This commentary analyses Article 9.1.8 of the UNIDROIT Principles of International Commercial Contracts (PICC). According to Art 9.1.8, the obligor has a right to be compensated by the assignor or the assignee for any additional costs caused by the assignment. The additional costs for which the obligor claims compensation must be caused by the assignment of a right; that is, they must be a direct consequence of it. In particular, additional costs may be caused by the fact that performance has to be rendered at a different place or to more than one obligee in the case of a partial assignment. This commentary discusses additional costs relating to change of place of performance and partial assignments, as well as the obligor's right to choose to claim compensation from either the assignor or the assignee.

This commentary analyses Article 9.1.4 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning partial assignment. Art 9.1.4 recognizes the economic need for assigning part of a right. Taking into account the underlying rationale of Section 9.1 of the PICC that the assignment should not burden the obligor, Art 9.1.4 draws a distinction between a right to the payment of a monetary sum and a right to other performance. According to this provision, a right to the payment of a monetary sum may be assigned partially. A right to other performance may be assigned partially only if it is divisible, and the assignment does not render the obligation significantly more burdensome. This commentary discusses the right to the payment of a monetary sum, right to other performance, the divisibility of a right, the additional burden that a partial assignment may put on the obligor, and the effects of partial assignment on the obligee and obligor.

This commentary analyses Article 9.1.3 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning the assignability of non-monetary rights. For a better understanding of Art 9.1.3, it is important to bear in mind the rule stated in Art 9.1.8, which provides for the right of the obligor to be compensated by the assignor or the assignee for any additional costs caused by the assignment. It was considered that the remedy set forth in Art 9.1.8 may not be sufficient when the assignment concerns a right to non-monetary performance, and therefore Art 9.1.3 was introduced. According to Art 9.1.3, a right to non-monetary performance may be assigned only if the assignment does not render the obligation significantly more burdensome. This commentary discusses obligations that are significantly more burdensome as well as the effects of transfer of a right to non-monetary performance, especially with respect to the obligee and obligor.

The defect microstructures of Si arising from ion implantation and subsequent regrowth for a (111) substrate have been found to be dominated by microtwins. Figure 1(a) is a typical diffraction pattern of annealed ion-implanted (111) Si showing two groups of extra diffraction spots; one at positions (m, n integers), the other at adjacent positions between <000> and <220>. The object of the present paper is to show that these extra reflections are a direct consequence of the microtwins in the material.

This article illustrates the potential of placing audiology services in a family physician’s practice setting to increase referrals of geriatric and pediatric patients to audiologists. The primary focus of family practice physicians is the diagnosis/intervention of critical systemic disorders (e.g., cardiovascular disease, diabetes, cancer). Hence concurrent hearing/balance disorders are likely to be overshadowed in such patients. If audiologists get referrals from these physicians and have direct access to diagnose and manage concurrent hearing/balance problems in these patients, successful audiology practice patterns will emerge, and there will be increased visibility and profitability of audiological services. As a direct consequence, audiological services will move into the mainstream of healthcare delivery, and the profession of audiology will move further towards its goals of early detection and intervention for hearing and balance problems in geriatric and pediatric populations.

PT XYZ sering mengalami keterlambatan waktu karena dalam setiap keterlambatan yang dilakukan selalu ada penalty yang diberikan kepada perusahaan dan hal ini mengakibatkan tambahan biaya , oleh karena itu hal ini harus dihindari dengan membuat penjadwalan yang efisien, dalam hal ini dilakukanlah perbaikan dengan meminimisasi waktu penyelesaian maksimum Cmax pada mesin paralel yang berpola aliran flowshop (dan tidak boleh dilakukan interupsi yang dilakukan pada pekerjaan yang sedang diproses, untuk melakukan pekerjaan lainnya, satu lintasan hanya memproduksi satu produk dan hanya satu produk juga yang dikerjakan secara langsung. Waktu penyelesaian yang berbeda dari setiap mesin dengan pengerjaannya juga adalah masalah yang dihadapi untuk menjadikan mesin mesin ini sesuai menjadi satu penjadwalan yang terintegrasi dengan metode integer programming yang membuat penjadwalan dengan konsep riset operasi dengan metode pendekatan 0-1 utuk menjadi lebih efisien lagi , dihasilkan minimisasi keterlambatan total penyelesaian order dengan 42,28 menit lebih baik dari sebelumnya.   PT XYZ often experiences time delays because in every delay made there is always a penalty given to the company and this results in additional costs, therefore this must be avoided by making efficient scheduling, in this case repairs are carried out by minimizing the maximum completion time of Cmax on parallel machines that are patterned with flowshop flow (and no interruptions should be carried out on the work being processed, to do other work, one track only produces one product and only one product is directly worked. Different completion times of each machine with the workmanship is also the problem faced to make this machine suitable to be one scheduling integrated with integer programming methods that makes scheduling with the operational research concept with the 0-1 approach method to be more efficient, resulting in minimization of the delay in the total settlement of orders with 42.28 minutes was better than before.

