ABSTRACT Natural resources along the shoreline of a tidal estuary were injured by oiling and physical disturbance following the accidental release of No. 6 fuel oil from a power plant in New Jersey, USA. Operation of heavy equipment on the shoreline during the emergency response entrained oil into sediments and physically damaged shoreline vegetation dominated by the low-value specie Phragmites australis. In response to this incident, the New Jersey Department of Environmental Protection (NJDEP) and the responsible party (RP) conducted a cooperative natural resource damage assessment (NRDA). During NRDA discussions, the NJDEP proposed that compensatory restoration for injured natural resources be provided at a ratio of 3:1 (restored-to-injured) based on the acreage of physically impacted vegetation. Since in-kind restoration of Phragmites was undesirable, native salt marsh vegetation was planted instead, resulting in enhancement of the injured habitat. Since the primary restoration actions yielded improvements beyond the baseline condition, the RP successfully negotiated a 1:1 replacement ratio for components involving habitat enhancement. By incorporating habitat enhancement into the design of primary restoration, the amount of the compensatory restoration was reduced. By expanding the primary restoration to include enhancement of adjoining degraded habitat that was not impacted by the incident, the RP was able to satisfy both primary and compensatory restoration obligations simultaneously by integrating these components into a single restoration project. The combined primary and compensatory restoration project was then implemented as emergency restoration 4–5 months after the incident. This integrated restoration approach enabled the RP to: (1) decrease compensatory restoration requirements by incorporating habitat enhancement into primary restoration; (2) reduce restoration costs by avoiding separate primary and compensatory restoration projects; and (3) expedite restoration by performing actions under the scope of emergency restoration. This strategy benefited the trustees by simplifying the assessment and reducing oversight burdens. The public and the environment benefited by receiving restoration on an accelerated timeframe.

ABSTRACT On June 24, 1989, the Uruguayan merchant marine tanker Presidente Rivera, loaded with 19 million gallons of No. 6 fuel oil, ran aground in the Delaware River near Marcus Hook, Pennsylvania, spilling between 200,000 and 300,000 gallons of oil. Currents spread the oil over approximately 29 miles of shoreline in New Jersey, Delaware, and Pennsylvania, reaching upstream as far as Little Tinicum Island, a wildlife refuge near Philadelphia, and downstream as far as Reedy Island, south of the Chesapeake and Delaware Canal. Natural resources under the trusteeship of New Jersey, Delaware, Pennsylvania, the U.S. Department of the Interior, and the National Oceanic and Atmospheric Administration (U.S. Department of Commerce) were affected by the spill, including shoreline parks, fisheries, marshes, birds, and wildlife. Additionally, portions of the river were closed to vessel traffic and nearby creeks were boomed off, preventing access to marinas and boat ramps. After three years of damage assessment, pretrial discovery, and negotiations, the trustees reached a settlement on natural resource damages with the responsible party. This paper discusses the strategy used by the trustees in developing a natural resource damage claim and highlights some of the lessons learned during the assessment and settlement process.

ABSTRACT Pursuant to the Oil Pollution Act of 1990 (OPA 90), natural resource trustees are empowered to seek recovery for damages to natural resources caused by discharges of oil and/or certain threats of discharges of oil. To determine the proper amount of damages, trustees undertake the process of “scaling,” which is an attempt to calculate the size of restoration actions that would be required to expedite recovery of injured natural resources to baseline and compensate the public for interim lost resources and services. Trustees utilize various scaling methods, including service-to-service methods, such as habitat equivalency analysis, and value-to-value methods, such as hedonic price models and contingent valuation. Regardless of the method chosen, however, the scaling is directly dependent on the level of injury caused by a spill. Disputes between trustees and those parties designated as responsible for the spill (responsible parties or RPs) often occur in determining the level of injury. In many cases, as a result of either these disputes or the trustees' desire to determine the precise level of injury, trustees undertake costly and time-consuming injury studies. These studies oftentimes are inefficient because the resulting gains in certainty often are achieved through disproportionately expensive studies relative to the resulting gains in restoration. In certain instances, attempts to achieve greater certainty can destroy an otherwise efficient and cooperative restoration effort and run contrary to the OPA 90 regulations. Such attempts also can lead to costly litigation for both the public and the RP involved. Lastly, attempts to achieve greater certainty during injury assessment can unnecessarily increase the scale of compensatory restoration because of delays in implementing restoration actions. Both trustees and RPs must recognize those instances in which achieving greater certainty leads to increased costs to both the public and the RP. In such situations, stipulating to certain injury assumptions can lead to overall net gains for both the public and the RP. These stipulations can be used to induce RPs to increase other aspects of the restoration, thereby increasing overall gains for the public at less cost to the RP.

