A Primer on Intellectual Property and Popular Culture Research

A large number of intellectual property (IP) law cases have centred around works of popular culture. Traditionally, IP scholars have focused only on technical legal analysis, neglecting research on the aesthetic and cultural value of such works, or the experiences of creators. However, a growing body of interdisciplinary scholarship has changed this trend. This chapter highlights examples of such interdisciplinary scholarship, focusing on scholarship incorporating approaches from the humanities and empirical social sciences. The chapter discusses the methodologies and perspectives used in such works, and how they can complement traditional legal analysis.

This chapter addresses the intersection between comparative law and intellectual property (IP) law and the role of comparative legal analysis as a research methodology for IP scholars. Due to the high level of international harmonization of IP laws, comparative legal analysis has traditionally played a prominent role for IP scholars. However, this methodology has become even more fundamental in recent decades because of the further integration of legal systems due to the process of globalization of trade and the fast-evolving worldwide technological developments. As a result of this economic and technological integration, different legal traditions have converged to an unprecedented level. In particular, after an overview of Comparative Law and the process required to conduct comparative analysis, this chapter offers several examples in the context of IP research.

Unlike sonographic examinations, sonic fetal heartbeat monitoring has received relatively little attention from scholars in the social sciences. Using the case of fetal heartbeat monitoring as part of midwifery prenatal care in Germany, this contribution introduces music as an analytical tool for exploring the aesthetic dimensions of obstetrical surveillance practices. Based on ethnographic stories, three orchestrations are compared in which three different instruments help audiences to listen to what becomes fetal heartbeat music and to qualify fetal and pregnant lives in relation to each other. In the Doppler-based orchestration, audible heartbeat music is taken as a sign of a child in need of parental love and care cultivated to listen. The Pinard horn makes esoteric fetal music that can be appreciated by the midwife as a skilled instrumentalist alone and helps to enact a child hidden in the belly. The cardiotocograph brings about soothing music and a reassuring relationship with a child but also durable scripts of juridical beauty. This material-semiotic analysis amplifies how well-being is shaped in midwifery prenatal care practices.

This special issue on anthropology and literature invited proposals for original contributions focusing on relationships between anthropology and literature. We were especially interested in the following questions: what role does literature play in anthropology? Can literature be considered as ethnography? What are the relationships between anthropology and literature, past and present? Are anthropology and anthropological motives used in literature? We also looked for critical readings of writers as anthropologists and critical readings of anthropologists as writers. Moreover, we wanted to assess the influence of literature on the invention of traditions, rituals and cultural performances. All these different questions and topics are clearly connected with the study of literacy, illiteracy and popular culture. They also lead to questions regarding potential textual strategies for ethnography and the possibilities of bringing together the field of anthropology (more associated with the social sciences) and literary studies (traditionally part of the humanities).

Ukraine’s healthcare system faces unprecedented national security challenges in the third wave of the COVID-19 pandemic. A particularly acute issue is countering counterfeit pharmaceuticals, preventing drug shortages, joining efforts of the authorities and national manufacturers of drugs and medical supplies. According to the UN, more than 60 % of the population lives below the poverty line in Ukraine. Timely response to these challenges and taking preventive measures will save lives, minimize the volume and consequences of the pandemic. The paper provides an economic and legal analysis, trends, risks and threats to national security of the state and health protection during a pandemic, in order to protect intellectual property rights, adequate coordination of actions at the national and international levels. The impact of counterfeiting on the criminal landscape in the EU, and also business and economy, is shown based on the analysis of studies by the OECD, the EU Intellectual Property Office (EUIPO) and Europol. The foundations of anti-counterfeiting management, measures to implement a standard anti-counterfeiting strategy are proposed.

