Building an Innovative Economy: Institutionalizing Intellectual Property Reform in China

A number of studies have been conducted with regard to the economic impact of intellectual property reform on economic growth. Majority of these studies, particularly works of an empirical nature, have focused on highly industrialized economies, with the findings supporting the conclusion that intellectual property rights (IPRs) have been economically beneficial to industrialized economies. Little research has been conducted on the economic benefit of IPR within developing countries. The current study considers the impact of IPR within ASEAN member countries to determine whether reform activities have been beneficial to IPR activity. The findings are mixed, suggesting that for some categories of IPR, reform activities have been beneficial while in other instances, regulatory reforms have not had a discernable impact. Additionally, the findings also indicate that intellectual property reform, where effective has been most effective in generating additional intellectual property activity, as measured by intellectual property applications, amongst non-residents, rather than amongst domestic registrants. This finding supports the conclusion that reform activities have engendered confidence amongst foreign firms and foreign nationals.

Intellectual property includes several areas of regulation which govern access to and uses of knowledge, information and technology. In addition to having many cultural and social benefits, knowledge, information and technology are key building blocks of an innovative economy. The central and perpetual challenge of intellectual property law and policy is to ensure that there are both adequate incentives for innovators and creators to generate these building blocks, and that those incentives do not overreach so as, in fact, to inhibit innovation. This description, however, no longer tells the whole intellectual property story. This article discusses the emergence through trade and investment agreements of a changed approach to the objectives of intellectual property protection, and the challenges that approach presents for knowledge-based and innovation development of New Zealand interests.

The article reveals the economic content of intellectual property as a ratio of the appropriation and alienation of property. It is shown that intellectual property acts as a unity of a person’s mental abilities, which are expressed in his ability to solve various kinds of problems, and the result of these abilities is the net income of the owner obtained as a result of alienation. The role of intellectual property as the most important changing factor in the development of an innovative economy is considered. The participation of the state and business in the use of intellectual property and the intensification of innovation is shown. The article discloses modern trends in the development of innovations aimed at a high degree of automation and the use of new technologies for continuous self-replicating economic growth, improving the welfare and standard of living of society, and the development of the human person.

Abstract This paper describes the most important problems related to the management of intellectual property in startups. Startups have become an inseparable element of the innovative economy. Many of these companies base their development on intellectual capital and innovations. In this context, it is extremely important to legally secure the innovations and protect intellectual property. These activities can often be the decisive factor in the development of startups. This article aims to identify, analyse and evaluate the most important issues related to the management of intellectual property in startups. The first part of this paper presents the performed literature review, which mainly concerns the definition of innovation, the state of entrepreneurship in Poland, and the definition of a startup. The second part of the article deals with the main problems related to the management of intellectual property in startups. It is divided into three issues: underestimating the importance of intellectual property, the lack of intellectual property management strategies in startups and financial challenges of startups. The main results of the research indicate that many startups still have low awareness of what is intellectual property and what can be the consequence of using exclusive rights of others. The protection of intellectual property should become one of the elements of business strategies. However, startups find that the creation of the strategy and its implementation is rather expensive.

Relevance. In the modern interpretation, intellectual property has an interdisciplinary nature, being a legal and economic category, which determines the complexity of training personnel in the field of intellectual property as one of the key elements in building an innovative economy. Great importance is attached to the solution of this problem in the implementation of the State Program of Innovative Development of the Republic of Belarus and the Strategy of the Republic of Belarus in the field of intellectual property. Methodology: the research is based on general scientific methods of complex and systematic analysis, including the methodology of comparative analysis of international and national experience in the field under study. Results. In a historical aspect, the article describes the experience of the Republic of Belarus in training personnel in the field of intellectual property, identified the main problems at the present stage and proposed a set of measures to solve them. Particular attention is paid to the development and teaching experience of the discipline «Fundamentals of Intellectual Property Management», which was introduced as a mandatory state component in the studying programs of higher educational institutions. Discussion. The study considered content of training programs for training students of the first and second levels of education, retraining on the basis of higher education and advanced training of specialists. The authors proposed and substantiated an approach to the organization of education in the field of intellectual property for economic specialties in the Republic of Belarus. The article concluded that the implementation of a set of proposed measures for the development of a system for training specialists in the field of intellectual property management will make it possible to train personnel for an innovative economy, digital transformation and solve social and economic problems facing the country.

The sources and amount of financing of internal expenses for carrying out scientific researches and developments are determined. It has been established that mainly scientific research is financed from the state budget, sources of foreign sources rank second, and the third place is occupied by the funds of organizations of the entrepreneurial sector. It was proved that the enterprises and organizations working in the sphere of education and science showed the greatest activity in the sphere of protection of intellectual property objects among the national applicants. Analysis of the innovation activity of the National Academy of Agrarian Sciences of Ukraine was carried out and it was defined that the general tendency of received security documents for the objects of intellectual property for 2015-2017 is negative. It was established that according to the report of the World Economic Forum on Global Competitiveness, "The Global Competitiveness Report 2016-2017," Ukraine ranked 85th among the 138 surveyed countries. It was determined that Ukraine's highest rating is based on the indicator "Higher, secondary and vocational education" – the 33d. The share of innovative products in the balance sheets of the countries with developed innovation environment, such as the EU, USA, Japan, is 23,14 and 13,8% respectively was considered. However, the share of innovation in the balance of Ukrainian enterprises is only 2%. It has been established that the new era of the innovative economy necessitates the institutional correction of accounting by recognizing new intellectual assets, adopting sectoral accounting, assessment and internal audit, and creating specialized structures that will strengthen the role of accounting through the formation of an information field and reduce the uncertainty of economic environment.
