The writing of this article is motivated by the implementation of marriage agreements in Article 147 of the KUHPerdata and Article 29 of Law Number 1 of 1974 about Marriage, which states that marriage agreements are made before the marriage happened. This rule restricts the freedom of two individuals to perform the agreement, so that it is contrary to Article 28 points e paragraph 2 of the 1945 Constitution. In 2015, the Constitutional Court (MK) issued Decision Number: 69 / PUU-XIII / 2015 which concerning about the issue of the marriage agreement. This article discusses the settlement of marital property disputes after the Constitutional Court's decision in terms of normative legal studies. The study focused on legal principles, legal systematics, legal synchronization, and legal history. The result: (1) based on the Constitutional Court's decision, the marriage agreement can be made as long as the marriage bond takes place with mutual agreement witnessed by a notary without having to be preceded by a court ruling; (2) the Constitutional Court's decision results in joint and third party assets that made and witnessed by a notary begins to take effect from the time the marriage takes place, unless otherwise specified in the marriage agreement. That is, if the parties do not determine when the marriage agreement will take effect, the marriage agreement will take effect from the time the marriage takes place. [Penulisan artikel ini dilatarbelakangi oleh pelaksanaan perjanjian perkawinan dalam Pasal 147 Kitab Undang-undang Hukum Perdata (KUHPerdata) dan Pasal 29 Undang-Undang Nomor 1 tahun 1974 tentang Perkawinan, yang menyebutkan bahwa perjanjian perkawinan dibuat sebelum perkawinan dilangsungkan. Peraturan ini membatasi kebebasan dua orang individu untuk melakukan perjanjian, sehingga bertentangan dengan Pasal 28 Poin e Ayat 2 Undang-Undang Dasar 1945. Tahun 2015, Mahkamah Konstitusi (MK) mengeluarkan Putusan Nomor: 69/PUU-XIII/2015 yang di antara ketentuannya menyangkut persoalan perjanjian perkawinan. Artikel ini membahas penyelesaian sengketa harta perkawinan pasca putusan MK tersebut dari sisi kajian hukum normatif. Kajian difokuskan pada asas-asas hukum, sistematika hukum, sinkronisasi hukum, dan sejarah hukum. Hasilnya: (1) berdasarkan pada putusan MK tersebut, perjanjian perkawinan dapat dibuat selama ikatan perkawinan berlangsung atas persetujuan bersama di depan notaris tanpa harus didahului oleh penetapan pengadilan; (2) putusan MK tersebut berakibat pada harta bersama dan pihak ketiga yang dibuat di hadapan notaris mulai berlakunya sejak perkawinan dilangsungkan, kecuali ditentukan lain dalam perjanjian perkawinan. Artinya, apabila para pihak tidak menentukan kapan perjanjian perkawinan tersebut mulai berlaku, maka perjanjian perkawinan tersebut berlaku sejak perkawinan dilangsungkan.]

 AbstrakSejak 2009 hingga saat ini terdapat 30 kasus yang diadili oleh Pengadilan Negeri di Indonesia dengan menggunakan Pasal 27 ayat (3) Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Berbagai kasus tersebut memunculkan opini dari sebagian masyarakat yang menganggap pasal-pasal delik pencemaran nama baik bertentangan dengan semangat reformasi yang menjunjung kebebasan berpendapat dan berekspresi. Jenis penelitian ini adalah penelitian hukum normatif. Tulisan ini berkesimpulan bahwa tindak pidana reputasi pasca Putusan Mahkamah Konstitusi Nomor 50/PUU-VI/2008, Putusan Mahkamah Konstitusi Nomor 2/PUU-VII/2009, Putusan Mahkamah Konstitusi Nomor 5/PUU-VIII/2010,  Putusan Mahkamah Konstitusi Nomor 31/PUU-XIII/2015 dan Putusan Mahkamah Konstitusi Nomor 76/PUU-XV/2017 tentang Pengujian Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 diatur secara terperinci dengan salah satu pointnya yaitu melakukan perubahan dalam Pasal 27 ayat (3) UU ITE dan menurunkan ancaman pidana pada 2 (dua) ketentuan.Kata Kunci: Delik Reputasi, Kepastian Hukum dan Mahkamah Konstitusi.Abstract  Since 2009 until now there have been 30 cases tried by the District Courts in Indonesia using Article 27 paragraph (3) of Law Number 19 Year 2016 concerning Amendments to Law Number 11 Year 2008 concerning Information and Electronic Transactions. These various cases gave rise to opinions from some people who considered the articles of defamation offenses contrary to the spirit of reform which upheld the freedom of opinion and expression. This type of research is normative legal research. Normative legal research prioritizes library research with a focus on studies of legal principles, legal systematics, legal synchronization and legal history, this research is also descriptive. This study concluded that the crime of reputation after the decision of the Constitutional Court Number 50 / PUU-VI / 2008, Decision of the Constitutional Court Number 2 / PUU-VII / 2009, Decision of the Constitutional Court Number 5 / PUU-VIII / 2010, Decision of the Constitutional Court Number 31 / PUU-XIII / 2015 and Constitutional Court Decision Number 76 / PUU-XV / 2017 concerning Testing of Law Number 19 Year 2016 concerning Amendment to Law Number 11 Year 2008 concerning Information and Electronic Transactions of the Constitution of the Republic of Indonesia Year 1945 is regulated in detail with one of the points, namely making changes in Article 27 paragraph (3) of the ITE Law and reducing criminal threats in 2 (two) provisions.Keywords: Reputation Delik, Legal Certainty and the Constitutional Court.

