Protection of human rights is a responsibility that must be carried out by the state, in this case the state must also resolve cases of human rights violations that have occurred. There are many cases of human rights violations that occurred in the past but cannot be resolved because there are no legal rules that govern at that time. The presence of Law Number 26 of 2000 concerning the court of human rightss is certainly a way for the government to resolve the problem of gross human rights violations in the past. The principle of retroactivity was included in Law Number 26 of 2000 concerning the court of human rightss so that gross violations of human rights that occurred in the past could be resolved. The retroactive principle in Law Number 26 of 2000 concerning the court of human rightss is considered to violate existing regulations in Indonesia, especially it is considered contrary to the 1945 Constitution. -Law Number 26 of 2000 concerning the court of human rightss. This research uses normative research methods. The data used are secondary data in the form of primary legal materials, secondary legal materials, and tertiary legal materials. The results of this study indicate that the application of the retroactive principle in Law Number 26 of 2000 concerning the court of human rightss does not contain elements that are absolutely contradictory to the Law. 1945 foundation.

AbstractExtraordinary crime requires a special step in its disclosure. Wiretapping is one of the efforts to gather evidence to uncover the crime. But in the RKUHP, wiretapping will also be applied to general criminal offenses. This places the law enforcers have access to personal interests in the name of the law. So vulnerable to human rights violations. Therefore it is important to conduct a study of the urgency of wiretapping in criminal acts. The research method used is normative juridical and the method used is the statutory and conceptual approach. The results of this study indicate that there is an urgency to conduct wiretapping arrangements on specific criminal acts and not on general crime This urgency arises based on the characteristics of the crime. The author's suggestion is that wiretapping of general criminal acts in the criminal procedure code should be abolished, and the state drafted a law on tapping that specifically regulates material and formal law.Keywords: criminal acts; urgency of wiretappingAbstrakKejahatan luar biasa membutuhkan langkah khusus dalam pengungkapannya. Oleh karena itu penting untuk melakukan studi tentang urgensi penyadapan dalam tindak pidana. Metode penelitian yang digunakan adalah yuridis normatif dan metode yang digunakan adalah pendekatan hukum dan konseptual. Hasil penelitian ini menunjukkan bahwa ada urgensi untuk melakukan pengaturan penyadapan pada tindakan kriminal tertentu dan bukan pada kejahatan umum. Urgensi ini timbul berdasarkan pada karakteristik kejahatan. Saran penulis adalah bahwa penyadapan tindakan kriminal umum dalam kode prosedur pidana harus dihapuskan, dan negara membuat undang-undang tentang penyadapan yang secara spesifik mengatur materi dan hukum formal.Kata kunci: tindak pidana; urgensi penyadapan

The existence of human rights infractions automatically raises the state's responsibility to resolve based on laws and regulations. The problem in this research is how the settings related to the completion of state responsibility for human rights infractions in the laws and regulations in Indonesia? and how efforts to resolve the human rights infractions committed by the state? The type of approach used is the conceptual approach and the statuteapproach. Article 28 paragraph (4) states that the protection, promotion, enforcement and fulfillment of human rights is the responsibility of the state. Jenis pendekatan yang digunakan adalah pendekatan konseptual dan pendekatan perudang-undangan.Pasal 28I ayat (4) menyebutkan perlindungan, pemajuan, penegakan, dan pemenuhan hak asasi manusia merupakan tanggung jawab negara, sehingga dibentuk Undang-Undang No. 26 Tahun 2000 tentang Pengadilan Hak Asasi Manusia yang mengatur upaya penyelesaian pelanggaran hak asasi manusia melalui ketentuan Pasal 11 sampai dengan Pasal 27.

This paper aimed to identify and analyze the resolution of past gross human rights violations in Indonesia through a restorative justice approach. The type of research used is normative legal research, using a juridical approach, the type of data used is secondary data consisting of primary legal materials, secondary legal materials, tertiary legal materials, data analysis used is qualitative analysis. Based on the results of the research, it is concluded that so far the Attorney General has not been proactive in looking for various legal facts that can support the evidence previously presented by Komnas HAM. The Attorney General in cases of gross human rights violations tends to be passive, even though the law instructs him to carry out an investigation as soon as possible after he receives a file from Komnas HAM. So far, Komnas HAM has completed the investigation results files and submitted them to the Attorney General to be followed up in the investigation process. However, the current problem is that the Attorney General's authority in conducting investigations has never been optimal, because it is influenced by various factors, the role of legal instruments; laws and regulations with human resources capacity as well as supporting facilities and facilities, unable to resolve past cases of gross human rights violations, the restorative justice approach is a paradigm that can be used as a framework for resolving cases of past gross human rights violations that aim to address dissatisfaction with the operation of the current human rights justice system.

