Respect for persons

The idea that one should treat persons with due respect is an important part of common sense morality, but opinions differ about when respect is called for, what it requires, and why. Respect for persons is also a central concept in many ethical theories. Some theories even hold respect for persons to be the foundation of all other moral duties and obligations. Respect is distinguished commonly, on one side, from fear and submission, and on another, from admiration, liking and affection. Respect for all persons as such is distinguished normally from esteem or special regard for persons of unusual merit. Some philosophers identify respect with agapē, a special kind of love, but respect is perhaps most often regarded as a distinct attitude that should constrain and complement the promptings of love. Kant, for example, held that the requirements of respect and love are different, though compatible, and that both are dependent upon the more general and fundamental idea that humanity in every person is an end in itself. Other key issues in discussions of respect for persons include: what moral requirement, if any, there is to respect all persons; what the grounds, scope, and theoretical status are of that requirement; whether one can forfeit all claim to respect as a person; what ‘respect for persons’ demands with regard to specific problems, such as conflicts rooted in race and gender differences; and whether there is the same ground and obligation to respect oneself as to respect others.

Sentencing represents the apex of the criminal process and is the most public stage of the criminal justice system. Controversial sentences attract widespread media coverage, intense public interest, and much public and political criticism. This chapter explores sentencing in the United Kingdom, and draws some conclusions with relevance to other common law jurisdictions. Sentencing has changed greatly in recent years, notably through the introduction of sentencing guidelines in England and Wales, and more recently, Scotland. However, there are still doubts about the fairness and consistency of sentencing practice, not least in the use of imprisonment. Among the key issues to be examined in this chapter are the tendency towards net-widening, the effects of race and gender, the impact of pleading guilty, the use of indeterminate sentences, the rise of mandatory sentences, and the role of the victim in the sentencing process. The chapter begins by outlining the methods by which cases come before the courts for sentencing. It then summarizes the specific sentences available to courts and examines current sentencing patterns, before turning to a more detailed exploration of sentencing guidelines, and of the key issues identified above. The chapter addresses two critical questions: What is sentencing (namely who exerts the power to punish)? Does sentencing in the UK measure up to appropriate standards of fairness and consistency?

A novice principal’s decision not to intervene on an ill-conceived policy prompts a parent to pursue a line of questioning administrators are not prepared for. In this case, a young man working through a high school transition while preparing for college is met with unexpected challenges in motivation. What the principal initially perceives as inconsequential becomes a Wicked Problem when the parent questions the ethics and legalities of the policy, teachers’ intent, and potential civil rights violations. Underscored are nuances in communication, decision making, motivation, and ethics. As the elements of the case unfold, matters pertaining to school and community relations, policy, law, race, and gender present themselves useful for discussing a variety of key issues related to school leadership.

This chapter traces the emergence, maturation, and subsequent decline of ethnographic studies of prisons and jails in the United States. It provides a summary and overview of classic and contemporary prison ethnographies and identifies key issues and themes that animate qualitative research on prisons and carceral facilities. These include questions about the forms that punishment, surveillance, and control take, the ways that incarcerated men and women experience, resist, and make sense of the conditions of confinement, and the impact incarceration has for their relationships with families, communities, and one another. The chapter considers the dramatic reduction in the number of ethnographic studies of prisons and jails at century’s end and identifies how punitive policies associated with mass incarceration made it all but impossible for ethnographers to gain entry to carceral institutions. Contemporary ethnographers have reinvented the form by documenting practices and ideologies of control in alternate carceral spaces including visiting rooms, drug treatment programs, and group homes. A summary of recent work is included, along with a review of the ways that contemporary ethnographers foreground issues related to race and gender inequality. The chapter concludes with a discussion of prison ethnography in Europe where ethnographers enjoy greater access to carceral facilities and have considerable influence over public policy. For comparative purposes, I include a summary of ethnographic research from Ireland, the United Kingdom, and France.

The analytical relationship between Marxism and feminism has engaged critical scholarship and leftist practice since the time of the foundational contributions of Marx and Engels. Socialist feminist analysis has profoundly advanced contemporary Marxism. However, some strands in Marxist theory and left practice continue to be resistant to feminist contributions. It is this resistance that animates this paper, which is theorized as epistemological dissonance. While not in any way universal, such dissonance is pervasive and suggests an epistemological framing. This is suggested to include four dimensions, regarding: (i) temporality; (ii) idealized masculinities; (iii) specific views of totality in relation to class, race and gender; and (iv) the relationship between activism and the academy. Collectively, these elements maintain and advance not only certain tenets understood as “knowledge”, but also generate a kind of problematic left common sense that can inhibit constructive Marxist and socialist feminist investigation.

Background: In order to better understand the posttraining suicide prevention behavior of gatekeeper trainees, the present article examines the referral and service receipt patterns among gatekeeper-identified youths. Methods: Data for this study were drawn from 26 Garrett Lee Smith grantees funded between October 2005 and October 2009 who submitted data about the number, characteristics, and service access of identified youths. Results: The demographic characteristics of identified youths are not related to referral type or receipt. Furthermore, referral setting does not seem to be predictive of the type of referral. Demographic as well as other (nonrisk) characteristics of the youths are not key variables in determining identification or service receipt. Limitations: These data are not necessarily representative of all youths identified by gatekeepers represented in the dataset. The prevalence of risk among all members of the communities from which these data are drawn is unknown. Furthermore, these data likely disproportionately represent gatekeepers associated with systems that effectively track gatekeepers and youths. Conclusions: Gatekeepers appear to be identifying youth across settings, and those youths are being referred for services without regard for race and gender or the settings in which they are identified. Furthermore, youths that may be at highest risk may be more likely to receive those services.
