AbstractThis chapter presents the evolution of EU energy policy, examining how concepts of inclusiveness and justice in energy have been progressively included in relevant energy policy documents. It discusses how EU energy policy has evolved to acknowledge the importance of the individual as well as the collective dimension of energy for an inclusive green transition. Recognizing the challenges linked to the translation of these concepts into concrete actions, the chapter elaborates a socio-energy system approach that can help in making visible important aspects of the energy transition that would go unrecognized in other analytical approaches that focus mainly on the technological side. There is an increasing awareness that the European Green Deal and other political initiatives for a sustainable future require not only technological change but also careful attention to the social implications of the transition. The chapter applies the proposed approach to smart metering technologies, discussing how the technology-centric view of the energy system is framed around the average consumer or early-adopter, leaving vulnerable groups and those living in energy poverty underrepresented. A socio-energy approach also challenges the predominant use of purely quantitative results such as energy or cost savings to evaluate the successfulness of initiatives tackling inclusiveness and fairness (e.g. energy poverty). Social outcomes of energy policy choices and technology arrangements need to be better investigated and accompanied by innovative ways to measure their success. The proposed socio-energy approach offers a way of including wider societal implications of the energy transition in the design of energy policies and in their implementation.

The individual chapters in this book have addressed how law can advance energy justice in all its multi-faceted aspects. In turn, this chapter provides summary conclusions drawn from the legal analyses contained in those chapters, emphasising how law is essential to achieving global and national goals for energy justice. In doing so, it provides particular emphasis on the fight against energy poverty, while examining the potential for a variety of existing legal measures to provide solutions to pressing energy justice issues for developing and developed nations. The analysis also highlights the lessons that can be learned for the future energy transition from the case studies of the barriers to energy justice that exist in many jurisdictions examined in this collection. In its survey of how Law can assist in facilitating developments, such as decarbonization, that are needed to transit to a new energy system, it has squarely kept a focus on enabling the transition to take place in the fairest possible way.

The Association of Southeast Asian Nations (ASEAN) faces tremendous challenges regarding the future energy landscape and how the energy transition will embrace a new architecture—including sound policies and technologies to ensure energy access together with affordability, energy security, and energy sustainability. Given the high share of fossil fuels in ASEAN’s current energy mix (oil, coal, and natural gas comprise almost 80%), the clean use of fossil fuels through the deployment of clean technologies is indispensable for decarbonizing ASEAN’s emissions. The future energy landscape of ASEAN will rely on today’s actions, policies, and investments to change the fossil fuel-based energy system towards a cleaner energy system, but any decisions and energy policy measures to be rolled out during the energy transition need to be weighed against potentially higher energy costs, affordability issues, and energy security risks. This paper employs energy modelling scenarios to seek plausible policy options for ASEAN to achieve more emissions reductions as well as energy savings, and to assess the extent to which the composition of the energy mix will be changed under various energy policy scenarios. The results imply policy recommendations for accelerating the share of renewables, adopting clean technologies and the clean use of fossil fuels, and investing in climate-resilient energy quality infrastructure.

The widely recognised Energiewende, (“energy transition”) in Germany has lost its original momentum. We therefore address the question of how the transition process to a new energy system can be reignited. To do so, we developed the “5Ds approach”, which lays the groundwork for a process analysis and the identification of important catalysts and barriers. Focusing on the five major fields required for the energy transition, we analyse the effects of: (1) Decarbonisation: How can efficiency and renewable energies be expanded successfully? (2) Digitalisation: Which digital solutions facilitate this conversion and would be suitable as sustainable business models? (3) Decentralisation: How can potential decentralised energy and efficiency opportunities be developed? (4) Democratisation: How can participation be strengthened in order to foster acceptance (and prevent “yellow vest” protests, etc.)? (5) Diversification of service: Which services can make significant contributions in the context of flexible power generation, demand-side management, storage and grids? Our paper comes to the conclusion that German policy efforts in the “5D” fields have been implemented very differently. Particularly with regard to democratisation, the opportunities for genuine participation among the different social actors must be further strengthened to get the Energiewende back on track. New market models are needed to meet the challenges of the energy transition and to increase the performance of “5D” through economic incentives.

In an energy transitions era, the citizens tend to be increasingly considered as actors of the energy system. This situation reinforces in turn the importance of public participation processes into energy policy or legislation design. In 2012-2013, a significant public participation process in the field of energy policy was organised in France, named National Debate on the Energy Transition. From the beginning, it was proclaimed that its results would be integrated into a flagship energy transition act, which did happen with the adoption of the Energy Transition for Green Growth Act of 2015. This paper provides an overview of the organisation of this public debate and of the integration of its outcome into the Energy Transition Act. The experience of France can serve for other countries engaged in a process of transition towards a more sustainable society and especially towards a massive change of their energy mix. It addresses the successes as well as the failures of the French case and provides some key learning points to enhance the public participation into the Law-making process concerning the energy transition.

The goal of this article is to outline and to analyse the key challenges to be faced by the Polish energy market, as it is only at the beginning of the energy transition process. The dynamics of energy policy adaptation process to the challenges of the energy security dimensions, in the face of the energy and climate policy set by the European Union and the expected transformation goals, may cause the growth of the energy security deficit both on a national and regional scale. Given the centralized model of energy infrastructure management, reliance of domestic generation capacity on conventional sources and insufficient development of cross-border networks, Poland is particularly exposed to a security deficit related to the transformation of its energy system, which may also negatively affect other countries in the East- Central Europe region. Using program documents and sector analyses, the article analyses possible strategies for ensuring energy security, setting the issues in the context of the specificity of the Polish energy sector and opportunities for development of regional cooperation between Central and Eastern European countries. As a result, the article reveals an assessment which shows an insufficient recognition by Poland both the external and internal factors determining the pace and direction of energy modernization, as well as a failure to adapt energy policy objectives to the specifics of low-carbon energy sources and the potential provided for by regional energy markets.

