Abstract The paper is aimed at the evaluation of current state of secondary resource market in Russia and the determination of factors of their influence on the extended producer responsibility (EPR). Research objectives include scientific justification of directions for the improvement of solid waste management handling process in the Russian regions in order to provide the support for manufactories and importers performing the extended producer responsibility activities. GAP-analysis was used as a method of obtaining the systematic results on the basis of the information received about the current state of the Russian secondary resource market according to various criteria, including the product quality, processing methods, communication between producers and consumers, and state regulations. Research is executed on the grounds of collaborative use of positivistic and phenomenological approaches, where the findings are based on the comparison of experts’ opinions on the factors influencing the development of EPR mechanism, and statistics of the financial performance of main players of the Russian secondary resource market. As a scientific novelty, it is proposed to use the development of secondary resource market for enhancing of EPR mechanism in Russia. The study reveals that successful functioning of the extended producer responsibility mechanism depends not only on business representatives involved in the production of goods and packaging, but also on consumers and on the state authorities.

AbstractThe role of subsequent state practice in the procedural law of treaties, and in the determination of consent in the implementation of treaties have become the subject of much scholarly debate in recent times. The UN International Law Commission has devoted copious amounts of study time into these issues under the distinguished guidance of Georg Nolte as Special Rapporteur. Ph.D. theses and research monographs, journal articles and commentaries have appeared on the matter, but the debate persists. At one end of this debate are treaty-text loyalists that reject the potential of subsequent state practice to modify what they regard as ‘solemn oaths’ taken by states when they conclude and adopt a treaty. That ‘temporal declaration of consent’ by states to be bound by a treaty regime is for them sacrosanct. At the other end are analytical jurisprudence scholars who appear to insist upon a purpose test approach to the matter. This article evaluates treaty-text loyalists’ arguments under current state practice on treaty implementation across a number of disciplines. It shows that the view that ‘temporal consent’ supremely prohibits the modification of treaties through subsequent state practice is exaggerated. Moreover, the ‘solemn oaths’ perception of treaties is not supported by recent examples of treaty implementation.

A powerful legal tool in evolving solid waste management (SWM) systems is extended producer responsibility (EPR). It is a mechanism that shifts the responsibility of a product to manufacturers/importers at the ‘end-of-life’ stage. Yet, implementation of the EPR concept has faced difficulties in developing countries. In Iran, as one such country, the principle of EPR system was issued in executive regulation of SWM in 2005, however, so far, it has been limited to a voluntary scheme. The problem merits further investigation. Therefore, this study aims to shed light on the obstacles in the path of developing EPR system for product packaging. The research examines the current SWM systems in four functional classified frameworks: legal, institutional, financial and technical. The strengths, weaknesses, opportunities and threats of the system are elaborated through semi-structured interviews with a senior executive in the Ministry of Interior (MoI). Then, viable methods to increase resource efficiency and sustainable waste treatment are suggested. The change in the financing mechanism in the Budget Law 2020 forces the manufacturers/importers of products containing recyclable components to pay the revenue from one in 1000 products to MoI for developing recycling facilities and incinerators through partnerships with the private sector. This new strategy would promote proper management of product packaging, create more jobs and a market for international cooperation. However, poor source-separation of wet/dry waste, informal sector activities, exclusive focus on the economic aspect of waste management, lack of expertise and public awareness campaigns are the barriers in this regard.

In the article the tendencies of development of social entrepreneurship at the present stage are considered, and the state support of this sphere of entrepreneurship is estimated. The main directions of state support of social entrepreneurship of Ugra are marked and priorities and key tasks are outlined. The urgency of the work lies in the increasing role of the development of social initiatives in entrepreneurship and state support for social entrepreneurship as a phenomenon in public life. The aim of the research, the results of which are given in this article, is to assess the role of state support in the development of social entrepreneurship in Yugra. The scientific significance of the research is a comprehensive study of the impact of state support on the current state of social entrepreneurship and the development of social initiatives. The practical importance of the work lies in applying the results of research in decision-making in the field of social project management and their effectiveness in implementation. The objectives of the study are: determination of directions of state support affecting the development of social entrepreneurship; determining the degree of influence of state support on the development of social entrepreneurship in the Autonomous Okrug; forecasting the further development of social entrepreneurship. In the process of scientific research, logical and formal methods of analysis and statistics were used: comparisons, computational and constructive, graphical, expert assessments, and others. The result of this work is the identification of the factors influencing state support for the development of social entrepreneurship in Ugra.

Purpose. The issue settlement of building production optimizing for contracting companies is an urgent task and is becoming more acute with regard to the current dynamic transformations in building market in context of Ukrainian regions. Methodology. The leading role of optimization models lies in discretization and modernization to organizational processes of building production for contracting companies, which are the basic structures for delivery of completed building projects. The study focuses on determination of need to optimize building processes and analysis of calculating concept the implementation efficiency of optimization models in contracting company. Findings. It has been considered the current state of domestic building market on the basis of analytical and statistical data; established that conjuncture of building markets has average, mainly low competitiveness indicators, there is a non-rhythmic development and formation of domestic building sector. Originality. Analytical and theoretical foundations were developed for actualization and conceptualization to implementation of optimization models and development of fundamentally new ones. Practical value. The theoretical and methodological foundations of analysis are scientific impetus to the practical formation of innovative approaches to organization of building production at the current stage of building market development in Ukraine.
