O Pacto Internacional sobre Direitos Civis e Políticos e a Convenção Americana sobre Direitos Humanos, ambos tratados internacionais aos quais o Brasil aderiu, garantem à pessoa presa o direito de ser levada, sem demora, à autoridade judicial competente. Para garantir tal direito, surge o instituto da audiência de custódia, que teve início com a parceria entre o CNJ, o Ministério da Justiça e o Tribunal de Justiça do Estado de São Paulo. A discussão sobre a sua aplicação pauta-se pela falta de estrutura e de legislação, sendo esses os motivos que levam à resistência de parte das Instituições. Por outro lado, com os resultados satisfatórios nas capitais, o CNJ, através da resolução 213, determinou aos Tribunais a implantação da audiência de custódia em todas as comarcas. O objetivo do presente trabalho é estudar a audiência de custódia, conceituando-a e apresentando os resultados, vantagens e críticas envolvidas, tendo como metodologia a revisão bibliográfica da doutrina, das jurisprudências e artigos, sendo assim, foi utilizado o método dedutivo. De forma geral, conclui-se pela necessidade da implantação da audiência de custódia em todo o país, devendo o Poder Judiciário e Executivo estabelecerem formas alternativas para o seu cumprimento, de forma que o direito do preso não seja prejudicado.   CUSTODY HEARING AND THE CRIMINAL PROSECUTION IMPLEMENTATION ABSTRACT The International Covenant on Economic, Social and Cultural Rights, both international treaties in which Brazil joined, guarantee people who are arrested the right to be taken, without delay, to the competent judicial authority. The custody hearing arises in order to ensure such right, it has immerged from the association of CNJ Ministry of Justice, and the State of Supreme Court of São Paulo. By one hand discussion around its applicability is guided by the lack of structure and legislation, being those the reasons that convey opposition by Institutions. By the other hand, satisfactory results in Capitals, the CNJ, through the resolution 213, has determined to Courts the implementation of the custody hearing in all counties. This study is aimed at looking at custody hearing, describing and proving data results as well as advantages, and reviews regarded to it, the methodology used was the bibliographic review of the doctrine found at judgments and articles, therefore, the deductive method was used.  In general, we conclude that the implementation of hearing custody must be taken into account, Judiciary and Executive Branches might provide alternative ways to its compliance, in order to preserve the inmate’s rights. Right to education is one of the most important human rights and has been widely so acknowledged in several international and regional documents related to human rights. These documents have defined the right in an elaborate manner placing a lot of emphasis on compulsory elementary education and thereby making it obligatory on the states to provide the same and also guarantee equality of accessibility of education at higher levels. The European Convention on Human Rights 1950 has guaranteed the right to education in Article 2 of Protocol 1.Unlike the International Covenant on the Economic, Social and Cultural Rights 1966 or the other regional documents, the European Convention on Human Rights 1950 has not defined the right to education in an elaborate manner, in the document. Thus, the burden of making the right to education more resourceful fell largely upon the shoulders of the enforcement mechanism, they being European Court and European Commission of Human Rights, both constituted by the Convention. This article makes an analysis of the right to education as interpreted by these two authorities.

This book is an ethnographic study of controversial sounds and noise control debates in Latin America’s most populous city. It discusses the politics of collective living by following several threads linking sound-making practices to governance issues. Rather than discussing sound within a self-enclosed “cultural” field, I examine it as a point of entry for analyzing the state. At the same time, rather than portraying the state as a self-enclosed “apparatus” with seemingly inexhaustible homogeneous power, I describe it as a collection of unstable (and often contradictory) sectors, personnel, strategies, discourses, documents, and agencies. My goal is to approach sound as an analytical category that allows us to access citizenship issues. As I show, environmental noise in São Paulo has been entangled in a wide range of debates, including public health, religious intolerance, crime control, urban planning, cultural rights, and economic growth. The book’s guiding question can be summarized as follows: how do sounds enter and leave the sphere of state control? I answer this question by examining a multifaceted process I define as “sound-politics.” The term refers to sounds as objects that are susceptible to state intervention through specific regulatory, disciplinary, and punishment mechanisms. Both “sound” and “politics” in “sound-politics” are nouns, with the hyphen serving as a bridge that expresses the instability that each concept inserts into the other.

The present study provides a rickettsial serosurvey in 25 dogs and 35 humans in an endemic area for Brazilian spotted fever in the State of São Paulo, where the tick Amblyomma aureolatum is the main vector. Testing canine and human sera by indirect immunofluorescence against four Rickettsia antigens (R. rickettsii, R. parkeri, R. felis and R. bellii) showed that 16 (64%) of canine sera and 1 (2.8%) of human sera reacted to at least one of these rickettsial antigens with titers <FONT FACE=Symbol>³</FONT> 64. Seven canine sera and the single reactive human serum showed titers to R. rickettsii at least four times those of any of the other three antigens. The antibody titers in these 7 animals and 1 human were attributed to stimulation by R. rickettsii infection. No positive canine or human serum was attributed to stimulation by R. parkeri, R. felis, or R. bellii. Our serological results showed that dogs are important sentinels for the presence of R. rickettsii in areas where the tick A. aureolatum is the main vector of Brazilian spotted fever.

