Critical Review of SME Regulation Optimization in Serbia

The European Union (EU) and the Republic of Serbia have recognized the importance of SMEs and are developing accordingly the institutional framework of this sector. In the process of EU accession, Serbia has to fulfil political, economic and legal requirements by implementing systemic reforms of its legal system in order to align it with the EU acquis. Some of these requirements have a direct or indirect impact on SME regulations, to which our chapter has been dedicated within a series of our papers on developing the SME regulatory framework. This paper will try to present the importance of innovating legal development of these companies. Furthermore, modern concepts will be introduced together with very important tools of legal forms of SME organization. The intention is to clearly define specific legal goals of SMEs, expressed through targeted legal forms. The modern regulatory framework relating to SMEs should combine the existing solid theoretical base and innovative models from the practice.

This article aims to carry out an analysis of the problems affecting the legal system, with particular reference to the criminal law and criminal procedure law, of the Republic of Albania. We will start from a rapid reconstruction of the Albanian system in a historical key to understand its peculiarities, to move on to the most significant steps in its evolution. At a later stage we will try to highlight the critical issues that have arisen not only on the level of criminal law, but also on the cultural one. The reasons that led to the 2016 constitution reform and then to the subsequent reforms that changed the face of the country's legal system will be highlighted. Will be highlighted. The news, the improvements and the problems related to the knowledge of the law and above all to the ability to create a law capable of being systematic. The article is dedicated to the prospects for the development of Russian-Moldovan relations after the victory of Maia Sandu in the presidential elections in the Republic of Moldova. The work examines the historical background and the current state of political and economic cooperation between Russia and Moldova. It is outlined that Russia retains its importance for Moldova in the felds of energy security and food exports; at the same time, a signifcant economic imbalance in relations is emphasized. The authors point to the instability of bilateral interaction due to three circumstances: external factors (primarily, the influence of the European Union), the stance of the newly elected president of the republic, and the balance of political forces in the national parliament of Moldova. According to the authors, the assumption of power by a pro-European politician does not imply Moldova’s unilateral refusal to cooperate with Russia. Despite the obvious intention to accelerate the country’s integration into the European Union, the new leadership is not yet ready to abandon the dialogue with Moscow. In the political, economic, and military profles of Moldova, Russia remains one of the most important partners. Since the internal political transformations in the republic carry the potential to diminish Russian influence over Moldova, the authors highlight possible steps on the Russian side that are capable of strengthening the existing foundation of positive interaction between countries, based on a study of the current confguration of bilateral relations. It is particularly underlined that against the background of the existing parameters of the modern system of international relations, even in the event of the most pessimistic scenario, the damage to Russian interests (apart from reputational losses) can be assessed as relatively insignifcant.

The objective of the research of connection between national interests and the security policy of the European Union is to perceive the possibilities of the Balkan states to preserve their identity and achieve their vital and permanent national interests by their membership in the European Union. According to the author, the implementation of the security policy of European Union is often opposite to one?s own national interests. However, a pragmatic question for political leaders is how to resolve the following dilemma: ?is the created european security identity more important at the moment than the preservation of immediate or some permanent national interests?? The author points to the fact that the notion of national interests is a variable both historically and theoretically. Political, economic, security and other objectives determine vital national interests in some historical periods. At the same time, not rarely, some states alter their strategies and objectives for their own interests assessing whether the conditions prevailing in the internal and external surroundings have changed. The author devotes special attention to a comparative analysis of defining, determining and conceptual determination of national interests from the aspect of national security policies of some important states and the European Union. The second part of the article contains an analysis of the response of a group of Macedonian experts to the questions pertaining to the possibility of preserving and achieving of national interests of the Republic of Macedonia through its membership in the European Union.

Abstract This article deals with the convergence of the Kazakh financial system with international standards in light of the new, enhanced agreement with the European Union on partnership and cooperation (January 19, 2015). Based on this research, the approaches used by the Kazakh financial system to converge with the European Union (EU) and the mechanism of implementing international standards in the national regulatory framework are determined. In practice, the study provides justification for the necessity of arranging the systematization of existing rules and regulations covering financial activity in the Republic, eliminating discrepancies between the national regulatory framework and international standards, and determining clear security guarantees for foreign investors’ financial activity in the Republic. The research results are primarily focused on the development of public finance management theory. Theories and conclusions present in the study can be used in the educational processes of economic and legal institutions and in the policymaking activity of public finance management bodies.

