Response to Leaf et al., 2021

In this commentary, we respond to a recent article published by Leaf and colleagues (2021), entitled “Concerns About ABA-Based Intervention: An Evaluation and Recommendations”. In their article, the authors attempt to address concerns raised by autistic people about ABA-based interventions. We argue that they only superficially engage with these important issues, and fall short of supporting neurodiversity, despite their intention to do so. We discuss issues related to biased claims of effectiveness of ABA, the potential for ABA-based interventions to cause harm, the reliance on past human rights abuses to justify current potential for harm, a lack of empirical support related to intervention intensity recommended by ABA provider groups, and the rigidity of procedures used to achieve therapist-determined goals.

In a recent article, Cass Sunstein and Adrian Vermeule argue that capital punishment is morally required if it will deter more killings than it inflicts. They claim that the state's duty is to minimize the incidence of murder, and that recent deterrence research shows that state executions, even if deemed murders themselves, can do so. If these findings are true, they argue, the state is morally obligated to undertake such "life-life tradeoffs." The logic of Sunstein and Vermeule's argument justifies not only state executions, but any state-perpetrated injustice that promises to reduce the incidence of similar injustices overall, as the authors acknowledge in a comment about torture. Recently such lesser evil arguments have indeed been invoked to justify state torture, detention without trial, and other human rights violations. In this essay, I identify problems that are common to all of these arguments, as illustrated by the well-developed example Sunstein and Vermeule have provided. My aim is to demonstrate that, however valid the lesser evil approach may be in some domains, it fails when invoked to defend state violations of the right to life and other fundamental human rights.

Fifty years of Israeli occupation was the focus of reports by the UN Office for the Coordination of Humanitarian Affairs (OCHA) and Oxfam that documented the ongoing human rights abuses in the occupied Palestinian territories. Other notable documents include Israeli NGO Gisha and UNSCO reports on the ten-year Gaza siege, Al Jazeera's interactive timeline of the Nakba, and an exchange of letters between the ACLU and U.S. senators on anti-BDS legislation.

Indigenous African societies have, for a long time, been using their knowledge for the betterment of their lives. They have also demonstrated an ability to manipulate their immediate or remote surroundings to live sustainably. Those who claim to fight for equal and human rights in Africa do so under the misconception that they, and the developing world, have historically and inherently violated, and continue to violate, human rights in numerous ways. While this might not be completely dismissed, there is a plethora of evidence from African folktales to demonstrate that Africans have not only respected human rights, but have also encouraged equal opportunities for every member of their society. This article cross-examines Ndebele folktales with the intention of demonstrating that African indigenous knowledge exhibited through folktales was a well-organised system, which ensured respect for human rights for all members, regardless of their physical or social stature. Central to this discussion are the folktales which focus on the role played by the vulnerable members of the animal community, who replicate their human counterparts. Folktales are unarguably a creation by the indigenes and emanate from their socio-political experiences, as well as their observations of the surroundings. This suggests that indigenous people already had an idea about human rights as well as the need for equal opportunities since time immemorial.

This chapter focuses on the connection between the international legal framework governing the conservation of natural resources and human rights law. The objective is to examine the potential synergies between international environmental law and human rights when it comes to the protection of natural resources. To do so, it concentrates on three main areas of potential convergence. It first focuses on the pollution of natural resources and analyses how human rights law offers a potential platform to seek remedies for the victims of pollution. It next concentrates on the conservation of natural resources, particularly on the interconnection between protected areas, biodiversity, and human rights law. Finally, it examines the relationship between climate change and human rights law, focusing on the role that human rights law can play in the development of the current climate change adaptation and mitigation frameworks.

While demand for international peacebuilding assistance increases around the world, the UN’s Peacebuilding Architecture (PBA) remains a relatively weak player, for many reasons: its original design, uneasy relations between the Peacebuilding Commission and Security Council, turf battles within the UN system, and how UN peacebuilding is funded. This chapter examines the PBA’s operations since 2005, against the evolution of the peacebuilding field, and discusses how the PBA can be a more effective instrument in the UN’s new “sustaining peace” approach. To do so, it would have to become the intergovernmental anchor for that approach, without undermining the intent that “sustaining peace” be a system-wide responsibility, encompassing the entire spectrum of UN activities in peace, security, development, and human rights.

This chapter argues that the philosophical debate around humanitarian intervention would be improved if it were less ‘ideal-theoretic’. It identifies two ideal-theoretic assumptions. One, in target states where humanitarian intervention is being considered, there are two distinct and easily identified groups: ‘bad guys’ committing serious human rights abuses, and innocent civilians against whom the abuses are being committed. Two, external to the target state in question, there are suitably qualified ‘good guys’—prospective interveners who possess both the requisite military power and moral integrity. If the assumptions hold, the prospects for successful humanitarian intervention are much greater. As a contrast, some possible non-ideal assumptions are that (i) there are many bad guys in a civil war, and (ii) the good guy intervener is itself supporting some of the bad guys. If these non-ideal assumptions hold, prospects for successful humanitarian intervention are small.
