Philosophical anarchism is a branch of political philosophy that is highly skeptical and sometimes even eliminative of the state. At their most ambitious, anarchist theories endorse a comprehensive ideal of social and political (if there should be such a thing at all) life in which the state does not play an essential role. Less ambitious versions attempt primarily to deny the legitimacy of the state. The reasons animating anarchist theories are diverse. Some regard the state as essentially an unjustifiably coercive institution. Others regard the existence of the state incompatible with important values, such as community. Yet, others merely object to the pretensions of authority by existing states. Philosophical anarchism has provided both negative and positive theses. Among its negative theses are the claims that existing states are illegitimate, that the typical uses of coercion by existing states are morally unjustified, and that citizens do not have a moral duty to obey the law. Among its positive theses are the claims that social stability is possible without centralized powers of legislation and enforcement as well as the more fundamental claim that people would in principle be able to treat each other justly if no state existed. Philosophical anarchism, then, refers to a particular set of philosophical views about the nature of political society. It should be distinguished from the political movement of anarchism, which typically calls more directly for resistance, including violent resistance, to the state. In the first instance, philosophical anarchist theories are committed only to regarding all existing state institutions as unjust, and not yet to any practical responses to these.

In order to codify the political and partisan activity in Iraq, after a difficult labor, the Political Parties Law No. (36) for the year 2015 started and this is positive because it is not normal for the political parties and forces in Iraq to continue without a legal framework. Article (24) / paragraph (5) of the law requires that the party and its members commit themselves to the following: (To preserve the neutrality of the public office and public institutions and not to exploit it for the gains of a party or political organization). This is considered because it is illegal to exploit State institutions for partisan purposes . It is a moral duty before the politician not to exploit the political parties or some of its members or those who try to speak on their behalf directly or indirectly to achieve partisan gains. Or personality against other personalities and parties at the expense of the university entity.

Abstract The author analyzes in this paper principles and ides of philosophy of law issued by Mircea Djuvara, which preserve their contemporaneity, being useful for the perfecting of the state institutions and of the democracy not only at national level, but also at European Union one. His ideas and logical demonstration on the rational fundamentals of law, the autonomy of the moral and legal conscience, the specificity of truth and of juridical knowledge, the philosophical substantiation of power and Constitution, the principles of the democracy and the connections between the political power and the law are just few of the original elements due to which Djuvara became an acknowledged and respected personality not only in Romania, but also in the experts clubs of the Europe between the two World Wars.

Historically human societies have never collectively organized, politically or socially, in any singular, standardized and/or universal way. Beginning with the Peace of Westphalia in 1647 the nation-state gradually proliferated as a legitimate manifestation of collective human organization at a global level. This proliferation has culminated in the standardization of a singular means of mobilizing and organizing human societies. The statist age that began in the 16th and 17th centuries consolidated and centralized the political power of the state. Divergent factions and regional power blocks within European states were discouraged, as politics became centralized at the national level. The proliferation of the nation-state represented the standardization of human political organization according to a single model. Given that there are, and have been, a variety of means by which humans identify and organize politically, this suggests that this universal acceptance and entrenchment of one model may be somewhat inappropriate.

"The Escape to Turkey. Ways and Methods of Illegal Border Crossings into Turkey from the perspective of SSI documents (1945-1948). Romania`s first years after the communist regime took political power in Romania, concurrent with the onset of the Cold War, meant a reshuffle of the state institutions at first and later a dramatic impact on people`s lives. The political and institutional purges were the first signal that soon repression and terror will follow, thus prompting numerous Romanian citizens to leave the country. Yet, due to the strict surveillance of the Secret Police Services which did not easily allow traveling to Western countries, the only way to escape was through illicit border crossings. One of the most common destinations was Turkey, with documents issued between 1945 and 1948 by the Secret police services revealing an impressive number of such cases. In 2007 the Chinese government nationally implemented the rural dibao programme. The chapter argues that while the circumstances of rural dibao’s implementation were different from its urban predecessor there are three striking similarities. First, in terms of values, it is argued that the rural dibao programme did fit comfortably with the agenda under Hu Jintao and Wen Jiabao to address China’s unequal development and in particular the san nong wenti of the countryside. However, the process surrounding implementation of the rural programme also carried appeals to social stability. Second, the political structure had a significant impact on the implementation of the rural MLG. As with the urban programme implementation faced local intransigence. This was overcome by not only using similar means as with the urban programme; but also through explicitly dealing with one common source of problems, funding. Finally, there is the problem of administrative capacity in running the rural MLG programme. This appears as a classic outcome of the fragmented political and decision making structure in China where local government, often struggling to meet mandates passed down from above, prioritises the resources it has. What this all shows is that the challenges facing social assistance in China are not specific to the urban or the rural programme; but are a consequence of the structure of the state.

