Every theory of justice requires a first-order theory specifying principles of justice, and a second-order view explaining why those principles constitute the correct principles of justice. According to John Rawls, political liberalism is committed to the two principles of justice specified in its first-order theory, “justice as fairness.” Justice as fairness, according to Rawls, in turn presupposes the second-order view that justice is a political conception. A political conception of justice treats the principles derived from the fundamental ideas in the public political culture as the correct principles of justice. Political liberalism, however, nowhere offers a defense of the view that justice is a political conception. Indeed, it even strives to avoid the admission that it presupposes that justice is a political conception by stating only that it uses a political conception of justice, while allowing that justice might not actually be a political conception. As to the truth of its second-order presupposition, political liberalism chooses to remain agnostic. Rawls claims that political liberalism has no choice at all. To do otherwise, he argues, would lead to an internal contradiction.

John Rawls (b. 1921–d. 2002) was the leading Anglo-American political philosopher of the second half of the 20th century. In his seminal 1971 book, A Theory of Justice (revised edition, Rawls 1999c, cited under Primary Texts), Rawls defends a liberal theory of social and political justice that he called “justice as fairness” as an alternative to utilitarianism, the then-dominant framework. By considering which principles of justice would be chosen from a hypothetical but fair initial choice situation called “the original position,” Rawls presents a variation on the traditional social contract doctrine. He argues that, deprived of specific knowledge of their own situation, the parties in the original position would be forced to reason impartially, and they would agree to principles of justice that required an equal scheme of basic rights and liberties, fair equality of opportunity, and an egalitarian (although not strictly equal) distribution of wealth and positions of authority. These principles are to be used to evaluate the basic structure of society—the system formed by a society’s basic social institutions. Rawls continues to defend these principles of justice and the argument from the original position, but in his second book, Political Liberalism (Rawls 2005, cited under Primary Texts), he presents justice as fairness as an example of a “political conception of justice” (pp. xxix, 11–15). Recognizing the diversity of reasonable comprehensive religious, philosophical, and moral doctrines, Rawls argues that a democratic society’s “public reason” should not be tied to any particular comprehensive doctrine, and its stability could be founded only on an overlapping consensus of reasonable comprehensive doctrines. Although Rawls intended his principles of justice to be used in evaluating the basic institutional structure of a society, some theorists argued that the same (or similar) principles should also be used to evaluate the justice of the global order. In The Law of Peoples (Rawls 1999b, cited under Primary Texts), however, Rawls rejects this direct extension. Instead he argues for a far less egalitarian standard of permissible economic inequality among societies and for toleration of certain non-liberal societies that reject the liberal rights he defends domestically (although toleration need not be extended to those who rejected basic human rights). In all three of these areas—defending a liberal conception of justice, modeled on the idea of a social contract, as an alternative to utilitarianism; developing the ideas of democratic justification contained in public reason and a political conception of justice; and introducing a distinction, grounded in a political liberalism itself, between the standards of domestic justice and those of international relations or global justice—Rawls was both controversial and agenda-setting for Anglo-American philosophy. In political philosophy today, his theories continue to represent a baseline against which other theories present themselves.

In A Theory of Justice, John Rawls assumes that the principles of justice are for individuals in a society, and in general he assumes that the society is an ethnically homogeneous state. He thus follows the tradition associated with the dominant form of the social contract theory, which focuses on the individual and the state. His assumptions neglect the fact that almost all states are ethnically plural or heterogeneous, and that many of them confer special status and rights on ethnic groups as collective entities; for example, many of them confer special status and rights on indigenous groups, on groups disadvantaged by prior discrimination, and on minorities and other groups conceded a right to survive as distinct cultural entities. Status and rights for groups necessarily mean differentiation among individuals depending on their membership; and this in turn means that a theory of justice that focuses on the individual and neglects the group both fails to account for existing practices and fails to give guidance where the practices are at issue.

The aim of this article is to characterize the John Rawls’s theory of justice as fairness developed in A Theory of Justice (1971), Political Liberalism (1993), Replay to Habermas (1995) and Justice as Fairness: A Restatement (2001), with a view to identifying the convergent points between deontological conception with teleological characteristics and identify a substantive conception of justice, not purely procedural, which is universalist albeit not transcendental, making possible an approach between communitarian and liberal ethical theories.

(1) In his recent paper, “Justice as Fairness: Political not Metaphysical,” John Rawls makes use of a footnote to disown what to many readers must have seemed one of the most striking and original underlying ideas of his theory of justice, that it “is a part, perhaps the most significant part, of the theory of rational choice.” That Rawls should issue this disclaimer indicates, at least in my view, that he has a much clearer understanding of his theory, and its relationship to rational choice than he did at the time that he wrote A Theory of Justice. As I note in Morals by Agreement (pp.4–5), Rawls does not show that principles of justice are principles of rational choice. Hence, in appropriating the idea, I can claim diat I am undertaking a pioneering enterprise. No doubt Thomas Hobbes would have undertaken it had the resources of the theory of rational choice been at his disposal, but I do not intend to pursue counterfactuals in a search for historical antecedents. Moral theory as rational choice theory is, I claim, a new venture.

In a previous experimental study of image formation using a thin (20 nm) negatively stained catalase crystal, it was found that a linear or first order theory of image formation would explain almost entirely the changes in the Fourier transform of the image as a function of defocus. In this case it was concluded that the image is a valid picture of the object density. For thicker, higher contrast objects the first order theory may not be valid. Second order effects could generate false diffraction spots which would lead to spurious and artifactual image details. These second order effects would appear as deviations of the diffraction spot amplitudes from the first order theory. Small deviations were in fact noted in the study of the thin crystals, but there was insufficient data for a quantitative analysis.

The wave resistance due to the steady motion of a ship was formulated in Lagrangian coordinates by Wehausen [1].2 By introduction of an iteration scheme the solutions for the first order and second order3 were obtained. The draft/length ratio was assumed small in order to simplify numerical computation. In this work Wehausen's formulas are used to compute the resistance numerically. A few models are selected and the wave resistance is calculated. These results are compared with other methods and experiments. Generally speaking, the second-order resistance shows better agreement with experiment than first-order theory in only a restricted range of Froude number, say 0.25 to 0.35, and even here not uniformly. For larger Froude numbers it underestimates seriously.

Abstract It has been argued (e.g., by De Villiers and colleagues) that the acquisition of sentence embedding is necessary for the development of first-order Theory of Mind (ToM): the ability to attribute beliefs to others. This raises the question whether the acquisition of double embedded sentences is related to, and perhaps even necessary for, the development of second-order ToM: the ability to attribute beliefs about beliefs to others. This study tested 55 children (aged 7-10) on their ToM understanding in a false-belief task and on their elicited production of sentence embeddings. We found that second-order ToM passers produced mainly double embeddings, whereas first-order ToM passers produced mainly single embeddings. Furthermore, a better performance on second-order ToM predicted a higher rate of double embeddings and a lower rate of single embeddings in the production task. We conclude that children’s ability to produce double embeddings is related to their development of second-order ToM.

Combining an energy-dispersive element with a magnetic prism results in an achromatic mass dispersive instrument, if parameters are chosen appropriately. A plane electrostatic mirror has been chosen as the energy-dispersive element. Trajectories are described in terms of lateral, angular, and energy variations about the principal trajectory. Achromatism and conjugate plane conditions have been calculated by the powerful method of matrix algebra. The first order theory is given in this article (part one), the second order term will be studied in part two which will be published later.