У статті досліджено вплив Суду Європейського Союзу (ЄС) на впровадження і застосування Угоди про асоціацію між Україною та ЄС, що викликало безпрецедентні політичні, економічні та правові реформи в Україні. Зокрема, розглядаються конституційні виклики, які постали перед державою під час виконання Угоди в правовій системі. Крім того, досліджено два питання. Перше – ефективне впровадження та застосування Угоди про асоціацію між Україною та ЄС в українській правовій системі. Друге – сумісність і відповідність Угоди Конституції України. Проаналізовано останні політичні та правові події в Україні через призму ефективної реалізації Угоди про асоціацію між Україною та ЄС і зростання проєвропейського правового активізму в державі. На закінчення стверджується, що Угода про асоціацію між Україною та ЄС посилює пристосованість національного конституційного устрою до цілей досягнення європейської інтеграції та застосування європейських спільних цінностей в Україні. Угода про асоціацію між Україною та ЄС створила стійку інституційну та правову основу для застосування acquis ЄС (правового доробку ЄС), включаючи прецедентне право ЄС та комплексне законодавче наближення між законодавством України та ЄС. Однак інституційні реформи, які вже відбулися, не можна вважати цілком достатніми. Верховній Раді України не вдалося запровадити основні та процедурні засади для застосування та впровадження Угоди в правовий порядок України. Однак ця прогалина частково заповнюється зростаючим судовим активізмом в Україні. Вітчизняні судді вже почали посилатися на Угоду про асоціацію між Україною та ЄС і відповідні частини acquis ЄС у своїх рішеннях, тим самим закладаючи основу для регулярного застосування загальних принципів права ЄС у процесі виконання й імплементації Угоди про асоціацію між Україною та ЄС.

The paper examines the possible usage of event templates derived from Frame-Based Terminology (Faber et al. 2005, 2006, 2007) as an aid to the extraction and management of legal terminology embedded in the multi-level legal system of the European Union. The method proposed here, which combines semi-automatic term extraction and a simplified event template containing six categories, is applied to an English corpus of EU texts focusing on victims of crime and their rights. Such a combination allows for the extraction of category-relevant terminological units and additional information, which can then be used for populating a terminological knowledge base organised on the basis of the same event template, but which also employs additional classification criteria to account for the multidimensionality encountered in the corpus.

Problem setting. On October 7, 2021, the Constitutional Tribunal of the Republic of Poland ruled in favor of Polish law over European Union law, which in the long run may violate the principles according to which the Union operates and the rights enjoyed by citizens of the state. Such a precedent can further serve as a basis for identical decisions of the bodies of constitutional jurisdiction of those states that have problems in fulfilling their obligations in the European community. Analysis of recent researches and publications. The problems of the functioning of the bodies of the European Union, the implementation of their decisions and the general status in EU law are widely studied in national science. In particular, many scholars have studied the legal nature of the EU, including: TM Anakina, VI Muravyov, NM Ushakov, A. Ya. Kapustina, NA Korolyova, Yu. Yumashev, BN Topornin, OYa Tragniuk, SS Seliverstov, IV Yakovyuk and others. Target of research is to establish the foundations of EU law in the functioning of Union bodies, especially the Court, as well as to determine the hierarchy of national law and EU law. Article’s main body. Over the years, the Court has, within its jurisdiction, issued a large number of judgments which have become the source of the Union’s Constituent Treaties and of EU law in general. Over the last two decades, the powers of the Court of Justice have changed significantly. In particular, this is due to the adoption of the Lisbon Treaty, which amended the EU’s founding treaties on the powers of the Court, then the reform of the European Court took place in 2015-2016, which concerned a change in the organizational structure of the Court. Despite the generally well-established case law of the Court of Justice of the European Union on the unification of the observance by the Member States of the basic principles of the European Union, the Constitutional Tribunal of the Republic of Poland adopted a decision on 7 October. Conclusions and prospects for the development. Following the decision of the Constitutional Court, the Polish authorities found themselves in a situation that significantly complicated its internal and external situation. The way out of which requires answers to fundamental questions about the legal nature of the EU. Undoubtedly, this is an issue not only between Poland and the EU, but also between other member states.
