The purpose of this study is to critically analyze the requirements regarding the framing of rural workers as a special insured, confronting them with the reality of the Brazilian rural area. Therefore, as a methodology, the jurisprudence of the higher courts was researched, exploratory bibliographic research and qualitative analysis were used. In addition, empirical research was carried out, listening to the various actors in the social security processes. Here it will be demonstrated that judges Jupiter, Hercules and Hermes can live harmoniously within the scope of Social Security Law, with space for each one of them, depending on the complexity of the specific case set out. In less complex cases, where the legal text is able to offer the appropriate response to the conflict, it is time for the Jupiterian exegesis to be applied by the interpreter. In hard cases, however, the toga of the first must give way to the toga of the last two, since the literality of the text does not deliver the most appropriate solution to the social security dispute. In this sense, the open type for the characterization of the special insured has the considerable advantage of flexibility, allowing the operator of the law a topic-problematic interpretation, to find the best answer for the specific case, taking into account, therefore, the heterogeneities of this continental country, whose social, geographical, climatic, economic and cultural differences are colossal. The legal system has gradually moved away from Kelsen’s pyramidal metaphor and towards a more horizontal and intertwined normative system - much closer to the sphinx of the Memphis alabaster than to the Cheops pyramid - with interdisciplinarity as a vector of stabilization of the system and this will be demonstrated in this study.

The topic is not only current due to several judgments of the Federal Social Court on the social insurance obligation of GmbH managing directors. It also concerns fundamental questions of the relationship between social security law and corporate law, in particular with regard to the interpretation of the concept of employment within the meaning of Section 7 (1) SGB IV. In this context, it is elaborated that, due to the idea of the unity of the legal system, arrangements under corporate law are in principle also recognized as effective under social security law, although the requirement of foreseeability of facts under social security and contribution law constitutes a decisive limit. The content of this requirement is examined.

Abstract This chapter analyses the social protection system in Estonia mainly from the immigration viewpoint. Perhaps because of low immigration rates in recent decades, immigration and emigration issues are seldom explicitly regulated in the Estonian legal system. Our findings indicate that social security rights are based mostly on legal resident status in Estonia, although EU foreign residents sometimes benefit from some better conditions, mainly in terms of taking into account employment records in other EU countries. Missing waiting periods for entitlement to social benefits guarantee that newly arrived immigrants have similar rights with long-term residents.

Compared to the China's urbanization and increased speed of rural workers’ group size, the author analyzes the reasons of social security system right absence for migrant workers from the perspective of both macro-and micro-urban, where dual urban-rural social structure decided by dual economic base is the basic reason that causes the social security system right absence. Besides, the existing social insurance system against those migrant workers and the weak awareness of migrant workers all have no adverse effect on the social security system right absence .

Pretende o presente artigo perquirir a real natureza do benefício de aposentadoria por idade rural, tendo em vista que, não obstante a lei tratá-lo expressamente como benefício de caráter previdenciário, a sua aplicação prática no ordenamento jurídico brasileiro tem lhe atribuído, na maior parte dos casos, um caráter assistencial, pois a aposentadoria por idade rural, além de ser conferida a segurados não filiados à Previdência Social, é concedida, na maioria das vezes, visando a uma finalidade social, qual seja: assegurar uma fonte de renda a pessoas carentes que não possuem condições mínimas de subsistência, mesmo não havendo início de prova material suficiente para a sua concessão, consoante exigido pela lei. Assim, este trabalho se propõe a analisar o verdadeiro caráter da aposentadoria por idade dos trabalhadores rurais, abordando os fundamentos da Seguridade Social brasileira, notadamente no que diz respeito à distinção entre os benefícios previdenciários e os assistenciais. PALAVRAS CHAVES: Previdência Social; Aposentadoria por Idade dos Trabalhadores Rurais; Natureza Assistencial; Inclusão Social.   ABSTRACT This article aims to discover the real nature of the benefit of rural retirement age, given that, notwithstanding the law treat it as specifically benefit pension character, its practical application in the Brazilian legal system is assigned in most cases, a character healthcare, retirement age for the rural as well as being given to policyholders not affiliated to Social Security, is granted, for the most part, aimed at a social purpose, namely, provide a source of income for people poor who lack the minimum conditions of survival, even with no initial evidence sufficient material for its grant, as required by law. This work aims to analyze the true character of the retirement age of rural workers, covering the basics of Social Security in Brazil, notably with regard to the distinction between welfare benefits and assistance.  KEYWORDS: Social Security; Retirement by age of Rural Workers; Assistencial Nature; Social Inclusion.

