<h1>The role of paralegals is needed to handle cases of non-litigation and litigation to fulfill the need for legal aid rights for the poor in facing the law, however, the provision of the role of paralegals in providing litigation legal assistance as stated in article 11 and article 12 Minister of Law and Human Rights of Republic of Indonesia number 1 of 2018 concerning paralegals in the provision of legal assistance based on the Supreme Court decision number 22 P / HUM / 2018 was declared contrary to the higher laws and regulations, namely Law Number 18 of 2003 concerning Advocates and hence not generally accepted. Thus, after the Supreme Court's ruling, paralegals can no longer provide legal litigation aid. Bantuan hukum adalah salah satu upaya mengisi hak asasi manusia (HAM) terutama bagi lapisan masyarakat termiskin rakyat Indonesia. Bantuan hukum harus dimaknai dan dilaksanakan sebagai upaya perjuangan menegakkan HAM bagi si miskin. Tujuan bantuan hukum perlu diperluas, dak saja terbatas pada bantuan hukum individual, tetapi juga struktural dan juga jangan terbelenggu dengan jalur-jalur formal semata. Dengan diundangkan Undang-Undang Nomor 16 Tahun 2011 tentang Bantuan Hukum memunculkan permasalahan bagaimana pengaruh bantuan hukum terhadap masyarakat? Dengan menggunakan metode peneli an norma f dan dengan pendekatan data secara kualita f yang dianalisis deskrip f, didapatkan kesimpulan bahwa keberadaan Undang-Undang Bantuan Hukum belum maksimal memberikan pengaruh terhadap bantuan hukum bagi masyarakat miskin, karena bantuan hukum masih dalam jalur formalis k dan masih bersifat pasif. Pendanaan penyelenggaraan bantuan hukum yang digeser dari Mahkamah Agung, Kejaksaan Agung, dan Kepolisian kepada Menteri Hukum dan HAM dan dilaksanakan oleh Lembaga Bantuan Hukum atau Organisasi Kemasyarakatan agar dapat menyentuh orang atau kelompok orang miskin, tetapi besar anggaran perlu memper mbangkan proses peradilan yang berjalan, karena dikhawa rkan dapat menghambat orang miskin dan kelompok orang miskin untuk mengakses keadilan guna mewujudkan hak-hak kons tusional mereka.<p>Legal aid is an effort to fulfill human rights, especially for Indonesian poorest society. Legal aid should be interpreted and implemented as an effort of human rights enforcement for the poor. The purpose of legal aid should be expanded, not just limited to individual legal assistance, but also structural and not fe ered by mere formal channels. By enacted the Law Number 16 Year 2011 on Legal Aid, raises the ques on of how the in fl uence of legal assistance to the society? By using norma ve research methods and approaches qualita ve data were descrip vely analyzed, was concluded that existence of legal aid has not been maximized e ff ect to legal assistance for the poor, and because of it is s ll on formalis c track and passive. Funding of legal assistance shi ed from the Supreme Court, A orney General and Police to the Ministry of Jus ce and implemented by a Legal Aid Ins tu on or civil society organiza on in order to reach people or the poor community, but the magnitude of budget needs to consider the judicial process, because it feared could hinder the poor to access of jus ce to realize their constuonal rights.</p>

I examine how patent enforcement affects corporate research and development (R&D), exploiting the legal changes induced by the Supreme Court decision eBay v. MercExchange. This ruling increased courts’ flexibility in remedying patent cases and effectively lowered the potential costs of patent litigation for defendants. For identification, I compare innovative activity across firms differentially exposed to patent litigation before the ruling. Across several measures, I find that the decision led to a general increase in innovation. This result confirms that the changes in enforcement induced by the ruling reduced some of the distortions caused by patent litigation. Exploring the channels, I show that patent litigation negatively affects investment because it lowers the returns from R&D and exacerbates its financing constraints. Brand registration is very important for business people. A brand is one of the distinguishing entities between the business activities of business actors. The problem occurs when business actors already have a trademark which is then well known in the community but in fact they have not registered the trademark, as experienced by Ruben Samuel Onsu with his Geprek chicken business. However, in its development, it turns out that there are other business actors using the same mark but have registered the mark. This research was conducted using a normative method through a statutory approach and concepts. This research examines the Supreme Court's decision rejecting the appeal from Ruben Samuel Onsu and analyzes the urgency and procedures for trademark registration. Based on the research results, trademark law in Indonesia is regulated in Law Number 20 of 2016 concerning Trademarks and Geographical Indications. The terms and procedures for application for registration of a mark are regulated in Article 4 - Article 8 and further regulated in the Regulation of the Minister of Law and Human Rights No. registration of a mark and being recognized as the legal owner of the mark and rights to the mark are obtainedafter the mark is registered. Ruben Onsu's Bensu mark was declared invalid because Ruben Onsu was not the first party to register the mark, and the Supreme Court decided to cancel all trademark applications made by Ruben Onsu.

