Abstract. In which ways can we theorise the recent illegalised migrations in Europe? This article considers theoretical novelties in the field of migration studies that have emerged since the mass migration into the European Union seen in 2015. Methodologically, the authors combine critical (discursive) analysis with the testing of certain still relevant theoretical concepts that have yet to be applied in migration studies, based on fieldwork along the Balkan Route over the last 5 years. The analysis has shown that the defining and decisive feature of the recent illegalised migrations, insufficiently considered by migrations scholarship, is the political subjectivity and agency of the migrants. Recognition of such agency makes migration the site of the critique of global inequalities and the site of inclusive social transformation. Since 2015, the migration crisis continues with varying intensity, and international security crisis as well as debt, institutional, and personnel crises are worsening, not only in the Eurozone. Probably war, economic and climate immigrants will continue to move into the Schengen area, showing how helpless the European Union is. Angela Merkel said there was no upper limit for the number of people admitted to escape political persecution. Germany leaves the Dublin system inconsistently, runs counter to European cohesion and stops differentiating between immigrants and refugees. Migration is shared by the EU Member States. Between “old” and “new” EU countries, scissors are opened. Moreover, in some European regions (France, Belgium, Germany, Sweden, the United Kingdom, Spain, Greece) there are closed communities where majority law is not valid. Our current socio-political and economic existence is based on a traditional understanding of security. However, in the third decade of the 21st century the image of prosperity and security is to be seen from a different perspective than in previous years. Dramatic development has led to the mass migration of African and Asian people and to the division of the European Union, especially regarding the mechanism of redistribution of asylum seekers.

AbstractThe political destabilization in the Middle East has caused such a significant wave of migration to European countries, that the situation has evolved into a migration crisis. Research on the awareness and opinions on mass migration conducted among a selected group of Polish youth show how differentiated attitudes are – from moderately positive to extremely negative. At the same time, almost everyone signaled that schools’ engagement in providing students with solid knowledge on migration was insufficient. In this context, this paper discusses the importance of taking account of students’ opinions in the planning of educational processes. If schools are to influence the attitudes of the young, they should create a space for dialogue and for students to express their opinions and values. Such activities, together with solid knowledge, will allow educational and pedagogical objectives to be reached.

This paper reconstructs the political thought of the Scottish legal philosopher, and eventually MEP, Sir Neil MacCormick (1941–2009), the founder of “constitutional pluralism,” one of the most influential legal theories of the European union today. It argues that his legal theory is underpinned by a coherent and original political theory of post-sovereignty. But, contrary to many current interpretations, this article argues that normatively, constitutional pluralism is not a purely liberal theory. Neither is it inherently illiberal, as has been contended. Instead, this article spells out the hybrid institutional design imagined by N. MacCormick and inspired by the thought of D. Hume, as well as the lineaments of an ethical theory of post-sovereignty he developed. So doing, while I will argue that it ultimately leads to a kind of republican cosmopolitanism, the political theory of constitutional pluralism is shown to open up an important, if not fully developed, avenue to escape some shortcoming commonly associated with post-sovereignty.

The European Union (EU) has certainly reduced its influence in the global economic affairs. Despite the fact that it unites 28 nations, including the former great powers such as the United Kingdom, Germany, France and Italy, the political and economic power of the community has considerably decreased starting with the second half of 2000s. The present research is undertaken with the aim of increasing the readers’ awareness regarding the necessity of enforcing the EU economic security through consolidating the authority of the supranational bodies in relation with national representatives. The objectives to be reached in this regard include assessing how much the governance efficiency alternations among the EU member countries influence the efficiency of the single market in a globalised society. It was found that several processes determined the decline of Europe’s strength including raising globalisation and increasing competition, economic weaknesses of the EU which worsened during the crisis, stagnation of the integration process, feeble leadership and lack of resoluteness, especially in the most developed EU nations, declining adherence to “core” values, migration crisis, little political commitment to protecting EU’s citizens’ interests, and countries’ individualism in promoting key initiatives.

The current migration crisis has far-reaching challenges for EU countries. Global migration is forcing countries to completely reconsider their migration policies, the effectiveness of control, and the integration of migrants. As one of the EU's leading countries, Germany is the biggest lobbyist for the establishment of a common migration policy in the EU. This chapter contributes to the academic discussion on establishing a single mechanism for managing migration flows in the European Union. The analysis confirms that EU countries are faced with the need to find new ways to resolve the migration crisis. In this direction, Germany has become the country where one can trace the uniqueness of the political phenomenon of integration of migrants into the host community as a measure to overcome the migration crisis. The evidence reveals the growth of threats for national, regional, and international security caused by the growing migration crisis and transformation of the policy of integration of migrants in Germany under the influence of this factor.

