanie sprawy w I i II instancji. Prawo do obrony zagwarantowane w szóstej poprawce do Konstytucji Stanów Zjednoczonych nie rozciąga się jednak na postępowania poza postępowaniem głównym. Skazani nie mogą zatem powołać się na nieefektywną pomoc obrońcy, aby odwrócić stan niezadośćuczynienia obowiązkom proceduralnym wynikającym z prawa stanowego. Taki stan rzeczy budził wiele wątpliwości. W wypadku gdy pełnomocnik wnioskodawcy w postępowaniu poza postępowaniem głównym nie powoła się na nieefektywną pomoc obrońcy, który reprezentował skazanego w postępowaniu w I lub II instancji, wnioskodawca nie będzie mógł później wnosić o habeas corpus na tejże podstawie, gdyż wymagania proceduralne prawa stanowego nie zostały spełnione.Do tego problemu odniósł się Sąd Najwyższy w orzeczeniu w sprawie Martinez v. Ryan. Sąd dopuścił możliwość powołania się przez wnioskodawcę na nieefektywną pomoc obrońcy w postępowaniu poza postępowaniem głównym jako przesłankę niemożności zaspokojenia wymogów proceduralnych postępowania przed sądem stanowym. Biorąc pod uwagę, iż w ponad połowie postępowań związanych z wnioskiem o habeas corpus wnioskodawcy powołują się na nieefektywną pomoc obrońców, orzeczenie to ma ogromny wpływ na doktrynę habeas corpus.

The prominent legal issues in balinese law can be classified in two problems, inheritance and purusa ( descendant ), purusa is an inherent status (comonly for male) after marriage. If there is later a divorce, the judge must consider the decision in applying the law that was enforced in deciding the divorce case. Referring to Balinese customary law, when there is a divorce, the child's custody will fall on the purusa / father because the child will become a descendant of the father's family, whereas in the Decision of the Supreme Court of the Republic of Indonesia number: 126K / Pdt. / 2001 dated August 28, 2003 states that "If the father and mother divorce, then the care of the underage child is left to the closest and familiar person to the child, namely the mother". Therefore, the basis for weighing judges in determining custody of children in Hindu religious divorce in Balinese customary law is to combine two legal mechanisms between customary law and national law, where from the aspect of Balinese customary law which adheres to the purusa system, the right is on the purusa party but because the child is still underage, the child is under the mother's care until the child become an adult, and mother can not prevent the child to exercising rights and obligations in the father's family as purusa.

The Harmonization of the Authority between Supreme Court (MA) institutions The Constitutional Court (MK) and Judicial Commission (KY) is a must. It is done by way of revision of the Law of the Supreme Court, MK and KY for the harmonization of authority. However, if the revision finds a dead end, then the fifth amendment (5) of the 1945 Constitution of the State of the Republic of Indonesia (UUDNRI 1945) is limited to be reconstructed by the provision of Article 24B paragraph (1) of the 1945 Constitution by affirming the authority of KY clear so that it is not considered to interfere with judicial power. The harmonization can be done by adding an institution that oversees the authority of the Constitutional Court by performing reconstruction in Article 24B paragraph (1) so that there is no more tendency of absolute power.
