The existence of human rights infractions automatically raises the state's responsibility to resolve based on laws and regulations. The problem in this research is how the settings related to the completion of state responsibility for human rights infractions in the laws and regulations in Indonesia? and how efforts to resolve the human rights infractions committed by the state? The type of approach used is the conceptual approach and the statuteapproach. Article 28 paragraph (4) states that the protection, promotion, enforcement and fulfillment of human rights is the responsibility of the state. Efforts to resolve the human rights violations can be observed through the provisions of Article 11 through Article 27 of the Law No. 26 Year 2000 on Human Rights Court. Adanya pelanggaran hak asasi manusia secara otomatis memunculkan tanggung jawab negara untuk melakukan upaya penyelesaian sesuai peraturan perundangan-undangan.Permasalahan dalam penelitian ini adalah bagaimanakah pengaturan tanggung jawab negara terkait penyelesaian pelanggaran hak asasi manusia dalam peraturan perundang-undangan di Indonesia?serta bagaimanakah upaya penyelesaian pelanggaran hak asasi manusia yang dilakukan oleh negara? Jenis pendekatan yang digunakan adalah pendekatan konseptual dan pendekatan perudang-undangan.Pasal 28I ayat (4) menyebutkan perlindungan, pemajuan, penegakan, dan pemenuhan hak asasi manusia merupakan tanggung jawab negara, sehingga dibentuk Undang-Undang No. 26 Tahun 2000 tentang Pengadilan Hak Asasi Manusia yang mengatur upaya penyelesaian pelanggaran hak asasi manusia melalui ketentuan Pasal 11 sampai dengan Pasal 27.

AbstractExtraordinary crime requires a special step in its disclosure. Wiretapping is one of the efforts to gather evidence to uncover the crime. But in the RKUHP, wiretapping will also be applied to general criminal offenses. This places the law enforcers have access to personal interests in the name of the law. So vulnerable to human rights violations. Therefore it is important to conduct a study of the urgency of wiretapping in criminal acts. The research method used is normative juridical and the method used is the statutory and conceptual approach. The results of this study indicate that there is an urgency to conduct wiretapping arrangements on specific criminal acts and not on general crime This urgency arises based on the characteristics of the crime. The author's suggestion is that wiretapping of general criminal acts in the criminal procedure code should be abolished, and the state drafted a law on tapping that specifically regulates material and formal law.Keywords: criminal acts; urgency of wiretappingAbstrakKejahatan luar biasa membutuhkan langkah khusus dalam pengungkapannya. Penyadapan adalah salah satu upaya untuk mengumpulkan bukti untuk mengungkap kejahatan. Namun dalam RKUHP, penyadapan juga akan diterapkan pada pelanggaran pidana umum. Ini menempatkan penegak hukum memiliki akses ke kepentingan pribadi atas nama hukum. Sangat rentan terhadap pelanggaran HAM. Oleh karena itu penting untuk melakukan studi tentang urgensi penyadapan dalam tindak pidana. Metode penelitian yang digunakan adalah yuridis normatif dan metode yang digunakan adalah pendekatan hukum dan konseptual. Hasil penelitian ini menunjukkan bahwa ada urgensi untuk melakukan pengaturan penyadapan pada tindakan kriminal tertentu dan bukan pada kejahatan umum. Urgensi ini timbul berdasarkan pada karakteristik kejahatan. Saran penulis adalah bahwa penyadapan tindakan kriminal umum dalam kode prosedur pidana harus dihapuskan, dan negara membuat undang-undang tentang penyadapan yang secara spesifik mengatur materi dan hukum formal.Kata kunci: tindak pidana; urgensi penyadapan

