Grey zones and triangulation of the employment relationship in globalisation

This article discusses the changes in employment relationships under globalisation and, more specifically, the phenomenon of triangulation and the attendant proliferation of employment grey zones. The first section sets out a framework for analysis of the conditions governing the organisation and exercise of power by employers in such situations by reviewing two types of relationship: an agency relationship and a relationship of intervention. Drawing on fieldwork and a number of case studies, the second part examines how human resources managers in large corporations use their powers of discretion in these situations. The third part analyses this particular form of regulation with regard to the nature of the subordinate relationship of employees to their employers. We show that the existence of employment grey zones reflects not so much a watering down of that subordinate relationship as a shift towards new values and new means of expression.

The selection method of existing employees or officers has been used since the beginning of the Third Polish Republic during the transformation of various public institutions, which consists of making discretionary decisions about whose employment will be continued, as well as under what new conditions it will be carried out. Using the framework for termination of employment for this purpose in subsequent acts, missing in them precise criteria for qualifying persons and the lack of regulations as to the manner of judicial protection are designed to reduce the number of people who would make attempts to contest their decisions. In 2016 on the occasion of the reform of the fiscal apparatus, this method was additionally extended to include the possibility of unilateral and selectively transforming the service relationships of customs officers into employment relationships, or vice versa - fiscal officials to officers. This option was implemented in practice in 2017. This represents a serious threat to the freedom to choose and pursue a profession which must either be restrained by declaring this type of regulation unconstitutional, or by making it unprofitable through court judgments restoring prior employment relationships. The recent case law of common courts and the Supreme Court favours it.

ABSTRACTThe research objective is to study and determine the level of non-standard employment relationships in Nigeria and Indonesia. The employment relationship is not as standard as is initial workers, which are contract employees and outsourcing. The nonstandard employment relationship are reinforced by the number of unemployment in Nigeria and Indonesia which are every form of nonstandard employment will offer the challenge but it will tend to have the great of losses.The results of the study found that non-standard employment relationships in Nigeria and Indonesia in general is not different. Most employees are not standard work is in positions which have low skills, without a career path and can harm the development of human resources for both companies or clients. On the other hand, who had a temporary job as an employee or non-standard employee is better than not having a job. Hubungan kerja tidak standar yang dimaksud sebagai karyawan kontrak dan outsourcing. Hubungan kerja tidak standar diperkuat oleh jumlah pengangguran yang ada di Nigeria dan Indonesia dimana setiap bentuk pekerjaan tidak standar menawarkan tantangan namun akan cenderung memiliki banyak kerugian. Hasil penelitian ditemukan bahwa hubungan kerja tidak standar di Nigeria dan Indonesia pada umumnya tidak berbeda. Sebagian besar karyawan merupakan pekerja tidak standar yang memiliki keterampilan kerja yang rendah, tanpa memiliki jenjang karir dan dapat membahayakan perkembangan sumber daya manusia baik bagi perusahaan maupun klien.  Di sisi lain, memiliki pekerjaan sementara baik sebagai pekerja standar ataupun pekerja tidak standar akan lebih baik daripada tidak memiliki pekerjaan. Dengan demikian tingkat pengangguran dapat dikurangi dan secara signifikan dapat meningkatkan pertumbuhan ekonomi negara.Kata kunci: Pengangguran, hubungan kerja tidak standar, karyawan kontrak, outsourcing,                    pertumbuhan ekonomi negara.

This paper describes the findings of the “Third International Conference on Waste Management in the Chemical and Petrochemical Industries,” held in Salvador, Brazil, October 20-23, 1993. A summary of the 74 technical papers, divided into six major categories, is presented together with comments on the more stringent legislation concerning source control programmes. Case studies of two large chemical complexes that have been developing successful waste minimization programmes are described in detail: CETREL-Environmental Protection Company in Camaçari, Brazil, and BASF AG in Ludwigshafen, Germany.

Literary history often positions Dryden as the precursor to the great Tory satirists of the eighteenth century, like Pope and Swift. Yet a surprising number of Whig writers expressed deep admiration for Dryden, despite their political and religious differences. They were particularly drawn to the enthusiastic dimensions of his writing. After a short reading of Dryden’s poem to his younger Whig contemporary William Congreve, this concluding chapter presents three case studies of Whig writers who used Dryden to develop their own ideas of enthusiastic literature. These three writers are Elizabeth Singer Rowe, John Dennis, and the Third Earl of Shaftesbury. These case studies are used to critique the political polarizations of seventeenth- and eighteenth-century literary history and to stress instead how literary friendship crossed political allegiances, and how writers of differing ideological positions competed to control mutually appealing ideas and vocabularies.

