This chapter examines legal encounters and legal relations between Indigenous peoples in both Australia and New Zealand and the British Empire. It looks at court decisions as a source of historical material in order to suggest two contact points between jurisdictions through which to think about indigenous laws and settler laws. It focuses on only two instances of contact: the colonial and the present. In many ways this choice reproduces ongoing gaps in tracing and thinking about legal encounters with Aboriginal law in Australia and, to a lesser extent, in New Zealand. Scholarship on legal encounter has tended to be centred on the colonial period to the detriment of the later nineteenth century and much of the twentieth century. The chapter looks at the ways in which colonial and modern law engaged/s with aboriginal law from the perspective of the colonizer, not the colonized.

Contemporary British imperial historiography argues that during the late 1850s/early 1860s antagonistic racial discourses became increasingly popular across the British Empire. According to this interpretation, escalating colonial violence and Darwinian racial discourses marginalized the humanitarian tenet that Indigenous peoples could achieve a measure of British civilization. During this same period the British colonies of New Zealand and Vancouver Island featured anxiety related to the threat of indigenous violence. But while New Zealand and Vancouver Island featured remarkable parallels in their colonial development, differing local conditions and relationships to the British metropole contributed to divergent reactions within local press to the threat of indigenous violence. This paper focuses on representative newspapers from New Zealand’s and Vancouver Island’s capital cities. An analysis of Auckland’s Southern Crossand Victoria’s British Colonist provides an opportunity to highlight the effects of colonists’ anxiety, the local resiliency of humanitarian discourses, and the influence metropolitan connections played in the formation of editorial perspectives.

Rooted in the extraordinary archive of Quaker physician and humanitarian activist, Dr Thomas Hodgkin, this book explores the efforts of the Aborigines' Protection Society to expose Britain's hypocrisy and imperial crimes in the mid-nineteenth century. Hodgkin's correspondents stretched from Liberia to Lesotho, New Zealand to Texas, Jamaica to Ontario, and Bombay to South Australia; they included scientists, philanthropists, missionaries, systematic colonizers, politicians and indigenous peoples themselves. Debating the best way to protect and advance indigenous rights in an era of burgeoning settler colonialism, they looked back to the lessons and limitations of anti-slavery, lamented the imperial government's disavowal of responsibility for settler colonies, and laid out elaborate (and patronizing) plans for indigenous 'civilization'. Protecting the Empire's Humanity reminds us of the complexity, contradictions and capacious nature of British colonialism and metropolitan 'humanitarianism', illuminating the broad canvas of empire through a distinctive set of British and Indigenous campaigners.

<p>The approximately 18,000 imperial troops who arrived in New Zealand with the British regiments between 1840 and 1870 as garrison and combat troops, did not do so by choice. However, for the more than 3,600 non-commissioned officers and rank and file soldiers who subsequently discharged from the army in New Zealand, and the unknown but significant number of officers who retired in the colony, it was their decision to stay and build civilian lives as soldier settlers in the colony. This thesis investigates three key themes in the histories of soldiers who became settlers: land, familial relationships, and livelihood. In doing so, the study develops an important area of settler colonialism in New Zealand history. Discussion covers the period from the first arrival of soldiers in the 1840s through to the early twentieth century – incorporating the span of the soldier settlers’ lifetimes. The study focuses on selected aspects of the history of nineteenth-century war and settlement.  Land is examined through analysis of government statutes and reports, reminiscences, letters, and newspapers, the thesis showing how and why soldier settlers were assisted on to confiscated and alienated Māori land under the Waste Lands and New Zealand Settlement Acts. Attention is also paid to documenting the soldier settlers’ experiences of this process and its problems. Further, it discusses some of the New Zealand settlements in which military land grants were concentrated. It also situates such military settlement practices in the context of the wider British Empire.  The place of women, children, and the regimental family in the soldier settlers’ New Zealand lives is also considered. This history is explored through journals, reminiscences, biography and newspapers, and contextualised via imperial and military histories. How and where men from the emphatically male sphere of the British Army met and married women during service in New Zealand is examined, as are the contexts in which they lived their married lives. Also discussed are the contrasting military and colonial policies towards women and marriage, and how these were experienced by soldier settlers and their families.  Lastly, the livelihood of soldier settlers is explored – the thesis investigating what sort of civilian lives soldier settlers experienced and how they made a living for themselves and their families. Utilising newspapers, reminiscences, biography, and government records the diversity of work army veterans undertook in the colony is uncovered. Notable trends include continued military-style roles and community leadership. The failed farming enterprise is also emphasised. Going further, it offers analysis of the later years of life and the different experiences of soldier settlers in their twilight years, particularly for those with and without family networks in the colony. The thesis challenges the separation between ‘war’ and ‘settlement’ by focusing on a group whose history spanned both sides of the nineteenth-century world of colony and empire.</p>

