Dalam kaitannya dengan penafsiran, dapatkah Mahkamah Konstitusi menafsirkan suatu norma pidana dan dapatkah Mahkamah Konstitusi membuat hukum baru atas norma hukum pidana. Untuk menjawab masalah tersebut, digunakan penelitian hukum normatif, Penelitian hukum normatif atau kepustakaan tersebut mencakup: (1) penelitian terhadap asas-asas hukum, (2) penelitian terhadap sistematika hukum, (3) penelitian terhadap sinkronisasi vertikal dan horizontal, (4) perbandingan hukum, (5) sejarah hukum. Oleh karena itu, maka bahan yang digunakan adalah bahan sekunder yang dilakukan melalui penelitian kepustakaan (library research). Berdasarkan hasil penelitian tersebut, Mahkamah Konstitusi melakukan judicial activism ketika norma tersebut melanggar hak konstitusional warga negara yang dijamin oleh Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, dan Mahkamah Konstitusi melakukan judicial restraint ketika harus menyatakan sesuatu yang semula bukan perbuatan pidana menjadi perbuatan pidana.In relation to interpretation, can the Constitutional Court interpret a criminal norm and can the Constitutional Court make a new law on criminal law norms. To answer this problem, normative legal research is used. Normative legal research includes: (1) research on legal principles, (2) research on legal systematics, (3) research on vertical and horizontal synchronization, (4) comparison law, (5) legal history. Therefore, the materials used are secondary materials which are carried out through library research. Based on the results of the study, first: the Constitutional Court conducted judicial activism when the norm violated the constitutional rights of citizens guaranteed by the 1945 Constitution of the Republic of Indonesia, second: the Constitutional Court conducted a judicial restraint when it had to declare something that was not a criminal act.

 AbstrakSejak 2009 hingga saat ini terdapat 30 kasus yang diadili oleh Pengadilan Negeri di Indonesia dengan menggunakan Pasal 27 ayat (3) Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Berbagai kasus tersebut memunculkan opini dari sebagian masyarakat yang menganggap pasal-pasal delik pencemaran nama baik bertentangan dengan semangat reformasi yang menjunjung kebebasan berpendapat dan berekspresi. Jenis penelitian ini adalah penelitian hukum normatif. Tulisan ini berkesimpulan bahwa tindak pidana reputasi pasca Putusan Mahkamah Konstitusi Nomor 50/PUU-VI/2008, Putusan Mahkamah Konstitusi Nomor 2/PUU-VII/2009, Putusan Mahkamah Konstitusi Nomor 5/PUU-VIII/2010,  Putusan Mahkamah Konstitusi Nomor 31/PUU-XIII/2015 dan Putusan Mahkamah Konstitusi Nomor 76/PUU-XV/2017 tentang Pengujian Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 diatur secara terperinci dengan salah satu pointnya yaitu melakukan perubahan dalam Pasal 27 ayat (3) UU ITE dan menurunkan ancaman pidana pada 2 (dua) ketentuan.Kata Kunci: Delik Reputasi, Kepastian Hukum dan Mahkamah Konstitusi.Abstract  Since 2009 until now there have been 30 cases tried by the District Courts in Indonesia using Article 27 paragraph (3) of Law Number 19 Year 2016 concerning Amendments to Law Number 11 Year 2008 concerning Information and Electronic Transactions. These various cases gave rise to opinions from some people who considered the articles of defamation offenses contrary to the spirit of reform which upheld the freedom of opinion and expression. This type of research is normative legal research. Normative legal research prioritizes library research with a focus on studies of legal principles, legal systematics, legal synchronization and legal history, this research is also descriptive. This study concluded that the crime of reputation after the decision of the Constitutional Court Number 50 / PUU-VI / 2008, Decision of the Constitutional Court Number 2 / PUU-VII / 2009, Decision of the Constitutional Court Number 5 / PUU-VIII / 2010, Decision of the Constitutional Court Number 31 / PUU-XIII / 2015 and Constitutional Court Decision Number 76 / PUU-XV / 2017 concerning Testing of Law Number 19 Year 2016 concerning Amendment to Law Number 11 Year 2008 concerning Information and Electronic Transactions of the Constitution of the Republic of Indonesia Year 1945 is regulated in detail with one of the points, namely making changes in Article 27 paragraph (3) of the ITE Law and reducing criminal threats in 2 (two) provisions.Keywords: Reputation Delik, Legal Certainty and the Constitutional Court.