ABSTRACT In the experiments reported in this paper the hypothesis that the decrease in the pituitary I. C. S. H.-content, which occurs after administration of steroid sex hormones in gonadectomized animals, is counteracted by a reflex stimulation of the hypophysis initiated by the operation has been investigated. If treatment with a low dose of testosterone propionate (100 μg) was started immediately after castration, the resulting decrease in the pituitary I. C. S. H.-content became more marked if the reflex stimulation of the hypophysis had been prevented. If, however, two months were allowed to elapse before the beginning of treatment, the presence or absence of this reflex was no longer of importance for the effect of testosterone propionate on the pituitary I. C. S. H.-content. And yet, in this case too, the decrease in the pituitary I. C. S. H.-content by testosterone propionate was less than in intact animals (see preceding paper). Hence this decrease appears to be counteracted by two factors: one rapidly occurring and short lasting, resulting from a reflex elicited by gonadectomy; the other gradually increasing in potency and possibly a direct consequence of the continued absence of pituitary inhibiting sex steroids.

AbstractScanning-tunneling spectroscopy experiments have been performed on conjugated polymer films and have been compared to a three-dimensional numerical model for charge injection and transport. It is found that field enhancement near the tip apex leads to significant changes in the injected current, which can amount to more than an order of magnitude, and can even change the polarity of the dominant charge carrier. As a direct consequence, the single-particle band gap and band alignment of the organic material can be directly obtained from tip height-voltage (z-V) curves, provided that the tip has a sufficiently sharp apex.

The article presents an overview of methods for determining the effectiveness of advertising appeals of the enterprise in conditions of competition. It is shown that the sale of goods in large batches leads to a reduction in sales costs associated with the organization of sales, transportation and storage. Therefore, when providing a quantitative discount, their value should not exceed the amount of cost savings of the seller, which is caused by the sale of goods in large batches. Similar to the effects of real responses to advertising appeals, the effects of the price of the enterprise's products are distinguished: the current effect, the form effect, the competition effect and the transition effect. The process of modeling the effects of the promotion price and the control price is considered, and of interest is the temporary price for the buyer with a discount, which is actually provided by sales managers at the enterprise. Then there will be an effect of discounts on temporary base prices. The price discount is considered as a part of the price of the goods which can be introduced by the enterprises-manufacturers for the purpose of stimulation and interest of the enterprises-sellers to sell production. In the study of product sales, a problem was found related to sales of products in the area of the price discount offered by the price list, which represents the constant prices of the company for a certain period of time. The promotion price is defined as the discount on the products of the enterprise price according to the price list. It is determined that buyers, focusing on the system of discounts, avoid buying hardware in the approach to the transition of prices and increase the volume of purchases after the transition discount. A comparison of retail and base prices, and base and wholesale prices for hardware. It is proved that the company when approaching the price discount loses the profit that could be obtained, and this problem causes losses to both parties and the seller and buyer. It is shown that the policy of promoting price discounts of Metal-Holding encourages consumers to buy more hardware, which is not beneficial to the buyer, because it causes additional costs for storage of the balance. It is concluded that the problem at some weight interval when approaching the existing price discount on the left and right requires the establishment of a floating price discount on the company's products.

