Abstract The third and final installment of this book-length contribution to the Common Knowledge symposium “Contextualism—the Next Generation” treats two further writers in seventeenth-century England whose work is not representative of any stance or discourse that contextualist historians have recognized as available in that era. In Aemelia Lanyer's poetry, we find a resistance to established perspectives that is related to her sense that divine signification is always incomplete and that, therefore, the diffidence of female cognition is superior, when approaching religious texts, to the assertive mentality that she associates with men. Despite his sex, however, and his reputation for theological and political radicalism, Milton too explicitly contends that the interpretation of scripture should always be “non-committal” because its signification is always incomplete. The “very magnitude” of the “great mystery” of the Incarnation, Milton argues in De Doctrina Christiana, should encourage the reader's mind to stand on “guard from the outset” against the tendency to make “rash or hasty assertions.” The urge to tamper with, pry into, add to, or hasten to understand the signifiers of divine meaning is shown, in Paradise Lost, to be the original sin of the first human couple. As much as for Lanyer, then, sex is for Milton bound up with hermeneutics—and, for both poets, the individual's relationship with God is a consuming passion, about which one may report a phenomenology of affects but can offer no contentions or arguments.

The zhahiriyyah school is a school that stores certain texts by forgetting the global objectives of sharia. Among them there are those who are more dominant with the nature of religion, and among them there are those who are dominant in the nature of politics, even though they are all the same in terms of understanding literalism. The Zhahiriyya have been exaggerated in extracting text literalism to bring them to the strange understanding rejected by religion and reason. Zahiriyyah characteristics literal understanding and interpretation in understanding and interpreting texts without seeing things hidden in them, both in illat form and intentions that can be known by profound researchers: 1) Difficult and difficult; 2) Arrogant towards their opinions; 3) Don't accept different people; 4) Kafir people who have different opinions; 5) Whatever slander. The Bathiniyyah school is the opposite of the forgotten zhahiriyah school, even deliberately refusing, certain texts. This flow claims that they see the common good and global goals. This flow dares to oppose religious texts brought by the revelation ma`sum, both the Qur'an or al-Sunnah. They reject the text without caring, and freeze it without knowledge and guidance unless they follow the nature of themselves or others who want to make slander against the teachings of truth revealed by God. When they annulled religious texts in the name of human benefits. They claim that from these spies they are not out of the Shari'ah, they defend their intentions and maintain their spirit and substance, even though they do not maintain symbols and forms. Characteristics of the divine; 1) Superficial understanding of sharia `ah; 2) Dare to think without knowledge; 3) Follow westward. The third characteristic of the bathiniyyah school is to follow the other, west, both capitalism, liberalism or marix, all born in the west. From this they want to impose Western philosophy on the life, western views of religion, the concept of western scularism, and western, social, political, linguistic, and cultural legal theories for us. AbstractSince 1988, when this journal carried an article on Andrics Bongen (ca. 1732-1792), probably the first cabinet-maker in Amsterdam to have made marquetry furniture in the French style in the third quarter of the eighteenth century, not one item has been added to his small oeuvre. It is therefore still not clear whether Bongen had a long and successful career, nor whether his production was large. This article deals with the eighteenth-century activities of Matthijs Horrix (1735 -1809), a furniture maker who in certain aspects may be regarded as Bongen's Hague counterpart. He, too, hailed from Germany, set up independently in the Netherlands in the 1760s and worked in the French style from the outset of his career. There are however no doubts as to bis success : he was The Hague's best-known furniture maker in the late eighteenth century, with the largest workshop. In the course of the nineteenth century the firm he founded grew into the largest in the Netherlands (note 4). Whereas it cannot be ascertained whether 'French' cabinet-making was ever a dominant trend in Amsterdam, one gets the impression that such was to some extent the case in The Hague after 1760. In the city where the Stadholder's court and foreign embassies were based, the French-oriented court style had been a significant factor since at least the late seventeenth century (notes 5, 6 and 8). Many patrons in The Hague were probably keen on furniture which actually came from France. In 1771 the guild of furniture makers complained to the city council about the influx of furniture imported from abroad; this probably meant imports from France (notes 9 and 10). Several furniture makers in The Hague began to imitate the French models. As early as 1761 Matthijs Franses (ca. 1726-1788), who came from Kempen near Krefeld, advertized that he made and sold a variety of veneered furniture in the French style. His descriptions are not very clear, but mention is made of commodes and tables inlaid with copper (in the Boulle technique?), commodes 'à la Diligence' with gilded bronze mouldings and marble tops, desks and 'Ouvrages en ébène'. Franses says nothing about marquetry featuring different kinds of wood, the most popular decorative technique in Paris around 1760 and the kind of work with which Bongen made his debut in Amsterdam in 1766. It seems likely that Horrix arrived in The Hague around 1761. He was born in 1735, probably in Lobberich near Krefeld (note 25). In a petition submitted in 1764 he stated that he had been apprenticed to a cabinet-maker in The Hague 'for some years'; the period in question was probably not longer than three years (notes 26 and 27). At the beginning of this period, then, Horrix was already 25 years of age or older. In view of the common practice throughout Europe for boys to be apprenticed to a craftsman at the age of fourteen or thereabouts for a period of some six years (note 28), Horrix may have worked in one or more shops elsewhere after his apprenticeship and before his arrival in The Hague. However, no information about this period is available. On May 15 1764, Horrix was enrolled in the Hague guild as a master cabinet-maker (note 33). On January 9th of that year he had acquired citizenship, and on May 5th he had married Elisabeth de la Fosse of The Hague. The wedding was witnessed by