The Constitutional Court based on Article 24C of the 1945 Constitution of the Republic of Indonesia has 4 authorities and 1 obligation. These provisions are further contained in Article 10 of Law Number 24 Year 2003 concerning the Constitutional Court. The constitutional authority of the Constitutional Court in examining, adjudicating and deciding cases of judicial review of the constitution is about the constitutionality of norms. The method used is normative (doctrinal) legal research, using secondary data in the form of primary, tertiary and secondary legal materials. One of the legal materials used as the basis for analysis is the judge's decision and its implications for the judicial review. The results of the study that, the authority to test the Act against the 1945 Constitution theoretically or practically, makes the Constitutional Court as a controlling and balancing body in the administration of state power. The KPK is not the object of the Parlement questionnaire rights. The ruling emphasized that the KPK was an institution that could be the object of the questionnaire right by the Parlement. The implications of the decision of the Constitutional Court Number 36 / PUU-XV / 2017, can be grouped in two ways, namely: first, the implications are positively charged, namely the affirmation of the ownership of the House of Representatives questionnaire rights in Indonesian governance. Second, the negative implication is the possibility of using the DPR's excessive questionnaire rights without regard to existing limitations.Keywords : constitutional court; KPK; parlement.Mahkamah Konstitusi berdasarkan Pasal 24C UUD NRI Tahun 1945 memiliki 4 kewenangan dan 1 kewajiban. Ketentuan tersebut dituangkan lebih lanjut dalam Pasal 10 UU Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi. Kewenangan konstitusional Mahkamah Konstitusi dalam memeriksa, mengadili dan memutus perkara pengujian undang-undang terhadap Undang-Undang Dasar adalah mengenai konstitusionalitas norma. Metode yang digunakan adalah penelitian hukum normatif (doktrinal), dengan menggunakan data sekunder berupa bahan hukum primer, tersier dan sekunder. Salah satu bahan hukum yang dijadikan dasar analisis adalah putusan hakim dan implikasinya terhadap yudicial review. Hasil penelitian bahwa, kewenangan menguji Undang-Undang terhadap Undang-Undang Dasar 1945 secara teoritis atau praktis, menjadikan Mahkamah Konstitusi sebagai lembaga pengontrol dan penyeimbang dalam penyelenggaraan kekuasaan negara, Dalam Putusan Nomor 36/PUU-XV/2017, Mahkamah Konstitusi memutuskan menolak permohonan pemohon yang pada intinya menyebut KPK bukan merupakan objek hak angket DPR. Putusan tersebut menegaskan KPK merupakan lembaga yang dapat menjadi objek hak angket oleh DPR. Implikasi dari putusan Mahkamah Konstitusi Nomor 36/PUU-XV/2017 tersebut, dapat dikelompokkan dalam dua hal, yaitu: pertama, implikasi yang bermuatan positif, yaitu penegasan dimilikinya hak angket Dewan Perwakilan Rakyat dalam ketatanegaran Indonesia. Kedua, Implikasi yang bermuatan negatif yaitu adanya kemungkinan penggunaan hak angket DPR yang eksesif tanpa memperhatikan batasan-batasan yang ada.Kata Kunci: DPR; KPK; Mahkamah Konstitusi.

This chapter argues that apex courts should not take the place of the legislative or the executive branch. It takes a critical stance towards the notion of optimization that legal principles entail. Optimization results in judicial activism that, in turn, shifts the power from politics to courts. The chapter then looks at some decisions by the German Federal Constitutional Court considered 'activist decisions' in the realm of socio-economic rights, and compares their follow-up with the Colombian experience. It suggests that judges must play a rather modest role and limit themselves to a case-by-case rationale even if social rights are systematically under-enforced. The chapter also calls the courts' attention to be aware of the financial restrictions of their countries. Finally, it asks courts to create incentives for the legislatures and executive branch to commit with social and economic rights, and insists that follow-up measures should not be taken by apex courts, but rather by the political branches.

