У статті досліджено вплив Суду Європейського Союзу (ЄС) на впровадження і застосування Угоди про асоціацію між Україною та ЄС, що викликало безпрецедентні політичні, економічні та правові реформи в Україні. Зокрема, розглядаються конституційні виклики, які постали перед державою під час виконання Угоди в правовій системі. Крім того, досліджено два питання. Перше – ефективне впровадження та застосування Угоди про асоціацію між Україною та ЄС в українській правовій системі. Друге – сумісність і відповідність Угоди Конституції України. Проаналізовано останні політичні та правові події в Україні через призму ефективної реалізації Угоди про асоціацію між Україною та ЄС і зростання проєвропейського правового активізму в державі. На закінчення стверджується, що Угода про асоціацію між Україною та ЄС посилює пристосованість національного конституційного устрою до цілей досягнення європейської інтеграції та застосування європейських спільних цінностей в Україні. Угода про асоціацію між Україною та ЄС створила стійку інституційну та правову основу для застосування acquis ЄС (правового доробку ЄС), включаючи прецедентне право ЄС та комплексне законодавче наближення між законодавством України та ЄС. Однак інституційні реформи, які вже відбулися, не можна вважати цілком достатніми. Верховній Раді України не вдалося запровадити основні та процедурні засади для застосування та впровадження Угоди в правовий порядок України. Однак ця прогалина частково заповнюється зростаючим судовим активізмом в Україні. Вітчизняні судді вже почали посилатися на Угоду про асоціацію між Україною та ЄС і відповідні частини acquis ЄС у своїх рішеннях, тим самим закладаючи основу для регулярного застосування загальних принципів права ЄС у процесі виконання й імплементації Угоди про асоціацію між Україною та ЄС.

In the closing paragraph of his inaugural lecture Law and Language, Professor Allott referred to what he termed “a daunting obstacle” to the intensive study of African legal systems.That obstacle is the rapid disappearance, before our very eyes, of the traditional systems that we have proposed to study. A generation ago there would not have been that difficulty; but today the traditional tribunals have vanished in many African countries where their place has been taken by statutory local courts. Even where the traditional courts appear to have survived, at least in name, they are usually affected by the impact of western law and institutions and of central government control.Those words were written in 1965. How true and necessary they were is shown by the fact that more than fifty years previously—even more than “a generation ago”—the impact of “western” influences upon the Tswana peoples of the Bechuanaland Protectorate (now the Republic of Botswana) had already led to many changes in the indigenous legal system, although, at that time, the “traditional courts” still survived virtually intact and not merely “in name”.The nature and extent of those changes can be readily ascertained by the fortunate chance that, there are still available the records of approximately 470 cases tried, over a period of six and a half years, in the highest traditional court of the Ngwaketse, a major Tswana chiefdom.

Past research has indicated that Major Depressive Disorder and exposure to violence are risk factors for offending. However, researchers have yet to examine how this disorder may predict recidivism risk among juvenile offenders and how the disorder moderates the effect of exposure to violence. Kaplan-Meier survival analysis was used to determine the impact of Major Depressive Disorder on time to recidivism. Cox proportional hazard modeling was applied to examine Major Depressive Disorder as a moderator of exposure to violence. Results indicated that participants with Major Depressive Disorder demonstrate greater risk for recidivism post-adjudication. The proposed moderation effect was not supported.

Significant work is currently being done around the world to protect the rights of the child, pay special attention to the upbringing of minors, create the necessary conditions for them to organize their time properly, take measures to prevent them from interfering in crime and to impose penalties and impunity on juvenile offenders. In this article analyzed features of inflicting of penalties to a juvenile, peculiarities of criminal prosecution of minors, improving institutions which discharge from liability and penalty based on international experience, in particular, convicting other noncustodial penalties and other legal measures at the period of COVID-19 and further development, introducing special principles for juvenile in criminal law, the impact of punishments imposed on juvenile offenders, As well as, issues of prevention and prophylaxis of youth delinquency, measures should be taken to prevent youth delinquency, problems and solutions on this field, reforms, the forms and methods of work of government agencies involved in the prevention of delinquency among young people, causes and conditions of juvenile systemic crime, domestic legislation on prevention and prophylaxis of youth delinquency and peculiarities of appointing punishment to minors are studied. The following article expresses a number of suggestions for improving the legislation system of juvenile delinquency, features of imposing them punishment and release of them from punishment.

En el marco de la reflexividad, este artículo propone una analísis de las bases teoricas que le dan le dan un sustento deontológico al derecho de la competencia en el ordenamiento jurídico colombiano; reconociendo el impacto de la globalización como un fenómeno cultural, inmerso en la economía de los diferentes países, el cual ha facilitado el intercambio continuo de productos, la competencia en los mercados, pero bajo ciertos requerimientos y restricciones que promuevan la calidad sin afectar la equidad en las relaciones de producción y permitan la intervención de organismos nacionales e internacionales, veedores de la eficacia, transparencia de las negociaciones y garantes de la proteccion de los derechos de los consumidores y sociedad en general. The political direction of the law in Indonesia in the development of national law simplifies legislation. The scope of national legal development is not only through legislation. There is the functionalization of the law that lives in society. The purpose of the research describes the political urgency of law in the development of national law and reviews the political direction of national law development law. This research uses a philosophical approach, namely to examine the law from the ideal side in the form of an idea of the direction of national law politics in the future. The results of this study show that the politics of law is necessary to provide direction in the development of national law. Each country has a legal political direction whose role as the basic policy of state organizers to determine the direction, shape, and content of the law to be established. Legal politics as a strategy of the formation process, as well as the implementation of laws based on the national legal system to achieve the goals and ideals of the state. The political direction of the law in Indonesia in the development of national law simplifies legislation. The scope of the development of the national legal system can be through legislation and functionalization of the living law. The political direction of the law in Indonesia in the development of national law simplifies the process of legislation. The impact will only be a successful legal state in law-making, but weak in law in action. The implication of this study is to expand the political direction of national law which includes the functionalization of the living law. By functionalizing "the living law", the resulting law is rooted in the legal consciousness of society.
