AbstractIn Bangladesh, disputes over custody and guardianship involving Muslim parties are principally governed by Muslim personal law. There remains a constant dilemma in judicial decisions over custody and guardianship matters as to what should be the paramount consideration in awarding child custody to a party – should traditional Muslim personal law rules or the welfare of the child prevail? The findings of this study indicate that there is a steady but inconsistent trend towards child welfare considerations. However, it cannot conclusively be said that a child’s welfare is now themostdominant, or theonlyconsideration for the courts. Focusing on this shift towards a welfare approach, this article critically examines some of the leading reported judgments of the Supreme Court of Bangladesh on the issue.

One of the causes of divorce which was decided by a Religious Court judge was because of the apostasy of one of the spouses. Divorce due to apostasy leaves problems in parenting. To whom the child custody will be given must be considered by the judge. This research is empirical research (field study) with fiqh and family psychology approach to get an understanding of the basic considerations of judges in establishing child custody in the case of an apostate partner. Through interviews and documentation, the study found, that the consideration of judges based on three things: first, normative basis, which is based on the consideration of Constitution No. 1 of 1974, Compilation of Islamic Law, Constitution No. 7 of 1989 Jo. Constitution Number 30 of 2006 concerning Childcare, and Number 23 of 2002, Supreme Court jurisprudence Number 210 / K / AG / 1990. Second, fiqh basis, which refers to the requirements of the Hadhanah which are in line with fiqh and the provisions of the Hadhanah based on Syafii's Madzab. Third, the psychological basis, which considers all psychological problems related to children. By using this integrative analysis the judge considers that the requirements for Muslims to care for children are in line with psychological values, that the family must provide Islamic education to shape the child's mental spirit.

One of the principles in national marriage law that is in line with religious teachings is to make divorce difficult (divorce), because divorce means the failure of the purpose of marriage to form a happy and eternal family due to human actions. The problem in this reshearch is how is the regulation of the implementation of divorce in the Religious Court, what is the effect of the divorce law on the grounds of lesbian behavior of a wife, how is the consideration of the judge in the Ambon Religious Court decisionNumber 110 / Pdt.G / 2016 / PA Ab. As a result of divorce law on the grounds that the lesbian behavior of a wife is related to child custody. The legal effect on marital property is that joint property is divided according to the provisions of the respective laws, laws, religion and customary law, while the inheritance remains controlled by each of the wives and divorced husbands. With regard to debt due to termination of marriage due to divorce borne by both parties with conditions that must be met where the rights and obligations of husband and wife are balanced in their authority to carry out legal actions. Judge's consideration in the decision of the Ambon Religious Court Number 110 / Pdt.G / 2016 / PA Ab in the case of sexual disorders (lesbians) immediately considers that this is in accordance with the provisions in Article 39 paragraph 2 of Law Number 1 of 1974 along with the explanation in letter e and letter f juncto Article 19 letter f Government Regulation Number 9 of 1975, Article 116 letter e and letter f Inpres No. 1 of 1991 concerning the Compilation of Islamic Law (KHI).

Human Rights contain provisions relating to Islamic law, especially family law. As a Sharia scholar, this topic is crucial to observe. This paper analyzes several aspects of family law in human rights, both universal human rights and universal human rights, such as marriage, inheritance, and child custody. There are the similarities and differences in both of these human rights like in the case of marriage. In Universal Declaration Human Rights, marriage is permissible for a couple without consideration of religion at all (article 2), whereas in Universal Declaration Human Rights, there is strong indication (Article 19 (1)a) that inter- religious marriage is forbidden, such as the comments of Elizabeth Mayer and others.DOI: 10.15408/ajis.v16i1.2892

Mediation or sulh at the Malaysian Shariah Court deals with a variety of issues relating to Islamic family law including the child custody issues. Disputes that exist between the parties can be resolved through litigation (court) and non-litigation (outside the court). Sulh is one of the non-litigation methods in settling disputes in peace and harmony. The Government initiative by introducing sulh since 2001 helps in reducing the backlog of cases, speeds up settlement of dispute and it has become a very constructive method of resolving disputes amicably. This article aims to discuss and analyse the principles of sulh in Islamic Law, its foundations and its implementation in Malaysia particularly in child custody disputes. The article also will look at how sulh interacts with the new implementation of the Special Court of Hadanah established in the Shariah Court of Federal Territories (MSWP). The methodology adopted, is library-based research to collect information, data and theories involved, from selected materials including journal articles, textbooks, statutes, as well as interview method. The data were analysed using the content analysis method. The study concludes that the practice of sulh in the child custody disputes is not only in line with the Islamic Law but also plays a vital role in protecting the children’s rights as outlined by the intent of the Divine Guidance (Maqasid Shariah).   Keywords: Sulh, mediation, Shariah court, child custody dispute, ADR. Abstrak Mediasi atau Sulh yang dilaksanakan di Mahkamah Syariah melibatkan pelbagai isu kekeluargaan termasuklan kes penjagaan kanak-kanak. Pertikaian yang terjadi diantara pihak-pihak dapat diselesaikan melalui dua kaedah iaitu perbicaraan (di dalam mahkamah) dan penyelesaian tanpa perbicaraan (luar mahkamah). Sulh adalah salah satu kaedah penyelesaian pertikaian secara damai dan harmoni yang dilakukan tanpa perbicaraan. Inisiatif Kerajaan memperkenalkan Sulh mulai tahun 2001 telah membantu mengurangkan lambakan kes di mahkamah, menyelesaikan kes dalam tempoh yang singkat dan ianya menjadi kaedah yang sangat konstruktif dalam menyelesaikan pertikaian secara damai tanpa sengketa. Tujuan kertas kerja ini disediakan adalah untuk membincangkan serta menganalisa kewujudan Sulh di dalam Undang-Undang Islam, melihat kepada asas serta pelaksanaan Sulh di Malaysia terutama dalam kes melibatkan pertikaian penjagaan kanak-kanak. Artikel ini juga meneliti bagaimana pelaksanaan Sulh membantu ke arah pelaksanaan Mahkamah Khas Hadhanah yang baharu ditubuhkan di Mahkamah Syariah Wilayah Persekutuan (MSWP). Metodologi yang dilaksanakan di dalam kertas kerja ini melibatkan kajian perpustakaan bagi mengumpulkan maklumat, data dan teori yang terlibat daripada bahan-bahan terpilih termasuklah jurnal artikel, buku teks, statut serta kaedah temubual. Data yang diperolehi kemudiannya dianalisa menggunakan kaedah analisa kandungan. Kajian ini menyimpulkan bahawa amalan Sulh melibatkan pertikaian penjagaan kanak-kanak bukan sahaja selari dengan Undang-Undang Islam, namun Sulh juga berperanan penting dalam melindungi hak kanak-kanak seperti yang digariskan oleh Maqasid Syariah. Kata Kunci: Sulh, mediasi, mahkamaah Syariah, pertikaian penjagaan kanak-kanak, ADR.