Dalam kaitannya dengan penafsiran, dapatkah Mahkamah Konstitusi menafsirkan suatu norma pidana dan dapatkah Mahkamah Konstitusi membuat hukum baru atas norma hukum pidana. Untuk menjawab masalah tersebut, digunakan penelitian hukum normatif, Penelitian hukum normatif atau kepustakaan tersebut mencakup: (1) penelitian terhadap asas-asas hukum, (2) penelitian terhadap sistematika hukum, (3) penelitian terhadap sinkronisasi vertikal dan horizontal, (4) perbandingan hukum, (5) sejarah hukum. Oleh karena itu, maka bahan yang digunakan adalah bahan sekunder yang dilakukan melalui penelitian kepustakaan (library research). Berdasarkan hasil penelitian tersebut, Mahkamah Konstitusi melakukan judicial activism ketika norma tersebut melanggar hak konstitusional warga negara yang dijamin oleh Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, dan Mahkamah Konstitusi melakukan judicial restraint ketika harus menyatakan sesuatu yang semula bukan perbuatan pidana menjadi perbuatan pidana.In relation to interpretation, can the Constitutional Court interpret a criminal norm and can the Constitutional Court make a new law on criminal law norms. To answer this problem, normative legal research is used. Normative legal research includes: (1) research on legal principles, (2) research on legal systematics, (3) research on vertical and horizontal synchronization, (4) comparison law, (5) legal history. Therefore, the materials used are secondary materials which are carried out through library research. Based on the results of the study, first: the Constitutional Court conducted judicial activism when the norm violated the constitutional rights of citizens guaranteed by the 1945 Constitution of the Republic of Indonesia, second: the Constitutional Court conducted a judicial restraint when it had to declare something that was not a criminal act.

Purpose. The purpose of the article is to identify the fundamental values of the Ukrainian people, on the basis of which not only his mentality, but also all national-state institutions, including institutions of justice and justice, as well as to identify trends of influence of these values on the further development of legal foundations of the judiciary and justice of Ukraine. Method. The methodological basis of the study was the combination of principles and methods of scientific knowledge. For the objectivity of the research, a set of general scientific, special-legal, special-historical and philosophical methods of scientific knowledge was used. Results. At the current stage of reforming the institutions of the judiciary and the judiciary, the notion of fair justice, which is formed on the basis of popular national culture, plays an important role. Given the functioning of the modern Constitutional Court of Ukraine, whose representatives are formed by delegation to the Verkhovna Rada of Ukraine, the President of Ukraine, the Cabinet of Ministers of Ukraine and the judiciary, this institution needs radical reform as it has repeatedly made political rather than constitutional decisions. Scientific novelty. Based on the analysis of the national tradition of justice, it is established that the Constitutional Court should be formed by public organizations, which are formed by legal experts. There are several higher scientific institutions in Ukraine which have departments, constitutional law research institutes. Their representatives should delegate the best experts in the constitutional right to competitive selection to fill vacancies in the constitutional court. Practical importance. The results of the study can be used in further historical and legal studies, preparation of special courses.

Land ownership for Indonesian citizens the result of mixed marriages without marriage agreement Indonesian citizen can only use the use rights and lease rights to buildings in the ownership of land. This study uses a normative juridical approach. It can be concluded that according to Law No. 5/1960 for Indonesian citizens, mixed marriages may own land with a status other than use rights and lease rights to buildings if there is a marriage agreement before or at the time of marriage. However, after the Constitutional Court ruling number 69 / PUU-XIII / 2015 gave a breath of fresh air for mixed marriages to still be able to receive their constitutional rights by making marriage agreements during the marriage.