Legal privilege and professional secrecy of attorneys relate to the right to a fair trial (Article 6 European Convention on Human Rights (ECHR)) as well as to the right to respect for private and family life (Article 8 ECHR). The reason for protecting the lawyer via fundamental rights is the protection of fundamental rights of the lawyer’s clients. All legal orders apply legal privileges and professional secrecy; however, the contents of such are not identical. Traditionally there is an important difference between common and civil law. The professional secrecy of an attorney in civil law jurisdictions is his right and at the same time his obligation based on his membership of the Bar (that is his legal profession). In common law legal privilege comprises the contents of documents issued by an attorney to the client. Professional secrecy of attorneys in civil law jurisdictions applies solely to independent lawyers; in-house lawyers are usually not allowed to benefit from rules on professional secrecy (exceptions in the Netherlands and Belgium). On the other hand, common law jurisdictions apply legal professional privilege, recognized also to in-house lawyers. Slovenian law follows the traditional civil law concept of professional secrecy and sets a limited privilege to in-house lawyers. The article then discusses Slovenian law of civil procedure and compares the position of professional secrecy in lawsuits before State’s courts and in arbitration.

This case comment analyses a decision by the São Paulo Court of Appeal in a case concerning whether the use of the image of a football player in a videogame, without the athlete's permission, constituted a violation of his image rights. The Court of Appeal found that the use of the image of a public person, without their consent, in a commercial activity with no relevant public interest to be protected, harms a fundamental personality right and generates the right to compensate for damages.

This paper discusses the normative framework of regulating the right to protection of personal data relating to biomedical treatment procedures of patients as human rights. The subjects of analysis are the European Convention, the Convention on Human Rights and Biomedicine and the relevant provisions of the Constitution of the Republic of Serbia. The right to protection of personal data in the field of biomedicine is analyzed comparatively in terms of the content of this right and in terms of basis for limiting this right. The analysis is carried out to find answers to the question if the constitutional framework is consistent in terms of exercising this right, taking into account the constitutional provision on the direct application of human rights guaranteed by international treaties and other provisions that determine the status of international sources of law in our legal system.

This article analyzes the pedagogical ideas of legal education in Brazil, in a historical and political perspective, seeking to question how positivist thought has exerted and still exerts influence in the formation of Law professionals, since, at present, the egress profile has was shown with the characteristics of a technical professional, who was often incapable of exercising a reflection of his own practice. Conceived in the nineteenth century, the positivist school, whose precursor was the philosopher Augusto Comte, maintained that only the laws established by science should be accepted. In the juridical field, positivism was elaborated in detail by the Austrian jurist and philosopher Hans Kelsen in his work "Pure Theory of Law", which corroborated the influence of philosophical positivism in the legal field, by maintaining that only the law is able to fully realize the Right. For the rigid thought, the norm is sufficient, being the main source of the Law, prevailing over all the others. The methodology used in the research was of a qualitative nature, developed from a bibliographic analysis of the philosophical legal concepts that compose the formation of this professional. A documentary investigation was also made in the curricular guidelines pointed out by the Ministry of Education and Culture (MEC). The final results of this research identified that legal positivism continues to influence the formation of the bachelor of Law. However, it is not the only factor that forges the current legal professional.ResumoO presente artigo analisa as ideias pedagógicas do ensino jurídico no Brasil, numa perspectiva histórica e política, buscando questionar como o pensamento positivista exerceu e ainda exerce influência na formação dos profissionais do Direito, uma vez que, atualmente, o perfil do egresso tem se mostrado com características de um profissional técnico, entretanto incapaz muitas vezes de exercer uma reflexão de sua própria prática. Concebida no século XIX, a escola positivista, que teve como precursor o filósofo Augusto Comte, sustentava que apenas as leis estabelecidas pela ciência deveriam ser aceitas. No campo jurídico, o positivismo foi detalhadamente trabalhado pelo jurista e filósofo austríaco Hans Kelsen em sua obra “A Teoria Pura do Direito”, que corroborou a influência do positivismo filosófico no campo jurídico, ao sustentar que apenas a lei é capaz de realizar plenamente o Direito. Para o rígido pensamento, a norma se basta, sendo a principal fonte do Direito, prevalecendo sobre todas as demais. A metodologia empregada na pesquisa foi de natureza qualitativa, desenvolvida a partir de uma análise bibliográfica dos conceitos filosóficos jurídicos que compõem a formação deste profissional. Também foi feita uma investigação documental nas diretrizes curriculares apontadas pelo Ministério da Educação e Cultura (MEC). Os resultados finais desta pesquisa identificaram que o positivismo jurídico continua influenciando a formação do bacharel do Direito.
