Based on the provisions in the 1945 Constitution article 1 paragraph 3 which states the State of Indonesia is a state based on law, it brings the consequence that every government action must always be based on the law. From another point of view related to the development of the 21st century, the State is often said to have developed into a modern state. Whereas the state's tasks, which were initially very limited, have become increasingly widespread. This is due to the increasing needs of modern humans and especially those related to the interests of life together. Regarding the social dynamics that occur in the community, licensing arrangements are needed. A license as a one-sided government action is a stipulation arising from the strategies and techniques used by the Government to control or control various conditions or activities carried out by the community. In other words, licensing is very much needed as an instrument of community guidance. However, the author limits the scope of research on licensing only to the nature of the authority of the permit, so that the author's research in this article is done through a literature review.

ABSTRACTThe 21st century should bet on a transmission of the History differently. Without losing the academic rigor we can serve this discipline for use in explanations of any event or crisis that occurs in today's world. There are new techniques that allow us to explain the sense of history in every moment of our life. Taking as an example the 16th century and the Empire of Carlos V, we can make an exercise in analysis that easily leads to keys to current passing through the birth of the modern State, its territorial configuration, or the relationship of Spain with America. The didactic eagerness of everything that we have must be fundamental. We must avoid distortions due to the knowledge of yesterday. History will help us to bring coherence to the message and delve into the creation of a rigorous, tolerant, plural and respectful society.RESUMENEl siglo XXI debe apostar por una transmisión de la Historia de manera diferente. Sin perder el rigor académico podemos servirnos de esta disciplina para su uso en las explicaciones de cualquier acontecimiento o situación de crisis que se produce en el mundo actual. Existen nuevas técnicas que nos permiten explicar el sentido de la Historia en cada momento de nuestra vida. Tomando como ejemplo el siglo XVI y el Imperio de Carlos V podemos hacer un ejercicio de análisis que nos conduce fácilmente a claves de actualidad que pasan por el nacimiento del estado moderno, su configuración territorial o la relación de España con América. El afán didáctico de todo lo que contamos debe ser fundamental. Hemos de evitar distorsiones gracias al conocimiento del ayer. La Historia nos ayudará a aportar coherencia al mensaje y a profundizar en la creación de una sociedad rigurosa, tolerante, plural y respetuosa.

RESUMEN: El discurso pastoral del Papa Francisco representa una teología de la cultura situada que llama a discernir sobre violencia-misericordia. El Papa denuncia los resultados del sistema y ataca sus causas. Comprenderlo implica una reflexión académica interdisciplinar sobre las características de la cultura actual que actúan como condición del discernimiento. Reflexionando de manera situada, se observan cambios tecnológicos significativos en los medios de comunicación que generan transformaciones en la cultura de un Estado moderno que aún continua pero que, en el siglo XXI, da signos de un giro postsecular donde lo político requiere nuevamente de lo teológico, no ya como fundamento sino como pensamiento crítico que tienda a desacralizar dioses mortales. Se presentarán, en un intento de diálogo interdisciplinario, los puntos de vista de cuatro autores: Antonio Spadaro SJ y su noción de cultura ciberespacial desterritorializada; Giacomo Marramao y su noción de postsecularismo y constitución de identidad; Miguel Yañez SJ y su interpretación de pobreza como violencia; y Luis Sarasa SJ con su lectura bíblica de la reconciliación en la tensión del conflicto.ABSTRACT: The pastoral discourse of Pope Francis represents a theology of the culture situated that calls to discern on violence-mercy. The Pope denounces the results of the system and attacks its causes. To understand it implies an interdis­ciplinary academic reflection on the characteristics of the current culture that act as a condition of discernment. Reflecting in a situated way, there are significant technological changes in the media that generate transformations in the culture of a modern state that still continues but which, in the 21st century, shows signs of a postsecular turn where the political again requires theological, not as a foundation but as critical thinking that tends to desacralize mortal gods. In an attempt for interdisciplinary dialogue, the views of four authors will be presented: Antonio Spadaro SJ and his notion of deterritorialized cyberspace culture; Giacomo Mar­ramao and his notion of postsecularism and constitution of identity; Miguel Yañez SJ and his interpretation of poverty as violence; and Luis Sarasa SJ with his biblical reading of reconciliation in the tension of conflict.

Family law is an essential dimension of women's citizenship in the modern state. The rights established in family law shape women's agency and autonomy; they also regulate access to basic resources—such as land, income, and education—that determine a citizen's ability to earn a living independently, among other life chances (Agarwal 1994; Deere and León 2001; Kabeer 1994; Okin 1989; World Bank 2012). Yet family law is a notorious site of sex inequality, historically and in the present. Equal rights enjoyed by women in national constitutions are often contradicted by family and civil codes that subordinate women to the decisions of their husbands and fathers. In the early 21st century, family law in a significant number of countries discriminated against women, denying them the rights held by men and contributing to their disadvantaged social positions.

The dynamism of the development of social relations during the 21st century in the modern state-legal order of Serbia reveals a new role of various organizational forms of public authority. Over time, there is an increasing need to innovate the classic position of local self-government in the system of providing public services, which is a challenge for scientific research. By considering the modern concept of service activity of local self-government units, a research basis will be created for drawing conclusions about the quality of existing normative solutions and their adequate application.