<p>Undang-Undang Nomor 17 Tahun 2014 tentang Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, Dan Dewan Perwakilan Rakyat Daerah (UU MD3) pasca putusan Mahkamah Konstitusi (MK) dinilai memiliki problem substantif/materil akibat materi muatannya bertentangan dengan Undang-Undang Negara Republik Indonesia Tahun 1945 (UUD NRI 1945), yang mengakibatkan kerugian konstitusional terhadap Dewan Perwakilan Daerah (DPD), meliputi dikuranginya kewenangan DPD untuk dapat mengajukan (Rancangan Undang-Undang) RUU, dikuranginya kewenangan DPD untuk membahas RUU dan dikuranginya kewenangan DPD dalam kedudukannya sebagai lembaga perwakilan daerah. Hal ini menunjukan bahwa pembentukan UU MD3 nyata-nyata tidak menghormati putusan MK yang diberi mandat UUD NRI 1945 sebagai lembaga penafsir dan penjaga konstitusi, dengan tidak menghormati, mematuhi, dan melaksanakan putusan MK ini menunjukkan ketidakpatuhan terhadap putusan lembaga negara yang telah ditunjuk konstitusi untuk mengawal kemurnian pelaksanaan konstitusi. Penelitian ini menggunakan metode normatif menggunakan pendekatan perundang-undangan ( statute approach ), pendekatan konsep ( conceptual approach ), dan pendekatan historis ( historical approach ). Ketidaktaatan penyusunan UU MD3 pada putusan MK merupakan pengingkaran UUD NRI 1945 dan perkembangan ini merupakan langkah mundur reformasi. Pembentuk Undang-Undang, dalam hal ini, Dewan Perwakilan Rakyat (DPR) dan Presiden harus segera melakukan perubahan UU Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan dengan berpijak pada rambu-rambu konstitusional Putusan MK Nomor 92/PUU-X/2012.</p><p>Law Number 17 Year 2014 on the People’s Consultative Assembly, House of Representatives, Regional Representatives Council, and the Regional House of Representatives (MD3 Law) after the decision of the Constitutional Court (MK) is considered to have a substantive problem due to the substance that is contrary to the 1945 Constitution of the Republic of Indonesia (the 1945 Constitution), which resulted in the constitutional loss of Regional Representatives Council (DPD), including the reduction of DPD authority to propose draft bills, to discuss draft bills and the reduction in its authority as the regional representative institution. This shows that the drafting of MD3 Law is obviously not respecting the decision of the Court that is mandated by the 1945 Constitution as the interpreter and guardian institution of the constitutional, by not respecting, obeying and implementing MK’s decision which indicates non-compliance with the decision of the state institution that has been designated to guard the purity of the constitution implementation of the constitution. This study uses normative method with statute approach, conceptual approach and a historical approach. The noncompliance of the drafting of MD3 Law towards the MK’s decision is a denial of MK and this development is a step back of Reformation. The legislators, in this case, the House of Representatives (DPR) and the President should immediately amend the Law Number 12 Year 2011 on the Establishment of Laws and Regulations based on the MK’s Decision No. 92/PUU-X/2012. </p>

The purpose of this study is to explain in depth how the responsibility of the state c.q Government of Indonesia against violations of the principle of freedom of religion in the case of Sampang, Madura. The method of approach used in this research is normative juridical in discussing the issue of implementation of protection and guarantee to freedom of religionand belief which is regulated in constitution and Indonesian legislation system and how state responsibility to religious conflict happened in Sampang, Madura, Jawa East. The results of the research conducted in the case of Sampang are, the security forces do not act or do omission(omission) in the event of riots. In addition, the government’s attitude that provoked provocation was shown by the MUI who issued a decree stating that the Shia taught by Tajul Muluk is heretical. The State should (in this case the Police) take precautions. Therefore, the State c.q The Government of Indonesia is obliged to provide compensation, restitution and rehabilitation to victims of human rights violations as well as to give legal assertiveness to all perpetrators of riots including government officials who allow the riots of human rights violations

Human Rights and the State could not be separated from one another. Both are interconnected in terms of how to ensure internal stability in a country. With the existence of human rights, it is hoped that state is not arbitrary to treat its people and is obliged to protect everyone in its territory including in this case Stateless persons mentioned in Article 7 paragraph 1 of the Convention relating Status of Stateless Persons in 1954. This study aims to analyze the obligations the State must take in relation to the protection of persons with stateless persons status, and to recognize the legal consequences and responsibilities of States in the event of omitting acts of human rights violations against people with stateless persons status. This paper using normative research methods with statute approach and conceptual approach. The study shows that in relation to the obligation of the state that each State shall be obliged to provide protection to persons with stateless persons status as stipulated in the 1954 Convention and the provisions of the International Human Rights Law, the obligations of state protection include the protection of the right to life, the right to employment and even the right to obtain citizenship status. The international legal consequences accepted by the state are listed in Article 39, Article 41, and 42 of the UN Charter. Then for state responsibility are listed under Article 35, Article 36, and Article 37 of UNGA 56/83 of 2001.   Hak Asasi Manusia dan Negara tidak bisa dipisahkan satu sama lain. Keduanya saling terkait dalam hal bagaimana menjamin stabilitas internal di suatu negara. Dengan adanya hak asasi manusia, diharapkan negara tidak sewenang-wenang memperlakukan rakyatnya dan berkewajiban melindungi semua orang di wilayahnya termasuk dalam hal ini para warga negara yang disebutkan dalam Pasal 7 ayat 1 Konvensi terkait Status Orang Tanpa Negara di tahun 1954. Tulisan ini bertujuan untuk menganalisis kewajiban yang harus diambil Negara sehubungan dengan perlindungan orang-orang dengan status orang tanpa kewarganegaraan, dan untuk mengakui konsekuensi hukum serta tanggung jawab negara dalam hal melakukan  tindakan pelanggaran hak asasi manusia terhadap orang-orang dengan status  tanpa kewarganegaraan. Tulisan ini menggunakan metode penelitian normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil studi menunjukkan bahwa sehubungan dengan kewajiban negara bahwa setiap Negara wajib memberikan perlindungan kepada orang-orang dengan status orang tanpa kewarganegaraan sebagaimana diatur dalam Konvensi 1954 dan ketentuan-ketentuan Hukum Hak Asasi Manusia Internasional, kewajiban perlindungan negara termasuk perlindungan hak untuk hidup, hak untuk bekerja dan bahkan hak untuk mendapatkan status kewarganegaraan. Konsekuensi hukum internasional yang diterima oleh negara tercantum dalam Pasal 39, Pasal 41, dan 42 Piagam PBB. Kemudian untuk tanggung jawab negara tercantum di bawah Pasal 35, Pasal 36, dan Pasal 37 UNGA 56/83 tahun 2001.

