Penelitian ini mempunyai tujuan untuk memahami hubungan setiap pihak pada sistem Peer to Peer Lending secara hukum serta menganalisis pengaturan penyelesaian sengketa pada sistem Peer to Peer Lending. Metode pada penelitian ini yaitu penelitian yuridis normatif dengan mempergunakan pendekatan perundang-undangan dalam menganalisis isu hukum yang sumber hukumnya berasal dari bahan hukum primer, sekunder, serta tersier. Hasil pada penulisan ini menunjukkan bahwa belum  terdapat pengaturan secara khusus terkait penyelesaian sengketa dalam sistem Peer to Peer Lending. Sengketa pada sistem tersebut membutuhkan proses penyelesaian sengketa yang cepat, mudah, serta  terjangkau sehingga perlu dibentuk  Lembaga Alternatif Penyelesaian Sengketa online yang khususnya  menangani sengketa bisnis dengan sistem Peer to Peer Lending. This study aims to understand the relationship of each party in the Peer to Peer Lending system legally and to analyze dispute resolution arrangements in the Peer to Peer Lending system. The method in this research is normative juridical research using a statutory approach in analyzing legal issues whose sources of law come from primary, secondary and tertiary legal materials. The results of this paper indicate that there is no specific arrangement regarding dispute resolution in the Peer to Peer Lending system. Disputes in this system require a dispute resolution process that is fast, easy, and affordable, so it is necessary to establish an alternative online Dispute Resolution Institute which specifically handles business disputes with the Peer to Peer Lending system.

AbstractIf the dawn of the Anthropocene heralds the collapse of the natural and social sciences into a single geostory, then why not also a radical synthesis of the anthropocentrism of Marxist theorising with the biocentrism of Deep Ecology? This article proposes just such a unification for theorising education. First, those on the educational left who wish to develop a fundamental unity between red and green should perhaps unearth the roots of Deep Ecological thinking and delve into the long and manifold history of socialist movements, with the aim of identifying where, between the deep red and deep green, might lie some shared origins in common ground. The flawed but nevertheless distinctive monism of the first philosopher of Marxism, Joseph Dietzgen, offers a philosophy that both prefigures the cosmology of Deep Ecology and suggests means of reconciling the narrative of human toil and ‘progress’ with that of human ‘nestedness’. The task facing the socialist looking to explore such a possibility needs to be located principally at the level of ‘cosmic’, rather than ‘social’ ontology, and this article sketches the outlines of such a unity project. Second, from this synthesis flows a set of implications for education and human growth. As the article explains, themes such as alienation and subjectification that cross-pollinate the theoretical perspectives might serve as central motifs in a red biocentric educational project fit for the Anthropocene. It is not solely environmental education, but approaches to education more broadly that require reconceptualisation for the Anthropocene.

The purpose of this study is to examine some of the major constitutional and legal issues that are imperative in Ghana’s public administration. Despite Ghana’s success in promoting democratic governance over the past decades since the 1992 transition, numerous constitutional and legal issues affect effective policy design and implementation that require urgent governmental reforms. The study discussed the constitutional and democratic theories as the basis of the work. The methodology used is based on the qualitative approach with combined sources from primary and secondary data. The findings in the study show that certain aspects of Ghana’s constitutional provisions and legal framework do adversely affect its policy design and implementation in diverse ways. The significance of the study is that the outlined challenges and recommendations will inform the government and key policy makers on the need to make effective policies in order to enhance the country’s political and socio-economic development. The study’s implication for theory is that it will inform its readers about the different theoretical perspectives on the issues discussed. The study also provides key insights into important issues in Ghana’s constitutional provisions, and the legal and policy environment, which can serve as useful tools or instruments for policy makers in the three organs of government and the bureaucracy. This study further contributes towards academic discussions on the viability of the constitutions drawn by authoritarian regimes prior to the third-wave democratic transitions in Africa, and the difficulties some of these constitutional provisions pose to making effective policies and governance, thus emphasizing the need for constitutional reviews.

This chapter offers an account of central issues in feminist social and political philosophy, examples of important contributions and disagreements within the field, and suggestions regarding future directions in feminist social and political philosophy. The chapter reviews the relationship between feminist social and political philosophy and nonfeminist social and political philosophy and proposes a thematic taxonomy for the field that demarcate four subareas within it: (i) social ontology, (ii) norms, structures and power, (iii) social justice, (iv) politics. While necessarily crisscrossing each other, every one of the subareas is organized around different enough questions and therefore shifts the theoretical perspectives that are developed through their discussion.

<p><em>Financial technology is the implementation of the use of technology to improve banking and financial services. The emergence of Fintech-based companies, especially those offering lending and borrowing services or Peer To Peer Lending (P2PL) is currently getting the attention of the public and regulators. P2PL-based fintech services are one of the solutions for limited access to financial services in the country and realizing financial inclusion through synergies with financial institutions and technology companies. With the development of fintech peer to peer lending, illegal fintech problems arise which are detrimental to society, so it is necessary to study the legal protection of the regulations that govern it, and how to resolve disputes against it This research is normative by examining legal issues regarding legal protection for consumers and fintech peer to peer lending services and dispute resolution in the fintech business. Kemunculan perusahaan-perusahaan berbasis <em>Fintech </em>terutama yang menawarkan layanan pinjam meminjam uang atau <em>Peer To Peer Lending </em>(P2PL) saat ini semakin mendapatkan perhatian publik dan regulator. Layanan <em>fintech </em>berbasis <em>P2PL </em>menjadi salah satu solusi terbatasnya akses layanan keuangan di tanah air dan mewujudkan iklusi keuangan melalui sinerginya dengan istitusi-institusi keuangan dan perusahaan-perusahaan teknologi. Semakin berkembangnya <em>fintech peer to peer lending </em>timbul permasalahan <em>fintech </em>illegal yang banyak merugikan masyarakat, maka itu perlu dilakukan kajian perlindungan hukum terhadap regulasi yang mengaturnya, serta bagaimana penyelesaian sengketa terhadapnya. Penelitian ini bersifat normatif dengan mengkaji isu hukum tentang perlindungan hukum terhadap konsumen dan layanan <em>fintech peer to peer lending</em> dan penyelesaian sengketa pada bisnis <em>fintech.</em> Metode penelitian yang digunakan meliputi pendekatan undang-undang <em>(statue approach)</em> dan pendekatan konseptual <em>(conceptual approach). </em></p><strong>Kata Kunci : </strong>Perlindungan hukum, <em>financial technology peer to peer lending.</em>

Peer-to-peer (P2P) lending is gaining popularity in Vietnam, especially in the past two years. In fact, this form of lending appeared a long time ago in the world with the establishment of Zopa in the U.K. in 2005. There is neither much research nor a strict legal framework on P2P lending in Vietnam. As a result, P2P lending platforms encounter many problems, especially legal issues during their operation in Vietnam. The article aims to provide a theoretical framework on P2P lending and the practical situation in developed markets such as the U.S. and European. We also present an overview of the P2P lending market and the performance of P2P lending platforms in Vietnam which we find not operating up to their essence. Based on the analysis and experience from other countries, we suggest some solutions to increase the effectiveness of this form of lending in Vietnam’s market.