The implementation of legal aid is a manifestation of Indonesia as a legal state that guarantees the human rights of citizens to equality before the law which is guaranteed in the 1945 Constitution. Within the framework of implementing this citizen's human rights, the provision of free legal aid is, among other things, obligated to advocates based on Article 22 Law on advocates and their implementing regulations. From this, two problem formulations were made as follows: What is the juridical review of the provision of pro bono legal aid? And what is the role of advocates in providing pro bono legal aid? This research is based on normative legal research, which is a research conducted by reviewing and analyzing legal materials and legal issues related to the problems studied. The results of the author's discussion found that free legal aid is the right of the poor to obtain the same justice as other communities, so that the protection of their rights is well fulfilled and the principle of equality before the law. Advocates are obliged to provide free legal aid to justice seekers, and to obtain free legal assistance, justice seekers must submit a written application to an advocate organization or legal aid institution.

This study aimed to analyze the reasons the Supreme Court issued a Supreme Court Decision Number 50 P/HUM/2018 which decided the cancellation of the Minister of Law and Human Rights Regulation Number 25 of 2017 and analyze the legal consequences of the decision on new notary candidates. This study used normative juridical with a statutory approach and historical approach. The reasons the Supreme Court issued Supreme Court Decision Number 50 P/HUM/2018 were influenced by two factors, i.e., juridical and non-juridical factors. The legal consequences of the Supreme Court Decision Number 50 P/HUM/2018 for new notary candidates was the disappearance of the notary candidate’s obligation to take the notary appointment exam and the emergence of problems related to the clarity of the qualifications that should be completed to register as a notary because the ruling resulted in a legal vacuum related to the terms of the conditions in the appointment of a public notary.

The Supreme Court (MA) decided that candidates for members of the Regional Representative Council (DPD) from political party administrators for the 2019 Election were still allowed, even though previously the Constitutional Court (MK) had banned it (Decision No. This conflict is due to differences in interpreting the timing of the implementation of the ongoing 2019 Election stage process. The Constitutional Court stated that the decision was enforced since the 2019 Election and this was not retroactive. Because it is still at the Provisional Candidate List (DCS) stage, so it is possible to change regulations. Meanwhile, the Supreme Court considers that the Constitutional Court's decision must be enforced after the 2019 Election or apply in the future (prospective), because the stages have been running, so that changes in requirements can be made The legal implication that occurs is that there is legal uncertainty for the General Election Commission (KPU) to follow which decision. To solve this problem can be used the doctrine of validity (enforceability of norms). The existence of a hierarchy of legal products being tested and a basis for testing certainly has a legal consequence of the existence of a hierarchy of norm validity in the decisions of the Supreme Court and the Constitutional Court. When there is a conflict between the Supreme Court decision and the Constitutional Court, the verdict with the basis and object of examination in the hierarchy of laws and regulations that is higher, namely the Constitutional Court decision, has a higher validity than the Supreme Court decision. So that problems like this do not exist anymore, testing of laws and regulations should only be carried out by one institution, namely the Constitutional Court.