Protection of human rights is a responsibility that must be carried out by the state, in this case the state must also resolve cases of human rights violations that have occurred. There are many cases of human rights violations that occurred in the past but cannot be resolved because there are no legal rules that govern at that time. The presence of Law Number 26 of 2000 concerning the court of human rightss is certainly a way for the government to resolve the problem of gross human rights violations in the past. The principle of retroactivity was included in Law Number 26 of 2000 concerning the court of human rightss so that gross violations of human rights that occurred in the past could be resolved. The retroactive principle in Law Number 26 of 2000 concerning the court of human rightss is considered to violate existing regulations in Indonesia, especially it is considered contrary to the 1945 Constitution. -Law Number 26 of 2000 concerning the court of human rightss. This research uses normative research methods. The data used are secondary data in the form of primary legal materials, secondary legal materials, and tertiary legal materials. The results of this study indicate that the application of the retroactive principle in Law Number 26 of 2000 concerning the court of human rightss does not contain elements that are absolutely contradictory to the Law. 1945 foundation.

On 24 February 2011, the Inter-American Court of Human Rights (IACtHR) issued its decision in Gelman v. Uruguay, condemning Uruguay for the forced disappearance of María Claudia García Iruretagoyena de Gelman and the kidnapping of her daughter Macarena Gelman during the military dictatorship. In the decision, the Court ordered Uruguay to remove all obstacles that enabled those responsible for the crimes to go unpunished. Accordingly, it declared that Law 15848 on the Expiry of Punitive Claims of the State (“Expiry Law”), a 1986 amnesty law that prevented the prosecution of people who had committed serious human rights violations during the military dictatorship, was incompatible with the American Convention on Human Rights and the Inter-American Convention on Forced Disappearance of Persons, and therefore lacked legal effect. That the law had been passed democratically and subsequently reaffirmed two times by popular referendums did not change the Court’s evaluation or impede the Court from annulling it.

Corruption is an extra ordinary crime that harms the state, damages the nation's economy and hinders national development. Therefore, it is necessary to take extraordinary action in its eradication without having to consider human rights and customs that exist in society. One of the most important elements in eradicating corruption lies in the system of laws and regulations of a country, because in our country it is known that no act can be punished unless the law regulates it, so the urgency of issuing a Goverment Regulation il lieu of Law is very necessary to perfect the law. - the invitations that have been there. This research tries to analyze the substance in law Number 31 of 199 concerning the Eradication of Corruption Crime, in conjunction with Law 20 of 2001, Law Number 30 of 2002 in conjunction with law Number 19 of 2019 concerning the Corruption Eradication Commission by analyzing The phenomenon of corruption is increasing day by day, especially in terms of the mode and method of the perpetrators of hiding the results of the corruption. This study uses qualitative normative research with a statutory approach. The results of this study raise the substance that exists in Law Number 30 of 2002 in conjunction with Law Number 19 of 2019 concerning the Corruption Eradication Commission which needs to be refined or revised by issuing a new law that does not only rely on the actions that have been carried out by law enforcement but also preventive measures in a systematic way.

The subject of this article is the problems of the nature, essence and purpose of prosecutorial activity. The purpose of the article is to study and justify the role of the human rights function in prosecutorial activities in the concept of a modern legal state. At the heart of prosecutorial activity is the implementation of the main function of the Prosecutor’s office – its rights and freedoms, their protection. This means that any type (branch) of Prosecutor's supervision is permeated with human rights content in relation to a citizen, society, or the state. This is confirmed by the fact that the Federal law “On the Prosecutor's office of the Russian Federation” establishes an independent type of Prosecutor's supervision-supervision over the observance of human and civil rights and freedoms. It is argued that the legislation enshrines the human rights activities of the Prosecutor's office as its most important function. It is proposed to add this to the Law “On the Prosecutor's office of the Russian Federation”.