This article explores the aesthetic elements of sovereignty. Building on the anthropological literature on sovereignty and on contemporary work on the politics of aesthetics, the article analyzes contemporary appearances of Batman symbols and figures in Rio de Janeiro. Despite political debate and academic discussion about the Batmen appearing in mafia-like militias and popular street protests in Rio, the question of what these appearances tell us about the relations between popular imagery and political contestation has remained untouched. This article supports the work of writers who argue that superhero comics and movies present fierce figures that operate in the zone of indistinction, at the crossroads of lawful order and its exception. However, it adds to this literature an analysis that shows in what kind of sociopolitical contexts these figures operate and how that plays itself out. To understand the contemporary appearances and force of figures of the entertainment industry better, this article proposes the concept “popular culture of sovereignty.”

Popular culture has critiqued ‘vertical video syndrome’, or video shot on smartphones in the portrait rather than landscape orientation, as something aesthetically unpleasing which should be avoided. But the design of smartphones seems to encourage shooting vertical video. This article examines the aesthetic desirability of vertical videos through applied media aesthetics. It traces the history of horizontal film and television orientations, as well as the image-centric orientation model found in still photography. It argues that vertical video, rather than a syndrome to be avoided, instead takes advantage of the technological innovations and embodied pleasures offered by the smartphone to rupture the visual paradigms and create a new visual aesthetic for phone-based moving images.

Abstract Infrastructure is often thought of in big material terms: dams, buildings, roads, and so on. This study, instead, draws on literatures in anthropology and the social sciences to analyse infrastructures in relation to society and environment, and so cast current conceptions of infrastructure in a new light. Situating the analysis in context of President Biden’s recent infrastructure bill, the paper expands what is meant by and included in discussions of infrastructure. The study examines what it means for different kinds of material infrastructures to function (and for whom) or not, and also consider how the immaterial infrastructure of human relations are manifested in, for example, labour, as well as how infrastructures may create intended or unintended consequences in enabling or disabling social processes. Further, in this study, we examine concepts embedded in thinking about infrastructure such as often presumed distinctions between the technical and the social, nature and culture, the human and the non-human, and the urban and the rural, and how all of these are actually implicated in thinking about infrastructure. Our analysis, thus, draws from a growing body of work on infrastructure in anthropology and the social sciences, enriches it with ethnographic insights from our own field research, and so extends what it means to study ‘infrastructures’ in the 21st century.

Artistic representations of the Carlist wars waned as the movement relinquished its political and discursive agency. In our present century, however, neo-historical painter Augusto Ferrer-Dalmau has reconfigured the aesthetic parameters of Spanish legitimism, while reallocating its ideological and cultural signifiers. This article explores how the resurgence of Carlist military imagery serves as a nostalgic repository of an imagined historical trajectory challenging contemporary political discursive practices. It also examines the visual texts’ function as a reaffirmation of Traditionalism’s unionist identity, decoupled from the legacy of Francoism, and as a contemplative lamentation of a vanishing cultural value system.

Making Home(s) in Displacement critically rethinks the relationship between home and displacement from a spatial, material, and architectural perspective. Recent scholarship in the social sciences has investigated how migrants and refugees create and reproduce home under new conditions, thereby unpacking the seemingly contradictory positions of making a home and overcoming its loss. Yet, making home(s) in displacement is also a spatial practice, one which intrinsically relates to the fabrication of the built environment worldwide. Conceptually the book is divided along four spatial sites, referred to as camp, shelter, city, and house, which are approached with a multitude of perspectives ranging from urban planning and architecture to anthropology, geography, philosophy, gender studies, and urban history, all with a common focus on space and spatiality. By articulating everyday homemaking experiences of migrants and refugees as spatial practices in a variety of geopolitical and historical contexts, this edited volume adds a novel perspective to the existing interdisciplinary scholarship at the intersection of home and displacement. It equally intends to broaden the canon of architectural histories and theories by including migrants' and refugees' spatial agencies and place-making practices to its annals. By highlighting the political in the spatial, and vice versa, this volume sets out to decentralise and decolonise current definitions of home and displacement, striving for a more pluralistic outlook on the idea of home.