China’s leadership is in the middle of overseeing a green transition of the Chinese energy system that aims to replace fossil fuels with clean energy. To move the energy transition ahead, there has been an acute need to continuously develop and adapt guiding policies and regulatory frameworks to stimulate the development of green technologies, complex reform solutions, and appropriate institutions. The responsible Chinese authorities and energy policy actors have chosen to collaborate with international partners to do this. They see Denmark as a best-practice learning case, and through a strategic government-to-government partnership, Denmark has gradually become one of China’s preferred strategic policy interlocutors on energy politics. This chapter examines the role of international policy learning and policy translation in energy policy design in China. It elaborates an analytical model to guide the analysis of policy translation practices, which views policy translation as a process of pragmatic, interactional, adaptive, solution-oriented collaborative efforts that combine a variety of tools to translate foreign energy policy meanings into Chinese energy politics.

Although the two concepts of lean and sustainable construction have been developed due to different incentives, and they do not pursue the same exact goals, there exists considerable commonality between them. This paper discusses the potentials for integrating the two approaches and their practices and how the resulting synergy from combining the two methods can potentially lead to higher levels of fulfilling the individual goals of each of them. Some limitations and challenges to implementing the integrated approach are also discussed. Based on a comprehensive review of existing papers related to sustainable and lean construction topics, the commonality between the two approaches is discussed and grouped in five categories of (1) cost savings, (2) waste minimization, (3) Jobsite safety improvement, (4) reduced energy consumption, and (5) customers’ satisfaction improvement. The challenges of this integration are similarly identified and discussed in the four main categories of (1) additional initial costs to the project, (2) difficulty of providing specialized expertise, (3) contractors’ unwillingness to adopt the additional requirements, and (4) challenges to establish a high level of teamwork. Industry professionals were then interviewed to rank the elements in each of the two categories of opportunities and challenges. The results of the study highlight how future research can pursue the development of a new Green-Lean approach by investing in the communalities and meeting the challenges of this integration.

Classical and contemporary phenomenological approaches in psychiatry describe schizophrenia as a disorder of common sense and self-affection. Although taking into account intersubjectivity, this conceptualization still puts forward an individualistic view of the disorder, that is, the intersubjective deficit resides within the person. To overcome such individualism, in this article, we first propose that schizophrenic experience might be understood as arising from a dialectic relation between the self’s loss of openness to the world and the world’s loss of openness to the self. To show the relevance of social factors at the onset of schizophrenic experience, we propose a phenomenological analysis of trigger situations. In the second and main part of this article, we then focus on the implications of these phenomenological insights for the clinical practice: we argue that if schizophrenia is understood as a loss of openness between self and social world, psychiatric institutions should be transformed into spaces that enable a reopening of selves. We first describe <i>enclosing</i> phenomena such as coercive treatment to then, in contrast, present particular forms of <i>open psychiatric spaces</i> such as open door approaches and open dialogue. Besides the institutional-structural level, we also highlight aspects of openness at the intersubjective level of the individual agents, thus particularly emphasizing the role of an open therapeutic stance. We thus speak of (re)opening <i>selves</i> as we believe that the reopening of the patients’ self cannot but be related to and fostered by a reopening of the professionals’ self and stance. We thus argue that openness in the therapeutic stance is key to initiating the further process of recovery, which we describe as a reattunement of selves both at the bodily and narrative level. Last but not least, we sketch out possibilities for future phenomenological research on the question of psychiatric space and draw some broader societal implications.

Transportation is a key factor in the fight against climate change. Consumer behavior changes in transportation are underrepresented in energy policies, even if they could be essential to achieve the fixed GHG emission reduction targets. To help quantify the role of behaviors in energy transition and their implications on the dynamics of an energy system, this study is conducted using the North American TIMES Energy Model, adapted to Quebec (Canada). A behavioral disruption scenario (an increase in carpooling) is introduced in the model’s transportation sector and is compared to a massive electrification scenario. Our results highlight the fact that a behavioral disruption can lead to the same GHG emission reductions (65%) by 2050 as an electrification policy, while alleviating different efforts (such as additional electrical capacity and additional costs) associated with massive electrification. Moreover, the results are sensitive to behavior-related parameters, such as social discount rates and car lifetimes.

Abstract The law and regulation of the energy sector in Australia is subject to overlapping responsibilities of both federal and state governments. Crucially for energy transition efforts, neither energy, environment nor climate is mentioned in the Australian Constitution. Australia has a tradition of creative cooperative federalism solutions for responding to problems of national importance. In the energy sector this has resulted in an intricate national framework for energy markets, which relies on mirror legislation passed by participating states, with oversight by state and federal executive governments. Independently of these frameworks, both federal and state governments have passed climate change legislation, which crucially includes renewable energy support mechanisms. At a time when a rapid transition to a decarbonized energy system is essential, legal frameworks struggle to respond in a timely fashion. The political discourse around energy has become increasingly toxic – reflecting a dysfunctional state–federal relationship in energy and climate law. Australia needs to consider whether its cooperative federalism solutions are sufficient to support the energy transition and how climate law at the state and federal levels interacts with energy market legal frameworks.