The study of this research is the submission of requests for reconsideration in criminal cases in the Indonesian legal system which became a polemic after the issuance of the Constitutional Court Decision Number 34 / XI-PUU / 2013 and Circular Letter of the Supreme Court (SEMA) Number 7 of 2014 concerning Submission of Reappeals in Cases Criminal. The research objectives to be achieved, in this case, are the regulation of legal reconsideration efforts in Indonesia and the procedure for submitting a request for review in the Indonesian system. Researchers use a normative juridical approach or library research or doctrinal legal research which can be interpreted as legal research by examining library materials and secondary materials. This study illustrates that the regulations for reconsideration in the legal system in Indonesia are based on various regulations, namely Law Number 8 of 1981 concerning the Criminal Procedure Code, Law No. 3 of 2009 concerning the Supreme Court, Law no. 48 of 2009 concerning Judicial Power, Circular Letter of the Supreme Court of the Republic of Indonesia No. 7 of 2014 concerning Review of Criminal Cases and Submission of Reconsiderations at this time refers to the provisions of the Circular Letter of the Supreme Court of the Republic of Indonesia No. 7 of 2014 concerning Reconsideration in Criminal Cases.

The purpose of this study was to determine how the role of the police in the investigation of corruption, how the authority of the police in investigating corruption and how the obstacles faced by the police in investigating corruption in the North Sumatra Regional Police. This research is directed towards normative juridical legal research or doctrinaire which is also referred to as library research or document study because more is done on secondary data in the library. Normative or doctrinaire legal research proposed in this study is a study of legal principles by conducting research in the North Sumatra Regional Police. The results of the research and discussion explaining the regulation of the role of the police in investigating criminal acts of corruption are found in Law No. 8 of 1981 concerning the Criminal Procedure Code, Law No. 31 of 1999 concerning Corruption Crimes as amended by Law No. 20 of 2001 and Law No. 2 of 2002 concerning the National Police of the Republic of Indonesia, in which of all the arrangements explained that the investigator included in the corruption case was the Republic of Indonesia's National Police Officer.

This paper aimed to discuss the legal politics of regulating narcotics and illegal drugs in Indonesia. Using normative legal research methods, this normative legal research focuses on an inventory of positive law, legal principles and doctrines, legal findings in cases in concreto, legal systematics, comparative law, and legal history. The writing of this scientific paper uses primary legal materials and secondary legal materials. Primary legal materials are in the form of laws and regulations related to the issues raised, including Law No. 35 of 2009 concerning Narcotics. Secondary legal materials are materials that explain primary legal materials, such as law books. The results of the research are supported by the opinions of legal experts (doctrine), as well as legal journals related to this research, among others, that narcotics legal politics is the main point in forming a legal system in the form of laws and regulations that regulate criminal acts as described above, Articles 111, 112 has a reasonably heavy prison sentence, which is a minimum of 4 years, and a maximum sentence of 20 years, even the death penalty.

The laws of The Republic Of Indonesia in 1945 became the highest legal source of lower legal products. The laws of The Republic Of Indonesia in 1945 from 1999 to 2002 have been amended four times. The consequences of the amendement certainly affect the laws that run it including synchronzation of local government law with the result of the amendment of the four constitutions of The Republic Of Indonesia in 1945. In this connection the formulation of this research problem is: a) How is the regulation of local government in the amendnment of the four laws of The Republic of Indonesia in 1945?, b) what the arrangement of local government after the amendnment of the four laws of The Republic of Indonesia in 1945?. Is normative legal research. As is known, normative legal research includes research on legal principles, legal system, legal synchronization level, and legal history research. In accordance with the characteristics and nature of normative law research, in this study will use several methods of approach: The Statue Approach (statutory approach, The analitical and Conseptual Approach)  Based on Article 18 of the 1945 Constitution of the State of the Republic of 1945 found The existence of development policy relation between central government and regional government as regulated in Law Number 23 Year 2014 about Local Government, that is base on: Decentralization, Deconcentration and Co-Administration, assignment from government to region and village and from region to village To perform certain tasks accompanied by financing, facilities and infrastructure and human resources with the obligation to report in its implementation and accountable to the commissioned. Undang-Undang Negara Republik Indonesia Tahun 1945 menjadi sumber hukum tertinggi produk hukum yang lebih rendah. Undang-Undang Negara Republik Indonesia Tahun 1945 dari Tahun 1999 sampai 2002 telah dilakukan amandemen sebanyak empat kali. Konsekwensi dari amandemen tersebut  tentunya berpengaruh terhadap Undang-Undang yang menjalankannya termasuk sinkronisasi Undang-Undang Pemerintahan Daerah dengan hasil Amandemen Keempat Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Dalam kaitan itu rumusan masalah penelitian ini adalah: a) Bagaimana pengaturan pemerintahan daerah dalam Amandemen Keempat Undang-Undang Negara Republik Indonesia Tahun 1945?,  b) Bagaimana pengaturan pemerintahan daerah dalam Undang-Undang Pemerintahan Daerah pasca Amandemen Keempat Undang-Undang Negara Republik Indonesia Tahun 1945?. Jenis penelitian ini adalah penelitian hukum normatif. Sebagaimana diketahui penelitian hukum normatif mencakup penelitian terhadap asas-asas hukum, sistematika hukum, taraf sinkronisasi hukum, dan penelitian sejarah hukum. Sesuai dengan karakteristik dan sifat penelitian hukum normatif, maka dalam penelitian ini akan memakai beberapa metode pendekatan: The Statue Approach (pendekatan perundang-undangan), The analitical and Conseptual Approach (pendekatan analisis konsep hukum). Berdasarkan Pasal 18 Undang-Undang Dasar Negara Republik 1945 ditemukan adanya hubungan kebijaksanaan pembangunan antara pemerintah pusat dan pemerintahan daerah sebagaimana diatur dalam Undang-Undang Nomor 23 Tahun 2014 Tentang Pemerintahan Daerah, yaitu dengan dasar-dasar : Desentralisasi, Dekonsentrasi, dan Tugas pembantuan, penugasan dari pemerintah kepada daerah dan desa dan dari daerah ke desa untuk melaksanakan tugas tertentu yang disertai pembiayaan, sarana dan prasarana serta sumber daya manusia dengan kewajiban melaporkan dalam pelaksanaannya dan mempertanggungjawabkan kepada yang menugaskan.

