This chapter examines the fast-moving area of law relating to climate change. This includes a considerable body of public international law, from the UN Framework Convention on Climate Change to the legally innovative Paris Agreement 2015. The chapter also considers legal developments at the EU and UK levels, which both contain a rich body of climate law and policy. The EU and the UK are both seen as ‘world leaders’ in climate law and policy. In EU law, this is due to the EU greenhouse gas emissions trading scheme and the EU’s leadership in advocating ambitious greenhouse gas mitigation targets and in implementing these targets flexibly across the EU Member States through a range of regulatory mechanisms. The UK introduced path-breaking climate legislation in the Climate Change Act 2008, which provided an inspiring model of climate governance, legally entrenching long-term planning for both mitigation and adaptation. The chapter concludes with an exploration of climate litigation, a new and growing field of inquiry.

We are called upon to resolve such controversies using the principles of sustainable development, which integrates ecology, economics and ethics. This timely book establishes a template for all types of resource allocation disputes, whether in Australia or overseas. An expert team of ecologists, economists and sustainability experts spent three years interviewing people in the Little Swanport catchment, seeking answers to the optimal allocation of water on the Tasmanian East Coast. The hinterland of this area produces some of the most valuable merino wool in the world, the estuary grows mouth-watering oysters, and much of the land is in near-pristine condition, providing very valuable biodiversity resources. The book is written in an easy-to-read style and gradually evolves to become the story of everyday life of one small Australian catchment. It is about people living in rural settings in the upper catchment with soils and rainfall suitable for farming; people residing in coastal settlements in the lower catchment; people working and relaxing in the estuary where fishing and aquaculture occur; and people and their business in adjacent towns.

This paper examines climate change mitigation and adaptation from an insurance industry perspective, with particular reference to London and the USA. It illustrates how British insurers are increasingly shaping public policy and using new technology to manage the risks from climate change impacts and makes a plea for society to make more use of insurance expertise in future decision making. In particular, more dialogue is needed between architects, planners and insurers to adapt our buildings and cities for climate change impacts. The paper is an abbreviated and updated version of the paper presented by the author in Houston, Texas, in 2005.

Although Africa’s contribution to the world’s greenhouse gas emission is the smallest compared to other continents, yet they tend to be affected most by the variability in Climate. Malawi is not an exception to this climate change, as they are not just faced with rising temperatures and variable rainfall patterns, but with reoccurring droughts and severe flooding. Agriculture has been noted to contribute significantly to not only climate change but also has significant impacts on global warming through its greenhouse gas emissions. Nevertheless, not all farming systems impact negatively on climate change. Conservation Agriculture is a farming system that encourages no or minimum soil disturbance, maintenance of a permanent soil cover, and diversification of crop species. These three interlinked principles combined with good agricultural practices promote biodiversity and normal biotic processes, both on and under the ground surface, thereby increasing the productivity and nutrient use efficiency of water, into a more resilient farming system which will help sustain and improve agricultural production. This review looks at Conservation Agriculture practices in the Machinga Agricultural Development Division of Malawi and its role in climate change mitigation and adaptation. This paper shows that Conservation Agriculture has played an active role in the adaptation and mitigation of climate change effect by reducing atmospheric greenhouse gas emissions but suggested there is a need for the government to formulate a CA framework that is founded on the three interlinked principles and not just based on soil and water conservation principles which are currently being advocated and practised.

Abstract Five experiments are reported to compare models of attitude formation about hot-button policy issues like climate change. In broad strokes, the deficit model states that incorrect opinions are a result of a lack of information, while the cultural cognition model states that opinions are formed to maximize congruence with the group that one affiliates with. The community of knowledge hypothesis takes an integrative position. It states that opinions are based on perceived knowledge, but that perceptions are partly determined by the knowledge that sits in the heads of others in the community. We use the fact that people's sense of understanding is affected by knowledge of others’ understanding to arbitrate among these views in the domain of public policy. In all experiments (N = 1767), we find that the contagious sense of understanding is nonpartisan and robust to experimental manipulations intended to eliminate it. While ideology clearly affects people's attitudes, sense of understanding does as well, but level of actual knowledge does not. And the extent to which people overestimate their own knowledge partly determines the extremity of their position. The pattern of results is most consistent with the community of knowledge hypothesis. Implications for climate policy are considered.