A sense of distance or exile is a recurrent theme of the literature in which the state of the political theory is either lamented or acclaimed. A review of these tales suggests that implicit definitions of the homeland of the sub-discipline as philosophical, practical or interpretive are inadequate, leading to mistaken diagnoses of the reasons for the ills or recovery of political philosophy. This paper argues that political theory has been exiled from its previous role or homeland of legitimation of political orders. Under contemporary conditions in the advanced liberal capitalist political order, in which a media-generated imagology of society as a communicative system fills the role of a legitimating discourse, political theory faces a legitimation crisis.

This chapter traces Carl Schmitt’s attempt, in his 1932 book The Concept of the Political, to quell the near civil war circumstances of the late Weimar Republic and to reinvigorate the sovereignty of the German state through a reappropriation of Thomas Hobbes’s political philosophy. The chapter then examines Schmitt’s reconsideration of the Hobbesian state, and his own recent reformulation of it, in light of the rise of the “Third Reich,” with particular reference to Schmitt’s 1938 book The Leviathan in the State Theory of Thomas Hobbes.

Of all the major episodes in Hegel's Rezeptionsgeschichte, British Hegelianism can seem the most foreign and outmoded, to have the least relevance to our current understanding of Hegel's thought. Even today, we are lead back to the Young Hegelians for the problems they pose in reading his work; we can sympathise with the concerns of Peirce, Royce and Dewey that drew them to him, and the interpretative picture they developed; we can take seriously the attempts by Croce and Gentile to bring about their “reforms”, given our contemporary ambivalence to his project; and we can see how in different ways the influence of Hegel on Kojève, Sartre, Lukács and the Frankfurt School have made some of his ideas central to our times. But few feel this sense of identification and illumination on encountering the work of Hegel's British interpreters from the turn of the century; rather, in their writings we seem to find a Hegel that is darker, more distant, more difficult for us to relate to contemporary concerns. This is not true in every respect, of course. In particular, several recent commentators have stressed how far it is possible to find here a reading and assessment of Hegel's political thought that does connect directly with many current issues, and that in this respect the thought of T H Green, Bernard Bosanquet and Henry Jones is not dead, either as a tradition within political philosophy, or as an interpretative approach to Hegel's theory of the state. Nonetheless, even those who seek to defend the importance of British Hegelianism in this regard clearly recognize that this is a fairly modest claim: for it fails to resurrect and revitalize the more fundamental aspect of the their encounter with Hegel, which was with his metaphysics – on which, as for Hegel, their political theories were based, rather than being primary in themselves. Those concerned with the political thought of the British Hegelians have not tried to take on this wider issue, leaving unchallenged the assumption that in their appropriation of his metaphysics, the British Hegelians have little to offer us either interpretatively or philosophically.

Chapter fifteen of Leviathan is concerned with what Hobbes calls “the laws of nature”; however, it is evident from the start that justice is the central problem of the chapter. Hobbes demonstrates a rather subtle sensitivity to a possible misunderstanding of his views on the state of nature and the function of natural reason by inventing the character of the fool who purports to use Hobbes' own principle of self-interest to deny the existence of justice. The fool may finally be a “straw man” who proposes precisely that argument which Hobbes can quickly refute, but even if this is so, the straw man has Hobbes' face, or one like it, because the line between the views of the fool and those of Hobbes himself is very fine indeed. This section of Leviathan is more significant than it would seem at first glance because it provides an avenue by means of which one can distinguish the political philosophy of Hobbes from that of classical “individualists” such as Callicles and Thrasymachus. It is all too easy to read Hobbes as an elaborate restatement of the sophistic position of Socrates' famous opponents; the example of the fool belies this facile identity and to a certain extent constitutes a refutation of the classical power theorists.