The effectiveness of human rights adjudicative procedures partly, if not most importantly, hinges upon the adequacy of the remedies they grant and the implementation of those remedies. This assertion also holds water with regard to the international and regional monitoring bodies established to receive individual complaints related to economic, social and cultural rights (hereinafter ‘ESC rights’ or ‘socio-economic rights’). Remedies can serve two major functions: they are meant, first, to rectify the pecuniary and non-pecuniary damage sustained by the particular victim, and second, to resolve systematic problems existing in the state machinery in order to ensure the non-repetition of the act. Hence, the role of remedies is not confined to correcting the past but also shaping the future by providing reforming measures a state has to undertake. The adequacy of remedies awarded by international and regional human rights bodies is also assessed based on these two benchmarks. The present article examines these issues in relation to individual complaint procedures that deal with the violation of ESC rights, with particular reference to the case laws of the three jurisdictions selected for this work, i.e. the United Nations, Inter-American and African Human Rights Systems.

The subject of this article is the problems of the nature, essence and purpose of prosecutorial activity. The purpose of the article is to study and justify the role of the human rights function in prosecutorial activities in the concept of a modern legal state. At the heart of prosecutorial activity is the implementation of the main function of the Prosecutor’s office – its rights and freedoms, their protection. This means that any type (branch) of Prosecutor's supervision is permeated with human rights content in relation to a citizen, society, or the state. This is confirmed by the fact that the Federal law “On the Prosecutor's office of the Russian Federation” establishes an independent type of Prosecutor's supervision-supervision over the observance of human and civil rights and freedoms. It is argued that the legislation enshrines the human rights activities of the Prosecutor's office as its most important function. It is proposed to add this to the Law “On the Prosecutor's office of the Russian Federation”.

Objective: This paper highlights the significant mental health vulnerabilities of people who have sought asylum in Australia and their additional adversities as a result of the Covid-19 pandemic. Conclusions: Australia’s policies in relation to asylum seekers result in multiple human rights violations and add significantly to mental health vulnerabilities. Despite a majority being identified as refugees, people spend years in personal and administrative limbo and are denied resettlement in Australia. Social isolation and other restrictions associated with Covid-19 and recent reductions in welfare and housing support compound their difficulties. The clinical challenges in working with people impacted by these circumstances and the role of psychiatrists and the RANZCP in advocacy are identified.

The task of this paper is to study the role of international human rights organizations in response to the conflict taking place in eastern Ukraine. The study is based on recent reports from the Office of the UN High Commissioner for Human Rights and the OSCE on Ukraine. The relevance of the stated topic is determined by the situation with human rights violations in the armed conflict in Ukraine and the significant role of international human rights organizations, making active efforts to resolve it. The purpose of this study is to determine the main aspects of the role that international organizations play in resolving this range of issues. This will help to identify potential opportunities to tackle the problem with human rights violations in the Ukrainian territories. The study combines quantitative and qualitative research of the entire spectrum of issues brought into the subject. The main results obtained are: analysis of the role and place of international human rights organizations in assessing the situation with the conflict in the Ukrainian territories and obtaining statistical information on the current status of human rights violations in these territories. The value of this paper lies in obtaining practical recommendations for finding ways to peacefully resolve the conflict in the East of Ukraine and implementing comprehensive measures to create conditions for the protection of human rights in this region

Departing from the increasingly widespread problem of People Smuggling, both in the form of organized and unorganized crime networks, both inter-state and domestic as a whole is a threat to the norms of life based on human rights. In this case the role of the immigration officer as the gatekeeper in the country's traffic in the case of people entering / leaving Indonesian territory, as in 2015, the People Smuggling case was successfully revealed by the Immigration Officer within the Soekarno-Hatta Airport Airport I, where immigration officers found three people women wearing fake passports who were about to leave for Kuala Lumpur with perpetrators Laila Yunita and Jamal Al Khatib. This writing aims to analyze the causes and effects of human smuggling, as well as examine the serious efforts made by PPNS in eradicating People Smuggling, especially in the case of People Smuggling committed by Laila Yunita and Jamal Al Khatib. The research uses a statutory approach, a conceptual approach and a case approach. So that with the case, it will be understood how important the value of legal human resources is in the scope of immigration in the context of national law development, as a breakthrough in competency development strategies

In accordance with the Decree of the Minister of Justice and Human Rights Number M-05 HT.01.01 of 2002 concerning the Enforcement of the Legal Entity Administration System at the Directorate General of General Legal Administration of the Ministry of Justice and Human Rights of the Republic of Indonesia, determines that all legal entity settlements include the ratification of the deed of establishment PT, application for approval and submission of deed reports, amendments to articles of association, fiduciary registration, will registration, are carried out with the online Legal Entity Administration System. So the notary has the authority to register all these legal acts online. The purpose of this research is to find out the role of the Notary in registering deeds and legalization of legal entities through the Directorate General of AHU Online services and to find out the responsibilities of the Notary if there are problems in registering deeds and legal entity approval through the services of the Directorate General of AHU Online. This study uses a normative juridical research method using a statutory approach and a conceptual approach. The results of the research, namely, the role of the notary in registering deeds and ratifying legal entities is entering deed data, checking all deed data to avoid data entry errors and the notary has the responsibility if there is an error from the notary's office, the notary will make corrections at a cost of Notary, however in this regard there is still cooperation from the applicant regarding the required data.
