This paper shows how solidarity is one of the founding principles in Thomas More's Utopia (1516). In the fictional republic of Utopia described in Book II, solidarity has a political and a moral function. The principle is at the center of the communal organization of Utopian society, exemplified in a number of practices such as the sharing of farm work, the management of surplus crops, or the democratic elections of the governor and the priests. Not only does solidarity benefit the individual Utopian, but it is a prerequisite to ensure the prosperity of the island of Utopia and its moral preeminence over its neighboring countries. However, a limit to this principle is drawn when the republic of Utopia faces specific social difficulties, and also deals with the rest of the world. In order for the principle of solidarity to function perfectly, it is necessary to apply it exclusively within the island or the republic would be at risk. War is not out of the question then, and compassion does not apply to all human beings. This conception of solidarity, summed up as “Utopia first!,” could be dubbed a Machiavellian strategy, devised to ensure the durability of the republic. We will show how some of the recommendations of Realpolitik made by Machiavelli in The Prince (1532) correspond to the Utopian policy enforced to protect their commonwealth.

Controversy continues to surround the age-old practice of virginity testing, which in South Africa made a visible comeback around the time of the country’s first democratic elections when most South Africans began to feel free to practise their cultural beliefs without fear. It coincided with the period when the HIV pandemic began to take hold. It is practised mainly in some countries of Asia and Africa, and in South Africa it is practised mainly amongst amaZulu. It is believed that this practice prevents unwanted pregnancies and sexually transmitted diseases (STDs), especially HIV/AIDS, as well as engendering a sense of pride in teenage and young females, in particular. However, some individuals, organisations and sectors of the community frown upon the practice because it violates constitutional laws that protect the right to equality, privacy, bodily integrity and sexual autonomy. The purpose of this article is to present current discourse on the cultural practice of virginity testing and the controversies surrounding this discourse. This article draws its arguments from the existing literature on virginity testing.

There is a consensus about the existence of an international right to vote in democratic elections. Yet states disagree about the limits of this right when it comes to the case of prisoners’ disenfranchisement. Some states allow all prisoners to vote, some disenfranchise all prisoners, and others allow only some prisoners to vote. This chapter argues that national courts view the international right to vote in three fundamentally different ways: some view it as an inalienable right that cannot be taken away, some view it merely as a privilege that doesn’t belong to the citizens, and others view it as a revocable right that can be taken away under certain conditions. The differences in the way states conceive the right to vote imply that attempts by the European Court of Human Rights to follow the policies of the majority of European states by using the Emerging Consensus doctrine are problematic.

The apartheid regime in South Africa and the fight against the same, followed by the reconciliation is the crux of this article. The first democratic elections held on April 27, 1994, were surprisingly free of violence. Then, in one of its first pieces of legislation, the new democratic parliament passed the Promotion of National Unity and Reconciliation Act of 1995, which created the Truth and Reconciliation Commission. At the outset, the South African TRC promised to “uncover the truth” about past atrocities, and forge reconciliation across a divided country. As oral historians, we should consider the oral testimonies that were given at the Human Rights Victim hearings and reflect on the reconciliation process and what it means to ask trauma survivors to forgive and reconcile with perpetrators. This article cites several real life examples to explain the trauma and testimony of apartheid and post-apartheid Africa with a hint on the still prevailing disappointments and blurred memories.

Abstract This article focuses on the conceptual implications of specific works of contemporary artist and wordsmith Adriaan Willem Boshoff. Boshoff uses his creations to challenge the terms of the current debate around indigenous languages in southern Africa through artworks such as Blind Alphabet and his Sand Writing Series. These works call viewers to an emphatic return to an understanding of scripts (and the worlds they produce) as embodied systems of tradition that occupy the central place not only in the groups they serve, but indeed in a larger vision of a culturally tolerant and affirmative nation. The article tracks key South African educational policies such as the Apartheid era Bantu Education Act of 1953, and the Corrective Language Act of 1998 after the first democratic elections to contextualize the politics of legislative development in South Africa as related to indigenous scripts and languages. Beyond this bureaucratic history, the article foregrounds partisan agency that individuals such as Wilhelm Bleek, Lucy Lloyd and Magrieta Jantjies displayed as custodians of endangered scripts and languages, culminating in a discussion of the provocative works Boshoff created to stimulate critical thought on contemporaneous philological concerns in South Africa.

International organisations have recently assumed a more intrusive role in settling conflicts in all continents. At the same time, post-conflict or post-settlement tasks seem to be emerging as an important function, encompassing the conduct of democratic elections, the guarantee of security, development of civil society, etc. In order to operationalise such wide-ranging and deeply intrusive social aims it is not sufficient to have peace-keepers or elections monitoring missions sent into the conflict-torn territories. Concentrated and centrally planned efforts of international governance are needed. In the present day, however, there is no such systematic scheme to which to refer. Yet institutional structures are needed to administer the extensive tasks and functions assigned in certain post-conflict situations. Therefore many questions of legitimacy and fundamental accountability arise.

The immediate origins of the democratic elections held in Malawi in 1994, which brought to an end over 30 years of political dominance by President Kamuzu Banda and the Malawi Congress Party (MCP), lie in the unprecedented events which shook the entire nation in 1992. Although that turbulent year was characterised by industrial action, serious urban riots, student demonstrations, the emergence of new domestic political groupings, and the Government's agreement to hold a national referendum on the future of the one-party system in the country, in retrospect perhaps what was most remarkable about these developments was that they were sparked off by the Catholic Church, and that their momentum was sustained at crucial stages by other Christian denominations in Malawi.1

It is clear that tested by the Constitution of the Soviet Union as revised and enacted in 1936, the USSR is the most inclusive and equalised democracy in the world.Sidney and Beatrice Webb, 1937Many who lauded Stalin's Soviet Union as the most democratic country on earth lived to regret their words. After all, the Soviet Constitution of 1936 was adopted on the eve of the Great Terror of the late 1930s; the “thoroughly democratic” elections to the first Supreme Soviet permitted only uncontested candidates and took place at the height of the savage violence in 1937. The civil rights, personal freedoms, and democratic forms promised in the Stalin constitution were trampled almost immediately and remained dead letters until long after Stalin's death.

AbstractMuch has been written on the positive effect of direct democracy (initiatives, referendums) on voter turnout. However, we have limited knowledge about potential differential effects on voters belonging to various ethnic groups. The paper argues that depending on a group’s responsiveness to the political context, direct democracy can (dis-)integrate voters (from) into the electorate. Empirical analysis of Current Population Survey (CPS) voting supplement survey data, together with data on the absolute use of direct democracy across US states, corroborates this theoretical expectation, however lending more support for the disintegrating assumption. Frequent direct democratic elections further widen the negative voting gap between first-generation Asian voters and voters living in the US for three generations or longer, whereas they tend to diminish this voting gap for first-generation Hispanic voters. The disintegrative pattern for first-generation Asian voters remains even significant when excluding California from the state sample, yet not the integrative tendency for first-generation Hispanics. Additional analyses using alternative measures of direct democracy and voting, and applying statistical adjustments to address causality concerns, confirm the robustness of these findings, which shed light on the so-far underexplored (dis-)integrative potential of political institutions.