This chapter shows how common law pleading, the use of common law vocabulary, and substantive common law rules lay at the foundation of every colony’s law by the middle of the eighteenth century. There is some explanation of how this common law system functioned in practice. The chapter then discusses why colonials looked upon the common law as a repository of liberty. It also discusses in detail the development of the legal profession individually in each of the thirteen colonies. Finally, the chapter ends with a discussion of the role of legislation. It shows that, although legislation had played an important role in the development of law and legal institutions in the seventeenth century, eighteenth-century Americans were suspicious of legislation, with the result that the output of pre-Revolutionary legislatures was minimal.

The characters of the apical system of a series of Holectypus hemisphæricus from the same horizon at two localities in Dorsetshire are analysed and described. It is found that the average relations of the plates of the system are different at the two localities, although certain numbers of identical forms occur at both. Out of 189 specimens (from both localities), 40 show serious departures from the normal type. These abnormalities are of three classes. One, the most prevalent, consists in the presence of madreporic pores on genital 3, in addition to the normal perforation of genital 2. This is regarded as a “progressive variant” in the direction of Discoides. The second, occurring in three specimens, consists in the interpolation of a supernumerary plate within the system. It is suggested that this may be either a “regressive variant” towards Acrosalenia, or a “progressive variant” towards Nucleolites (as illustrated by N.orlicularis). In neither case would this variation coincide with actual phyletic sequence, so that it is styled “parallel variation”. The third type of variant, seen in one specimen only, combines both the first and second types, and in addition shows an absence of genital 5 and a corresponding increase in the size of the posterior oculars, which meet round the back of the system. The variation in this specimen is interpreted as being “progressive” towards Discoides, “parallel progressive” or “regressive” towards Nucleolites or Acrosalenia respectively, and “progressive” towards Conulus. There are indications of a different series of variants in the Holectypus depressus from the Cornbrash. The high percentage of variation in the composition of the apical system of Holectypus is regarded as an indication of the evolutional activity of the genus, and of its near approximation in time and phylogeny to the common origin of many of the groups of Irregular Echinoids.

AbstractThe machine theatre in France achieves its peak in the second half of the seventeenth century. It is the construction of machines that permits the adequate representation of the third dimension on stage. This optical illusion is created by flying characters, as heroes, gods, or demons moving horizontally and vertically. The enumeration indicates that only characters possessing either ethically exemplary character traits or incorporating sin are allowed to fly. Therefore, the third dimension indicates bienséance – or its opposite. According to this, the following thesis is deduced: The machine theatre illustrates via aesthetic concerns characterising its third dimension an ethic foundation. Ethic and aesthetics determine each other in the context of both, decorum and in theatre practice. In order to prove this thesis three steps are taken. First of all, the machine theatre’s relationship to imitation and creation is explored. Second, the stage design, representing the aesthetic benefits of the machines in service of the third dimension, are explained. Finally, the concrete example of Pierre Corneille’s Andromède is analysed by pointing out the role of Pegasus and Perseus.

This study reconstructs the connected history of socio-economic and intellectual practices related to property in seventeenth-century Bengal. From the perspective of socio-economic practices, this study is concerned with the legal transfer of immovable property between individuals. From the perspective of intellectual practice, this study is concerned with how property was understood as an analytical category that stood in a particular relation to an individual. Their connected history is examined by analysing socio-economic practices exemplified in a number of documents detailing the sale and donation of land and then situating these practices within the scholarly analysis of property undertaken by authors within the discipline of nyāya—the Sanskrit discipline dealing primarily with ontology and epistemology. In the first section of the essay, I undertake a detailed examination of available land documents in order to highlight particular conceptions of property. In the second section of the essay, I draw out theoretical issues examined in nyāya texts that relate directly to the concepts expressed in the land documents. In the third and final section of the essay, I discuss the shared language and shared concepts between the documents and nyāya texts. This last section also addresses how the nyāya analysis of property facilitates a better understanding of claims in the documents and what nyāya authors may have been doing in writing about property.

Abstract Hardly any corpus doctrinae had as intensive a reception and as wide a dissemination as the Corpus Doctrinae Philippicum (1560). Situating it in the history of the concept of a corpus doctrinae and briefly sketching its origin and goal elucidate the function and significance of this collection of Melanchthon’s writings. An intensive investigation reveals however any connection of this work with the development of the Reformation in Siebenbürgen (ung. Erdély, rum. Transilvania) in the later 16th century. The records of the Siebenbürgen synods mention the Corpus Doctrinae Philippicum occasionally, revealing the extent to which it served as a norm for public teaching. Unique and characteristic for Siebenbürgen is that the Formula of Concord (1577) did not replace this Corpus Doctrinae; it remained influential long into the seventeenth century. It was however interpreted within the horizon of a Wittenberg theology that was marked by the pre-confessional harmony and doctrinal agreement between Luther and Melanchthon while seeking to ignore Philippist interpretations and focusing on the common teachings of both reformers.