Abstract Objective: to describe how the progressive creation of the Social Security (providing widespread health care) affected the birth assistance in Spain from the 1940s to the 1970s in a rural area. Method: historical ethnography. Twenty-seven people who lived at that time were selected and interviewed guided by a semistructured script. Based on their testimonies, a chart was built with the functional elements involved in birth assistance in this region. Results: three agents performed such care: traditional midwives, women of the family/neighbors and health workers. Conclusion: although birth assistance had been transferred to the hands of the health workers from the forties in this region, women in labor continued to count on the domestic resources until the early seventies, when births were compulsorily transferred to hospitals. This research brings to light the names and recognizes the work performed by these female characters of the popular sphere, who helped women in labor of that community to give birth, for at least three decades.

Este trabajo describe el procedimiento administrativo que sigue la Tesorería General de la Seguridad Social, como Entidad Gestora, para obtener la devolución o reintegro de prestaciones percibidas indebidamente por supuestos beneficiarios, sobre todo, en el caso de las pensiones no contributivas dentro del ámbito de la Comunidad Autónoma de Andalucía. En primer lugar, se hace un pequeño bosquejo de aspectos que son comunes o generales a todas las comunidades autónomas, de acuerdo con la estructura política de España. En segundo lugar, se analizan algunos aspectos inherentes a las pensiones no contributivas: para qué son, a quienes benefician, cómo se otorgan, cuál es su cuantía y cómo se extinguen, para valorar así la incidencia en la Comunidad Autónoma de Andalucía, en cuanto a las pensiones no contributivas como parte integrante de la Seguridad Social española. Por último, se aborda el procedimiento que debe seguirse para el reintegro de las prestaciones indebidamente percibidas por parte de los beneficiarios, de acuerdo con lo dispuesto en nuestro ordenamiento jurídico, de manera que cada Comunidad Autónoma debe ser garante, tanto de la correcta asignación de las prestaciones como del retorno o reintegro de las cantidades percibidas por beneficiarios de manera indebida, sea originada por errores cometidos por la propia Administración Pública, o por omisión, falsedad o alteración intencionada de datos por parte del beneficiario.This work describes the administrative procedure follwed by the Social Security General Treasury, as Management Entity, in order to obtain the refund or reimbursement of allowances unlawfully received by alleged beneficial owners, especially in the case of non-contributory benefits, within the area of Andalusia Autonomous Community. Firstly, it is made a short draft of those common or general aspects in all the autonomous communities, in accordance with the Spanish political structure. Secondly, it is analised some inherent aspects to the non-contributory benefits: what they are, who the profit, how they are bestowed, which their quantity is and how they expire. Thus, it can be valued the incidence in the Andalusia A C regarding the non-contributor benefits as an integral part the Spanish Social Security. Finally, it also deals with the proceedings which are to be followed for the reimbursement of the allowances unlawfully received by the beneficial owners in accordance with the procedure provided by our legal system so that every autonomous community must be a warrantor of both, the appropriate assignment of the allowances, as well as the drawback or reimbursement of the quantities received by the beneficial owners unlawfully, having been originated by mistake made by the Public Administration or due to default, counterfeit or intentional alteration of data by the beneficial owners.