Dalam Surat Edaran Mahkamah Agung (SEMA) No. 10 Tahun 2010 mengamanahkan tentang pembentukan Pos Bantuan Hukum (Posbakum) di setiap pengadilan di bawah Mahkamah Agung (MA). Pengadilan Agama (PA) Sleman menjadi salah satu pilot project dalam pembentukan Posbakum, yang dimulai sejak 2011 dan berakhir 2012. Penyelenggaraan Posbakum di PA Sleman dirasakan sangat membantu masyarakat miskin dan bagi mereka yang tidak dapat memahami birokrasi pengadilan dan bagaimana memecahkan persoalan hukum. Namun, keberadaan Posbakum perlu diteli Ɵ mengenai bagaimana penyelenggaraan Posbakum di PA Sleman dan sejauhmana efek Ɵ fi tasnya dalam membantu masyarakat miskin untuk mengakses keadilan? Hasil penelitian menunjukkan bahwa penyelenggaraan Posbakum di PA Sleman selama 2011 hingga 2012 dapat berjalan dengan baik dan efek tif. Data dari DPW APSI DIY dan LSBH UIN Yogyakarta menunjukkan bahwa lebih dari 1000 orang (1.272 orang) yang datang ke Posbakum PA Sleman mendapatkan layanan jasa bantuan hukum yang mereka butuhkan. Penelitian ini merekomendasikan untuk penyediaan anggaran bantuan yang lebih besar yang digunakan Ɵ dak hanya sebatas pemberian advis dan pembuatan berkas gugatan/permohonan saja, tetapi juga pada pendampingan perkara terutama perkara-perkara tertentu yang urgen seperti Kekerasan Dalam Rumah Tangga dan Perlindungan Anak. Selain itu penyelenggaraan bantuan hukum harus ditunjang oleh aturan main yang jelas yang tidak membuka tafsir liar sehingga membuat potensi adanya pemberian bantuan hukum yang salah sasaran.<p>The mandate Seth forth in SEMA No. 10 Year 2010 is establishing legal aid centre (Posbakum) in any court which under the Supreme Court authority. Religious Court (PA) of Sleman becomes one of the pilot projects in the establishment POSBAKUM, which started since Year 2011 and ended in Year 2012. Implementation POSBAKUM in Religious Court Sleman is extremely helpful for poor society and those who could not understand how bureaucracy of court and how to resolve legal issues. Nevertheless, the existence of Posbakum needs to be researched as to how the implementation of Posbakum in PA Sleman and how far its effectiveness in helping the poor to access justice. The result of research showing that implementation of POSBAKUM at religious court Sleman during year 2011-2012 runs properly and effectively. Data from DPW APSI DIY and LSBH UIN Jogjakarta showing that more than 1000 people (1272 people) comes into POSBAKUM Religious court Sleman and obtain legal assistance services which they needed. This research recommends providing a larger aid budgets are used not only limited to giving advice and making the lawsuit/petition but also on mentoring cases, especially in certain ma Ʃ ers such as domestic violence which urgent and child protection. Besides, implementations of legal aid have to support by clear rules that do not open to multi interpretation so that make a potential misdirected for legal assistance.</p>

Tujuan penelitian ini untuk mengetahui bagaimana pengaturan tentang penyelesaian tentang konflik norma antara peraturan menteri terhadap undang-undang dan unruk mengetahui bagaimana sifat putusan mahkamah agung dalam hak uji material. Metode yang digunakan adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konsep. Pengaturan tentang penyelesaian konflik norma antara Peraturan Menteri Terhadap Undang-Undang, metode penyelesaian konflik norma itu dengan digunakannya asas lex superior derogate lex inferior ini, yang digunakan dengan terjadinya konflik norma antara UU Peraturan Perundang-Undangan dengan Permenkumham Nomor 2 Tahun 2019 terkait pengaturan penyelesaian konflik norma antara peraturan menteri dengan Undang-Undang, maka berdasarkan asas tersebut yang digunakan adalah UU Peraturan Perundang-Undangan, sehingga Permenkumham Nomor 2 Tahun 2019 harus dikesampingkan. Maka, Pengaturan mengenai Penyelesaian Konflik Norma Antara Peraturan Menteri Terhadap Undang-Undang, menjadi kewenangan Mahkamah Agung berdasarkan Pasal 9 UU Peraturan Perundang-Undangan. Dan Sifat Putusan Mahkamah Agung dalam Hak Uji Materiil dalam memberikan putusannya yang pada prinsipnya yang memiliki konsekuensi hukum aturan tersebut apabila terbukti secara sah dan meyakinkan bertentangan dengan aturan di atasnya maka aturan tersebut akan menjadi tidak sah serta tidak berlaku, dan menjadi tanggungjawab instansi terkait untuk mencabutnya. The purpose of the study is to find how adjustment of the settlement of norm conflicts between Ministerial Regulations toward the Constitution and to find out how the nature of the Supreme Court decision in the right of judicial review. The method used was normative legal research method with the legislation approach and concept approach. Adjustment on resolving norms of conflict between Ministerial Regulations toward the Constitution, the method of resolving norms conflicts by using the principle of lex superior derogate lex inferior, which was used in the norm conflicts between the Constitution on Laws and Regulations with Minister of Law and Human Rights Regulation Number 2 of 2019 in relation to conflict resolution arrangements the norm between Ministerial Regulations and the Constitution, then based on the principle used was the Constitution on Laws and Regulations, so Minister of Law and Human Rights Regulation Number 2 of 2019 must be set aside. Thus, the adjustment on resolving norms of conflict between Ministerial Regulations toward the Constitution became authority of the Supreme Court based on Article 9 of the Constitution on Laws and Regulations. And the nature of the Supreme Court's Decision in the Right to Judge Material in providing its decision which in principle had legal consequences of the rule if it was proven legally and convincingly contrary to the rules above, the rule would be invalid and not applicable, and it was the responsibility of related agencies to revoke it.