Tulisan ini ingin menjawab dua isu utama mengenai hubungan hukum internasional dan pengujian undang-undang oleh Mahkamah Konstitusi RI (MKRI). Isu pertama adalah legitimasi penggunaan hukum internasional sebagai alat interpretasi dalam pengujian undang-undang, sedangkan isu kedua adalah urgensi penguasaan hukum internasional oleh hakim MKRI. Tulisan ini merupakan penelitian hukum yang menggunakan pendekatan konseptual dan pendekatan historis dalam menjelaskan perkembangan pengujian undang-undang di Indonesia sekaligus menemukan legitimasi penggunaan hukum internasional oleh MK RI. Kesimpulan dari tulisan ini menegaskan bahwa hukum internasional memiliki sumbangsih yang penting dalam perannya sebagai alat interpretasi dalam proses pengujian undang-undang oleh Mahkamah Konstitusi, khususnya terkait hak asasi manusia. Justifikasi keabsahan praktik penggunaan hukum internasional tersebut ditarik dari tradisi ketatanegaraan yang secara implisit dikehendaki UUD NRI Tahun 1945. Manfaat positif yang diberikan hukum internasional nyatanya harus disertai juga dengan penguasaan hukum internasional oleh hakim MK RI supaya hukum internasional dapat digunakan secara tepat. Pembahasan dalam tulisan ini dibagi ke dalam empat sub bahasan inti yakni, pengujian undang-undang, penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang oleh MK, legitimasi penggunaan hukum internasional sebagai the interpretative tool dalam pengujian undang-undang, pentingnya penguasaan hukum internasional oleh hakim MK.This article intentionally answers two principal issues regarding the relationship between international law and judicial review by the Constitutional Court of the Republic of Indonesia. The first issue is the legitimacy of international use as an interpretative tool in judicial review. The second issue talks about the necessity of urgent international law mastery by the Constitutional Court’s judges. This legal research utilizes both a conceptual approach and a historical approach to explain the development of judicial review in Indonesia, and to find legitimacy of international law by the Constitutional Court. The analysis in this article affirms that international law positively contributes as an interpretative tool in judicial review by the Constitutional Court, particularly pertaining to human rights. A justification of a legitimate international law use is withdrawn from constitutional tradition which is implicitly desired by the Indonesian Constitution (UUD NRI 1945). Since international law has provided better insights into norms, a mastery of international law should be encouraged. There are four main discussions in this article: judicial review, application of international law in judicial review process, legitimacy of international law application in judicial review, and the importance of international law mastering by Constitutional Court judges.