The problem of constructing Q-optimal experimental designs for polynomial regression on the interval [–1, 1] is considered. It is shown that well-known Malyutov – Fedorov designs using D-optimal designs (so-called Legendre spectrum) are other than Q-optimal designs. This statement is a direct consequence of Shabados remark which disproved the Erdős hypothesis that the spectrum (support points) of saturated D-optimal designs for polynomial regression on a segment appeared to be support points of saturated Q-optimal designs. We present a saturated exact Q-optimal design for polynomial regression with s = 3 which proves the Shabados notion and then extend this statement to approximate designs. It is shown that when s = 3, 4 the Malyutov – Fedorov theorem on approximate Q-optimal design is also incorrect, though it still stands for s = 1, 2. The Malyutov – Fedorov designs with Legendre spectrum are considered from the standpoint of their proximity to Q-optimal designs. Case studies revealed that they are close enough for small degrees s of polynomial regression. A universal expression for Q-optimal distribution of the weights pi for support points xi for an arbitrary spectrum is derived. The expression is used to tabulate the distribution of weights for Malyutov – Fedorov designs at s = 3, ..., 6. The general character of the obtained expression is noted for Q-optimal weights with A-optimal weight distribution (Pukelsheim distribution) for the same problem statement. In conclusion a brief recommendation on the numerical construction of Q-optimal designs is given. It is noted that in this case in addition to conventional numerical methods some software systems of symbolic computations using methods of resultants and elimination theory can be successfully applied. The examples of Q-optimal designs considered in the paper are constructed using precisely these methods.

ABSTRAKPenelitian ini bertujuan mengetahui peran PPAT setelah terjadinya penetapan pembagian waris di Pengadilan Agama Garut, apabila terjadi hal terkait masalah proses peralihan hak atas tanah dan atau pembagian warisan sebaiknya para ahli waris terlebih dahulu datang ke kantor PPAT untuk berkonsultasi, agar dijelaskan tentang mekanisme penyelesaian serta di buatkan akta terkait pembagian waris sesuai peristiwa hukumnya yang sebelumnya sudah melalui proses pembagian waris di Pengadilan Agama. Penelitian ini mengggunakan pendekatan yuridis empiris.Berdasarkan metode tersebut penelitian menghasilkan pada pokoknya (1) Peran PPAT dalam proses peralihan hak dan Pembagian Waris di Pengadilan Agama Garut Menurut Putusan Pengadilan Agama yang isinya mengembalikan dan membagikan harta warisan kepada masing-masing ahli waris, selanjutnya PPAT membuatkan APHB, pada umumnya sama dengan alasan-alasan yuridis terkait pembuatan APHB yang menyatakan bahwa tanah yang merupakan warisan belum didaftar wajib dilampirkan dokumen-dokumen yang berkaitan dengan kewarisan dalam proses pendaftaran haknya sebagaimana tersebut dalam pasal 42 ayat 2 PP.24/1997, Pasal 111 PMA nomor 3 tahun 1997, KHI pasal 171-176, Pasal 37 ayat (1) PP 24/97, Pasal 136 PMA, UUPA nomor 5 Tahun 1960, PP 37 Tahun 1998, PP 3 Tahun 1997, PP 1 Tahun 2006, Perkaban Nomor 8 Tahun 2012. (2) Kendala dan solusi yang dihadapi oleh PPAT : a. Ketentuan yang mengharuskan pencantuman tanda tangan asli para ahli waris dalam pembuatan Surat Keterangan Waris dan Akta Pembagian Hak Bersama. b. Sistem pemecahan secara sempurna yang melahirkan produk akhir berupa sertifikat hak atas tanah dengan kepemilikan bersama atas nama para ahli waris. c. Perhitungan Pajak APHB. d. Persyaratan administratif yang harus dilengkapi oleh para ahli waris. e. Kantor Pertanahan terlalu kaku dalam menerapkan kelengkapan persyaratan. f. Kebiasaan Pejabat Pembuat Akta Tanah menyuruh pegawainya untuk menjadi saksi dalam pembuatan Surat Keterangan Waris. g. (2 ) Constraints and solutions faced by PPAT: a. The provisions that require the inclusion of the original signatures of the heirs in the making of the Certificate of Inheritance and the Deed of Rights Sharing. b. A perfect splitting system that produces the final product of a land title certificate with joint ownership on behalf of the heirs. c. APHB Tax Calculation. d. Administrative requirements to be completed by the heirs. e. Land Office is too rigid in applying the requirements. f. Habit of Officers of the Deed Land Author instructs his employees to become witnesses in the making of the Inheritance Certificate. g.
