In the past three decades, social scientists have made real progress in understanding “desistance,” or the process of transitioning away from criminal behavior. Yet criminal justice policies and practices have been slow to adopt the lessons of life course criminology. Connecting research on desistance theories, particularly identity-based theories, to reentry policies is crucial to understanding the context of criminal offending. Repeated interactions between individuals involved in crime and the police, courts or prison populations can actually increase the salience of criminal identities and strengthen relationships with others involved in crime. Alternatively, movement toward more positively valued adult roles can help foster and gradually stabilize non-criminal identities through the same role commitment process. As a short-term reform, “the problem facing those returning to civilian life from prison is fundamentally a problem of entry rather than reentry.” Furthermore, if the task of entry is one of integrating into “pro-social adult life”, people need programs that support desistance by fostering success in education, employment, family relationships, maintaining a residence, and participating as a citizen in the community. In the medium-term, we see a crucial need to eliminate most collateral consequences of criminal justice involvement because “It makes little sense for a system to encourage or support the adoption of an identity if the people who pass through it are marked as unredeemable.” Finally, there is a long-term need to eliminate structural barriers that prevent people from fully participating in civil society and minimize crime through equitable social policy.

A newly discovered autobiographical manuscript is used to reconstruct Hutton’s early life in Derby and Nottingham. Of the data in his ‘Memorandums from Memory all Trifles and, of Ancient Date’, 70 per cent was not included in his published Life. This chapter analyses the people, places, and subjects found in this manuscript. Hutton’s earliest memories reveal his hardships as a child labourer in a Derby silk mill and an apprentice stockinger in Nottingham. We observe the strategies he used to find a pathway out of poverty, and the details of his self-education. The importance of family relationships, social networks, and urban marketplaces were common factors shared by entrepreneurs in the Industrial Revolution. How Hutton prepared to become a bookseller is also revealed.

Clayton Paul Alderfer died on October 30, 2015. In addition to the people he left behind (family, friends, colleagues, and former students), Clay also bequeathed a richly varied scholarly legacy. This article introduces the reader to Alderfer’s life and work. Since Alderfer believed that one’s work is influenced by one’s stage of life, his work is presented in chronological order from early adulthood through late adulthood. What emerges is a picture of how the major intellectual themes he worked on—need theory, embedded intergroup relations, organizational diagnosis, and race relations—developed over the course of his adult life. Alderfer is presented in his own words, sentences and paragraphs excerpted from his published legacy, to minimize interpretation and maximize the reader’s exposure to the man and his ideas.

Online criminal histories document and publicize even minor brushes with the law and represent people who may not even be guilty of any crime. This has dramatically changed the relationship that millions of Americans have with the criminal justice system and may affect their social and private lives. Drawing on interviews and fieldwork with people attempting to expunge and legally seal their criminal records, I explore how online versions of these records impact family relationships. Many who appear on mug shot and criminal history websites are arrestees who are never formally charged or convicted of a crime. The indiscriminate posting of all types of justice contact on websites may impact those who, for the most part, desist from crime and are core contributors to their family and community. I find that many of those who are affected by the stigma of online records did not know that records existed until they “popped up” unexpectedly, and that this experience leads them to self-select out of family duties that contribute to child well-being.

Node-link mapping, a graphic representation tool, was used to improve mandated substance-abuse treatment in a 4-month residential criminal justice program. Three hundred eighty probationers (residents) were randomly assigned to either mapping-enhanced or standard counseling. Compared to those in standard counseling, residents receiving mapping gave more favorable evaluations to their group meetings, counselors, co-residents, and security staff. They also rated themselves higher on treatment effort and self-efficacy measures than did their counterparts. These findings suggest that mapping-enhanced counseling fosters more effective communication during meetings, promotes stronger therapeutic alliances, and thus enhances the perceptions of the effectiveness of the program and of the people associated with it.

This chapter addresses the question of whether Americans like to punish. The United States clearly punishes more heavily and for longer periods than other countries, with comparable social and political values. One can land in an American prison for life over minor offenses—a punishment not used for serious offenses in Western Europe. The leading comparativist on criminology, James Whitman, argues that a politics of dignity has instilled mercy and mildness in European systems, while leveling impulses, distrust of authority, and too much power in the people is said to have left the United States with a criminal justice system long in degradation and short on mercy.

Social science has a ‘context sensitivity’ problem: the people that we study, and the situations they engage in, are so complex and variable that predicting how they will think, feel, and behave in a given situation is very challenging. Even when we are able to make such predictions, it is often unclear how accurate they will be if some feature of the studied subjects and/or situation changes. This limits the utility of our research for application and policy, as the ‘contextual factors’ that might change our conclusions are often unknown. It is time to address this context sensitivity problem in social science research. While do not yet know how to solve it, we believe social scientists can make great progress by working together to build an inference engine.