Standard histories of electronic music tend to trace the lineage of musique concrète as lying mainly in the Futurists’ declarations of the 1910s, through Cage’s ‘emancipation’ of noise in the 1930s, to Schaeffer’s work and codifications of the late 1940s and early 1950s. This article challenges this narrative by drawing attention to the work of filmmakers in the 1930s that foreshadowed the sound experiments of Pierre Schaeffer and thus offers an alternative history of their background. The main focus of the article is on the innovations within documentary film and specifically the sonic explorations in early British documentary that prefigured musique concrète, an area ignored by electronic music studies. The theoretical and philosophical underpinnings of the documentary movement’s members, particularly their leader John Grierson, will be compared with those of Pierre Schaeffer, and the important influence of Russian avant-garde filmmaking on the British (and musique concrète) will be addressed. Case studies will focus on the groundbreaking soundtracks of two films made by the General Post Office Film Unit that feature both practical and theoretical correspondences to Schaeffer: 6.30 Collection (1934) and Coal Face (1935). Parallels between the nature and use of technologies and how this affected creative outputs will also be discussed, as will the relationship of the British documentary movement’s practice and ideas to post-Schaefferian ‘anecdotal music’ and the work of Luc Ferrari.

According to the characteristics of human resources managers’ competency and the research of relevant literatures at home and abroad, a competency evaluation method of human resources managers based on multi-granularity linguistic variables and VIKOR method is proposed. Firstly, the evaluation indicator system based on the competency of human resources managers is constructed. Then, by converting the evaluation information of different experts in different granularity to the same granularity by two-semantics, the comprehensive evaluation values can be obtained by integrating information of different experts. Further, the objective weights of the evaluation indexes were determined by the entropy method and an evaluation method were proposed based on the VIKOR method. Finally, an application example is given to illustrate the evaluation procedures of the developed approach and to demonstrate their practicality and effectiveness.

This chapter presents an examination of why—in contemporary Africa, with Southern Africa as the primary focus—there are very few artists working with sound in a manner that fits the paradigm of sound art as it is known in Euro-America. Emphasis is not placed on a lack of intellectual engagement, which is significant in the Euro-American definition of sound art. What is presented does not aim to deviate from this, but rather acts to affirm an engagement with alternative forms of knowledge and mechanisms of sound found in the South. Three areas are explored; these however are interlinked and do not stand alone. The first is an understanding of the practice of interdisciplinarity as political engagement. The second explores the role of community and communal interaction with sound and how this is fundamental to form in the region. The third extends this by showing how the histories of knowledge and power are fundamental to these explorations in the region, emphasizing how contemporary explorations of sound are used to both contain and shift these histories. The chapter takes shape with the use of case studies and draws on interviews conducted by the authors.

PurposeThe aim of this study was to analyse the influence of different employment relationships (ERs) on the sustainability results of cooperatives. The authors approached the type of ER comparing the inducements offered by the firm with the contributions that the manager expects from employees. In this way, the authors study how the orientation toward the employment relationship influences the economic, social and environmental sustainability of the firm.Design/methodology/approachThis article presents a theoretical and empirical research model about the relationship between ERs and sustainability. The necessary information was obtained through a questionnaire that was completed by the human resource (HR) managers and chief executive officers (CEOs) of 124 cooperative companies, and structural equation modelling was applied to evaluate the relationships between the proposed constructs, using the partial least squares technique (PLS-SEM).FindingsThe obtained results suggest that mutual investment and overinvestment ERs favour economic, social and environmental sustainability, whereas quasi spot contract and underinvestment ERs have a negative influence on all three types of sustainability. Therefore, it is confirmed that the type of ER adopted can condition the sustainability of the company, either favouring or worsening it.Originality/valueThis work contributes to covering the lack of studies about which ERs impact the sustainability of organisations, and it provides information on the role of ERs in the search for a more sustainable organisation, demonstrating that the type of employment relationship developed by the firm has a relevant impact on its sustainability.

The Iranian legislator has sought to protect public property and public ownership in the Iranian Constitution in accordance with Islamic principles, terms and procedures. There are a number of principles that have been directly applied to this purpose; however, one principle has had a very significant impact on government domination of the economy of Iran: principle 44. This principle does not directly describe public property; rather, it aims to determine the areas that are under public ownership and are administered by the government. However, the principle has some contradictions and legal challenges in itself. In addition, the supplementary law that has been enacted to provide the areas for the enforcement of principle 44 fails to secure the aims of the legislator. Therefore, this paper analyses legal challenges of the principle, as well as its supplementary law, and gives suggestions to solve the challenges.This paper is divided into four sections. The first section provides an analysis of the principle itself, and its relationship and consistency with other principles of the constitution. In the second section, the Law of Implementation of Principle 44 and the legal challenges that arise from it will be discussed. The third section focuses on the negative economic impacts of this law, as well as case studies of it. Lastly, the paper provides a summary of suggestions to amend this law.