This paper is a literature study explaining a concept, principles and characteristics of a good governance. Furthermore, it explains the definition, development and utility of an efficient, effective and accountable government in creating a good governance mechanism having a strong impact to the democratic economy and social welfare. It also analyzes the importance of government concern for improving democratic economy suitable with human and natural resources and the culture values of Indonesia.

This article is a theoretical and ethnographic investigation of the role of marketing and branding within the contemporary ISKCON movement in the United States. In it, I examine the digital marketing enterprises of two prominent ISKCON temples: ISKCON of New Jersey and ISKCON of D.C. I argue that by attending to the vastly different ways in which these temples present and portray ISKCON online—including the markedly different media imagery by which they aim to draw the attention of the public—we can learn about an ideological divide concerning marketing within American ISKCON. This divide, I argue, highlights different ideas regarding how potential newcomers become attracted to ISKCON. It also illuminates an unexplored facet of the heterogeneity of American ISKCON, principally in terms of the movement’s public face.

Environmental impact assessment report is the primary document required to assess sustainable issues of any business/commercial activity, but it is most often overlooked for serious anomalies in its presentation to the public. It is most often incomplete and there is a need to review the standards of impact assessment procedures that help preserve environmental integrity among developing nations. The absence of sanctions for improper assessment of environmental, social and economic impacts of commercial activities, including extraction of natural resources by domestic and multinational corporations undermines sustainable development across the globe. The procedures in place to study various impacts of a business activity that enable access to genuine, verifiable and actionable information by the public require review and oversight by a third-party institution. The standardization of procedures and universal harmonization of enforcement and compliance regulations by nations has to become a topic for debate at various academic levels to gain importance. Essentially, EIA reports in large infrastructure projects serve as a blueprint for low carbon economies. Developing nations ignore vital provisions relating to the listing and analysis of alternatives in their attempt to meet developmental goals. Environmental protection is to maintain the ecological integrity of habitats and ecosystems. EIA reports, ultimately, aim at conserving and replenishing the reserves of natural resources. Judicial law has played an important role in highlighting the importance of alternatives in EIA. It is therefore important as how developing nations use the provision for the alternative analysis within their environmental laws. This paper will discuss EIA under the auspices of International law relating it to Sustainable Development. As políticas públicas ocupam importante papel no âmbito do planejamento estratégico e da gestão pública nos mais diferenciados setores. Sendo assim, este estudo tem como objetivo analisar a política pública de meio ambiente, tendo como foco principal o Plano Diretor da APA da Serrinha do Alambari, no município de Resende/RJ e sua correlação com a política setorial de turismo inscrita no Plano Diretor Municipal. A pesquisa se caracteriza como exploratória e de abordagem qualitativa, com estudo de caso. O resultado aponta para a falta de sinergia entre as políticas ambiental e a de turismo, comprometendo, pois, não só a atividade turística como a preservação do patrimônio natural. Espera-se que os dados e as informações obtidas norteiem o poder público para que sejam desenvolvidas ações efetivas, através das políticas públicas, para compatibilizar a prática do ecoturismo com a preservação e conservação dos recursos naturais, ambas pautadas na ótica do desenvolvimento sustentável. Thus, this study aims to analyze the public environmental politic, focusing mainly on the Master Plan of the Serrinha Alambari Protect Area in the municipality of Resende (RJ, Brazil) and its correlation with the sectoral politic entered in the tourism Master Plan. The research is characterized as exploratory and qualitative approach with case study. The result points to the lack of synergy between environmental and tourism politics, compromising therefore not only to tourism activity as the preservation of natural heritage. It is expected that the data and information obtained will guide the government to be developed effective actions, through public politics, in order to reconcile the practice of ecotourism with the preservation and conservation of natural resources, both predicated in optics of sustainable development.