Margot Badran's Gender and Islam in Africa: Rights, Sexuality, and Law, and Christina Jones-Pauly and Abir Dajanfi Tuqan's Women under Islam: Gender Justice and the Politics of Islamic Law collectively advance a movement in Islamic legal studies that focuses on interdisciplinary explorations into the ways particular constructions of Islamic law are foregrounded and reified in accordance with the existential impulses and demands of a particular society at a particular time, what we might call the “hermeneutic of experience.” I would argue that gender functions as the category that most regularly exposes the limitations of various historically situated concepts of orthodoxy, and these books bear out this claim.

Rapid development of housing construction raises various concerns related to making the customer satisfied and at concurrently allowing the developer to make profit. Increase in housing development does not go in pair with increase in compliance of obligations made by the entrepreneurs.   Terms and conditions of the business construction agreement are prepared by the entrepreneur and listed as standard agreement or standard clause. The purpose of this research was to determine the resolution of disputes in consumer protection law. The normative approach consists of learning the laws regarding the juridical process and debating about the standard agreement using terms of consumer protection law.   he outcome of this research ar (1) Legal Provisions of standard clauses in PPJB which is detrimental to consumer and is contained in the provisions of the article 18 of law Number 8 from  1999 concerning consumer protection. (2) Resolved the consumer dispute through mutual agreement or by means of a third party (authorized agency).  The existence of standard agreement has impact on the profitability of the entrepreneurship. Research shows that there is a necessity to regulate the contents of standard clauses in order to make the development of Indonesian business more transparent.Keywords: Consumer Protection, standard agreement, dispute resolution ABSTRAKPesatnya pembangunan rumah susun menimbulkan permasalahan lain yang sering muncul dalam pemenuhan kebutuhan akan perumahan yakni hak-hak konsumen yang dirugikan. Meningkatnya pembangunan perumahan, seringkali tidak diselaraskan dengan pemenuhan kewajiban oleh pelaku usaha. Permasalahan dalam bisnis rumah susun yang sering muncul adalah ketentuan mengenai pernyataan dan persetujuan untuk menerima segala persyaratan dan ketentuan-ketentuan yang ditetapkan secara sepihak dan ketentuan-ketentuan penandatanganan atas dokumen-dokumen yang telah dipersiapkan lebih awal oleh pelaku usaha, tercantum dalam surat pemesanan yang sering disebut perjanjian baku atau klausula baku. Tujuan dari penelitian ini adalah untuk mengetahui penyelesaian sengketa dalam bidang hukum perlindungan konsumen. Metode pendekatan normatif, yang terdiri dari pendekatan yuridis dengan cara mempelajari isi dari Undang-Undang,dengan melihat perdebatan mengenai perjanjian baku  ditinjau menurut UU Perlindungan Konsumen.  Adapun hasil penelitian ini adalah : (1) Ketentuan hukum terhadap pencantuman klausula baku  dalam PPJB yang merugikan konsumen menurut Undang-undang Perlindungan Konsumen terdapat dalam ketentuan pada Pasal 18 Undang-Undang No. 8 Tahun 1999 Tentang  Perlindungan Konsumen.(2) Penyelesaian sengketa dalam bidang hukum perlindungan konsumen pada umumnya dapat diselesaikan setidak-tidaknya melalui 2 (dua) cara penyelesaian, yaitu, Penyelesaian sengketa secara damai dan Penyelesaian melalui lembaga atau instansi yang berwenang, karena adanya kontrak baku perjanjian ini, cenderung merugikan pihak yang kurang dominan dalam hal ini pihak konsumen. Adapun  saran dalam penelitian ini diantaranya adalah Perlunya adanya peraturan dan sanksi terhadap pencantuman  klausa baku untuk memberikan batasan-batasan bagi perkembangan bisnis di Indonesia.Kata Kunci: Perlindungan Konsumen, Perjanjian Baku, penyelesaian sengketa

AbstractThe late Harold Berman was a pioneering scholar of Soviet law, legal history, jurisprudence, and law and religion; he is best known today for his monumentalLaw and Revolutionseries on the Western legal tradition. Berman wrote a short book,Law and Language, in the early 1960s, but it was not published until 2013. In this early text, he adumbrated many of the main themes of his later work, includingLaw and Revolution.He also anticipated a good deal of the interdisciplinary and comparative methodology that we take for granted today, even though it was rare in the intense legal positivist era during which he was writing. This essay contextualizes Berman'sLaw and Languagewithin the development of his own legal thought and in the evolution of interdisciplinary legal studies. It focuses particularly on the themes of law and religion, law and history, and law and communication that dominated Berman's writing until his death in 2007.

Impacts Romania may find it hard to avoid economic damage from the assault on the rule of law. The steep reverse in Europeanising this post-communist country will not easily be undone. Romania’s slide into being an illiberal and kleptocratic EU member will increase doubts about admitting similar applicant states.