Following a brief description of the unprecedented waves of migration flowing into Europe from the Middle East and Africa, the author analyses the migration policy of the European Union and Hungary's attitude towards this policy between 2014 and 2019. The study centers on the positions, views, and specific actions of the leadership of the European Commission and the political class of Hungary, as well as the relations between them. The main approaches of the parties towards solving the problems of the migration crisis and the differences between them on key issues of migration policy, which at times turned into confrontations between Budapest and Brussels, are shown. Particular attention is given to the circumstances that led to the EU migration crisis.

When, if at all, can a federal political order expel a member state against its will? In political theory, expulsion has—unlike the scenario of secession as voluntary separation—so far received no systematic attention; an omission that is reinforced by the paucity of historical precedent. However, current debates around the potential disintegration of the European Union show that expulsion, as a theoretical and political possibility, deserves a more careful analysis. The article sets out to consider a route toward theorizing expulsion in systematic and realist terms. It outlines possible motivational constellations, feasibility constraints, legitimacy issues, as well as procedural dimensions. The resulting claim—that expulsion may be feasible in some circumstances but that its legitimacy is bound to remain contested—is applied to the case of the European Union.

The article analyzes the problem of right-wing populism in Switzerland. The study of the features of the country's political and electoral system highlights the issues of its immigration policy and relations with the European Union. The authors argue that the phenomenon of Swiss populism should be considered in a broader context, in connection with which attention is paid not only to the Swiss people's party, the Ticino League and the Geneva citizens ' Movement, but also to the populist parties of countries belonging to the Alpine macroregion – the Austrian freedom party (Austria) and the League (Italy). A discursive analysis of the programs shows that the anti-immigrant program is an essential part of the identity of right-wing populists. All of them are opposed to European integration and globalization, linking them to increased ethnic and religious tensions, unemployment and increased crime. At the same time, a special feature of Swiss parties is the fact that they position migration as a phenomenon mainly associated with cross-border movement of European citizens. Already complex, during the COVID-19 pandemic, this issue has become even more acute, and has become an integral part of their agenda. Meanwhile, the 2015-2018 migration crisis that preceded the pandemic allowed the Swiss people's party to strengthen its identity as a right-wing populist neoliberal party with a strong localist and conservative program aimed at cultural dominance over migrants. The authors also note that the Germanic focus on environmental protection is part of the populist agenda of right-wing regional parties, although it is usually characteristic of the left parties.

The importance of studying migration processes is due to their massive, regular nature, the impact on the political and social environment of the host countries. Often, a poorly thought out, inconsistent and generally ineffective immigration policy leads to problems in the host countries, reduces the quality of life of the indigenous population, thus creating a split in society, which may result in increasing migrant phobia, xenophobia, etc. A particularly striking example of this situation can serve as some countries of the European Union, in particular, Germany and France. The populations of these countries account for one of the largest shares of migrants not only in Europe, but throughout the world. Of particular research interest is the change in the political preferences of the voters in favor of the forces advocating a rigid migration policy. Within the framework of the systematic and historical-descriptive approaches, the electoral processes in Germany and France were analyzed during the period of the most intense manifestation of the migration problem. It was found that in parallel with the migration crisis in the host countries, a reshuffling of political forces is rapidly taking place: lesser-known political leaders, parties, movements not only appear on the political arena, but quickly gain voters’ support, starting to determine immigration policy. There is a clear relationship between anti-immigration slogans and the entry into the arena of Germany and France of right-wing parties, which are fundamentally changing the political alignment of forces and their political course as a whole. Supporters of the right-wing political persuasion quickly gained popularity at the peak of the migration crisis, but with this problem fading into the background, the need for these political forces began to decrease. As a result of the study, the hypothesis that the migration problem is one of the key factors in the alignment of political forces in Germany and France was confirmed.

The economic crises of the 21st century have challenged the unity of the European Union. The initially strong centripetal forces started to be weakened by new, unexpected centrifugal forces. What does the future hold for the European Union, and how can it face the unforeseen challenges? Currently the most important divisive, centrifugal forces within the EU include the management of mass migration, the debates surrounding the EU budget, the lack of a common foreign policy and the issue of sovereignty versus federalism. The essay addresses these topics one by one, because a strong, influential and unified Europe cannot exist without a solution to the migration crisis which is accepted by all Member States, a more coordinated fiscal and foreign policy and an explicit, uniformly accepted interpretation of the sovereignty of nation states. These areas are likely to remain divisive, centrifugal forces hampering the progress of European integration for years to come, but they should be discussed to identify the most important things to do.
