The subject. The main issues of law enforcement activity on the application of administrative punishment in the form of administrative suspension of operations for identified offenses in the field of industrial safety of hazardous production facilities.The purpose of the article is to confirm or disprove hypothesis that Russian legislation allows the resumption of activities after the expiration of the period of its suspension without eliminating violations of industrial safety.The methodology of research is logical analysis of Russian legislation, statistical data and judicial decisions concerning enforcement of administrative suspension of operations in Russia.The main results. There is an ambiguous approach in the scientific literature to fixing the administrative suspension of operations in the system of administrative penalties. The effectiveness of its application is noted by some authors. At the same time, there are adverse consequences associated with the application of administrative suspension of operations for the further production activities of economic entities. Social tension in the collective of enterprises, difficulties of recovery after forced downtime, unclear prospects for further economic activity – this is not a complete list of problems arising in connection with the administrative suspension of activity. When making a court decision, judges often appoint a fine as a penalty and rarely a penalty in the form of suspension of operations. This is due to the complexity of the actual realization of suspension of operations, the special social significance of objects; the lack of a specialist's conclusion about the real danger of an offense. But if violations of industrial safety are detected during the operation of hazardous production facilities, it is initially possible to assume a high probability of serious consequences for the life and health of people, the environmental safety. Administrative suspension of activities is carried out by both judicial and non-judicial control authorities. In authors’ opinion, the application of this type of administrative punishment should be exclusively in the judicial jurisdiction. The law enforcement judicial practice concerning administrative suspension of operations in Russia is not uniform.Conclusions. There is a legal uncertainty in the mechanism of imposing administrative punishment in the form of administrative suspension of operations for violations of industrial safety of hazardous production facilities (Article 9.1 of the Russian Code of Administrative Offences). The uncertainty is manifested in the fact that the economic entity does not always eliminate the detected violations within the legally established period and after the expiration of the period for which the activity was suspended, the company resumes its activities nevertheless. Such opportunity reduces the preventive value of this punishment.

Creating an industrial safety management system for enterprises requires the development and application of a set of mechanisms that ensure the prevention of accidents and incidents. Risk management systems are one of the most effective mechanisms for industrial safety. However, very little attention has been paid to automation of risk management. This article is devoted to the formation of the conceptual framework for creating automated risk management systems for industrial enterprises with hazardous production facilities. The paper analyzes the structural and logical scheme of risk management. It is shown that one of the most “risk-bearing” components of hazardous production facilities are technical devices. At the same time, the maximum level of automation is possible for technical devices in relation to their maintenance, repair, and risk management tasks. Analysis of the tasks related to risk management shows their complexity and diversity. The solution of these problems is possible through the use of modern information technologies. At the same time, it is necessary to create a unified database of hazardous production facilities, a comprehensive database of regulatory, technical and legal information, automation of risk modeling and analysis of control processes, and decision-making and implementation of processes that minimize risks. At the same time, the maximum level of automation is possible for technical devices in relation to their maintenance, repair, and risk management tasks.

The paper examines the types of uncertainties associated with operation of hazardous production facilities caused by the natural variability of the facility parameters and the limited knowledge about complex processes in the system under consideration, as well as the uncertainty of the results of quantitative risk assessment. Qualitative and quantitative criteria of tolerable (acceptable) risk adopted in various countries of the world are presented. The article considers the operation of the ALARP principle in making managerial decisions on the need to implement protective measures aimed at reducing individual risk, which allows to provide a compromise between competing requirements for ensuring safety and economic efficiency in the operation of hazardous production facilities. In the future of socio-economic development, due to the improvement of existing and the emergence of new safety technologies, the maximum allowable and acceptable levels of risk should be revised in order to meet more stringent safety requirements. Therefore, the value of tolerable individual risk in case of accidents at hazardous production facilities may not be a strictly specified value (as is generally accepted), but may decrease as the reliability of technological systems increases, the efficiency of industrial safety management increases, and the background (average) risk of mortality decreases. A necessary condition for implementing a risk management system is to improve the efficiency of the system for collecting and analyzing data on reliability, accident rate, monitoring and control of technical condition at hazardous production facilities, and further develop the methodological support for risk analysis within the framework of the currently implemented risk-oriented approach in the field of industrial safety.

The paper presents the results of the study aimed at improving the quality of specialists training in higher educational institutions who will fork for industrial enterprises where hazardous production facilities are operated. The quality of training depends on the level of industrial safety of hazardous production facilities and as a consequence the likelihood of accidents. At the moment, despite the general trend of reducing accidents at hazardous production facilities over the past ten years, their number remains quite significant. At the same time, social and economic damage from accidents can be estimated at 600-700 billion rubles per year, which will have a negative impact on the economic stability of the Russian Federation. The obligations of industrial enterprises where hazardous production facilities are operated and its employees are defined by the legislation. The content of education should take into account these basic requirements, which should be formed into separate themes. Accordingly, the modular principle is used in the design of the training content. The development of content in the form of modules will ensure the organizational and substantive unity of students training. We accept lectures and practical classes, as well as group and individual ones as the main methods of the educational process. Learning the material based on the results of lectures, practical training and self-training should allow students to form the qualities specified in our profesionogram. How the educational material proposed for study is learned should be checked during the control activities, starting from the initial-input control and ending with the final control.

Every year, the problem of industrial safety is becoming increasingly relevant. The effective industrial safety management system (ISMS) organization becomes especially important for nuclear energy, chemical, petrochemical, oil and gas, mining, metallurgical industries, coal mines and other industries, including enterprises with hazardous production facilities (HPF). Any violation of operating modes, unaccounted technological and operational defects can lead to serious consequences and accidents, accompanied by significant material costs and technological disasters. An important place among the problems of industrial safety is the problem of trouble-free operation of technical devices (units, machines and mechanisms, technical systems and complexes, technological equipment, instruments and apparatus) of hazardous production facilities. However, existing approaches to solving this problem have limited application. The article proposes an effective solving method of the problem based on the use of graph models. The advantage of such modelling is the simplicity, clarity and ease of mathematical algorithmization of the studied production processes and technical systems.

Modern requirements to industrial safety presuppose the use of scientifically based methods and means of technical diagnostics for obtaining direct quantitative information sufficient for the subsequent normative calculation determination of a set of the parameters of strength, resource, reliability, survivability and risks. It is shown that such information includes data on the accumulated and developing technological and operational defects in the load-bearing elements, on the kinetics of stress-strain states in the most loaded hazardous zones of a structure, on the thermal, chemical, biological and radiation dangerous effects, on the changes in characteristics over time of the basic mechanical properties of material strength and ductility. Such an approach to diagnostics should be linked both with the existing system of a set of equations with the diagnosed parameters included in them for the analysis of permissible, hazardous and limiting states, and with the implementation of the results of new fundamental studies of complex deformation, damage and destruction processes that determine the probability of accidents and catastrophes at the production facilities, as well as relevant applied scientific and methodological, hardware and software developments. Relevance and importance of promising research and development in this direction are associated both with the facilities of I, II classes of hazard, and the objects that are critically and strategically important for national safety.