This chapter examines the creation of new orders at the beginning of the twentieth century, which was the culmination of a prolonged period of “unprecedented honorific inventiveness” starting in the late nineteenth century. In Britain the new Order of the British Empire was branded the “Order of Britain’s Democracy” in recognition of the fact that it extended far deeper into non-elite classes in British society than any previous honour. Between 1917 and 1921 more than 20,000 people in Britain and throughout the British Empire were added to this new Order. This was an unprecedented number, orders of magnitude larger than honours lists in previous years. While the new Order was successful in reaching a wider, more middle-class audience than the honours system before the war, which was socially narrow, there was a substantial backlash to what was widely perceived by elites to be an excessive (and diluting) opening-up of the “fount of honour.” This backlash was connected to political controversies about the sale of honours that eventually helped bring about Lloyd George’s downfall. This chapter also contains a brief description of all the components of the British honours system at the beginning of the twentieth century.

The epilogue rounds off the argument by returning to Crusoe as a paradigm of the act of reading in the British empire. In the hands of different readers not even Robinson Crusoe was as straightforward as it seemed. Despite the fact that the novel has often been read as a manual for empire, it is far more complex than some commentaries would have us believe. Similar ambivalences apply to the lives and minds of many overseas British in the long nineteenth century. While the early twentieth century is commonly thought to have embodied a decline in imperial values, the reading habits of colonial subjects throughout the period would seem to indicate that imperial assurances were less robust than official sources would seem to suggest. The five reading constituencies that are described in the foregoing chapters, all of them in different ways operating within the web of empire, were ones in which individuals often found imperial confidence in its own mission wanting, something that was time and again demonstrated through in their acts of reading.

Since the time South Asia, together with other Asian and African countries, became an integral part of the British Empire, the significance of manuscripts, published works and other artefacts, relating to those regions has stimulated continued appreciation in the United Kingdom, albeit with varying degrees of interest. It is interesting to note that the factors which have contributed in one way or another to the collecting of South Asian I material for British institutions vary in their nature, and thus illuminate the attitudes of different periods. During the entire nineteenth century, the collectors were primarily administrators; for most of the first half of the twentieth century, it was the interest and the needs of British universities that led to the accumulation of substantial holdings in many academic or specialist libraries.

This chapter explores the transnational formation of the gendered and racialized figure of the “white man” in the constitutive relations of colonial conquest and imperial rule across the nineteenth and into the twentieth century. The self-styled bearer of a “civilizing mission” to indigenous peoples, the white man became a perpetrator of violence and atrocity as imperial rule and colonial settlement encountered continuing resistance and guerrilla warfare. In the process, the older ideal of moral manliness gave way to a more modern conception of masculinity characterized by toughness, aggression, and a capacity to use firearms to “pacify the natives.” Defined by power, even as he was haunted by his vulnerability, the white man engaged in systematic denial and disavowal, evasion, and euphemism and narratives of nation-building that justified his right to rule.

AbstractThis article examines the relationship between the frontness of /u/ and the aspiration of /t/ in both Māori and New Zealand English (NZE). In both languages, these processes can be observed since the earliest recordings dating from the latter part of the nineteenth century. We report analyses of these developments for three groups of male speakers of Māori spanning the twentieth century. We compare the Māori analyses with analyses of related features of the speakers' English and of the English of monolingual contemporaries. The occurrence of these processes in Māori cannot be seen simply as interference from NZE as the Māori-speaking population became increasingly bilingual. We conclude that it was the arrival of English with its contrast between aspirated and unaspirated plosives, rather than direct borrowing, that was the trigger for the fronting of the hitherto stable back Māori /u/ vowel together with increased aspiration of /t/ before both /i/ and /u/.

During the nineteenth century and in the early years of the twentieth century wattle was circulated by botanists, botanical institutions, interested individuals, commercial seedsmen and government authorities. Wattle bark was used in the production of leather and was the subject of debate regarding its commercial development and conservation in Australia. It was also trialled in many other locations including America, New Zealand, Hawaii and Russia. In the process, South Africa became a major producer of wattle bark for a global market. At the same time wattle was also promoted as a symbol of Australian nationalism. This paper considers this movement of wattles, wattle material and wattle information by examining the career of one active agent in these botanical transfers: Joseph Maiden. In doing so it demonstrates that these seemingly different uses of the wattle overlap transnational and national spheres.