Henrike Genzel & Anja Franz: Decision Making for a Long Term International Voluntary Service – Which Role Do Social and Educational Background Play?): The article attempts to reveal differences in the decision process for a long term international voluntary service. Those differences are analyzed with regards to the social, as well as the educational background, of the people making the decisions. The findings are discussed in view of rational choice theories based on Boudon (1974). Guided interviews with future or former “traditional” and “non-traditional” volunteers from the organization “Aktion Sühnezeichen e.V.” are used as data basis. The results show that the motivation, as well as the decision process, are influenced by the individual access to voluntary services. “Non-traditional” volunteers often structure their decisions based on occasions whereas the “traditional” volunteer’s decision are mostly shaped by rational arguments. Financial costs and an inflexible flow of information are identified as structural barriers.

The article examines the issue of combating criminal offenses in the field of economics. It is emphasized that economic crime is caused by destructive tendencies in the development of market relations in the economy and social sphere. Lack of real protection of legitimate economic relations, lag of law-making activity from the needs of economic practice, unsystematic adoption of legal acts concerning certain elements of the economic system. Recently, there has been a process of merging economic and criminal offenses, as well as merging with organized crime. Penetrating into various spheres of the economy, criminal associations seek not only to establish control over the activities of specific enterprises but also to create their own structures capable of occupying a leading position in the infrastructure of individual industries. The intellectual level of criminal activity increases, the scope, and methods of encroachment expand. The reasons for committing mercenary crimes in the economic sphere are both objective and subjective. Thus, in the determination of crime involved both biological and social characteristics of man. An economic criminal does not perceive himself as a criminal, although he admits that he is breaking the law. The problem here is that the media is very one-sided coverage of the image of the traditional criminal, as well as the fact that economically criminal behavior is difficult at first glance to distinguish from socially obedient. Economic criminals justify their crimes by committing them with the tacit consent or approval of public opinion. They deny causing harm to citizens, and also claim that almost all businessmen do the same. If the profit significantly exceeds the possible punishment, then such a crime becomes profitable. Criminal behavior should not be economically or socially profitable. At the same time, it is important to improve the economic and social living conditions of the people.

The Dispute Resolution Council was established as a public institution in the last few decades to reduce the number of cases sent to the judiciary in Iran and strengthen public participation and increase the role of the people in criminal justice policy. Although the activities of this institution in recent years have led to a decrease in the number of cases sent to judicial institutions, but its public aspect was not fulfilled as intended. In addition, the law of this council has many contradictions with the constitution with limitations and problems in the legal and structural field that have affected its functions. However, the role of the people is significant in similar institutions in the legal system of the Common Law and France, while strengthening the participatory aspect. This issue has been an effective measure in strengthening participatory criminal policy in these countries. Meskipun kegiatan lembaga ini dalam beberapa tahun terakhir telah menyebabkan penurunan jumlah kasus yang dikirim ke lembaga peradilan, tetapi aspek publiknya tidak terpenuhi sebagaimana dimaksud. Selain itu, undang-undang dewan ini memiliki banyak kontradiksi dengan konstitusi dengan keterbatasan dan masalah di bidang hukum dan struktural yang mempengaruhi fungsinya. Namun, peran masyarakat cukup signifikan dalam lembaga sejenis dalam sistem hukum Common Law dan Perancis, sekaligus memperkuat aspek partisipatif. Isu ini telah menjadi langkah yang efektif dalam memperkuat kebijakan kriminal partisipatif di negara-negara tersebut. Tujuan dari penelitian ini adalah untuk mengetahui kebijakan kriminal dari Dispute Resolution Council dan lembaga sejenis di Perancis.Kata Kunci: Dewan Penyelesaian Sengketa, Hukum Prancis, Kebijakan Peradilan Pidana Iran Оценка роли и позиции советов по решению спорных вопросов В уголовной политике ирана по сравнению с аналогичными учреждениями во французской судебной системе  АннотацияСовет по решению спорных вопросов был создан как государственное учреждение в последние десятилетия для сокращения количества дел, передаваемых в судебные органы в Иране, и расширения участия общественности и повышения роли общественности в политике уголовного правосудия. Хотя деятельность этого учреждения в последние годы привела к уменьшению количества дел, направляемых в судебные органы, общественный аспект не выполняется должным образом. Кроме того, закон этого совета имеет много противоречий с конституцией с ограничениями и проблемами в правовой и структурной областях, которые влияют на его функционирование. Тем не менее, роль сообщества весьма значительна в аналогичных учреждениях в системе общего права и правовой системы Франции, а также в усилении аспекта участия. Этот вопрос стал эффективным шагом в укреплении совместной уголовной политики в этих странах.