The purpose of this research is to determine the constitutional complaint mechanism based on comparisons in other countries, practices, and adaptation of constitutional complaints under the authority of the Constitutional Court of the Republic of Indonesia. Many cases with constitutional complaint substance have been submitted to the Constitutional Court of the Republic of Indonesia even though they don’t have this authority. This research uses a normative legal research method using a statutory approach, a conceptual approach, a comparative approach, and a case approach. This research indicates that the constitutional complaint mechanism in Germany, South Korea, and South Africa has been well implemented. In practice, cases with constitutional complaint substance are filed to the Constitutional Court of the Republic of Indonesia by changing the form by using the legal means of a judicial review, such as case number 16/PUU-VI/ 2008, case number 140/PUU-XIII/2015 and case number 102/PUU-VII/2009. Due to the consideration of the structure, substance, and culture of law, adaptation of constitutional complaint within the authority of the Constitutional Court of the Republic of Indonesia needs to be carried out by amending Law Number 24 of 2003 jo. Law Number 7 of 2020 concerning the Constitutional Court.

This research aimed to study how the party`s accountability for offences committed by legislative candidates. What action that taken by a party of electoral violations and whether the party can be charged for. In the doctrine of Criminal Law known by criminal responsibility related to offenders, and in progress subject to criminal law, not only individual but institution or agency or corporation/firms. So, they should be responsible for it. It was a normative legal research, studying the principles of law related to criminal responsibility. Collecting data were done by two stages that were literature and field research. The first aimed to obtain secondary data namely, law material ;primary, secondary and tertiary. And then, the second, collecting data with an in-depth interview with certain key informant. It used a qualitative method.The result showed that party never asked for their responsibility related to offences by legislative candidates who committed election crime because the act did not rule it. The party had not take action associated with offences were done by them. Politic party as cooperation/firms ideally should take account to candidates who conducted the crime. It was a necessary regulation that managed its accountability as in cooperation. Besides, the party should give politics education and strict sanctions to them who did despicable manners. Key words: accountability, party, election of criminal act, legislative ABSTRAK Penelitian ini dimaksudkan untuk mengkaji bagaimana pertanggungjawaban partai terhadap pelanggaran yang dilakukan oleh Calon Anggota Legislatif, Apa tindakan yang diambil oleh partai terhadap pelanggaran pemilu yang dilakukan oleh Calon Anggota  Legislatif dan apakah  partai dapat dipersalahkan terhadap pelanggaran yang dilakukan oleh Calon Anggota legislatif. Hal ini dilatarbelakangi oleh karena di dalam doktrin hukum pidana dikenal adanya pertanggungjawaban pidana yang dikaitkan dengan pelaku, dan dalam perkembangannya subyek hukum pidana bukan hanya orang perorangan, malainkan juga suatu badan atau korporasi. Sehingga yang dapat dimintai pertanggungjawaban adalah juga suatu badan atau korporasi. Penelitian ini merupakan penelitian hukum normatif, yang mengkaji asas hukum yang terkait dengan pertanggungjawaban pidana, namun demikian diperlukan data lapangan sebagai pelengkap. Pengumpulan data dilakukan melalui dua tahap yaitu penelitian kepustakaan dan penelitian lapangan. Penelitian Kepustakaan (library research), untuk memperoleh data sekunder  berupa bahan hukum; primer, sekunder dan tertier. Penelitian lapangan dilakukan dengan cara wawancara mendalam (deptintevew) dengan narasumber yang ditentukan. Data yang terkumpul baik dari hasil penelitian lapangan maupun dari penelitian kepustakaan dianalisis dengan menggunakan metode kualitatif. Hasil penelitian menunjukkan bahwa Partai tidak pernah dimintai pertanggungjawaban sehubungan dengan pelanggaran yang dilakukan oleh calon anggota legislatif yang melakukan tindak pidana Pemilu, karena Undang-undang  tidak mengatur pertanggungjawaban Partai terhadap tindak pidana yang dilakukan oleh calon anggota ligeslatif. Partai tidak pernah melakukan tindakan terkait dengan calon legislatif yang melakukan pelanggaran. Partai Politik sebagai Korporasi idealnya juga harus bertanggungjawab terhadap tindak pidana yang dilakukan oleh calon anggota legislatif. Diperlukan regulasi  yang mengatur pertanggungjawaban partai terhadap tindak pidana yang dilakukan oleh Calon anggota legislatif sebagaimana pertanggungjawaban dalam tindak pidana korporasi. Di samping itu, hendaknya partai melakukan pendidikan politik kepada anggotanya dan memberikan sanksi tegas kepada anggota partai politik yang merlakukan perbuatan yang tercela. Kata Kunci: Tindak pidana Pemilu
